127STATEMENT OF THE ISSUE

131The issue presented for decision in this case is whether

141PetitionerÓs claim of additional life insurance benefits should

149be paid or denied.

153PRELIMINARY STATEMENT

155By letter dated March 7 , 20 11 , the Department of Management

166Services, Div ision of State Group Insurance notified Petitioner,

175Mary H . King , that h er claim for $ 6, 1 84.38 in additional life

191insurance benefits for W illiam King was denied. The letter

201stated in part, " [s]pecifical ly, you requested that his life

211insurance benefit be changed from $2,500 to $10,000, based upon

223the claim that neither you nor Mr. King were informed of his

235options ."

237Petitioner requeste d a formal administrative hearing to

245contest the denial of benefits. On A pril 1 8, 20 11 , the

258Department forwarded the case to the Division of Administrative

267Hearings for assignment of an Administrative Law Judge. The

276case was scheduled for hearing on June 17 , 20 11 , and was

288commenced on that date. However, due to video teleconference

297technical difficulties, the remainder of the hearing was

305rescheduled , continued on August 15 , and concluded on August 30,

3152011 .

317At hearing, Mary King testified on behalf of h er husband's

328estate. Petitioner 's Exhibits numbered 1 through 8 were

337admitted into evidence, with the exception of handwriting

345contained on Exhibit numbered 4 . Respondent presented the

354testimony of Sand ie Wade, Mike Waller , Laura Cutchen , James

364West, Rob in Collins, Verla Lawson, and Janice Lowe.

373RespondentÓs Exhibits numbered 1 through 46 and 48 were ad mitted

384into evidence. Respondent's E xhibit numbered 47 was proffered.

393The hearing was not transcribed. Respondent filed a Motion

402to Extend Time for Fil ing Proposed Recommended Orders, which was

413granted. The parties timely filed P roposed Recommended Orders,

422which have been considered in the preparation of this

431Recommended Order. References to statutes are to Florida

439Statutes (2010) unless otherwise note d.

445FINDINGS OF FACT

4481. The State of Florida Group Insurance Program (the

457Program) is a benefit available to State of Florida officers,

467employees, and retirees. The Division of State Group Insurance

476(DSGI) is an administrative unit located within the Dep artment

486of Management Services. The life insurance policy at issue in

496these proceedings is part of the Program which is administered

506by DSGI.

5082 . At the time of his retirement, March 1, 1998, William

520King and his wife resided at 4159 Stratford Way, J acksonville,

531Florida 32225 (the Stratford address.) Mr. and Mrs. King moved

541from the Stratford address in May 1999 to 12830 Muirfield

551Boule vard N., Jacksonville, Florida 32225 ( the Muirfield

560address.)

5613 . Mr. King died on September 25, 2010. At the time of

574his death, Mr. King was a retired state employee with life

585insurance coverage through the Program. At the time of his

595death, Mr. King resided at the Muirfield address .

6044 . Mary H . King is the widow of William King, and the

618named beneficiary to Mr. Ki ng's life insurance policy provided

628through the Program .

6325 . DMS has contracted with Northgate Arinso (Northgate),

641formerly Convergys , Inc., to provide human resources management

649services, including assisting in the administration of employee

657benefits. Northgate primarily performs these tasks through an

665on - line system known as "People First." People First became the

677system of record for DSGI benefits data, including addresses, on

687January 1, 2005. Prior to that, the system of record for DSGI

699was the CO PES system. However, People First does not administer

710the State of Florida retirement pension program.

7176 . Prior to January 1, 2000, life insurance coverage for

728retirees was $1,500, with a premium of $4.20 per month.

739Effective January 1, 2000, the cover age for retirees was

749increased to $10,000, and the premium continued to be $4.20 per

761month.

7627 . The Open Enrollment Guide for Plan Year 2000 notified

773all current life insurance plan participants that they must re -

784enroll for the life insurance program , an d that failure to do so

797would result in those retirees no longer receiving life

806insurance benefits.

8088. Because the retirees' response to the 1999 Open

817Enrollment was poor, DSGI developed a letter dated November 10,

8271999, to provide the retirees another c hance to enroll, as

838opposed to their losing life insurance coverage as of January 1,

8492000, due to lack of response.

8559 . By letter dated November 10, 1999, DSGI sent a letter

867to Mr. King notifying him of the above - referenced increase in

879retiree life insu rance coverage from $1,500 to $10,000 effective

891January 1, 2000. The November 10, 1999 letter informed retirees

901that they had to complete a new enrollment form in order to

913continue retiree group life insurance coverage. This

920November 10, 1999 letter was addressed to the Muirfield address.

