98On September 23, 2011, Petitioner, Natalie Ann Greenough,
106on behalf of and as parent and natural guardian of Aiden Curtis
118Gordon Morris (Aiden), a min or, filed a Petition for Benefits
129Pursuant to Florida Statute Section 766.301 et seq. (Petition)
138with the Division of Administrative Hearings (DOAH) for
146compensation under the Florida Birth - Related Neurological Injury
155Compensation Plan (Plan). The Petitio n named Dean E.
164Altenhofen, M.D. (Dr. Altenhofen), and Sacred Heart Hospital.
172The case was originally assigned to Administrative Law
180Judge Ella Jane P. Davis, but was reassigned to Administrative
190Law Judge Susan Belyeu Kirkland due to Judge Davis' retireme nt.
201DOAH served NICA and Dr. Altenhofen with copies of the
211Petition on September 28, 2011. On February 6, 2012, DOAH
221served Sacred Heart Hospital with a copy of the Petition. As of
233the date of this Summary Final Order, neither Sacred Heart
243Hospital nor D r. Altenhofen has petitioned to intervene in this
254proceeding.
255On October 24, 2012, NICA filed a Motion for Summary Final
266Order, asserting that Aiden did not sustain a "birth - related
277neurological injury" as that term is defined in section
286766.302(2), Florid a Statutes. No response was filed to the
296motion.
297On November 14, 2012, an Order to Show Cause , was issued.
308Petitioner was ordered to show cause on or before November 30,
3192012, why Respondent's Motion for Summary Final Order should not
329be granted. To dat e, Petitioner has filed no response.
339The two - day final hearing is scheduled to commence on
350December 17, 2012, in Pensacola, Florida.
356FINDINGS OF FACT
3591. Aiden Curtis Gordon Morris was born on September 15,
3692011, at Sacred Heart Hospital in Pensacola, Fl orida. He
379weighed 3,300 grams at birth.
3852. NICA requested that Donald Willis, M.D., an
393obstetrician specializing in maternal - fetal medicine to review
402the medical records of Ms. Greenough and Aiden. The purpose of
413his review was to determine whether an i njury occurred in the
425course of labor, delivery, or resuscitation in the immediate
434post - delivery period in the hospital due to oxygen deprivation
445or mechanical injury. Dr. Willis reviewed the records and made
455the following findings, which he set forth in an affidavit
465attached to the Motion for Summary Final Order.
473According to the medical records, the
479mother Natalie Greenough was a 16 year old
487G1. She presented to the hospital at 38
495weeks gestational age in labor. Her cervix
502was dilated 5 to 6 cms on adm ission.
511Amniotic membranes were ruptured with clear
517fluid.
518The fetal heart rate (FHR) monitor on
525admission shows a reactive heart rate
531pattern with a normal baseline rate of 120
539to 130 bpm. Some variable FHR decelerations
546and episodes of reduced FHR var iability are
554noted during labor. An abnormal FHR pattern
561with reduced heart rate variability and
567variable decelerations continued for about
57290 minutes prior to delivery. Severe
578variable decelerations with a drop in FHR to
<60 bpm="" occurred="" about="" 40="" minute="" s="">60>
586delivery.
587Cesarean delivery was done for the non -
595reassuring FHR pattern. Birth weight was
6013,300 grams. The newborn was depressed with
609Apgar scores of 1/4/6. Umbilical cord blood
616gas was abnormal with a reported pH of 6.99.
625Initial resuscitatio n included bag and mask
632ventilation with a good improvement in heart
639rate. Despite the improvement in heart
645rate, poor perfusion and respiratory
650depression continued. Intubation for
654mechanical ventilation was required.
658Admission physical exam in the NIC U
665describes the baby as lethargic with poor
672perfusion of the extremities and on the
679ventilator for respiratory depression. Body
684cooling was initiated due to hypoxic
690ischemic encephalopathy (HIE).
