203STATEMENT OF THE ISSUE
207The issue for determina tion is whether Southern Baptist
216H ospital of Florida, Inc., d/b/a Baptist Medical Center should
226be reimbursed by AIG for medical services rendered in accordance
236with the proposed agency action by the Department of Financial
246Services, Division of Workers' Compensation, Office of Medical
254Ser vices issued on April 22, 2011.
261PRELIMINARY STATEMENT
263On April 22, 2011, the Department of Financial Services,
272Division of Workers' Compensation, Office of Medical Services
280(Department) issued a determination on a dispute between
288Southern Baptist Hospital of Florida, Inc., d/b/a Baptist
296Medical Center (Baptist Medical Center), and AIG regarding
304reimbursement for medical service s rendered. The Department ' s
314determination was favorable to Baptist M edical Center. AIG
323disputed the Department ' s determination an d requested a hearing.
334On July 6, 2011, this matter was referred by the Department to
346the Division of Administrative Hearings.
351P ursuant to notice, this matter wa s scheduled for final
362hearing by webcast and telephone conference call between
370locations in Mi ami, Jacksonville, and Tallahassee, Florida , on
379September 21, 2011.
382On July 11, 2011, Baptist Medical Center filed a Motion to
393Dismiss AIG's Late Petition for Administrative Relief requesting
401dismissal of AIG's Pe tition for Administrative Hearing
409(Petition ) as untimely. Among other things, AIG filed a
419response asserting that the Petition was timely , to which
428Baptist Medical Center filed a reply. The Depar tment did not
439file a response.
442Pertinent hereto, on August 11, 2011, t he undersigned
451issued an Order R egarding Motion to Dismiss. The undersigned
461determi ned that, based upon Baptist Medical Center 's suggesting
471that it become an additional respondent and not objecting to AIG
482being a pa rty to the instant case as the Petitioner , Baptist
494Medical Center was wi thdrawing its Motion to Dismiss . However,
505subsequently, Baptist Medical Center indicated that it was not
514withdrawing its Motion to Dismiss and desired the dismissal of
524the Petition. As a result, on September 1, 2011, the
534undersigned issued an Order Vacat ing Order Regarding Motion to
544Dismiss.
545On August 12, 2011, Baptist Medical Center filed, among
554other motions, a Motion for Summary Final Order, which is
564considered a motion for recommended order of dismissal, 3 and
574which also incorporates arguments presente d by Baptist Medical
583Center in its Motion to Dismiss . In essence, Baptist Medical
594C enter's position is that AIG's P etition , challenging the
604Department's determination , is untimely and should be dismissed.
612On August 19, 2011, AIG filed a response in oppos ition to the
625M otion for Summary Final Order . On August 25, 2011, Baptist
637Medical Center filed a reply to AIG's response. On August 26,
6482011, the Department filed a response to AIG's response.
657Further, Baptist Medical Center's Motion to Dismiss is
665conside red a motion for a recommended order of dismissal. 4 The
677Motion to Dismiss is also considered in this Recommended Order
687in that, essentially, the same arguments for dismissal are being
697presented in both the Motion to Dismiss and the Motion for
708Summary Fina l Order .
713A basic tenant of law is that , in addressing motions to
724dismiss, allegations of a petition or complaint must be accepted
734as true in the light most favorable to the Petitioner or
745complainant. City of Gainesville v. State of Fla., Dep't of
755Transp. , 778 So. 2d 519, 522 (Fla. 1st DCA 2001); Fox v. Prof'l
768Wrecker Operators of Fla., Inc., 801 So. 2d 175, 178 (Fla. 5th
780DCA 2001). Consequently, the allegations in the Petition must
789be taken as true and in the light most favorable to AIG.
801FINDING S OF FACT
805Based on the Petition and assertions by the parties to
815which no disagreement exists, the following Findings of Fact are
825made:
8261. Baptist Medical Center filed a Petition for Resolution
835of Reimbursement Dispute (Petition for Resolution) with the
843Department . Baptist Medical Center was the Petitioner , and AIG
853was the respondent.
8562. On April 22, 2011, the Department issued its decision
866in favor of Baptist Medical Center. Contained in its decision,
876a mong other things, the Department notified all affected
885per sons, including AIG and AIG's servicing agent, Specialty Risk
895Services , Inc. (SRS), that any petition for hearing was required
905to be filed within 21 days from their receipt o f the decision
918and that failure to do so would constitute a waiver of the right
931to a hearing regarding the Department's decision.
9383. Both AIG and SRS received their respective copy of the
949Department's decision on April 25, 2011. A petition for hearing
959was required to be filed with th e Department on or before
971May 16 , 2011.
9744. SRS forw arded a petition for administrative hearing to
984the Department's Clerk by Federal Express on May 10, 2011. An
995inference is drawn and a finding of fact is made that SRS'
1007petition for administrative hearing was received by the
1015Department on May 11, 2011. SR S' petition for administrative
1025hearing reflects, among other things, in the style and the
1035allegations, SRS as the Petitioner and SRS as requesting the
1045hearing . A lso , in an allegation identifying the Petitioner and
1056the Petitioner 's address, SRS includes AI G and Liberty Asset
1067R ecovery as Petitioner s.
10725. Subsequently, AIG was contacted by the Department's
1080counsel on June 16, 2011. The Department's counsel advised AIG
1090that SRS did not have standing to file the petition for
1101administrative hearing; that AIG, i nstead of SRS, must be named
1112as the Petitioner ; and that the 21 - day deadline would be
1124extended to allow AIG to file an amended petition for
1134administrative hearing to correct the defect of SRS as the
1144Petitioner .
