132STATEMENT OF THE ISSUE

136The issue is whether Petitione r ' s application for licensure

147by examination as a d ietitian/ n utritionist should be granted or

159denied for the reasons stated in the Corrected Notice of Intent

170to Deny 1/ (CNOI).

174PRELIMINARY STATEMENT

176On December 16, 2011, the Department of Health, Board of

186M edicine, Dietetics and Nutrition Practice Council (Council) ,

194notified Petitioner, Lucy Ellen Mollan (Ms. Mollan) , that her

203application for licensure by examination was denied. The Council

212stated that her " Bachelor ' s degree in health and wellness Î

224nutriti on " was " not equivalent to a degree in human nutrition,

235food and nutrition, dietetics, or food management, because it

244lacks sufficient courses including medical nutrition therapy. "

251Ms. Mollan timely submitted a " Petition for Formal Administrative

260Hearing (Premised Upon Respondent ' s " Corrected " Notice of

269Denial) " (Petition) , wherein she requested:

274that the hearing officer issue a recommended

281order finding that (1) she is entitled to the

290license in question; (2) the Respondent

296either exceeded its legal dutie s and/or

303erroneously denied the Petitioner the

308requested licensenot [sic] in compliance; (3)

314directing the Respondent to issue the license

321to the Petitioner; and (4) directing the

328Respondent to reimburse the Petitioner for

334her incurred, reasonable attorney s ' fees and

342costs resulting from the instant proceedings.

348On January 11, 2012, the Council referred the Petition to

358DOAH for the assignment of an Administrative Law Judge.

367Following one continuance , the hearing was held on May 29, 2012.

378At the final he aring , the parties offered two joint

388exhibits , which were received into evidence. Ms. Mollan

396testified in her own behalf, and Petitioner ' s Exhibit 1 was

408received into evidence. The Council presented the testimony of

417Ms. Mollan, Ivy Shivers, and Jodee Dor sey, Ph.D. Respondent ' s

429Exhibits 1 through 5 were received into evidence. At the

439Council ' s request, and with no objection from Ms. Mollan ,

450official recognition was taken of c hapter 468, Part X (Dietetics

461and Nutrition Practice) , Florida Statutes (2011) , 2 / and Florida

471Administrative Code Chapters 64B8 - 40 and 64B8 - 42.

481The one - volume Transcript was filed with DOAH on June 18,

4932012. The parties agreed to file their proposed recommended

502order (PRO) within ten days of the filing of the Transcript.

513Prior to th e PRO filing day, Petitioner ' s Unopposed Motion for

526Enlargement of Time for Filing of Proposed Recommended Order

535(Motion) was filed. The Motion was granted, and both parties

545timely submitted their PRO s . Each PRO has been considered in the

558preparation of this Recommended Order.

563FINDING S OF FACT

5671. The Council, which serves under the supervision of the

577Board of Medicine, is the entity responsible for certifying

586persons for licensure by examination as a dietitian/nutritionist.

594§ 468.509, Fla. Stat. ; Fla. A dmin. Code R . 64B8 - 40.003(1)(a).

6072. The requirements for licensure by examination as a

616d ietitian/ n utritionist are found in section 468.509 3/ and rule

62864B8 - 42.002. 4/

6323. Ivy Shivers has worked for the Department of Health for

643over 24 years in a variety of positions. Since 1997 , she has

655worked in the Medical Quality Assurance (MQA) section. She is

665currently a regulatory supervisor consultant. Ms. Shivers

672supervises two MQA employees and has oversight of the

681administrative processes for the Council, includ ing the

689application process, Council agenda preparation, licensure

695maintenance, continuing education activities, and related issues.

702Neither she nor the two MQA employees she supervises have any

713authority over any application other than to ensure that the

723Council has a complete application for its review, consideration ,

732and determination. Ms. Mollan ' s application was handled in a

743routine fashion. Once the noted deficiencies were resolved , and

752Ms. Mollan ' s application was complete, it was submitted to the

764Council for its review and determination. Her testimony was

773credible.

