149PRELIMINARY STATEMENT

151By letter dated September 20 , 2011, the Department of

160Financial Service s ("Department" or "Respondent") issued its

170Notice o f Denial by which it informed Franceline Pierre ("Pierre"

182or "Petitioner") that the Department intended to deny her

192application for a Resident General Lines A gent license.

201Petitioner challenged the Department's decision and timely

208requested a formal hearin g. On November 23, 2011, the Department

219referred the case to the Division of Administrative Hearings for

229assignment of an Administrative Law Judge to conduct the hearing.

239The hearing was held on February 9, 2012. At the final

250hearing, Petitioner testifie d on her own behalf and did not

261present any exhibits . The Department presented the testimony of

271Petitioner, Ga rdonal Marcellot, Otto V. Latimer, Jr. , and Wendi

281Cameron. The Department's Exhibits numbered 1 , 3, 6 through 13,

29115 through 20, 22, and 24 thro ugh 27 were received into evidence.

304The proceeding was transcribed. The one - volume Transcript

313was filed with DOAH on March 2 , 2012. The parties availed

324themselves of the right to submit proposed recommended orders.

333Petitioner late file d her Proposed Reco mmended Order. Respondent

343did not object to Petitioner's untimely filing and the

352undersigned has considered both Proposed Recommended Orders as

360well as the testimony and exhibits presented at hearing in the

371preparation of this Recommended Order.

376FINDING S OF FACT

3801. Petitioner owns two insurance agencies, All Florida

388Insurance and Tax Services ("All Florida") and One Florida

399Insurance Agency, Inc. ("One Florida").

4062. On or about January 5, 2010, Gardonal Marcellot

415("Marcellot") filled out an application and interviewed with

425Petitioner for an insurance agent position. The same day,

434Petitioner offered Marcellot a job at All Florida as an insurance

445agent . 1 /

4493. Marcellot accepted the job and provided Pierre a copy of

460his 2 - 20 General Lines Insurance Agent l icense and Social

472Security card . Pierre informed Marcellot that his start date for

483employment with All Florida would be January 15, 2010.

4924. Soon thereafter, there was a major earthquake in Haiti ,

502and Petitioner informed Marcellot by email that she had t o go out

515of the country to help her family and she was pushing back his

528start date with the company.

5335. Marcellot never reported to work or started his

542employment with All Florida after Pierre left the country. 2 /

5536. On or about February 12, 2010, Petitio ner applied for

564agency licensure with the Department for All Florida and named

574Christopher Jeremie as the Agent in Charge. Pierre also named

584Marcellot as the secretary and treasurer of All Florida on the

595application. Marcellot n ever held a corporate offi cer position

605at All Florida .

6097. While operating All Florida, Pierre engaged in all the

619activities that require an insurance agent license. She admitted

628during the hearing that she ran the office, met with customers by

640phone and in person, respond ed to fa x and email insurance

652requests, provided insurance quotes for customers, completed

659forms for customers, input the insurance information in the

668computer to get quotes for customers to review, input the

678information online, and processed numerous insurance

684ap plications .

6878. On February 26, 2010, Petitioner fil l ed out an

698application for a Change of Agent in Charge for All Florida and

710named Marcellot Agent in Charge without his permission . 3 /

7219. Pierre continued to utilize Marcellot's licensure

728information and name him Agent in Charge without his permission

738to obtain Agency appointments with companies 4 / for at least five

750insurance applications.

75210. On May 22, 2010, Pierre next utilized Otto Latimer 's

763("Latimer") licensure information without his permission and

772changed the A gent in C harge for All Florida by naming Latimer to

786the position . 5 /

79111. On June 22, 2010, Petitioner submitted an Application

800for Agency Licensure on line to the Department on behalf of One

812Florida and also named Latimer as the Agent in Charge without his

824permission .

82612. Latimer never worked at or served as Agent in Charge

837for All Florida or One Florida .

84413. Latimer owns his own business, Service Ace C orporation,

854where he works full time . He has b een licensed since 1983 as a

869General Lines In surance agent.

87414. At some point, Latimer discovered that Pierre was

883having problems getting a 2 - 20 license agent. He offered to help

896her by allowing her to rent space at his agency location and for

909her to work under his license. He never gave her permi ssion or

922allowed her to use his license or name him as Agent in Charge for

936appointments.

93715. Pierre utilized Latimer's licensure information without

944his permission for her insurance companies and named him Agent in

955Charge for both Universal Property and C asualty Insurance Company

965and Citizen s Property Insurance Corporation ("Citizens")

974insurance appointments for a total of about 19 insurance

983applications .