11466. AIG forwarded its Petition to the Departm ent's Clerk by
1157Federal Express on June 20, 2011. An inference is drawn and a
1169finding of fact is made that AIG's Petition was received by the
1181Department 's Clerk on June 21, 2011.
11887. The Department's Clerk received AIG's Petition more
1196than 21 days from the date that AIG received the Department's
1207decision on the Petition for Resolution. AIG's Petition i s
1217untimely.
1218CONCLUSIONS OF LAW
12218 . The Division of Administrative Hearings has
1229jurisdiction over the subject matter of this proceeding and the
1239parties there to pursuant to sections 120.569 and 1 20.57(1),
1249Florida Statutes (2011 ).
12539 . Section 120.569, provides in pertinent part:
1261(2)(a) Except for any proceeding conducted
1267as prescribed in s. 120.56 , a petition or
1275request for a hearing under this section
1282shall be filed with the agency. . . . A
1292request for a hearing shall be granted or
1300denied within 15 days after receipt.
1306* * *
1309(c) Unless otherwise provided by law, a
1316petition or request for hearing shall
1322include those items required by the uniform
1329rules adop ted pursuant to s. 120.54(5)(b) .
1337Upon the receipt of a petition or request
1345for hearing, the agency shall carefully
1351review the petition to determine if it
1358contains all of the required information. A
1365petition shall be dismissed if it is not in
1374substantial compliance with these
1378requirements or it has been untimely filed.
1385Dismissal of a petition shall, at least
1392once, be without prejudice to Petitioner 's
1399filing a timely amended petition curing the
1406defect, unless it conclusively appears from
1412the face of the pe tition that the defect
1421cannot be cured. The agency shall promptly
1428give written notice to all parties of the
1436action taken on the petition, shall state
1443with particularity its reasons if the
1449petition is not granted, and shall state the
1457deadline for filing an amended petition if
1464applicable. This paragraph does not
1469eliminate the availability of equitable
1474tolling as a defense to the unt imely filing
1483of a petition.
1486(d) The agency may refer a petition to the
1495division for the assignment of an
1501administrative law ju dge only if the
1508petition is in substantial compliance with
1514the requirements of paragraph (c).
151910 . Pertinent to the instant case, the Department provided
1529in its decision that any petition for hearing was required to be
1541received by the Department within 21 days from receipt of its
1552decision.
155311 . AIG received the Department's decision on April 25,
15632011. As a result, AIG's Petition should have been received by
1574the Department's Clerk on or before Monday, May 16, 2011.
1584However, AIG's Petition was not received until June 21 , 2011,
1594more than one month after the date that AIG received the
1605Department's decision and more than one month after the date
1615that the Department should have received AIG's Petition.
162312 . AIG argues that its Petition is not untimely because
1634t he action by the Department's counsel , after the filing
1644deadline, extended and waived the 21 - day requirement. The
1654undersigned is not persuaded that the action by the Department's
1664counsel extended and waived the 21 - day requirement. See
1674Riverwood Nursing C tr., LLC. v. Ag. for Health Care Admin. , 58
1686So. 3d 907 , 911 (Fla. 1st DCA 2011). Furthermore, even though
1697not argued, equitable tolling does not apply to the
1706circumstances presented in the instant case. Id.
171313 . Additionally, AIG argues that its Petiti on is not
1724untimely because its Petition amends or relates back to the
1734earlier petition for hearing filed by SRS with the Department's
1744Clerk on May 11, 2011. The undersigned is not persuaded that
1755the relation back rule applies in this particular situation.
1764Id. See a lso Trosso v. Fla. Ins. Guar. , 538 So. 2d 103 (Fla.
17784th DCA 1989).
178114. Consequently, AIG's Petition i s untimely.
178815. The agency with whom a petition for hearing is filed
1799determines whether the petition should be dismissed as untimely.
1808§ 120. 569(2)(c), Fla. Stat. SRS' petition for hearing was filed
1819with the Department , as SRS being the Petitioner . AIG's
1829Petition was filed with the Department , as AIG being the
1839Petitioner . The refore, the Department determines whether AIG's
1848P etition should be dismissed as untimely.
185516 . The Department shall dismiss a petition for hearing,
1865at least once, without prejudice and allow the Petitioner to
1875file an amended petition curing the defect, unless it appears
1885conclusively from the face of a petition that the de fect in the
1898petition cannot be cured. § 120.569(2)(c), Fla. Stat.
190617. The Department determined that SRS did not have
1915standing to file a petit ion for hearing as a Petitioner , but did
1928not dismiss SRS' petition for hearing.
193418. AIG did not file a petitio n for hearing before the
1946expiration of the 21 - day requirement.
195319. Subsequent to the 21 - day requirement, the Department's
1963counsel contacted AIG and advised AIG of SRS' standing defect
1973and that AIG was required to file the petition for hearing. AIG
1985then f iled its Petition.
199020. Unless the Department determines that the defect in
1999SRS' petition for hearing, as SRS being the Petitioner , could be
2010cured by AIG 's filing a petition for hearing, as AIG being the
2023Petitioner , AIG's Petition should be dismissed.
202921. AIG's Petition is untimely and should be dismissed.
2038RECOMMENDATION
2039Based on the foregoing Finding s of Fact and Conclusions of
2050Law, it is
2053RECOMMENDED that the Department of Financial Services,
2060Division of Workers' Compensation, Office of Medical Services
2068e nter a final order dismissing AIG's Petition for Administrative
2078Hearing.