7744. Jodee Dorsey , Ph.D., has an extensive educational and

783professional background in dietetics and nutrition. Dr. Dorsey

791is a Florida - licensed dietitian/nutritionist, and she is also a

802registered dietitian. She served on the Council from 2004

811through 2009. While on the Council , Dr. Dorsey performed those

821duties as set forth in the statutes and rules governing the

832Council. Those duties included reviewing applicants (and

839applications) for licensure, reviewing requests for temporary

846permits, establishing fees, adopting rules as necessary , 5/ and

855other responsibilities. Dr. Dorsey was accepted as an expert in

865dietetics and nutrition, including the educational requirements

872for licensure i n Florida.

8775. Several years ago, Ms. Mollan attended Florida Southern

886College 6/ in Lakeland, Florida. Thereafter Ms. Mollan obtained an

896a ssociate of a rts (AA) degree from Valencia Community College, in

908Orlando, Florida. 7/ Her AA was in general education and business

919courses. In 2008, Ms. Mollan transferred her AA (108 credits) to

930and enrolled in Kaplan University, Online (KU). Ms. Mollan

939enrolled in the KU program " XVI Advanced Start Bachelor of

949Science in Health and Wellness Î Nutrition. " The KU cour se

960catalog reflected that two of the prerequisite requirements for

969the program included a natomy and p hysiology I and II. Ms. Mollan

982did not complete either course at her undergraduate programs, nor

992did she complete either course while at KU.

10006. M s. Molla n chose KU based on its representation that ,

1012once she was finished , she " would have a bachelor ' s degree in

1025Health and Wellness in their health science college and that ' s

1037what " she was pursuing.

10417. On January 26, 2010, Ms. Mollan earned a " Bachelor of

1052Scie nce " (Degree) fr om KU.

10588. On August 31, 2011, the Council received Ms. Mollan ' s

1070application for licensure by examination. Her initial

1077application failed to contain all the required information. The

1086Council staff requested the missing information from Ms . Mollan.

1096Once the additional information was received, Ms. Mollan ' s

1106completed application was placed on the Council agenda.

11149. The KU course descriptions provided did not reflect a

1124major course of study in human nutrition, food and nutrition,

1134dietetics, or food management, or an equivalent major course of

1144study. 8/ The KU courses did not specify the requisite dietary or

1156nutritional elements for courses to be deemed equivalent.

116410. When asked about specific KU courses she had taken,

1174Ms. Mollan ' s testimon y was frequently couched in phrases of " I

1187believe " it met the requirements, or it was " my understanding "

1197that the courses were aimed specifically at becoming a dietician.

1207Her persuasiveness was diminished greatly by the multiple uses of

1217these equivocal te rms. Further, based on her description of one

1228specific course, HW 499 (Bachelors Capstone in Health and

1237Wellness), Ms. Mollan confirmed that she did not make any

1247progress towards any new nutritional or dietary educational goals

1256or objectives in that parti cular class, but rather " they just

1267took all of the stuff that we had done over the years and put it

1282all together in a neat little package and said this is everything

1294that you ' ve accomplished. " Ms. Mollan 's course description does

1305not match the course desc ription that was provided in the KU

1317cata log.

131911. KU measures its course credits in quarter hours. It

1329was established that , although Ms. Mollan had 40 quarter hours of

1340credit in her major program , not all of those courses met the

" 1352major course in human nu trition, food and nutrition, dietetics,

1362or food management, or an equivalent major course study "

1371requirement. Additionally, when converted to semester hours, she

1379only had 26.67 semester hours of the requisite course of study.

1390Thus, Ms. Mollan failed to o btain the requisite semester hours or

1402equivalent major course of study hours.

140812. At the October 28, 2011, general meeting, the Council

1418was to make a " review of her [Ms. Mollan ' s] education and

1431experience. " Based on that review, the Council unanimously v oted

1441to deny the application for licensure by examination " on the

1451basis the course of study was not deemed equivalent as specified

1462in the Section 468.509, Florida Statutes. "

146813. The degree Ms. Mollan obtained from KU does not reflect

1479a baccalaureate degre e with a major course of study in human

1491nutrition, food and nutrition, dietetics, or food management, or

1500an equivalent major course of study.

1506CONCLUSIONS OF LAW

150914. The Division of Administrative Hearings has

1516jurisdiction over the parties to and the subj ect matter of this

1528proceeding. §§ 120.569 and 120.57, Fla. Stat.