693The newborn hospital course was
698complicated. Multisystem failure occurred.
702Poor perfusion required intravenous fluid
707boluses. Respiratory depression was present
712at birth and required intubation and
718mechanical ventilation. Disseminated
721intravascular coagulation manifest with
725hematuria and required fresh frozen plasma.
731Platelet count dropped to 91,000. Seizure
738activity was noted on DOL 2. EEG was
746consistent with mild HIE. MRI on DOL 7 was
755reported as normal.
758In summary, labor was complicated by
764fetal distress, requiring Cesarean delivery.
769The newborn was d epressed. Umbilical cord
776blood gas showed significant acidosis with a
783pH or 6.99. The baby was lethargic, had
791poor perfusion and respiratory depression at
797birth. Hospital course was complicated by
803multisystem organ failure. Although the MRI
809on DOL 7 wa s reported as normal, EEG was
819consistent with HIE.
8223. Dr. Willis opined that there was an apparent
831obstetrical event that resulted in loss of oxygen to the baby's
842brain during labor, delivery, and continuing into the immediate
851post delivery period, which resulted in brain injury. He could
861not opine on the severity of the injury.
8694 . NICA requested Raymond J. Fernandez, M.D.
877(Dr. Fernandez), a pediatric neurologist, to review the medical
886records for Aiden and to conduct an independent medical
895examination of Aiden. Dr. Fernandez examined Aiden on August 8,
9052012. He made the following findings, which he set forth in an
917affidavit attached to the Motion for Summary Final Order, based
927on the medical records and a history from Ms. Greenough.
937Aiden's mother, Ms . Natalie Greenough,
943was admitted to the hospital on
949September 15, 2011, in active labor. The
956expected date of delivery was September 24,
9632011. She received adequate prenatal care
969and the pregnancy was uncomplicated.
974Mrs. Greenough was 16 years old duri ng the
983pregnancy. Her blood pressure on admission
989was 110/50 and pulse rate was 80. There was
998arrest of descent during labor and a
1005nonreassuring fetal heartrate with
1009bradycardia detected, requiring delivery by
1014Cesarean section. The Apgar scores were 1,
10214, and 6 and the umbilical artery cord blood
1030pH was 6.9. Aiden required intubation in
1037the delivery room. In the initial newborn
1044examination he was described as having
1050decreased movement and tone, poor perfusion
1056and apnea.
1058Upon admission to the Neonatal Intensive
1064Care Unit, birth weight was 3,300 grams,
1072length 52 centimeters, head circumference 36
1078centimeters, temperature 101, heart rate 154
1084and blood pressure was 55/22. He was
1091lethargic and movement was reduced. He
1097aroused during the examination. The Moro
1103reflex was present. Sucking reflex was
1109present, but diminished. Gag reflex was
1115present as were plantar and palmar grasping
1122reflexes. He was intubated and receiv ing
1129assisted ventilation. He met clinical and
1135neurological criteria for whole body
1140cool ing, which was initiated promptly
1146(criteria for whole body cooling included
1152periodic hypotohnia, decreased activity and
1157lethargy).
1158There was reduced urine output and
1164hematuria due to urethral trauma during
1170insertion of a Foley catheter. Seizures
1176were a c oncern on September 16th, treated
1184with Phenobarbital. There was seizure
1189recurrence on September 18th and
1194Phenobarbital was continued. On
1198September 21, 2011, muscle tone and activity
1205were decreased, but improving. Body
1210rewarming began on September 21, 20 11.
1217Cranial ultrasound on September 15th was
1223normal and MRI of the brain on September 21,
12322011 was normal also. Specifically, there
1238were no areas of restricted diffusion. An
1245EEG on September 20, 2011, was abnormal due
1253to a somewhat poorly organized back ground,
1260consistent with a mild encephalopathy, but
1266no seizures. In the discharge summary dated
1273September 25, 2011, it was stated that
1280muscle tone and activity were normal.
