80This cause came on for consideration pursuant to sections

89766.304 and 766.305(7), Florida Statutes, upon Petitioners' and

97Respondent's Stipulation and Joint Petition for Compensation

104Arising Out of Florida Birth - Related Neurological Injury

113Pursuant to Chap ter 766, Florida Statutes (Stipulation and Joint

123Petition), filed with the Division of Administrative Hearings on

132March 19, 2012, for entry of an order approving the resolution

143of a claim for compensation benefits filed in accordance with

153the provisions of chapter 766 and a resolution of the exclusive

164remedy otherwise available as outlined in chapter 766.

172By the terms of their stipulation, the parties have agreed

182that Petitioners, Bryan Edwards and Yamilette Edwards, are the

191parents and legal guardians of B ryanna Samone Edwards (Bryanna),

201a deceased minor; that Bryanna was born on November 18, 2009, in

213Pembroke Pines, Florida, at Memorial Hospital West, a "hospital"

222as defined in section 766.302(6); and that Bryanna's birth

231weight exceeded 2,500 grams. The parties have further agreed

241that Lawrence Stempel, M.D., delivered obstetrical services at

249Bryanna's delivery and was a "participating physician" in the

258Florida Birth - Related Neurological Injury Compensation Plan, as

267defined by section 766.302(7). The par ties have agreed that

277Bryanna suffered a "birth - related neurological injury," as that

287term is defined by section 766.302(2), and died on November 18,

2982009. By telephonic conference call held on March 20, 2012,

308Petitioners and Respondent have orally stipul ated that Bryanna's

317birth was a live birth.

322After due consideration of the interests of all parties and

332being otherwise fully advised in the premises, it is

341ORDERED:

3421. The Stipulation and Joint Petition filed on March 19,

3522012, is hereby approved, and th e parties are directed to comply

364with the provisions of the Stipulation and Joint Petition.

3732. Petitioners Bryan Edwards and Yamilette Edwards, as the

382parents and legal guardians of B r yanna S amone Edwards, a

394deceased minor, are awarded $100,000.00, pursua nt to section

404766.31(1)(b)1. and a death benefit of $10,000.00, pursuant to

414section 766.31(1)(b)2., to be paid in lump sum.

4223. Petitioners are awarded payment of past benefits

430pursuant to section 766.31(1)(a), subject to the provisions of

439paragraph 20 of the Joint Stipulation and Petition.

4474. No provision is made under section 766.31(2) to pay

457future benefits/expenses because Bryanna is deceased.

4635. Respondent, Florida Birth - Related Neurological Injury

471Compensation Association, will reimburse Andrew Need le, 1/

479Esquire, attorney for Petitioners, an attorney 's fee of

488$10,000.00 and expenses of $500.00, totaling $10,500.00 for

498services rendered in the filing of this claim.

5066. Upon payment of the award to Petitioners of

515$100,000.00, a death benefit of $10,00 0.00, and past benefits

527under section 766.31(1)(a) and payment of $10,500.00 to

536Andrew Needle, Esquire, for attorney's fees and costs, the

545claims of Petitioners shall be deemed fully satisfied and

554extinguished.

5557. The Division of Administrative Hearings r etains

563jurisdiction over this matter to resolve any disputes, should

572they arise, regarding the parties' compliance with the terms of

582this Order.
