1. On October 12,2010, the Department of FinancialServices, Division of Workers'

Compensation (hereinafter "Department") issued a Stop-Work Orderand Order of Penalty

Assessment in Division of Workers' Compensation CaseNo. 1O-270-D7 to FODEN

CONSTRUCTION DRYWALL DIVISION, INC.(FODEN).The Stop-Work Orderand Order

of Penalty Assessment included a Notice of Rights wherein FODENwas advised thatany

requestforan administrative proceeding to challenge orcontestthe Stop-Work OrderandOrder

of Penalty Assessment must befiled within twenty-one (21)days of receipt of the Stop-Work

OrderandOrder of Penalty Assessment in accordance withSections120.569and120.57, Florida

Statutes.

2.OnOctober 13,2010, theStop-WorkOrderandOrder of Penalty Assessment was

servedviapersonalserviceonFODEN.Acopy of theStop-WorkOrderandOrder of Penalty

Assessment isattachedheretoas "Exhibit A"and incorporated hereinbyreference.

3.OnOctober 27,2010, theDepartmentissuedanAmendedOrder of Penalty

Assessment toFODENinCaseNo.10-270-D7.TheAmendedOrder of Penalty Assessment

assessedatotal penalty of$47,409.98 againstFODEN.TheAmendedOrder of Penalty

Assessment includedaNotice of RightswhereinFODENwasadvisedthatanyrequestforan

administrative proceeding tochallengeorcontesttheAmendedOrder of PenaltyAssessment

mustbefiledwithintwenty-one(21)days of receipt of theAmendedOrder of Penalty

AssessmentinaccordancewithSections120.569and120.57,FloridaStatutes.

4.TheAmendedOrder of Penalty Assessment wasservedonFODENbypersonal

serviceon November 5,2010.Acopy of theAmendedOrder of Penalty Assessment isattached

heretoas "Exhibit B"and incorporated hereinbyreference.

5.OnOctober 26,2010, FODENfiledatimely Petition foraformaladministrative

hearinginaccordancewithSections120.569and120.57,FloridaStatutes.The Petition was

forwardedtotheDivision of Administrative HearingsandassignedCaseNo.10-10768.

6.On December 28,2010, the Department serveditsFirstInterlocking Discovery

RequestsuponFODEN, consisting of 11 requestsforadmissions,14requestsforproduction,and

15interrogatories. FODEN's responsestothe Department's FirstInterlocking Discovery

Requestswereduewithin35days,orbyFebruary 1,2011.

7.On February 9,2011, theDepartmentfiledaMotiontoCompel Discovery

Responses,seekinganOrderfromtheAdministrativeLawJudgewhichcompelledFODENto

respondtothe Department's FirstInterlocking Discovery Requests.

8.On February 11,2011, Administrative LawJudgeEleanor Hunter issuedanOrder

GrantingMotionto Compel Discovery Responses, directing FODENtosubmititsresponsesto

the Department's First Interlocking Discovery Requests onorbefore February 18,2011. Acopy

of theOrderGranting Motion toCompel Discovery Responsesisattachedheretoas "Exhibit C."

9.On February 18,2011, the Department fileditsMotiontoDeemMattersAdmitted

andto Relinquish Jurisdiction PursuanttoS.120.57(i),FloridaStatutes,basedon FODEN's

failuretosubmit responses tothe Department's First Interlocking Discovery Requests,as

requiredbythe February 11,2011 OrderGranting Motion toCompel Discovery Responses.

10.On February 22,2011, Administrative LawJudgeEleanor Hunter enteredan

OrderGranting Motion toDeemMatters Admitted andRelinquishing Jurisdiction andClosing

File, relinquishing jurisdiction tothe Department. A copy of thisOrderisattachedheretoas

"Exhibit D."

FINDINGSOFFACT

11.ThefactualallegationsintheStop- Work OrderandOrder of Penalty Assessment

issuedonOctober 12,2010, andthe Amended Order of Penalty Assessment issuedonOctober

27,2010, whicharefullyincorporatedhereinby reference, arehereby adopted asthe

Department's Findings of Factinthiscase.

CONCLUSIONS OFLAW

12.BasedontheFindings of Factadoptedherein,the Department concludes that

FODEN violated the specific statuesandrules alleged intheStop-WorkOrderandOrder of

Penalty Assessment andtheAmendedOrder of Penalty Assessment,andherebyadoptsthe

violations chargedinthe Stop-Work OrderandOrder of Penalty Assessment andtheAmended

Order of Penalty Assessment asthe Conclusions of Law inthiscase.

PENALTY IMPOSED

13.TheStop-WorkOrderandOrder of Penalty Assessment, AmendedOrder of

Penalty Assessment, andFebruary 22,2011 OrderGrantingMotiontoDeemMattersAdmitted

and Relinquishing Jurisdiction andClosingFile,takentogetherwiththeFindings of Factand

Conclusions of Lawadoptedherein, constitute groundsforthe Chief FinancialOfficertoimpose

the penalty andorderthe cessation of business operationsassetforthherein.

ITIS THEREFORE ORDEREDthat:

a)FODENshall immediately paythetotal penalty of $47,409.98infullto

the Department fordepositintothe Workers' Compensation Administration TrustFund,

based uponitsviolation of the workers' compensation coveragerequirementscontained

in Chapter 440,FloridaStatutes.

b)FODENshall immediately ceaseallbusinessoperationsintheState of

Florida untilsuchtimeasthe Department issuesanOrder Releasing theStop-WorkOrder

andOrder of PenaltyAssessment.The Department shallnotissueanOrderReleasingthe

Stop-WorkOrderandOrder of Penalty Assessment until FODEN hascomeinto

compliance withthecoverage requirements of Chapter440, Florida Statutes,andhaspaid

thetotalpenalty of $47,409.98totheDepartment.