1286MRI of the brain at four months of age
1295was reportedly normal.
1298* * *
1301Foll owing discharge, he was healthy. He
1308displayed some periodic eye rolling
1313movements for which he was examined by his
1321Neurologist who performed a brain scan and
1328an EEG that he stated were normal. These
1336episodes have nor recurred and he has not
1344required anti epileptic drug treatment since
1350he was in the nursery.
1355Initially, it was felt that Aiden had
1362mild cerebral palsy because of tightness in
1369his arms, but this has resolved. His
1376neurologist in the Pensacola area thought
1382that his development and his physical
1388e xamination were normal at the time of the
1397last visit and he did not feel that a return
1407appointment was necessary.
1410Aiden was evaluated by the Early Steps
1417Development Program and he has been enrolled
1424in physical therapy. He has been able to
1432shift himself t o the sitting position for
1440several weeks. He crawls or creeps and
1447about a month ago began pulling himself to
1455the standing position. He is able to stand
1463for a few seconds independently, but does
1470not yet take independent steps. He cruises
1477along furniture. Aiden was described a s
1484being alert, attentive, and inquisitive. He
1490babbles, imitates sound, says "ma - ma" and
"1498da - da" meaningfully and says and waves
"1506bye - bye" meaningfully. He plays pat - a -
1516cake. He uses both hands well. Picks up
1524small objects with thu mb and index finger,
1532feeds himself and claps his hands in play.
15405 . After performing a physical examination on Aiden on
1550August 8, 2012, Dr. Fernandez made the following findings:
1559PHYSICAL EXAMINATION: Head circumference
156347 centimeters (50th percentile). Weight
1568last week was 20 pounds 13 ounces. No
1576dysmorphic features. No skin abnormalities
1581of neurological significance. Funduscopic
1585examination was limited, but grossly normal.
1591Heart, lung and abdomen were normal. No
1598orthopedic abnormalities. Skull wa s
1603symmetric. There were no abnormalities over
1609the spine.
1611Aiden was alert. Attentive and
1616inquisitive. He played appropriately with
1621toys and spinning and rotating parts that he
1629manipulated well. He consistently turned
1634when his name was called. He babbl ed and
1643said and waved "bye - bye" when leaving the
1652room. Vision and hearing were grossly
1658normal. Eyes were well aligned and eye
1665movement was full, horizontally and
1670vertically, without significant nystagmus.
1674There was no drooling.
1678Muscle tone was normal, proximally and
1684distally. He shifted himself to sitting and
1691crawling positions and pulled to stand. He
1698cruised along furniture and took steps with
1705hands held. He had good sitting balance and
1713shifted position quickly and in well
1719coordinated fashion. He m oved about either
1726in the crawling or sitting position by
1733pushing with his arms or either leg. He did
1742not yet crawl in reciprocal fashion. Muscle
1749tone was normal and he moved all limbs well.
1758There were no focal or lateralized motor
1765abnormalities. No tre mor or involuntary
1771movement. He had well - coordinated pincer
1778grasp, bilaterally, and transferred smoothly
1783from hand to hand. He held one block in
1792each hand and banged them together. He
1799stretched his arms and leaned forward for
1806toys that were otherwise ou t of reach. He
1815looked for objects that were hidden from
1822view. Deep tendon reflexes were 2. There
1829were no pathological reflexes elicted.
18346 . Based on his review of the medical records, discussions
1845with Ms. Greenough, and a physical examination of Aiden ,
1854Dr. Fernandez opined that there was no evidence of brain injury
1865due to oxygen deprivation during labor and delivery resulting in
1875substantial and permanent mental or motor impairment. He felt
1884that Aiden should continue to improve in all areas and di d not
1897anticipate that in the future that there would be evidence of
1908substantial mental and motor impairment due to oxygen
1916deprivation during labor and delivery.