93010. In this effort to get a better response to the

941reenrollment requirement, DSGI created a file with names and

950social security numbers and provided that to the Division of

960Retirement (D OR ) . DOR then provided DSGI wi th a disk containing

974the addresses for those persons from the DOR database. The

984November 10, 1999 letter , including the one sent to M r . King,

997used the addresses furnished by DOR.

100311. Although the DOR address data base was used to mail the

1015letter dated N ovember 10, 1999, no c hange was made to the DSGI

1029data base ( which, at that time, was COPES ), for those retirees

1042whose address es w ere different in the DOR database . Later

1054mailings by DSGI were to the addresses of record in the

1065DSGI/COPES system.

106712 . A cha nge of address notification card dated August 10,

10791999 , regarding Mr. King's change of address from the Stratford

1089address to the Muirfield address is in evidence. I t is not

1101clear from the face of the change of address form as to whether

1114this was sent to D SGI or to DOR .

112413 . Two months later, DSGI sent another letter to retirees

1135informing them that they were enrolled in the life insurance

1145plan but required them to submit an enclosed form to indicate a

1157decision either to decline the coverage or to provide

1166beneficiary coverage. This letter was dated January 12, 2000 ,

1175and was mailed to the Stratford address , Mr. King's former

1185address .

118714 . Several of Mr. King's State of Florida Statements of

1198Retirement Benefit Payments are in evidence and reflect that the

1208payment of $4.20 was regularly deducted from Mr. King's monthly

1218retirement benefit for State life insurance, including the

1226monthly statement dated January 31, 2000. The monthly

1234retirement benefits statements were mailed to the Muirfield

1242address by DOR.

124515 . Sandi Wade is a benefits administrator for DSGI.

1255According to Ms. Wade, the cost of retiree life insurance was

1266supplemented in the past with funds from a trust account ,

1276thereby reducing the premium charged to retirees.

128316 . I n 2006, DSGI deter mined that the funds used to augment

1297the retirees' benefits from years 2000 through 2007 would be

1307depleted after 2007. DSGI then determined that the current life

1317insurance premium of $4.20 would support a benefit of $2,500,

1328and that the premium to continu e $10,000 of life insurance

1340coverage would be $35.79 per month. This resulted in a change

1351in the life insurance options available to retired employees.

136017 . By letter dated July 31, 2006, DSGI informed retired

1371state employees of this change in a letter w hich read in

1383pertinent part:

1385Dear Retiree:

1387RE: State of Florida Life Insurance

1393* * *

1396The upcoming annual open enrollment period

1402will provide you with three (3) options

1409regarding your life insurance coverage. You

1415should caref ully examine all options and the

1423information provided in your Open Enrollment

1429packet, which will be mailed prior to Open

1437Enrollment, to decide which choice best

1443suits your unique circumstances.

1447Effective January 1, 2007, the three (3)

1454life insurance opt ions available will be:

1461- A $2,500 benefit for a monthly premium of

1471$4.20

1472- A $10,000 benefit for a monthly premium

1481of $35.79

1483- Terminate life insurance coverage

1488(precludes participants from re - enrolling

1494for the product in the future.)

1500Consistent wi th our practice in previous

1507years, should you not participate in the

1514Open Enrollment process, or make no change

1521to your life insurance election, you will

1528continue to be enrolled with retiree life

1535insurance coverage. Your default election

1540will be the $2,50 0 benefit, with its

1549associated premium.

1551If there is a desire to modify your open

1560enrollment life insurance election, requests

1565for changes to your life insurance coverage

1572enrollment will be accepted through Friday,

1578January 19, 2007.

1584This notice in advance of open enrollment is

1592being provided in order that you will have

1600additional time to consider all options

1606available to you. Life insurance choices

1612are important decisions.

161518 . Mike Waller, an employee of DSGI, maintains benefits

1625data for People First/DSGI. In July 2006, Mr. Waller was asked

1636to prepare a file containing the names and mailing addresses of

1647all retirees who were covered by life insurance. He created a

1658file used in a mail merge to send all retirees a copy of the

1672July 31, 2006 letter.

167619 . In preparing the file containing the mailing addresses

1686of retirees covered by life insurance in July 2006, Mr. Waller

1697used the addresses of record from the benefits data he

1707maintained.

170820 . In July 2006, the address of record in t he DSGI

1721data base for Mr. King was the Stratford address, and was

1732included in the mailing addresses file.

