101STATEMENT OF THE ISSUES
105The issues in this case are whether Respondent violated
114section 401.411(1)(g ) , Florida Statutes (2009) , 1 / and, if so,
125what discipline should be im posed.
131PRELIMINARY STATEMENT
133On November 19, 2010, Petitioner, Department of Health
141(Department), filed an Administrative Complaint against
147Respondent, Julio R. Colon (Mr. Colon), alleging that he
156violated section 401.411(1)(g). Mr. Colon filed a Petitio n for
166Formal Hearing, requesting an administrative hearing. The case
174was forwarded to the Division of Administrative Hearings on
183January 10, 2011, for assignment to an Administrative Law Judge.
193The final hearing was scheduled for March 25, 2011. On
203Febru ary 16, 2011, Mr. Colon filed Respondent's Consent Motion
213to Continue Final Hearing. The final hearing was rescheduled
222for May 10, 2011.
226On April 27, 2011, counsel for Mr. Colon requested to
236withdraw. On April 29, 2011, the Department filed Department' s
246Motion to Amend Administrative Complaint Based on Newly
254Discovered Evidence, attaching the Amended Administrative
260Complaint. On May 12, 2011, an Order was entered granting the
271motion to amend the Administrative Complaint, and the Amended
280Administrative Complaint was deemed filed as of the date of the
291Order. On May 6, 2011, an Order was issued granting the request
303to withdraw as counsel, and an Order was entered continuing the
314final hearing to June 29, 2011.
320The final hearing was scheduled to commence at 9:00 a.m. on
331June 29, 2011, and Mr. Colon had been provided notice of the
343hearing date and time. At the appointed time, Mr. Colon did not
355appear nor did any representative of Mr. Colon appear on his
366behalf. The commencement of the final hearing was dela yed for
37730 minutes to give Mr. Colon to an opportunity appear, but he
389did not. To date, Mr. Colon has not contacted the Division of
401Administrative Hearings concerning his failure to appear.
408At the final hearing, the Department called George A.
417Ralls, M.D. , as its witness. Petitioner's Exhibits 1 through 5
427were admitted in evidence. No witnesses or evidence were
436presented on behalf of Mr. Colon.
442The Transcript was filed on August 11, 2011. The
451Department filed its p roposed r ecommended o rder on August 15,
4632011. No post - hearing submittal was filed by Mr. Colon.
474FINDINGS OF FACT
4771. Mr. Colon is eligible for Emergency Medical Technician
486(EMT) licensure, license number EMT 50126, and is licensed as a
497paramedic, license number PMD 510323.
5022. On January 15, 2 011, Mr. Colon pled nolo contendere to
514a charge of exposure of sexual organs in Case No. 09 - 003621 -
528MMM - A in the County Court, Fifth Judicial Circuit in and for
541Hernando County, Florida. Adjudication was withheld, and
548Mr. Colon was placed on probation for one year and sentenced to
56025 hours of community service.
5653. On January 15, 2011, Mr. Colon pled nolo contendere to
576a charge of exposure of sexual organs in Case No. 09 - 003622 -
590MMM - A in the County Court, Fifth Judicial Circuit in and for
603Hernando County, Florida. Adjudication was withheld, and
610Mr. Colon was placed on probation for one year and sentenced to
62225 hours of community service. The sentence in Case No. 09 -
634003622 - MMM - A ran concurrently with the sentence in Case No. 09 -
649003621 - MMM - A.
6544. One of the cases dealt with an argument that Mr. Colon
666had with a young lady. Mr. Colon had made a u - turn into the
681drive way of a mobile home park, and saw a young lady walking
694by. Mr. Colon and the young lady had words, and the young lady
707make a remark that Mr. C olon considered derogatory. He got out
719of his car sans his lower garments; showed the young lady his
731anatomy, bare from the waist down; and told her to kiss his ass.
744He got back into the car, knowing that he had done a very stupid
758thing, and drove off. The young lady took a picture of
769Mr. Colon's bareness with her telephone.
