117STATEMENT OF THE ISSUE S
122The issue s are w hether Respondent discriminated against
131Petition er by not providing a reasonable accommodation , steam
140clean ing the apartment after the sprinkler head broke , that
150Petitioner was entitled to , and Respondent was required to
159provide, and, if so, whether Petitioner should receive damages
168as a result of Respo ndent's failure to provide Petitioner with a
180reasonable accom m odation .
185PRELIMINARY STATEMENT
187In a Housing Discrimination Complaint , filed on March 3,
196201 1 , and subsequently investigated by the Florida Commission on
206Human Relations ( " Commission " ) , Judith Amadiz ( " Petitioner " or
" 216Amadiz " ) charged that Sunbeach Apts. Corp. ( " Respondent " or
" 226Sunbeach " ) unlawfully discriminated against Petitioner by not
234providing the reasonable accommodation of steam cleaning her
242apartment after the sprinkler head broke.
248The C ommission investigated Petitioner ' s claim and on
258November 17, 2010 , issued a notice setting forth its
267determination finding that reasonable cause existed to believe
275that a discriminatory housing practice had occurred. On
283March 2, 2011, a Notice of Failure of Conciliation was issued by
295the Commission. Thereafter , Petitioner filed a Petition for
303Relief, which the C ommission sent to the Division of
313Administrative Hearings ( " DOAH " ) on August 8, 2011.
322The final hearing was noticed and scheduled for October 12,
3322011. After several continuances, the final hearing was set and
342heard on May 9, 2012. Both parties appeared at the appointed
353place and time.
356At the final hearing, Amadiz testified on her own behalf .
367Petitioner ' s Composite E xhibit s 1 through 6 were adm itted in to
382evidence . Respondent presented the testimony of three
390witnesses: Maria G arcia, Enrique Perez, and Rene Fernandez , an
400expert witness . Respondent ' s E xhibit s 2 , 4, 7, 9 though 15, 18 ,
416and 20 were offered and received into evidence.
424The hearing was recorded and transcribed. On June 15,
4332012, the Transcript was filed at DOAH. On June 29, 2012, the
445undersigned issued an Order Granting Extension of Time. B oth
455parties filed timely P roposed R ecommended O rders , which have
466been duly considered in pre paration of this Recommended O rder .
478FINDINGS OF FACT
4811. On December 8, 2009, Amadiz applied to become a tenant
492at Sunbeach. Amadiz informed Sunbeach at the time of her
502application that she had l upus.
5082. Sunbeach approved Amadiz 's application and she be came a
519tenant of unit 417 , a studio apartment having approximate ly 400
530square f eet of living spaces . The apartment came furnished with
542a bed, dresser , nightstand, stove refrigerator, and desk.
5503. On April 11, 2010, Amadiz arrived home to her apartment
561at approximately 1:30 a.m. , from volunteering at a fundraiser
570held by Miami Beach Veiled Wine Society.
5774. After Amadiz entered her apartment and closed the door ,
587the sprinkler system started and an outpour of brownish water
597came out of the sprinkler because the cover was not on the
609sprinkler and the sprinkler head was not in place. The water
620wet Amadiz .
6235. Amadiz left the apartment and went to report the
633incident to the property manager Miguel Echemendia
640("Echemendia" ) . Although Echemendia and Amadiz had a difficult
651time communicat ing with one another because she didn't speak his
662language ( Spanish ) , Echemendia go t dressed and went upstair s
674with Amadiz to assist her.
6796. Enchemendia looked at the water in Amadiz 's apartment.
689He tried to locate the shut off but was not able to find it to
704cut off the running sprinkler.
7097. After about 45 minutes, Amadiz's neighbor helped
717Echemendia find the sprinkler shut - off and turned it off .
7298. Water covered Amadiz' s tiled floors in the bathroom,
739closet , and main living a rea.
7459. After the sprinkler was turned off , Amadiz pumped water
755out of her apartment for about three hours.
