1381. On May 19,2011, the Department of Financial Services, Division of Workers'

3383. On June 2, 2011, the Department received an Election of Proceeding requesting
351administrative review ("Petition") from WILLIAM KEELE, DBA, WILLIAM MIL TON

373MIL TON KEELE LLC. A copy of the Petition is attached hereto as "Exhibit B" and

3934. On June 7, 2011, the Department issued an Amended Order of Penalty
406Assessment to WILLIAM KEELE, DBA, WILLIAM MIL TON KEELE LLC, A DIS SOL VED
420FLORIDA LIMITED LIABILITY COMPANY AND WILLIAM MIL TON KEELE LLC. The
431Amended Order of Penalty Assessment amended the legal name of the employerto WILLIAM
444KEELE, DBA, WILLIAMMILTON KEELE LLC, A DISSOLVEDFLORIDA LIMITED
452LIABILITY COMPANY AND WILLIAM MIL TON KEELE LLC. The Amended Order of
464Penalty Assessment assessed a total penalty of $43,256.29 against WILLIAM KEELE, DBA,
477WILLIAM MILTON KEELE LLC, A DISSOLVED FLORIDA LIMITED LIABILITY
486COMPANY AND WILLIAM MIL TON KEELE LLC. The Amended Order of Penalty
498Assessment included a Notice of Rights wherein WILLIAM KEELE, DBA, WILLIAM

7117. Following issuance of subsequent Amended Orders of Penalty Assessment, on
722February 17,2012, the Department issued a 3rd Amended Order of Penalty Assessment to

749LIMITED LIABILITY COMPANY AND WILLIAM MIL TON KEELE LLC. The 3rd
760Amended Order of Penalty assessed a total penalty of$4,708.85 against WILLIAM
772KEELE, DBA, WILLIAM MILTON KEELE LLC, A DISSOLVED FLORIDA LIMITED
782LIABILITY COMPANY AND WILLIAM MIL TON KEELE LLC. The 3rd Amended Order of
795Penalty Assessment included a Notice of Rights wherein WILLIAM KEELE, DBA, WILLIAM

8528. On AprilS, 2012, the Department filed a Motion to Amend Order of Penalty
866Assessment with the Division of Administrative Hearings in DOAH Case No. 11-6178. A copy

894Amended Order of Penalty Assessment is attached hereto as "Exhibit E" and incorporated herein

9109. On April 18, 2012, the Administrative Law Judge issued an Order Granting
923Motion to Amend Penalty Assessment in DOAH Case No. 11-6178. The Order Granting Motion
937to Amend Penalty Assessment is attached hereto as "Exhibit F" and incorporated herein by
951reference.
95210. On April 30, 2012, the Administrative Law Judge entered an Order Closing File
966and Relinquishing Jurisdiction due to Respondent's failure to participate in discovery and appear
979at the scheduled formal hearing in DOAH Case No. 11-6178. A copy of the Order Closing File
996and Relinquishing Jurisdiction is attached hereto as "Exhibit G" and incorporated herein by
1009reference.
1010FINDINGS OF FACT
101311. The factual allegations contained in the Stop- Work Order and Order of Penalty
1027Assessment issued on May 19,2011, the Amended Order of Penalty Assessment issued on June
10427,2011, and the 3rd Amended Order of Penalty Assessment issued on February 17,2012, and
1058fully incorporated herein by reference, are hereby adopted as the Department's Findings of Fact
1072in this case.
1075CONCLUSIONS OF LAW
107812. The Department has jurisdiction over the subject matter of and the parties to this
1093matter pursuant to Chapter 440, Florida Statutes.
110013. Based upon the Findings of Fact adopted herein, the Department concludes that
1113WILLIAM KEELE, DBA, WILLIAM MILTON KEELE LLC, A DISSOLVED FLORIDA
1123LIMITED LIABILITY COMPANY AND WILLIAM MIL TON KEELE LLC violated the
1134specific statutes and rules alleged in the Stop- Work Order and Order of Penalty Assessment, the
1150Amended Order of Penalty Assessment, and the 3rd Amended Order of Penalty Assessment, and
1164hereby adopts the violation(s) charged in the Stop-Work Order and Order of Penalty Assessment,
1178the Amended Order of Penalty Assessment, and the 3rd Amended Order of Penalty Assessment
1192as the Conclusions of Law in this case.
1200PENALTY IMPOSED
120214. The Stop-Work Order and Order of Penalty Assessment, the Amended Order of
1215Penalty Assessment, and the 3rd Amended Order of Penalty Assessment, taken together with the
1229Findings of Fact and Conclusions of Law adopted herein, constitute grounds for the Chief
1243Financial Officer to impose the penalty as set forth herein.
1253IT IS THEREFORE ORDERED that:
1258a. WILLIAM KEELE, DBA, WILLIAM MILTON KEELE LLC, A
1267DISSOLVED FLORIDA LIMITED LIABILITY COMPANY AND WILLIAM MIL TON
1276KEELE LLC shall immediately pay the total penalty of$4,708.85 in full to the Department of
1292Financial Services for deposit into the Workers' Compensation Administration Trust Fund; and
1304b. WILLIAM KEELE, DBA, WILLIAM MIL TON KEELE LLC, A
1314DIS SOL VED FLORIDA LIMITED LIABILITY COMPANY AND WILLIAM MIL TON
1325KEELE LLC shall inimediately cease all business operations until such time as the Department
1339issues an order releasing the Stop-Work Order and Order of Penalty Assessment and the 3rd
1354Amended Order of Penalty Assessment. The Department shall not issue an order releasing the
1368Stop-WorkOrder and Order of Penalty Assessment and the 3rd Amended Order of Penalty
1381Assessment until WILLIAM KEELE, DBA, WILLIAM MIL TON KEELE LLC, A
1392DISSOLVED FLORIDA LIMITED LIABILITY COMPANY AND WILLIAM MIL TON
1401KEELE LLC has come into compliance with the coverage requirements of Chapter 440, Florida
1415Statutes, and has paid the total penalty of $4,708.85 to the Department.