17382 1 . Mr. Waller prepared the file and on July 3, 2006,

1751delivered it to Dick Barnum and Thomas Lockridge.

17592 2 . Thomas Lockridge delivered the file to Laura Cutchen,

1770another employee of DSGI.

17742 3 . DSGI contracted with Pitney Bowes t o mail the July 31,

17882006 letter to 29,392 retired state employees.

17962 4 . After obtaining copies of the letter from the print

1808shop of DSGI, Ms. Cutchen delivered the lett ers and the file

1820containing names and addresses of retirees to Pitney Bowes to

1830assemble. Pitney Bowes provided the envelopes, assembled the

1838letters (inserting them in each of the 29,392 envelopes), and

1849addressed the letters by ink jet.

18552 5 . The letters w ere delivered to the U.S. Post Office,

1868accompanied by Ms. Cutchen. The State of Florida first class

1878mailing permit had been applied to each envelope.

18862 6 . The July 31, 2006 letter was mailed to Mr. King at the

1901Stratford address .

19042 7 . The return addres s on the envelope containing the

1916July 31, 2006 letter was DSGI, 4050 Esplanade Way, Suite 215,

1927Tallahassee, Florida 32399 - 0949.

19322 8 . Janice Lowe is employed by DSGI and has been for over

194632 years. Her duties include assisting retirees with insurance

1955issu es. According to Ms. Lowe, DSGI received numerous returned

1965letters as undeliverable . These undeliverable letters were

1973processed by Ms. Lowe. If the returned envelope showed a

1983different address on a yellow sticker applied by the U.S. Postal

1994Service, the letter was re - mailed to that address.

200429 . However, if the returned envelope did not provide a

2015different address, DSGI accessed the DOR data base to determine

2025whether there was another address for the retiree to whom the

2036returned letter was addressed. E ach time a name was accessed on

2048the DOR system, DSGI printed that Retirement Benefit Information

2057s creen showing the address in the DOR database. If the address

2069in the DOR database was different from the address in the DSGI

2081database, the original envelope and letter were placed in

2090another envelope and mailed to the retiree at the address from

2101the DOR database.

210430 . A copy of each retirement print screen that was

2115accessed by Ms. Lowe was printed and in serted alphabetically

2125into binder s .

212931 . The presen ce of a DOR print screen indicates that the

2142initial letter was returned as undeliverable and processed as

2151described above.

21533 2 . From each retirement screen that was accessed,

2163Ms. Lowe typed the name of the retiree and DOR address in a

2176format used for a ddress labels. Once she had typed a full page

2189of names and addresses, she printed those onto mailing labels

2199and put the new labels on envelopes . She then placed the

2211July 31, 2006 letter and original envelope that had been

2221returned into the new envelope b earing the newly created address

2232label.

22333 3 . There is a DOR print screen for Mr. King, thereby

2246indicating that the letter to him dated July 31, 2006, and

2257mailed to the Stratford address, had been returned to DSGI, and

2268was processed as described above.

22733 4 . Ms. Lowe re - mailed the July 31, 2006 letter to

2287Mr. King at the Muirfield address on or about October 13, 2006.

2299A copy of the address label used to mail this to Mr. King is in

2314evidence. This label reflects the Muirfield address.

23213 5 . The letters mail ed by Ms. Lowe were mailed first

2334class. The return address printed on the envelopes was the

2344State of Florida, Division of State Group Insurance, P.O. Box

23545450, Tallahassee, Florida 32314 - 54 5 0.

23623 6 . When one of the letters as prepared and mailed by

2375Ms. Lowe was returned to DSGI, Ms. Lowe stapled the letter to

2387the DOR print screen for that retiree.

23943 7 . The retirement print screen that Ms . Lowe printed for

2407Ms . King does not contain a letter that was returned, indicating

2419that the envelope with the Muirf ield address , mailed in October

24302006, was not returned to DSGI as undeliverable .

24393 8 . Although Ms. Lowe re - mailed the letter using the

2452Muirfield address, she did not change Mr. King's address in the

2463DSGI database, and does not have access that would allo w her to

2476do so.

247839 . Prior to Convergys assuming responsibility for the

2487administration of benefits, DSGI maintained benefits information

2494in the COPES system . When Convergys assumed responsibility for

2504the management of benefits on January 1, 2005, the ben efits

2515information from COPES was imported into the Convergys/People

2523First system.

252540 . For reasons that are not entirely clear, People First

2536and DOR do not share databases and each maintains its own

2547database of names and addresses. This results in two di visions

2558(DSGI and DOR) of the same state agency (DMS) using different

2569databases.

