111STATEMENT OF THE ISSUES

115The issues in this case are whether Respondent violated

124sections 497.152(1)(a) and 497.152(4)(h), Florida Statutes (2008

131and 2009); section 497.146, Florida Statutes (2009); sections

139497.152(5)(b) and 497.152(5)(g), Florida Statutes (2008); 2/ and

147Florida Administrat ive Code Rule 69K - 21.055, and, if so, what

159discipline should be imposed.

163PRELIMINARY STATEMENT

165On September 27, 2010, Petitioner, Department of Financial

173Services, Board of Funeral, Cemetery, and Consumer Services

181(Department), filed a three - count Administ rative Complaint

190against Respondent, Tebbie Singleton (Mr. Singleton), alleging

197that he violated sections 497.152(1)(a), 497.152(4)(h), 497.146,

204497.152(5)(b), and 497.152(5)(g) and rule 69K - 21.055.

212Mr. Singleton requested an administrative hearing, and th e case

222was forwarded to the Division of Administrative Hearings on

231April 15, 2011, for assignment of an Administrative Law Judge to

242conduct the final hearing.

246Mr. Singleton had been represented by counsel, John A.

255Rudolph, Jr. On June 14, 2011, Mr. Rudolp h filed a Motion to

268Withdraw as Counsel for Respondent. At the commencement of the

278final hearing, the motion was granted.

284The Department advised at the commencement of the final

293hearing that it would not be presenting any evidence relating to

304the allegati ons contained in Count II of the Administrative

314Complaint. After learning that no evidence would be presented

323concerning Count II, Mr. Singleton advised that he was prepared

333to proceed without benefit of counsel.

339At the final hearing, the Department call ed Sandra Gan t t -

352Ford, Mr. Singleton, and Kurt Schuler as its witnesses. Joint

362Exhibits 2 and 3 were admitted in evidence. Petitioner's

371Exhibits A through H were admitted in evidence. Mr. Singleton

381testified in his own behalf and did not submit any exhib its for

394admission in evidence.

397The Transcript of the final hearing was filed on June 30,

4082011. The parties agreed to file proposed recommended orders

417within ten days of the filing of the Transcript. The Department

428filed its Proposed Recommended Order on July 11, 2011. On the

439same date, Mr. Singleton filed a letter, which is deemed to be

451his p roposed r ecommended o rder.

458FINDINGS OF FACT

4611. Mr. Singleton has been licensed by the Department as a

472funeral director and embalmer since December 15, 1997. His

481license number is F043742.

4852. On August 26, 2008, the Department entered a Final

495Order finding Mr. Singleton guilty of the violations alleged in

505the administrative complaint, In the Matter of: Tebbie

513Singleton (License Number F043742) , Case No. 95046 - 08 - FC. The

525Department imposed the following penalty:

530Respondent [Mr. Singleton] shall pay an

536administrative fine in the amount of $5,000.

544Said fine shall be paid within ninety (90)

552days of the date of the filing of this Final

562Order. The fine shall be paid by cashier's

570check or money order payable to the Board of

579Funeral, Cemetery, and Consumer Services and

585delivered to the Board office at the

592Department of Financial Services, Board of

598Funeral, Cemetery and Consumer Services,

603200 East Gaines Street, Tallah assee 32399.

610In addition, Respondent is required to pay

617interest on the fine due to the Board at a

627rate of 11% per annum, beginning on the

635ninety - first (91st) day after the issuance

643of this Final Oder.

647Respondent is placed on probation for a

654period of on e year. Respondent must attend

662an in - person meeting of the Board at the

672last scheduled meeting prior to the

678expiration of the one year probation.

684Respondent must notify the Division Director

690of his intent to attend no less than one

699month prior to the mee ting. Respondent

706shall demonstrate compliance with the Order

712and demonstrate by testimony, presentation

717of letters, or recommendation from

722individuals within the industry, or other

728indicia of rehabilitation, that Respondent

733is able to resume practicing wi th reasonable

741care and safety and is in compliance with

749the laws of the State of Florida and rules

758of this Board.

7613. Mr. Singleton failed to pay the fine with in 90 days of

774the issuance of the Final Order. On December 22, 2008, the

785Department entered a N otice of Intent to Enter Emergency Order

796of Suspension, advising Mr. Singleton that if he did not comply

807with the Final Order issued on August 26, 2008, that his license

819would be suspended.