76310. Amadiz threw out a lot of personal items the next day
775while trying to clean up from the water . A friend came over and
789assisted Amadiz with th e clean up. They cleaned the tiled floor
801with bleach, dried the floors, and discarded wet and damaged
811goods. Amadiz and her friend were able to dry up most of the
824water.
82511. A t about 3:45 p.m. o n April 11, 2012, the same day as
840the sprinkler incident , Amadiz wrote Respondent a letter, which
849she sent certified, detailing the sprinkler outpour situation of
858earlier that morning .
86212. In the letter, Amadiz informed Sunbeach that she
"871cleaned the floors to the best of her ability." Amadiz also
882inform ed Sunb each that "as water has seeped under the dresser,
894the refrigerator and stove, I am unable to complete the process
905without any assistance " and she requested "complete maintenance
913review for sprinkler systems, clean up of the areas I noted,
924fair reparations for the items [listed] damaged."
93113. By April 12, 2010, the water under the bed had dried
943up. However, t he dresser had some brown water around it.
954Amadiz moved the dresser as far as she could and removed the
966water that she saw and cleaned the floor with b leach . Amadiz
979was concerned that there might be more water under the dresser
990that she couldn't get to left over from the sprinkler outpour.
100114. Amadiz also had a concern s about water she had
1012discovered when she reached under the stove and refrigerator
1021that she could not reach to clean. Amadiz dried up the areas
1033around the appliances she could reach in the floor area.
104315. Amadiz was worried about water residue because the
1052grout in her apartment was brown ish , not white , after the
1063outpour of water . Amad iz concluded that a mold - type condition
1076existed even though mold does not colonize on tile floors .
108716. The areas that Amadiz couldn't access underneath the
1096stove, refrigerator, and behind the floorboards concerned her .
1105Amadiz neither asked no r sought any one to help her access any of
1119the areas. And, she was never able to determine if there was
1131water behind the floorboard , stove, and refrigerator.
113817. On April 12, 2010, Sunbeach's repairman , Erique Perez
1147("Perez") , went to unit 417 with Echemendia to eval uate the
1160water damage. He checked both the floors and walls with his
1171hands. He checked underneath the refrigerator and stove by
1180pulling it forward and did not find any water. Perez determined
1191that there was no water damage in the apartment.
120018. On Apri l 13, 2010, Amadiz sent Sunbeach a second
1211letter requesting that Sunbeach come "check out the damage of
1221her apartment, provide steam cleaning support or speak with her
1231about the next steps . " She also stated in the letter that she
1244had been given antibiotic s and a steroid cream for a rash and
1257set up another doctor's appointment.
126219. On April 15, 2010, Am a diz called Garcia to follow up
1275on her requests from the letters . Garcia indicated that she
1286would speak to her supervisor and get back in contact with
1297Amad iz the next week.
130220. Soon thereafter, code compliance visited Amadiz's
1309apartment.
131021. O n April 27, 2010, Amadiz sent a third letter to
1322Respondent notifying Sunbeach that she was going to withhold
1331rent if repairs weren't made in seven days and requested the
1342following:
1343Steam cleaning of the u nit in which I reside
1353as soiled water residue stil l remains under
1361the appliances and furniture and within the
1368grout of the tiles in the main living area
1377as well as the bathroom
1382An inspection of the two remaining
1388sprink lers in the unit
1393The rug directly in front of door remains
1401and has begun showing signs of mold and
1409mildew enough in fact that the smell can be
1418ascertained from the elevators.
142222. Amadiz further detailed the items for which she wanted
1432to be reimbursed and stated:
1437These addressed issues coupled with my own
1444health issues (on SSA Disability for
1450systemic lupus erythematosus) cited in my
1456previous correspondence lead me to assume
1462the habitability of the unit is of little
1470concern. I have made you aware of the ne ed
1480for antibiotics and steroid creams to offset
1487the effects of the soiled water . . . the
1497presence of mold and mildew within and
1504without the unit creates inhabitable living
1510conditions.
151123. Amadiz paid rent up to April 27, 2010, then withheld
1522rent paymen ts per her attorney ' s advice.
