requestforanadministrativeproceedingtochallengeorcontesttheStop-WorkOrderandOrder

of Penalty Assessment mustbefiledwithintwenty-one(21)days of receipt of theStop-Work

OrderandOrder of PenaltyAssessmentinaccordancewithSections120.569and120.57,Florida

Statutes,andmustconformtoRule28-106.2015,FloridaAdministrativeCode.

2.OnNovember9,2010,theStop-WorkOrderandOrder of PenaltyAssessment

waspersonallyservedonWorldAsphalt.Acopy of theStop-WorkOrderandOrder of Penalty

Assessmentisattachedheretoas"ExhibitA"andincorporatedhereinbyreference.

3.OnNovember 18,2010, WorldAsphaltfiledwiththeDepartmentarequestforan

administrativehearing("Petition")pursuanttosection120.57(1),FloridaStatutes,challenging

theStop-WorkOrderandOrder of PenaltyAssessment.ThePetitionwasforwardedtothe

Division of AdministrativeHearingsandassignedDOAHCaseNo.10-10929.Acopy of the

Petitionisattachedheretoas"ExhibitB".

4.OnDecember2,2010,theDepartmentissuedanAmendedOrder of Penalty

AssessmenttoWorldAsphalt.TheAmendedOrder of PenaltyAssessmentassessedatotal

penalty of $70,088.22againstWorldAsphalt.

5.OnDecember 6,2010, theAmendedOrder of PenaltyAssessmentwasservedon

WorldAsphaltbycertifiedmail.Acopy of theAmendedOrder of PenaltyAssessmentis

attachedheretoas"ExhibitC"andincorporatedhereinbyreference.

6.OnMarch10,2011,theDepartmentissueda2ndAmendedOrder of Penalty

AssessmenttoWorldAsphalt.The2ndAmendedOrder of PenaltyAssessmentassessedatotal

penalty of$I,OOO.OO againstWorldAsphalt.

7.OnMarch10,2011,the2ndAmendedOrder of PenaltyAssessmentwasfiled

withtheDivision of AdministrativeHearings.Acopy of the2ndAmendedOrder of Penalty

Assessmentisattachedheretoas"ExhibitD"andincorporatedhereinbyreference.

8.OnMarch15,2011,theDepartmentandWorldAsphaltfiledaNotice of

SettlementwiththeDivision of AdministrativeHearings.OnMarch17,2011,Administrative

LawJudgeW.DavidWatkinsenteredanOrderClosingFile,whichrelinquished jurisdiction of

themattertotheDepartment.

9.ThefactualallegationscontainedintheStop-WorkOrderandOrder of Penalty

Assessment,theAmendedOrder of PenaltyAssessment,andthe2ndAmendedOrder of Penalty

Assessment,attachedheretoas"ExhibitA", "Exhibit C",and"ExhibitD",respectively,and

fullyincorporatedhereinbyreference,areherebyadoptedasthe Department's Findings of Fact

inthiscase.

CONCLUSIONSOFLAW

10.BasedupontheFindings of Factadoptedherein,theDepartmentconcludesthat

WorldAsphaltviolatedthespecificstatutesandrulesallegedintheStop-WorkOrderandOrder

of PenaltyAssessment,theAmendedOrder of PenaltyAssessment,andthe2ndAmendedOrder

of PenaltyAssessment,andherebyadoptstheviolation(s)chargedintheStop-WorkOrderand

Order of PenaltyAssessment,theAmendedOrder of PenaltyAssessment,andthe2ndAmended

Order of PenaltyAssessmentastheConclusions of Lawinthiscase.

PENALTYIMPOSED

11.TheStop-WorkOrderandOrder of PenaltyAssessment,theAmendedOrder of

PenaltyAssessment,andthe2ndAmendedOrder of PenaltyAssessment,takentogetherwiththe

Findings of FactandConclusions of Lawadoptedherein,constitutegroundsforthe Chief

FinancialOfficertoimposethepenaltyassetforthherein.

ITISTHEREFOREORDEREDthat:

a.WorldAsphaltshallimmediatelypaythetotalpenalty of $1,000.00infulltothe

Department of FinancialServicesfordepositintotheWorkers'CompensationAdministration

TrustFund;and

b.WorldAsphaltshallimmediatelyceaseallbusinessoperationsintheState of

FloridauntilsuchtimeastheDepartmentissuesanOrderreleasingtheStop-WorkOrderand

Order of PenaltyAssessment.TheDepartmentshallnotissueanOrderreleasingtheStop-Work

OrderandOrder of PenaltyAssessmentuntilWorldAsphalthascomeintocompliancewiththe

coveragerequirements of Chapter440,FloridaStatutes,andhaspaidatotalpenalty of$l,OOO.OO

totheDepartment.
