135PRELIMINARY STATEMENT
137Petitioner, Mary E. Ehrhardt, filed an application with
145Respondent for licensure as a H ealth C are R isk M anager. On or
160about July 5, 2011, the Agency for Health Care Administration
170(AHCA) sent a Notice of Intent to Deem Application Incomplete
180and Withdrawn from Further Review. Specifically, the Notice
188alleged that Petitioner had been earlier informed that
196additional information was needed before it considered her
204application to be complete . As this information was not timely
215received by AHCA, the application was deemed incomplete.
223Petitioner requested a formal administrative hearing, and
230AHCA forwarded the case to the Division of Administrative
239Hearings on or about July 28 , 20 11 .
248A heari ng was scheduled for October 12, 2011, and was heard
260as scheduled .
263At hearing, Petitioner testified on her own behalf .
272PetitionerÓs Exhibits numbered 1 through 5 were admitted into
281evidence and Petitioner's Exhibit 6 was rejected .
289Respondent present ed the testimony of Laura MacLafferty and

331The hearing was not transcribed. Petitioner timely filed a
340post hearing submission and Respondent timely filed a Proposed
349Recommended Order, which have been considered in the preparation
358of this R ecommended O rder. Unless otherwise indicated, all
368references to Florida Statutes are to the 20 10 codification.
378FINDINGS OF FACT
3811. AHCA is the agency responsible for the licensing and
391regulation of Health Care Risk Managers in Florida pursuant to
401sections 395.0971 through 395.0975, Florida Statutes.
4072. Petitioner holds a Master of Science A dministration
416from the University of West Florida and is licensed in the state
428of Florida as a Clinical Laboratory Supervisor.
4353 . Petitioner filed an application for licensure with AHCA
445as a Health Care Risk Manager on May 11, 2011. The application
457was reviewed by Mark Hajdukiewicz , a Health Services and
466Facilities Consultant employed by AHCA .
4724 . Section 6 of the application entitled "Qualifications
481for Licensure" states: "In the appropriate section below, check
490a ll of the applicable criteria. Com plete only one section."
501The "sections" on the application are ways or approaches from
511which an applicant may choose to demonstrate his or her
521qualifications for licensure as a Health Care Risk Manager. On
531this initial application, Petitioner completed t hree sections.
5395 . By letter dated June 2, 2011 (the Omissions Letter),
550Mr. Hajdukiewicz notified Petitioner that AHCA received her
558initial application and, after review, f ound it to be
568incomplete. The Omissions Letter further stated:

669not meet the Rule requirements. The Agency

7676 . Petitioner submitted a revised section 6 of her
777application on or about June 23, 2011. On this revised portion
788o f her application, Petitioner elected to seek licensure based
798upon her credentials as a Health Care Administrator as defined
808in Florida Administrative Code Rule 59A - 10.032(14). Petitioner
817also submitted a copy of her transcript for a Master of Science
829Adm inistration from the University of West Florida.
8377 . Mr. Hajdukiewicz reviewed Petitioner's revised
844application and determined that the documentation submitted by
852Petitioner in support of her application did not meet the
862cr iteria set forth in r ule 59A - 10 . 032(14), which defines a
877health care administrator. Mr. Hajdukiewicz forwarded a
884recommendation that the application be deemed incomplete to his
893supervisor, Laura MacLafferty.
8968. Ms. M a c L afferty concurred with Mr. Hajdukiewicz's
907recommendation and issued the Notice of Intent to Deem
916Application Incomplete and Withdrawn from Further Review.
923Subsequently, Petitioner submitted a copy of her transcript
931reflecting the curriculum for her master's degree program from
940the University of West Florida. Alth ough, as a transcript copy,
951it was extremely difficult to read, Ms. M a c L afferty reviewed the
965curriculum and determined that it was insufficient to warrant
974reversal of the Agency's decision.
9799 . At hearing, Petitioner acknowledged that her degree
988does not say "hospital" as specified in r ule 59A - 10.032 (14)
1001(i.e., hospital administration, hospital finance, hospital
1007management).
100810 . As Petitioner elected to qualify for licensure
1017pursuant to demonstrating attainment of credentials as a Health
1026Care Administrat or as defined in r ule 59A - 10.032(14), her
1038application was not evaluated pursuant to the other possible
1047ways of demonstrating qualifications for licensure. 1/
1054CONCLUSIONS OF LAW
105711 . The Division of Administrative Hearings has

108512 . A s an applicant for a license, Petitioner bears the
1097burden of proof in this proceeding by a preponderance of the
1108evidence. Dep ' t of Banking & Fin . v. Osborne Stern & Co . , 670
1124So. 2d 932 (Fla. 1996).
112913 . Section 395 . 10974 , Florida Statutes, provides that a
1140license issued by AHCA is req uired in order to perform as a
1153H ealth C are R isk M anager in this state.
11641 4 . Florida Administrative Code Rule 59A - 10.032(14) states
1175as f ollows:
1178(14) The term "Health Care Administrator"
1184means a person who has a degree, awarded by
1193an accredited institution of higher
1198learning, in hospital administration,
1202hospital finance, hospital management,
1206public health administration, or such other
1212edu cation which included successful
1217completion of college level courses in the
1224management and administration of a health
1230care facility.
123215 . Petitioner has not met her burden of demonstrating
1242that she qualifies for licensure under the method she chose in
1253he r application.
1256RECOMMENDATION
1257Based upon the foregoing Findings of Fact and Conclusions
1266of Law set forth herein, it is
1273RECOMMENDED:
1274That the Agency for Health Care Administration enter a
1283final order d enying Petitioner's app l ication for licensure as a
1295H ealth C are R isk M anager, without prejudice to reapply under the
1309other criteria specified in Florida Administrative Code Rule s
131859A - 10.032(15) and 59A - 10.035, and section 6 of the licensure
1331application form.