8224. Mr. Singleton sent a check in the amount of $6,340.00

834and date d January 17, 2011, to the Department. The check was

846drawn on the account of Betty Miller (Ms. Miller), who was a

858friend of Mr. Singleton's mother. At the top of the check was

870handwritten: "Tebbie Singleton, 9506 Fieldview Drive,

876Thonotosassa, Florida 3 3592, 850 - 577 - 6500." Mr. Singleton

887claims that neither he nor Ms. Miller wrote the address on the

899check, which was a starter check. The address that appeared on

910the check was an address at which Mr. Singleton had previously

921lived. Mr. Singleton's testim ony that neither he nor Ms. Miller

932wrote the address on the check is not credible. The Department

943had no record prior to the receipt of the check that

954Mr. Singleton had ever resided at that address.

9625. Ms. Miller's check was returned for insufficient fun ds.

972Mr. Singleton explained that Ms. Miller, a 72 - year - old woman,

985had her Social Security check deposited in the account and that

996the money was used for bills so the account was overdrawn. As

1008of the date of the final hearing, Mr. Singleton had not paid t he

1022fine.

10236. On January 21, 2009, the Department entered an

1032Emergency Order of Suspension because Mr. Singleton had failed

1041to pay the administrative fine of $5,000.00 as required by the

1053Final Order issued on August 26, 2008. The Emergency Order of

1064Suspens ion provides:

1067IT IS THERERFORE ORDER E D that all licenses,

1076appointments and eligibility for licensure

1081heretofore issued to Licensee, Tebbie

1086Singleton, within the purview of the

1092Department, are hereby SUSPENDED.

1096(a) You, TEBBIE SINGELTON, shall return

1102your license to the Division of Funeral,

1109Cemetery and Consumer Services within ten

1115(10) days of the issuance of the suspension.

1123(b) Your, TEBBIE SINGLETON'S, licenses

1128shall not thereafter be reinstated except

1134upon written request by you. Reinstatement

1140shall be conditioned upon your compliance

1146with all terms of the Final Order, including

1154payment of the administrative fine and upon

1161compliance with the terms of this

1167suspension.

1168(c) This suspension shall terminate upon

1174notice by the Department to the licensee

1181that the Department has received

1186satisfactory evidence that the licensee has

1192come into compliance with the Board's order.

1199The Department shall promptly provide said

1205notice to the licensee upon receipt of such

1213evidence.

1214(d) During the period of suspensio n, you,

1222TEBBIE SINGLETON, shall not engage in or

1229attempt or profess to engage in any

1236transaction or business for which a license

1243or appointment is required under the Florida

1250Funeral, Cemetery and Consumer Services Act.

12567. Mr. Singleton has had odd jobs since the Final Order

1267imposing the fine, but Mr. Singleton has made no effort to make

1279even minimal payments on the fine. Instead, he tries to get

1290friends to help him pay his fine. He intends to get married

1302later on this year and thinks that his fiancée's family will

1313help him pay the fine. As of the date of this Recommended

1325Order, nothing has been submitted by Mr. Singleton that the fine

1336has been paid. He did state in his post - hearing submittal that

1349he had not paid the fine, but that he would be paying t he fine

1364within the next few days.

13698. Prior to June 7, 2007, Mr. Singleton had provided the

1380Department with the following address for himself: 5607 North

1389Armenia Avenue, Tampa, Florida 33609. He changed his address on

1399June 7, 2007, to 8551 Manassas Road, Tampa, Florida 33635. On

1410or about August 3, 2009, Kurt Schuler, a financial specialist

1420with the Department, sent a letter to Mr. Singleton notifying

1430him of an investigation concerning allegations of his unlicensed

1439practice. The letter was sent to the Ma nassas Road address, but

1451was returned by the United States Postal Service as "unable to

1462forward." On October 8, 2009, Mr. Singleton filed a license

1472renewal with the Department and changed his preferred mailing

1481address to "5108 Mission Hill Drive, # 332, T ampa, Florida

149233617." He had been living at the " 5108 Mission Hill Drive "

1503address since sometime in December 2008.

15099. No evidence was presented concerning the allegations of

1518practicing with a suspended license as set forth in Count II of

1530the Administrative Complaint.

1533CONCLUSIONS OF LAW

153610. The Division of Administrative Hearings has

1543jurisdiction over the parties to and the subject matter of this

1554proceeding. §§ 120.569 & 120.57, Fla. Stat. (2010).

156211. The Department has the burden to establ ish the

1572allegations in the Administrative Complaint by clear and

1580convincing evidence. Dep't of Banking & Fin. v. Osborne Stern &

1591Co. , 670 So. 2d 932 (Fla. 1996).