7755. The other case dealt with Mr. Colon again lowering his
786pants at a school. Mr. Colon admitted to an officer of the
798Hillsborough County Sheriff's office that the incidents were
806id entical as far as the amount of clothing that he was not
819wearing. Again, Mr. Colon's nakedness was caught by a camera.
829Mr. Colon thinks that the reason that he showed himself on this
841occasion was a result of a bet that he lost.
8516. Mr. Colon admitted to the officer of the Hillsborough
861County Sheriff's Office that on at least three to four other
872occasions that he has disrobed while outdoors. He contends that
882these occasions happened late at night when he was drunk and
893stupid.
894CONCLUSIONS OF LAW
8977. The Division of Administrative Hearings has
904jurisdiction over the parties to and the subject matter of this
915proceeding. §§ 120.569 & 120.57, Fla. Stat. (2010).
9238. The Department has the burden to establish the
932allegations in the Administrative Compla int by clear and
941convincing evidence. Dep't of Banking & Fin. v. Osborne Stern &
952Co. , 670 So. 2d 932 (Fla. 1996).
9599. The Department has alleged that Mr. Colon violated
968section 401.411(1)(g), which provides:
972(1) The department may deny, suspend, or
979revok e a license, certificate, or permit or
987may reprimand or fine any licensee,
993certificateholder, or other person operating
998under this part for any of the following
1006grounds:
1007* * *
1010(g) Unprofessional conduct, including, but
1015not limited to, any depart ure from or
1023failure to conform to the minimal prevailing
1030standards of acceptable practice as an
1036emergency medical technician or paramedic,
1041including undertaking activities that the
1046emergency medical technician or paramedic is
1052not qualified by training or e xperience to
1060perform.
106110. The Department contends that crimes to which Mr. Colon
1071pled nolo contendere were acts of unprofessional conduct.
1079Section 401.411(1)(g) lists certain conduct which is considered
1087to be unprofessional. The conduct that is listed pertains to
1097the actual practice of a paramedic or an emergency medical
1107technician . In determining whether the plea of nolo contendere
1117to crimes of exposure of sexual organs in situations in which
1128the practice of a paramedic or an emergency medical technician
1138is not involved constitutes unprofessional, the doctrine of
1146ejusdem generis is applicable. "This doctrine means that 'where
1155an en umeration of specific things is followed by some more
1166general word or phrase, such general work or phrase will usually
1177be construed to refer to things of the same kind of species as
1190those specifically enumerated.'" Arnold v. Shumpert , 217 So. 2d
1199116, 119 (Fla. 1968), citing Children's Bootery v. Sutker , 107
1209So. 345 (Fla. 1926).
121311. In the instant case, the general term, "including, but
1223not limited to," is referring to conduct that deals with conduct
1234involving the practice of a paramedic or an emergency me dical
1245technician. While Mr. Colon's conduct may have been immoral,
1254section 401.411 does not provide for discipline for immoral acts
1264not committed in the practice of a paramedic or an emergency
1275medical technician.
127712. The Department has failed to establis h that Mr. Colon
1288violated section 401.411(1)(g).
129113. In its p roposed r ecommended o rder, the Department
1302contends that Mr. Colon lied to the officer of the Sheriff's
1313Department who interviewed Mr. Colon. No allegations in the
1322Amended Administrative Complia nt refer to Mr. Colon lying to law
1333enforcement officials.
133514. In its p roposed r ecommended o rder, the Department
1346contends that Mr. Colon is impaired and is unfit to perform his
1358duties as a paramedic or an emergency medical technician. No
1368such allegation s were alleged in the Amended Administrative
1377Complaint.
137815. Violations not alleged in the Amended Administrative
1386Complaint cannot form a basis for disciplining Mr. Colon. To
1396find a respondent guilty of a violation for which he was not
1408charged is a violat ion of due process. Wray v. Dep't of Prof'l
1421Reg. , 435 So. 2d 312, 315 (Fla. 1st DCA 1983).
1431RECOMMENDATION
1432Based on the foregoing Findings of Fact and Conclusions of
1442Law, it is RECOMMENDED that a final order be entered dismissing
1453the Amended Administrative Complaint against Mr. Colon.
