105STATEMENT OF THE CASE
109On October 19, 2011, Petitioners, Misty Mobley and
117Tavaris Sanders, individually and as parent s of Tavarion Sanders
127(Tavarion), a minor, filed a Petition for Determination of
136Compensability Pursuant to Florida Statute Section 766.301 et
144seg. (Petition) with the Division of Administrative Hearings
152(DOAH) for compensation under the Flori da Birth - Related
162Neurological Injury Compensation Plan (Plan). The Petition
169named Mohamad Shahmohamady, M.D., and Homestead Hospital.
176DOAH served NICA with a copy of the Petition on October 26,
1882011. DOAH served copies of the Petition on Homestead Hospit al
199and Dr. Shahmohamady on October 27, 2011. As of the date of
211this Summary Final Order of Dismissal, Dr. Shahmohamady has not
221petitioned to intervene in this proceeding. On November 23,
2302011, Homestead Hospital, Inc. , d/b/a Homestead Hospital filed a
239Pe tition for Leave to Intervene. By Order dated December 6,
2502011, Homestead Hospital was granted leave to intervene.
258On May 3, 2012, NICA filed a Motion for Summary Final
269Order, asserting that Tavarion did not sustain a "birth - related
280neurological injury" a s that term is defined in section
290766.302(2), Florida Statutes. No response was filed to the
299motion.
300On May 16, 2012, an Order to Show Cause was entered
311requiring Petitioners to show cause why the Motion for Summary
321Final Order should not be granted. On May 16, 2012, Homestead
332Hospital filed Intervenor, Homestead Hospital, Inc. , d/b/a
339Homestead Hospital's Motion for Extension of Time to Respond to
349NICA's Motion for Summary Order. The motion was granted, and an
360Order was entered on May 25, 2012, extendin g the time for
372Homestead Hospital to respond to the Motion for Summary Final
382Order to July 25, 2012. As of the date of this Summary Final
395Order of Dismissal, Homestead Hospital has not filed a response
405to the Motion for Summary Final Order.
412FINDINGS OF FA CT
4161. Tavarion Sanders was born on September 16, 2009, at
426Homestead Hospital in Homestead, Florida. Tavarion weighed
4332,755 grams at birth.
4382. Donald Willis, M.D. (Dr. Willis), was requested by NICA
448to review the medical records for Tavarion. In an aff idavit
459dated April 27, 2012, Dr. Willis stated:
466The Florida Birth - Related Neurological
472Injury Compensation Association retained me
477as an expert in maternal - fetal medicine to
486review the medical records from both
492Tavarion Sanders and his mother,
497Misty Mobley . The purpose of my review of
506the medical records of Tavarion Sanders and
513Misty Mobley was to determine whether an
520injury occurred in the course of labor,
527delivery or resuscitation in the immediate
533post - delivery period in the Hospital due to
542oxygen depriv ation or mechanical injury
548occurring in the course of labor, delivery,
555or resuscitation in the immediate post
561delivery period in the Hospital.
566* * *
569There was no apparent obstetrical event that
576resulted in loss of oxygen or mechanical
583trauma to the baby's brain during labor,
590delivery or in the immediate post delivery
597period.
598As such, it is my opinion that there was no
608oxygen deprivation or mechanical injury in
614the course of labor, delivery or
620resuscitation in the immediate post - delivery
627period i n the Hospital. Further, in that
635there was no oxygen deprivation or
641mechanical injury occurring in the course of
648labor, delivery, or resuscitation in the
654immediately post - delivery period in the
661Hospital, th en accordingly, there was no
668causal event which w ould have rendered
675Tavarion Sanders permanently and
679substantially mentally and physically
683impaired as a result of same .
6903. Tavarion was examined and evaluated by Michael S.
699Duchowny, M.D. (Dr. Duchowny), on January 25, 2012.
707Dr. Duchowny found the follo wing on his examination of Tavarion:
718NEUROLOGIC EXAMINATION reveals an irritable
723infant who is prone to temper tantrums and
731difficult to examine for this reason.
737Relatively minor perturbations cause
741Tavarion to cry and kick, and the parents
749are continuall y soothing him in order to
757complete testing. He clearly recognizes and
763understands his environment and does show
769curiosity for novel stimuli. However, his
775attention span remains fixed for just a few
783seconds after which he begins crying and
790fidgeting. He understood occasional simple
795commands but showed no evidence of
801expressive communication by either verbal or
807nonverbal means. Cranial nerve examination
812reveals full visual fields to direct
818confrontation testing. The pupils are 3 mm
825and react briskly to direct and consensually
832presented light. Funduscopic examination
836w a s felt to be suboptimal due to poor
846cooperation but was grossly normal. There
852remains a subtle alternating esotropia
857bilaterally. The extraocular movements are
862otherwise full and there i s no nystagmus.
870There are no facial asymmetries. The uvula
877is midline. The pharyngeal folds are
883symmetric. The tongue movements are poorly
889coordinated. Motor examination reveals a
894generalized static hypotonia with slight
899generalized hypertonicity with activity.
903There is no focal weakness, fasciculation or
910atrophy. Tavarion walks across the room in
917a stable fashion and his arm swing is
925symmetric. There is slight scissoring of
931the lower extremities when he walks. Deep
938tendon reflexes are 1 - 2 bilater ally and
947both plantar responses are downgoing.
952Tavarion withdraws all extremities to
957stimulation in a symmetric fashion. Sensory
963examination is intact to withdrawal of all
970extremities to stimulation. Neurovascular
974examination reveals no cervical, crania l, or
981ocular bruits and no temperature or pulse
988asymmetries.