98516. On August 11, 2010, C itizens terminated All Florida's

995Agent Appointment Agreement after determini n g that Pierre had

1005committed forgery and larceny based on false person i fic ation

1016because Pierre signed Marcellot's name to the agent appointment

1025application and named him as agent of record.

103317. On December 13, 2010, Pierre filed an application with

1043the De partment for a Resident General Lines Agent license.

105318. On December 21, 2010, Petitioner signed and issue d All

1064Florida check number 1003 to Del Rio D iscount Corp oration, in the

1077amount of $1 , 000.00. Pierre cut check number 1003 as the gross

1089down payment on a premium finance agreement dated October 1,

10992010 , for the homeowner policy purchased by Bernard and Eleanor

1109Woodside. The check was returned for insufficient funds.

111719. Del Rio Finance filed a complaint with the Department

1127against Petitioner for Pier re issuing check 1003 on behalf of All

1139Florida because the check bounced for in sufficient funds.

114820. Wendi Cameron ("Cameron") , the Department's

1156investigator in this matter, started investigating the complaint

1164in January 2011. She went to Pierre's office location to s ee

1176Latimer, whom she believed was the Agent in C harge based on the

1189paperwork Pierre had falsely completed and filed . Latimer was

1199not present and so Cameron spoke to Pierre, who told Cameron that

1211Latimer was out of the office.

121721. On May 29, 2011, w hile Pierre's insufficient funds

1227investigation was still pending, Cameron received another

1234complaint about Pierre namely that Citizens Insurance Company had

1243terminat ed Pierre's appointment after being advised by Marcellot

1252that Pierre had used his i dentity without his knowledge and

1263forged his name on applications.

126822. Cameron visited Petitioner's office three times d uring

1277Petitioner's investigation s and an Agent in C harge was never

1288present. Pierre was managing the office on each visit. On th e

1300four th visit to the office , it was closed with a note on the

1314door. Cameron was never able to sp eak to an A gent in C harge and

1330was always informed that one was not available each time she

1341called or visited.

134423. The Department concluded its investigation of Pie rre

1353and denied her application for licensure based on the

1362Department's sections 626.112(1)(a) , (b)4, 626.112(9),

1367626.172(2) , (3), 626.611(7 ), (8), 626.621(2),(3), and (6).

1376CONCLUSIONS OF LAW

137924. The Division of Administrative Hearings has

1386jurisdiction ove r the subject matter of this proceeding and the

1397parties thereto pursuant to sections 120.569 and 120.57(1),

1405Florida Statutes.

140725. Petitioner is the person seeking licensure in this

1416proceeding. To prevail, Petitioner bears the ultimate burden of

1425proving e ntitlement to a license and that she meets all of the

1438relevant statutory criteria for obtaining a license. Dep 't of

1448Banking & Fin . v. Osborne Stern & Co . , 670 So. 2d 932 (Fla.

14631996).

146426. Chapter 626 , Florida Statutes, under which Respondent's

1472denial of a 2 - 20 General Line Insurance Agent l icense has been

1486denied, sets forth the acts for which the Respondent may deny a

1498license.

149927. Several statutory provisions are relevant to the

1507Department's determination regarding Petitioner's eligibility for

1513licensure. For instance, s ection 626.201 provides:

1520* * *

1523(2) The department or office may, upon

1530completion of the application, make such

1536further investigation as it may deem

1542advisable of the applicant's character,

1547experience, background, and fitness for the

1553lic ense or appointment. Such an inquiry or

1561investigation shall be in addition to any

1568examination required to be taken by the

1575applicant as hereinafter in this chapter

1581provided.

158228. Section 626.211 provides that under certain

1589circumstances, the Department is compelled to deny licensure to

1598an applicant. Section 626.611 provides in pertinent part:

1606The department shall deny application for .

1613. . the license or appointment of any

1621applicant, . . . if it finds that as to the

1632applicant, . . . any one or more of t he

1643following applicable grounds exist:

1647* * *

1650(7) Demonstrated lack of fitness or

1656trustworthiness to engage in the business of

1663insurance.

1664( 8 ) Demonstrated lack of reasonably adequate

1672knowledge and technical competence to engage

1678in the transactions a uthorized by the license

1686or appointment.

168829. Section 626.621 also provides the Department grounds

1696for discretionary refusal to deny licensure to an applicant.

