90STATEMENT OF THE ISSUE

94The issue is whether this case should be dismissed based on

105Petitioner's failure to make an appearance at hearing.

113PRELIMINARY STATEMENT

115On or about September 28, 2010 , Pet itioner , Gayle Wilburn

125(Petitioner) , filed a Petition for Relief with the Florida

134Commission on Human Relations (FCHR). The petition alleged that

143Respondent , City of Pensacola, Department of Housing

150(Respondent) , had committed a discriminatory housing pra ctice

158and a discriminatory public accommodation practice against her.

166T he Florida Commission on Human R elations (FCHR) investigated

176PetitionerÓs complaint. On December 14, 2010, FCHR issued a

185Notice of Determination of No Cause on PetitionerÓs complaint.

194Thereafter, Petitioner filed a Petition for Relief alleging that

203Respondent had committed a h ousing discriminatory practice

211against her.

213FCHR referred the case to the Division of Administrative

222Hearings on January 6, 2011 .

228FINDINGS OF FACT

2311. On Jan uary 7, 2011 , the undersigned issued the Initial

242Order in this case.

2462. Petitioner and Respondent respond ed to the Initial

255Order.

2563. On February 10, 2011 , the undersigned issued a Notice

266of Hearing, scheduling the hearing for March 28, 2011 . The

277Notice of Hearing was not returned as undeliverable to

286Petitioner. Indeed, Petitioner wrote and filed several letters

294regarding her upcoming hearing and case in general.

3024 . On March 18, 2011, the hearing was convened as

313scheduled. After waiting 15 minu tes, Petitioner did not appear

323at the hearing and did not contact the undersignedÓs office

333regarding any problem with commencing the hearing as scheduled.

342Accordingly, no evidence to support PetitionerÓs allegations was

350introduced at the hearing. Given t his lack of evidence, the

361Petition for Relief should be dismissed.

367CONCLUSIONS OF LAW

3705 . The Division of Administrative Hearings has

378jurisdiction over the parties and the subject matter of this

388proceeding pursuant to s ections 120.569, 120.57(1), and 760. 35,

398Florida Statutes (2010).

4016 . Petitioner has the burden of proving the allegations in

412her petition by a preponderance of the evidence. See

421§§ 760.34(5) an d 120.57(1)(j), Fla. Stat. (2010 ).

4307 . Petitioner failed to appear at the hearing or provide

441notice of her inability to attend the hearing. On the other

452hand, Respondent and its witnesses were prepared to go forward

462on the merits.

4658 . There is no indication that Petitioner failed to

475receive any orders, notices, or pleadings. There is no show ing

486of any emergency situation that would prohibit Petitioner from

495at least contacting the undersigned's office to request a

504continuance.

5059 . Since Petitioner did not appear at the hearing,

515Petitioner has failed to meet her burden of proof to support he r

528claim and the Petition for Relief should be dismissed .

538RECOMMENDATION

539Based on the foregoing Findings of Fact and Conclusions of

549Law, it is

552RECOMMENDED:

553That the Florida Commission on Human Relations enter a

562final order dismissing the Petition for Re lief.