989A review of Tavarion's medical records
995confirms that he was born by cesarean
1002section at Homestead Hospital. His birth
1008weight was 2755 g m and he was judged to be
1019at 37 weeks gestation. Apgar sc ores were 6
1028and 9 and Tavarion breathed spontaneously
1034and did not require ventilator y support. He
1042never experienced seizures. A n ultrasound
1048examination of the brain performed on
1054September 17 was normal. Bilateral
1059cephalohematomas were recognized and tre ated
1065conservatively.
1066Tavarion's neurological examination today
1070reveals findings consistent with a
1075substantial mental impairment. He has a
1081moderate motor impairment which I suspect
1087will improve over time and I do not believe
1096that his motor deficit ultimat ely will prove
1104to be substantial in nature. Furthermore,
1110the medical records do not provide
1116supporting evidence that Tavarion's
1120neurological problems were acquired
1124intrapartum during labor and delivery due to
1131either asphyxia or mechanical injury. I
1137would however like to review the MRI and CT
1146scans before making a final recommendation.
11524. By letter dated April 19, 2012, Dr. Duchowny opined:
1162I have had an opportunity to review an MR
1171study on Tavarion. This study does not
1178reveal findings to suggest hypoxi c ischemic
1185encephalopathy. It therefore provides
1189further corroboration of the opinion that
1195Tavarion should not be considered her [sic]
1202compensation with the NICA Program.
12075. A review of the file in this case reveals that there
1219have been no expert opinio ns filed that are contrary to the
1231opinions of Dr. Willis and Dr. Duchowny. The opinions of
1241Dr. Willis and Dr. Duchowny that Tavarion did not suffer a
1252neurological injury due to oxygen deprivation or mechanical
1260injury during labor, delivery, or immediate p ost - delivery period
1271are credited. Additionally, Dr. Duchowny's opinion that
1278Tavarion does not have a substantial and permanent physical
1287impairment is credited.
1290CONCLUSIONS OF LAW
12936 . The Division of Administrative Hearings has
1301jurisdiction over the parti es to and the subject matter of these
1313proceedings. §§ 766.301 - 766.316, Fla. Stat.
13207 . The Plan was established by the Legislature "for the
1331purpose of providing compensation, irrespective of fault, for
1339birth - related neurological injury claims" relating to births
1348occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
13598 . The injured infant, her or his personal representative,
1369parents, dependents, and next of kin may seek compensation under
1379the Plan by filing a claim for compensation with DOAH.
1389§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1397which administers the Plan, has "45 days from the date of
1408service of a complete claim . . . in which to file a response to
1423the petition and to submit relevant written information relating
1432to the issue of whether the injury is a birth - related
1444neurological injury." § 766.305(4), Fla. Stat.
14509 . If NICA determines that the injury alleged in a claim
1462is a compensable birth - related neurological injury, it may award
1473compensation to the claimant, pr ovided that the award is
1483approved by the administrative law judge to whom the claim has
1494been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
1505NICA disputes the claim, as it has in the instant case, the
1517dispute must be resolved by the assigned ad ministrative law
1527judge in accordance with the provisions of chapter 120, Florida
1537Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
154510 . In discharging this responsibility, the Administrative
1553Law Judge must make the following determination based upon the
1563available evidence:
1565(a) Whether the injury claimed is a birth -
1574related neurological injury. If the
1579claimant has demonstrated, to the
1584satisfaction of the administrative law
1589judge, that the infant has sustained a brain
1597or spinal cord injury caused by ox ygen
1605deprivation or mechanical injury and that
1611the infant was thereby rendered permanently
1617and substantially mentally and physically
1622impaired, a rebuttable presumption shall
1627arise that the injury is a birth - related
1636neurological injury as defined in s.
1642766. 303(2).
1644(b) Whether obstetrical services were
1649delivered by a participating physician in
1655the course of labor, delivery, or
1661resuscitation in the immediate postdelivery
1666period in a hospital; or by a certified
1674nurse midwife in a teaching hospital
1680supervised by a participating physician in
1686the course of labor, delivery, or
1692resuscitation in the immediate postdelivery
1697period in a hospital.
1701§ 766.309(1), Fla. Stat. An award may be sustained only if the
1713administrative law judge concludes that the "infant has
1721s ustained a birth - related neurological injury and that
1731obstetrical services were delivered by a participating physician
1739at birth." § 766.31(1), Fla. Stat.
17451 1 . The term "birth - related neurological injury" is
1756defined in section 766.302(2) as follows:
"1762Bir th - related neurological injury" means
1769injury to the brain or spinal cord of a live
1779infant weighing at least 2,500 grams for a
1788single gestation or, in the case of a
1796multiple gestation, a live infant weighing
1802at least 2,000 grams at birth caused by
1811oxygen de privation or mechanical injury
1817occurring in the course of labor, delivery,
1824or resuscitation in the immediate
1829postdelivery period in a hospital, which
1835renders the infant permanently and
1840substantially mentally and physically
1844impaired.
18451 2 . The evidence, wh ich is not refuted, established that
1857Tavarion did not sustain an injury to the brain or spinal cord
1869caused by oxygen deprivation or mechanical injury occurring in
1878the course of labor, delivery, or resuscitation in the immediate
1888postdelivery period in a hos pital. Therefore, Tavarion is not
1898eligible for benefits under the Plan.
1904CONCLUSION
1905Based upon the foregoing Findings of Fact and Conclusions
1914of Law, it is ORDERED that the Petition filed by Misty Mobley
1926and Tavaris Sanders, individually and as parents of
1934Tavarion Sanders, is dismissed with prejudice.