19217 . A review of the file in this case reveals that there
1934have been no expert opinions filed tha t are contrary to the
1946opinion of Dr. Fernandez. The opinion of Dr. Fernandez that
1956Aiden is not substantially and permanently mentally and
1964physically impaired is credited.
1968CONCLUSIONS OF LAW
19718 . The Division of Administrative Hearings has
1979jurisdiction ove r the parties to and the subject matter of these
1991proceedings. §§ 766.301 - 766.316, Fla. Stat.
19989 . The Plan was established by the Legislature "for the
2009purpose of providing compensation, irrespective of fault, for
2017birth - related neurological injury claims" relating to births
2026occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
203710 . The injured infant, her or his personal
2046representative, parents, dependents, and next of kin may seek
2055compensation under the Plan by filing a claim for compensation
2065wi th DOAH. §§ 766.302(3), 766.303(2), and 766.305(1), Fla.
2074Stat. NICA, which administers the Plan, has "45 days from the
2085date of service of a complete claim . . . in which to file a
2100response to the petition and to submit relevant written
2109information relati ng to the issue of whether the injury is a
2121birth - related neurological injury." § 766.305(4), Fla. Stat.
213011 . If NICA determines that the injury alleged in a claim
2142is a compensable birth - related neurological injury, it may award
2153compensation to the claima nt, provided that the award is
2163approved by the administrative law judge to whom the claim has
2174been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
2185NICA disputes the claim, as it has in the instant case, the
2197dispute must be resolved by the assig ned administrative law
2207judge in accordance with the provisions of chapter 120, Florida
2217Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
22251 2 . In discharging this responsibility, the Administrative
2234Law Judge must make the following determination based upon the
2244available evidence:
2246(a) Whether the injury claimed is a
2253birth - related neurological injury. If the
2260claimant has demonstrated, to the
2265satisfaction of the administrative law
2270judge, that the infant has sustained a brain
2278or spinal cord injury caused by oxygen
2285deprivation or mechanical injury and that
2291the infant was thereby rendered permanently
2297and substantially mentally and physically
2302impaired, a rebuttable presumption shall
2307arise that the injury is a birth - related
2316neurological injury as defined in s .
2323766.303(2).
2324(b) Whether obstetrical services were
2329delivered by a participating physician in
2335the course of labor, delivery, or
2341resuscitation in the immediate postdelivery
2346period in a hospital; or by a certified
2354nurse midwife in a teaching hospital
2360supe rvised by a participating physician in
2367the course of labor, delivery, or
2373resuscitation in the immediate postdelivery
2378period in a hospital.
2382§ 766.309(1), Fla. Stat. An award may be sustained only if the
2394administrative law judge concludes that the "infant has
2402sustained a birth - related neurological injury and that
2411obstetrical services were delivered by a participating physician
2419at birth." § 766.31(1), Fla. Stat.
24251 3 . The term "birth - related neurological injury" is
2436defined in section 766.302(2) as follows :
"2443Birth - related neurological injury " means
2449injury to the brain or spinal cord of a live
2459infant weighing at least 2,500 grams for a
2468single gestation or, in the case of a
2476multiple gestation, a live infant weighing
2482at least 2,000 grams at birth caused by
2491ox ygen deprivation or mechanical injury
2497occurring in the course of labor, delivery,
2504or resuscitation in the immediate
2509postdelivery period in a hospital, which
2515renders the infant permanently and
2520substantially mentally and physically
2524impaired.
25251 4 . The evide nce, which is not refuted, established that
2537Aiden is not permanently and substantially mentally and
2545physically impaired. Therefore, Aiden is not eligible for
2553benefits under the Plan.
2557CONCLUSION
2558Based upon the foregoing Findings of Fact and Conclusions
2567of Law, it is ORDERED :
25731. T he Petition filed by Natalie Ann Greenough, on behalf
2584of and as parent and natural guardian of, Aiden Curtis Gordon
2595Morris is dismissed with prejudice.
26002. The final hearing scheduled for December 17 and 18,
26102012, is cancelled .
