This matter isbefore Florida Agricultural and Mechanical University Board of Trustees

("F AMU," "Respondent," orthe "University") forfinal agency action.RobertE. Nixon,

Petitioner, was previously employed bytheUniversityas Director of theFAMU Institute on

Urban Policy andCommerce. ("Institute") OnoraboutJuly1,2010,theGrandJuryforthe

United States District Courtforthe Northern District of Florida, Tallahassee Division,issuedan

indictment against Petitioner alleging certaincriminal violations asmorefully set-forth in

Respondent's Exhibit 1,attachedhereto.Asaresult of thesaid indictment, the University, on

July8,2010, immediately severedits employment relationship withPetitioner.(See Exhibit 1)

Petitioner requested areview of the University's action,andthe matter wasreferredtothe

Division of Administrative Hearings. ("DOAH") The cause wasinitiallysetfor hearing

commencing January18,2011,butwas continued pendingthe outcome of Petitioner's federal

trial.On November 12,2010, Petitioner wasconvictedonallcounts. (Respondent's Exhibit 2)

ByOrderenteredJanuary11,2011,thefileatDOAHwasclosedand jurisdiction was

relinquished tothe University.

Accordingly, itis hereby ORDERED and ADJUDGED that the July 8, 2010 termination

of Petitioner is hereby ratified.