159812. The Department has alleged that Mr. Singleton violated

1607sections 497.152(1)(a), 497.152(4 )(h), 497.152(5)(b), and

1613497.152(5)(g), which provide:

1616This section sets forth conduct that is

1623prohibited and that shall constitute grounds

1629for denial of any application, imposition of

1636discipline, or other enforcement action

1641against the licensee or other p erson

1648committing such conduct. For purposes of

1654this section, the requirements of this

1660chapter include the requirements of rules

1666adopted under authority of this chapter. No

1673subsection heading in this section shall be

1680interpreted as limiting the applicabil ity of

1687any p aragraph within the subsection.

1693(1) GENERAL PROVISIONS. -- The generality of

1700the provisions of this subsection shall not

1707be deemed to be limited by the prov isions of

1717any other subsection.

1720(a) Violating any provision of this chapter

1727or any law ful order of the board or

1736department or of the statutory predecess ors

1743to the board or department.

1751(4) OBLIGATIONS TO REGULATORS A ND OTHER

1758GOVERNMENT AGENCIES. --

1764(h) Failing to perform any statutory or

1771legal obligation place d upon a licensee.

1778(5) LIMITATIONS ON SCOPE OF PRACTICE;

1784UNLICENSED PRACTICE.

1789(b) Practicing or attempting to practice

1795with a revoked, suspended, inactive, or

1801delinquent license.

1803* * *

1806(g) Using the name or title "funeral

1813director," "embalmer," "direct disposer," or

1818other title suggesting licensure that the

1824person using such name or title does not

1832hold.

183313. The Department has established by clear and convincing

1842evidence that Mr. Sing leton violated sections 497.152(1)(a) and

1851497.152(4)(h) by failing to pay the administrative fine that was

1861imposed on him by the Department's Final Order dated August 26,

18722008.

187314. The Department presented no evidence concerning

1880violations of sections 497 .152(5)(b) and 497.152(5)(g); thus,

1888the Department has failed to establish these violations as set

1898forth in Count II of the Administrative Complaint.

190615. The Department has alleged that Mr. Singleton violated

1915section 497.146, which provides:

1919Each licensee under this chapter is

1925responsible for notifying the department in

1931writing of the licensee's current business

1937and residence mailing address and the street

1944address of the licensee's primary place of

1951practice and shall notify the department in

1958writing within 30 days after any change in

1966such information, in accordance with

1971procedures and forms prescribed by rule.

1977Notwithstanding any other provision of law,

1983service by regular mail to a licensee's last

1991known address of record with the department

1998constitutes adeq uate and sufficient notice

2004to the licensee for any official

2010communication to the licensee by the board

2017or the department, except when other service

2024is expressly required by this chapter.

2030Rules may be adopted establishing forms and

2037procedures for licensees to provide the

2043notice required by this section.

204816. The Department has alleged that Mr. Singleton violated

2057rule 69K - 21.055, which provides:

2063Each licensee and registrant shall provide

2069by mail written notification to the

2075Department the licenseeÓs current mailing

2080address and place of practice. The term

2087Ðplace of practiceÑ means the physical

2093location where the practice of the

2099profession occurs, and for a funeral

2105director in charge the place of practice is

2113the location designated where the funeral

2119director i s in charge.

212417. The Department has established by clear and convincing

2133evidence that Mr. Singleton violated section 497.146 and

2141rule 69K - 21.055 by failing to provide the Department with

2152written notification of his current mailing address within

216030 days after his address had changed. According to

2169Mr. Singleton, he had been living at the " Mission Hill Drive "

2180address since sometime in December 2008. He did not change his

2191mailing address until October 8, 200 9 , which was more than

220230 days from the time he moved to the " Mission Hill Drive "

2214address and more than 30 days from the time that the

2225Department's letter addressed to the Manassas Road address,

2233which was the address on file for Mr. Singleton, was returned as

2245unable to be forwar ded.

2250RECOMMENDATION

2251Based on the foregoing Findings of Fact and Conclusions of

2261Law, it is RECOMMENDED that a final order be entered finding

2272that Mr. Singleton violated sections 497.152(1)(a),

2278497.152(4)(h), and 497.146 and rule 69K - 21.055; finding that

2288Mr. Singleton did not violate sections 497.152(5)(b) and

2296497.152(5)(g); imposing an administrative fine of $2,500.00;

2304suspending his license until he becomes complaint with the Final

2314Order issued on August 26, 2008 , and the payment of the fine

2326imposed in this case ; and placing him on probation for two years

2338after his suspension is lifted.