257041 . Each year, DSGI holds an open en rollment period as

2582required by s ection 110.123(3)(h) 5. , Florida Statutes. Open

2591enrollment is that period of time once a year, as ident ified by

2604DSGI, during which participants in the state group insurance

2613programs , including retirees, may change, add, or cancel

2621participation in the insurance plans offered.

26274 2 . Prior to open enrollment, DSGI mails to each employee

2639and retiree participa t i ng in the state group insurance program a

2652package that explains the benefits and options that are

2661available for the next year.

26664 3 . There is a copy of correspondence from DSGI addressed

2678to Mr. King regarding open enrollment for 2001. This

2687correspondence was mailed to Mr. King at the newer Muirfield

2697address. It states in part, "The Annual Enrollment Period

2706begins on September 11, 2000 and ends on October 11, 2000."

2717This correspondence contained a copy of a return postcard

2726addressed to DSGI and also cont ained the statement "Detach this

2737postcard and mail to DSGI by 9 - 22 - 00 to obtain the desired

2752information." It is unclear from the record how the Muirfield

2762address was used at this p oint in time when the DSGI data base

2776still reflected the Stratford address f or Mr. King.

27854 4 . DSGI maintains that its database reflected that the

2796DSGI address of record for Mr. King was the Stratford address

2807until February 8, 2011, after the death of Mr. King.

28174 5 . The 2006 Open Enrollment period for the 2007 plan year

2830ran from September 19, 2006, through October 18, 2006.

28394 6 . During Open Enrollment for Plan Year 2007, the People

2851First Service Center was charged with the responsibility of

2860sending open enrollment packages to State of Florida employees

2869and retirees. The Op en Enrollment packages for Plan Year 2007

2880were mailed by People First using the U.S. Postal Service.

28904 7 . People First mailed Mr. King's Open Enrollment 2007

2901package o n September 3, 2006, to the older Stratford address .

291348 . The Open Enrollment package m ailed to Mr. King on

2925September 3, 2006, contained Mr. King's 2007 Benefits Statement;

2934a letter f rom John Mathews, former Director of DSGI; Information

2945of Note; a Privacy Notice; and the 2007 Benefits Guide.

295549 . The 2006 Open Enrollment package for year 2007 also

2966included a document entitled, " State Group Insura nce Program -

2976Information of Note" which reads in pertinent part:

2984RETIREE LIFE INSURANCE

2987For Plan Year 2007, those currently enrolled

2994with retiree life insurance may elect to

3001retain the current $4. 20 premium for a

3009benefit of $2,500, retain the current

3016benefit of $10,000 for a premium of $35.79,

3025or cancel coverage. If no change is made

3033during open enrollment, participation will

3038continue at the $4.20 premium level.

304450 . Prior to the benefits chang e effective January 1,

30552007, Mr. King paid a monthly premium of $4.20 for $10,000 in

3068life insurance coverage. This amount was deducted from his

3077retirement benefit monthly payment. This amount continued to be

3086deducted from his retirement benefits followin g the change in

3096January 20 07 until December 2007 when the amount deducted

3106increased to $7.41.

310951 . In any event, no election to pay the increased premium

3121of $35.79 was received by DSGI for Mr. King. This is not

3133surprising since Mr. King did not receiv e the Open Enrol l ment

3146package informing him of the right to make this election as it

3158was mailed to the Stratford address.

316452 . For those retirees who did not make a timely election

3176pursuant to the Open Enrollment notice sent in 2006 for Plan

3187Year 2007, th e death benefit automatically became $2,500,

3197effective January 1, 2007, for the monthly premium of $4.20.

320753 . Throughout the years, the Benefits Guides and

3216newsletters sent from DSGI have informed program participants of

3225their responsibility to maintain current addresses with DSGI,

3233including reminders to notify both DOR and DSGI in writing if

3244there was an address change.

324954 . Neither DGSI nor DOR notifies the other of receipt of

3261address change. A change of address of one division of DMS does

3273not automat ically change the address in another as the t wo

3285divisions have separate data bases.

329055 . While it is beyond the scope of this proceeding to

3302evaluate the fact that these two divisions of the same state

3313agency do not share data bases, it is noted that DOR ser ves a

3327larger population of persons. That is, the database of the DOR

3338consists of all retirees that participate in the Florida

3347Retirement System, including retirees of various local

3354government agencies and educational entities .

