115STATEMENT OF THE ISSUE

119The issue to be determin ed is whether Respondent violated

129section 480.046(1)(c), Florida Statutes (2007), as alleged in the

138Administrative Complaint, and if so, what penalty should be

147imposed?

148PRELIMINARY STATEMENT

150On April 21, 2009, the Department of Health (Petitioner or

160Department) filed an Administrative Complaint charging

166Respondent , Angel DeJesus (Respondent or Mr. DeJesus), with

174violating section 480.046(1)(c), based upon his conviction for

182sexual battery. On June 2, 2009, Respondent executed an Election

192of Rights form and requested a section 120.57(1) hearing. On

202February 22, 2011, the case was referred to the Division of

213Administrative Hearings for the assignment of an administrative

221law judge.

223On March 7, 2011, a Notice of Hearing was iss ued, scheduling

235the case for hearing on April 28, 2011, and the case proceeded as

248scheduled. Respondent, who is incarcerated, pa rticipated in the

257proceedings by telephone.

260At hearing, Petitioner presented the testimony of Paula

268Mask, and Petitioner's Exh ibits 1 through 4 were admitted into

279evidence. Petitioner was afforded the opportunity to file the

288depositions of Sergeant Bankert (Petitioner's Exhibit 5) and

296Jennifer Mason (Petitioner's Exhibit 6) no later than 30 days

306after the hearing. Respondent di d not present any witnesses or

317exhibits at hearing.

320The Transcript of the proceedings was filed with the

329Division on May 9, 2011 . Petitioner's Exhibit 5 was filed May 4,

3422011, and Petitioner's Exhibit 6 was filed May 20, 2011. On

353May 27, 2011, a Schedul ing Order issued directing the parties to

365file their proposed recommended orders no later than June 10,

3752011. Petitioner filed its Proposed Recommended Order on June 9,

3852011. To date, there has been no written submission by

395Respondent.

396FINDINGS OF F ACT

4001. The Department is the state agency charged with the

410regulation of the practice of massage therapy pursuant to section

42020.43 and chapters 456 and 480, Florida Statutes.

4282. At all times material to the allegations in the

438Administrative Complaint, Re spondent was licensed as a massage

447therapist in the State of Florida, having been issued license

457number MA49928.

4593. On September 19, 2007, Deputy Darin Bankert was a sworn

470law enforcement officer working as a violent crimes investigator

479with the Manatee C ounty Sheriff's Office. He was called to the

491scene of an alleged sexual battery.

4974. The reported crime involved a sexual attack of a massage

508therapist client during a massage. Respondent was the subject of

518the investigation , which was initiated by the victim .

5275. On October 22, 2007, Respondent was charged with sexual

537battery in violation of section 794.011(5), Florida Statutes, a

546second - degree felony. The information in Case Number 2007 CF

557003650 issued in the Circuit Court, Twelfth Judicial Circu it, in

568and for Manatee County, states:

573ANGEL DEJESUS on the date of 9/19/2007,

580. . . in the County and State aforesaid, did

590commit a sexual battery upon [victim], a

597person twelve years of age or older, to - wit:

607ANGEL DEJESUS with his sexual organ,

613penet rated or had union with the vagina

621and/or the anus of [victim] and in the

629process thereof used physical force and

635violence not likely to cause serious personal

642injury to the said [victim] contrary to

649Section 794.011(5), Florida Statutes, in such

655case made, and provided and against the peace

663and dignity of the State of Florida.

6706. On September 19, 2008, as a result of a jury trial,

682Respondent was found guilty of sexual battery as alleged in the

693indictment. On September 25, 2008, the trial court adjudicat ed

703him guilty and sentenced him to fifteen years in prison, with

714credit for 372 days for time served before sentencing. The court

725designated Respondent as a sexual offender with all of the

735reporting requirements associated with that status, and

742prohibited any contact with the victim.

7487. Sexual battery on a massage therapy client is a crime

759directly related to the practice of massage therapy . Sexual

769battery , whether or not involving a massage therapy client , is

779directly related to the practice and the ab ility to practice

790massage therapy .

793ust between a massage therapist and a client is an

803integral component of the therapist - client relationship. Sexual

812battery demonstrates a lack of hon esty, self - control and

823judgment. Given the vulnerable position of a client during any

833massage, anything that undermines that trust impairs the

841therapist's ability to fulfill his or her responsibilities as a

851therapist.

852CONCLUSIONS OF LAW

8559 . The Divisio n of Administrative Hearings has jurisdiction

865over the subject matter and the parties to this action in

876accordance with s ections 120.569 and 120.57(1), Florida Statutes.

88510. The Department is seeking to take disciplinary action

894against Respondent's license as a massage therapist. Because

902disciplinary proceedings are considered to be penal proceedings,

910the Department has the burden to prove the allegations in the

921Administ rative Complaint by clear and convincing evidence. Dep' t

931of Banking and Fin . v. Osborne Stern and Co. , 670 So. 2d 932

945(Fla. 1996); Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987).

956As stated by the Supreme Court of Florida,

964Clear and convincing evidence requires that

970the evidence must be found to be credible;

978the facts to which the witnesses testify must

986be distinctly remembered; the testimony must

992be precise and lacking in confusion as to the

1001facts in issue. The evidence must be of such

1010a weight that i t produces in the mind of the

1021trier of fact a firm belief or conviction,

1029without hesitancy, as to the truth of the

1037allegations sought to be established.

1042In re Henson , 913 So. 2d 579, 590 (Fla. 2005), quoting Slomowitz

1054v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983).

106511. The Administrative Complaint charges Respondent with a

1073single count of violating section 480.046(1)(c), which provides

1081in pertinent part:

1084(1 ) The following acts constitute grounds

1091for denial of a license or disciplinary

1098action, as specified in s. 456.072 (2):

1105* * *

1108(c) Being convicted or found guilty,

1114regardless of adjudication, of a crime in any

1122jurisdiction which directly relates to the

1128practice of massage or to the ability to

1136practice massage. Any plea of nolo

1142contendere shall be considered a conviction

1148for purposes of this chapter.

115312. In this case there is no question that Respondent was

1164convicted of sexual battery. However, the only evidence tying

1173the conviction directly to Respondent treating a massage client

1182is hearsay. The victim did not testify and the officer who

1193investigated the crime only related what he was told when he took

1205over the investigation.

120813. This direct evidence is unnecessary. When a person

1217goes in for a massage, there is a level of trust required given

1230the vulnerable position of the c lient and access that is afforded

1242the therapist. Any action that undermines the trust required of

1252a massage therapist is directly related to the therapist's

1261ability to practice the profession. Committing sexual battery,

1269whether or not on a massage client , clearly undermines that

1279trust. The Department has proven the violation of section

1288480.046(1)(c) by clear and convincing evidence.

129414. The Board of Massage Therapy has adopted disciplinary

1303guidelines in accordance with section 456.079, Florida Statutes ,

1311to provide notice of a meaning range of penalties to be imposed

1323for violations of c hapters 456 and 480 and the applicable rules.

1335The undersigned has reviewed the provisions of Florida

1343Administrative Code Rule 64B7 - 30.002 in determining the

1352appropriate p enalty to be determined.

1358RECOMMENDATION

1359Upon consideration of the facts found and conclusions of law

1369reached, it is

1372RECOMMENDED that a final order be entered finding that

1381Respondent has violated section 480.046(1)(c), Florida Statutes,

1388and revoking his lic ense to practice massage therapy.