1705Section 626.621 provides in pertinent part :

1712The department may, in its discretion, deny

1719an app lication for . . . the license or

1729appointment of any applicant . . . any one or

1739more of the following applicable grounds

1745exist under circumstances for which such

1751denial, suspension, revocation, or refusal is

1757not mandatory under s. 626.611 :

1763* * *

1766(2) Violation of any provision of this code

1774or of any other law applicable to the

1782business of insurance in the course of

1789dealing under the license or appointment.

1795(3) Violation of any lawful order or rule of

1804the department, commission, or office.

1809* * *

1812( 6) In the conduct of business under the

1821license or appointment, engaging in unfair

1827methods of competitio n or in unfair or

1835deceptive acts or practices, as prohibited

1841under part IX of this chapter, or having

1849otherwise shown himself or herself to be a

1857source of injury or loss to the public.

186530. Pierre admitted at hearing that she operated as a n

1876insurance agen t by solici ting insurance , giving individual quotes

1886in an attempt to persuade customers to purchase an insurance

1896product , processing applications, as well as complet ing orders or

1906applications for insurance products , which actions all require

1914licensing purs uant to sections 626.112(1)(a) and (b)4. Further,

1923Pierre signed the applications for First Florida and One Florida

1933but falsely named both the officers and A gent in C harge on her

1947application s contrary to the requirement to correctly do so in

1958section 626.17 2 (2)(e) . Pierre's noncompliance with sections

1967626.112(1)(a) , (b)4, and 626.172(2)(e), are grounds for denial of

1976licensure pursuant to section 626.621(2) .

198231. The Department also alleges that Petitioner's license

1990should be denied because she committed a f elony of the third

2002degree by knowingly transact ing insurance or otherwise engag ing

2012in insurance activities without a license pursuant to section

2021626.112(9). The aforementioned st at ute designates a felon y of

2032the third degree punishable under the criminal p rovisions. The

2042undersigned does not have the jurisdiction to determine such

2051matters that are handle d in circuit court . Therefore, section

2062626.112 (9) is not a ground for denial of Pierre's license in this

2075case .

207732. The credible evidence also demonstrates that

2084Petitioner 's actions of forging licensees names on insurance

2093license applications demonstrate a lack of fitness or

2101trustworthiness to engage in the business of insurance . Further,

2111Pierre acted and held herself out as a licensed in surance agent

2123and f alsely named persons a s the Agent in Charge of All Florida

2137and One Florida, which are violation s of section 626.611(7) , a

2148ground for denial of licensure .

215433. The evidence also shows Pierre did not have adequate

2164knowledge and technical competence to engage in the transactions

2173authorized by her company's appointments in violation of section

2182626.611(8) . Further, Pierre acted like an insurance agent

2191processing applications and issued an insufficient All Florida

2199check , a nother ground for denial of licensure .

22083 4. The record is void of any evidence to demonstrate

2219Petitioner violated any lawful order or rule of the department,

2229commission, or office pursuant to section 626.621(3) , and

2237therefore, such an allegation is not a ground for denial of

2248Pierre's license.

225035 . In this case, Petitioner has failed to satisfy h er

2262burden to establish a legal basis that s he is entitled to a

2275General Lines Insurance Agent license in that the credible

2284evidence shows that Pierre violated numerous statutes , as found

2293above, that prevent her from obtaining licensure with the

2302Department .

2304RECOMMENDATION

2305Upon consideration of the foregoing Findings of Fact and

2314Conclusions of Law reached , it is RECOMMENDED that the Department

2324of Financial Services enter a final order denying Petitioner's

2333appl ication for licensure as a General Lines Insurance Agent in

2344the State of Florida.

24171 / Marcellot denied any knowledge of Pierre hiring him as the

2429Agent in Charge for All Florida. Such testimony is found to be

2441credible .

24432 / Marcellot denied ever reporting to work a t All Florida or

2456working there. Such testimony is found to credible .

24653 / There was conflicting testimony as to whether Marcellot

2475provided Pierre permission to use his name or authorized his

2485appointment as Agent in Charge for All Florida. Marcellot's

2494te stimony is found to be more credible.

25024 / University Property Casual ty Insurance C ompany and Citizens

2513Property Insurance Corporation were two of the insurance

2521companies with which Petitioner utilized Marcellot's name and

2529information without his permission .

25345 / Latimer denied allowing Petitioner use of his licensure

2544information or providing her permission to name him Agent in

2554Charge. Latimer's testimony is found to be more credible than

2564Pierre .