33605 6 . Deductions were made monthly for state life insurance

3371premiums until Mr. King's death in September 2010. No evidence

3381demonstrated that Mr. King informed DSGI in any way that he

3392desired to maintain his $10,000 life insurance benefit.

3401CONCLUSIONS OF LAW

340457 . The Division o f Administrative Hearings has

3413jurisdiction over the parties and the subject matter of this

3423proceeding pursuant to s ection 120.57(1), Florida Statutes.

343158 . The burden of proof is on the party asserting the

3443affirmative of an issue before an administra tive tribunal. Fl a .

3455Dep ' t of Transp . v. J.W.C. Corp . , Inc. , 396 So. 2d 778 (Fla. 1st

3472DCA 1981); Balino v. Dep 't of H RS , 348 So. 2d 349 (Fla. 1st DCA

34881977). Accordingly, Petitioner bears the burden of proof in

3497this proceeding by a preponderance of the evi dence.

3506§ 120.57(1)(j), Fla. Stat.

351059 . DSGI and DOR are divisions established by statute

3520within DMS . § 20.22(2), Fla. Stat. DSGI is the entity charged

3532with administering the st ate group insurance program.

3540§ 110.123(3) and (5), Fla. S tat. No other agency is given

3552authority to act regarding state insurance benefits.

355960 . DOR, while also a division of DMS, administers the

3570Florida Retirement System pursuant to the provisions of c hapter

3580121, Florida Statutes.

358361 . There i s nothing in the statutes governing these

3594entities or the rules implementing them which would require DSGI

3604and DOR to share databases.

36096 2 . As provided in s ection 110.123(4)(f), the state cannot

3621increase the insurance premium deducted from reti rement warrants

3630unless requested by the retiree. As provided in s ection

3640110.123(4)(e), the state cannot contribute to the premium paid

3649by retirees that participate in the state insurance program.

36586 3 . While there is no evidence that Mr. King elected to

3671reduce his coverage, there is also no evidence that he elected

3682to maintain the $10,000 by agreeing to pay the increased

3693premium.

369464 . It is presumed that mail properly addressed, stamped

3704and mailed was received by the addressee. Berwick v. Pruden tial

3715Prop. and Cas. Ins. Co. , 436 So. 2d 239 (Fla. 3d DCA 1983).

3728Proof of mailing of a document to the correct address creates a

3740presumption that the item mailed was received. W.T. Holding,

3749Inc., v. Ag . for H ealth Care Admin . , 682 So. 2d 1224 (Fla. 4th

3765D CA 1996). This presumption is a rebuttable one. Id. ; Scutieri

3776v. Miller , 584 So. 2d 897, 900 (Fla. 3rd DCA 1991). A denial of

3790receipt does not automatically overcome the presumption of

3798receipt but creates a question of fact for the trier of fact.

3810W.T. Holding v. Ag. for Health Care Admin . , supra .

382165. The question becomes, did DSGI send the pertinent

3830information to the correct address? Clearly, Mr. King had moved

3840from the Stratford address. There is evidence that he notified

3850someone of this addre ss change, but no competent evidence that

3861this notification went to DSGI. The November 1999 and October

38712006 mailings used the Muirfield address, which DSGI obtained

3880from DOR in tho se instances. The DSGI database was not updated

3892with the address furnishe d by DOR, which clearly had the newer

3904Muirfield address. The DSGI database contained the Stratford

3912address until Mr. King's death in 2010.

391966 . Applying the analysis supplied by case law, the

3929evidence presented by Petitioner is not sufficient to rebut the

3939presumption established by Respondent. Respondent's evidence

3945established that DSGI mailed the pertinent notices to Mr. King's

3955address of record with DSGI. The evidence also established that

3965DSGI personnel tracked all July 31, 2006, letters that were

3975returned to DSGI, and that the letter mailed to Mr. King was

3987returned. It then obtained the Muirfield address from DOR and

3997remailed it in October 2006. This mailing to the Muirfield

4007address, Mr. King's correct address, was not returned. Thus,

4016based upon the above - referenced case law, this creates a

4027presumption that it was received prior to the implementation of

4037the insurance premium change January 1, 2007. W hile the end

4048result is harsh under the circumstances of this case , the

4058undersigned is c ompelled to follow the applicable case law and

4069does not have jurisdiction to grant equitable relief.

4077RECOMMENDATION

4078Based on the foregoing Findings of Fact and Conclusions of

4088Law, it is

4091RECOMMENDED:

4092That the Department of Management Services enter a Final

4101Order deny ing Petitioner's request for an increase in life

4111insurance benefits.