153515. Ms. Mollan has applied to the Council for licensure by

1546examination to practice as a dietitian/nutritionist. As the

1554applicant for a new license by examination, Ms. Mollan has the

1565burden of presenting evidence of her fitness for licensure.

1574Dep ' t of Banking & Fin. v. Osborne Stern , 670 So. 2d 932, 934

1589(Fla. 1996). If Ms. Mollan presented evidence supporting her

1598fitness for licensure by examination, the burden of going forward

1608with eviden ce would shift to the Council to show any violation of

1621statutes or rules supporting denial. However, the ultimate

1629burden of persuasion remains upon Ms. Mollan, the applicant. Id.

163916. Section 468.509 sets out the requirements for licensure

1648by examinatio n as a dietitian/nutritionist and provides in

1657pertinent part:

1659(1) Any person desiring to be licensed as a

1668dietitian/nutritionist shall apply to the

1673agency to take the licensure examination.

1679(2) The agency shall examine any applicant

1686who the board certif ies has completed the

1694application form and remitted the application

1700and examination fees specified in s. 468.508

1707a nd who:

1710(a)1. Possesses a baccalaureate . . . degree

1718with a major course of study in human

1726nutrition, food and nutrition, dietetics, or

1732food management, or an equivalent major

1738course of study, from a school or program

1746accredited, at the time of the appli cant ' s

1756graduation, by the appropriate accrediting

1761agency recognized by the Commission on

1767Recognition of Postsecondary Accreditation

1771and the United States Department of

1777Education; and

17792. Has completed a preprofessional

1784experience component of not less tha n

1791900 hours or has education or experience

1798determined to be equivalent by the

1804board; . . . . [ 9/ ]

181217. Rule 64B8 - 42.002(1)(a)1., in pertinent part, provides:

1821(1) Every applicant for certification by

1827examination shall file the Application for

1833Dietitian/Nut ritionist Licensure, DOH Form

1838DH - MQA 1161, ND APP, Rev. 10/2009, which can

1848be accessed at www.doh.state.fl.us/mqa, and

1853demonstrate to the Council that he meets one

1861of the following:

1864(a)1. Has a baccalaureate or post

1870baccalaureate degree with a major in h uman

1878nutrition, food and nutrition, dietetics,

1883food management or equivalent major as

1889determined by the Council from a school or

1897program accredited by the appropriate

1902accrediting agency recognized by the Council

1908on Post - secondary Accreditation or its

1915succe ssor and the United States Department of

1923Education . . . .

192818. Rule 64B8 - 42.002(2) provides:

1934(2) An equivalent major as mentioned in

1941subparagraph 64B8 - 42.002(1)(a)1., F.A.C.,

1946shall be a course of study specially designed

1954to prepare an individual to inte grate and

1962apply principles of nutrition under varying

1968conditions of health, social, physical,

1973psychological, and economic status to the

1979appropriate care, nourishment and education

1984of individuals or groups throughout the life

1991cycle. Any major must include at least

1998thirty semester hours covering human

2003nutrition, nutrition in health and disease,

2009nutrition education and counseling, food

2014science, nutrition in the community, and

2020administration of food service or nutrition

2026programs.

202719. Based on the F indings of F act above, Ms. Mollan failed

2040to prove by a preponderance of the evidence that the KU degree

2052contained a major course of study in human nutrition, food and

2063nutrition, dietetics or food management , or an equivalent major

2072course of study. Ms. Mollan failed to provide persuasive

2081evidence that she met the statutorily - required education.

2090RECOMMENDATION

2091Based on the foregoing Findings of Fact and Conclusions of

2101Law, it is RECOMMENDED that the Department of Health, Board of

2112Medicine, Dietetics and Nutrition Prac tice Council , enter a final

2122order denying Ms. Mollan ' s application for licensure by

2132examination as a dietitian/nutritionist in Florida.

2411University, but sh e did not provide any specific testimony about

2422or transcripts of courses taken there.

24288/ Dr. Dorsey testified that the KU degree does not contain a

2440science - based curriculum including organic chemistry,

2447biochemistry, or biology; however , those requirement s are not

2456explicitly set forth in section 468.509. Rule 64B8 - 42.002

2466alludes to a science - based curriculum.

24739/ Ms. Mollan does not have a foreign degree ; thus , that section

2485of the statute is not applicable and will not be addressed.