153124. On or about May 17, 2010, Amadiz received a three - day
1544eviction notice from Sunbeach .
154925. Amadiz responded with a fourth letter dated May 17,
15592010, which chronicled her previous letters , requested steam
1567cleaning an d inspe ction, and reparations for lost items, and
1578listed her health issues identically as she had in the letter of
1590April 27, 2010.
159326. Amadiz remained in the apartment from April 11, 2010,
1603to June 29, 2010. She vacated the unit 417 on July 3, 2010 ,
1616pursuant to the final judgment of eviction by Sunbeach entered
1626against her for non - payment of rent .
1635CONCLUSIONS OF LAW
16382 7 . DOAH has jurisdiction over the subject matter of this
1650proceeding and of the parties pursuant to s ections 120.569 and
1661120.57(1), Florida Statutes .
16652 8 . Under Florida ' s Fair Housing Act, sections 760.20
1677through 760.37, it is unlawful to discriminate in the sale or
1688rental of housing. Section 760.23 states, i n pertinent part:
1698(8) It is unlawful to discriminate against
1705any person in the terms, condit ions, or
1713privileges of sale or rental of a dwelling,
1721or in the provision of services or
1728facilities in connection with such dwelling,
1734because of a handicap of:
1739(a) That buyer or renter;
1744(b) A person residing in or intending to
1752reside in that dwelling aft er it is sold,
1761rented, or made available; or
1766* * *
1769(9) For purposes of subsections (7) and
1776(8), discrimination includes:
1779(b) A refusal to make reasonable
1785accommodations in rules, policies,
1789practices, or services, when such
1794accommodations may be ne cessary to afford
1801such person equal opportunity to use and
1808enjoy a dwelling.
181129. To prevail with a reasonable accommodation claim ,
1819Petitioner must establish that (1) s he is disabled or
1829handicapped within the meaning of the F lorida H ousing A ct , (2)
1842s he re quested a reasonable accommodation, (3) such accommodation
1852was necessary to afford her an opportunity to use and enjoy her
1864dwelling, and (4) the defendant refused to make the requested
1874accommodation. United States v. Hialeah Hous. Auth. , 418 Fed .
1884Appx. 87 2 (11th Cir. Fla. 2011). Under this approach, Amadiz
1895must demonstrate a prima facie case for discrimination.
190330. In this matter, Respondent stipulates that Petitioner
1911has l upus and is disabled or handicapped within the meaning of
1923the Florida Housing Act. However, Petitioner has failed to
1932prove a prima facie case. First, Amadiz fails to establish the
1943second prong of the test that a specific demand was made for a n
1957accommodation. Amadiz's letters fail to establish any specific
1965or direct request for steam cleaning services as a reasonable
1975accommodation . In fact, l upus was not even mentioned in the
1987first two letter s of April 11 and 13, 2010. And, the April 27,
20012010, letter , which was a notice to terminate lease agreement
2011and the May 17, 2010, letter both f ail to make any direct
2024connect ion between the request for steam cleaning and Amadiz's
2034lupus disability.
203631. And, if the last two letters could have been tied to
2048Petitioner's l upus condition, which was noted in her application
2058for an apartment, the record lacks any credible evidence of
2068Amadiz putt ing Sunbeach on notice why her l upus condition
2079required the reasonable accommodation of steam cleaning
2086services. 1 The re is no persuasive evidence showing that
2096Petitioner was precluded from steam cleaning the floor s in her
2107apartment. Accordingly, Petitioner's failure to establish the
2114two prongs of a reasonable accommodation claim ends any further
2124inquiry regarding discrimination because Amadiz fails to meet
2132her burden.
213432. As to the issue of damages , Petitioner is not entitled
2145to any damages because Sunbeach did not fail to provide her a
2157reasonable accommodation.
2159RECOMMENDATION
2160Based on the foregoing Findings of Fact and Conclusions of
2170Law, it is RECOMMENDED that the Florida Commission on Human
2180Relations enter a fi nal order dismissing Petitioner ' s Petition
2191for Relief filed by Judith Amadiz in its entirety.
