139Petitioner, Department of Business and Professional

145Regulation, Division of Hotels and Restaurants , filed an

153Administrative Complaint alleging v iolations of the provisions

161of c hapter 509, F lorida Statutes, or the applicable rules

172governing the operation of public food establishments.

179Respondent disputed the allegations in the Administrative

186Complaint and petitioned for a formal administrative hearing.

194The case was referred to the Divisio n of Administrative Hearings

205on or about February 8 , 20 1 2 . A Notice of Hearing was issued on

221February 14, 2012, scheduling the formal hearing for April 5 ,

23120 1 2 . The Notice of Hearing was mailed to the parties at their

246addresses of record. The hearing to ok place as scheduled.

256At the commencement of the hearing, the Petitioner ' s

266counsel entered his appearance, and Petitioner's Request to

274Accept Qualified Representative was granted. N o appearance was

283made on behalf of Respondent. The hearing was recessed for

293approximatel y 2 0 minutes to give a representative of Respondent

304an opportunity to appear, but no appearance was made on behalf

315of Respondent.

317At hearing, Petitioner presented testimony of two

324witness es , Edward Bouza and C ynthia Ross . Petitioner ' s Exhibits

337numbered 1 , 2 and 4 were admitted into evidence. Petitioner

347also withdrew allegations in the Administrative Complaint

354referencing an April 6, 2011, inspection. Official R ecognition

363wa s requested of s ection 509.032 (6) , Florida Statutes, Florida

374Administrative Code Rule s 61C - 4 .00 1 ( 14 ) , and 61C - 1.005 , and

391pertinent portions of the United States Food and Drug

400Administration ' s Food Code (Food Code). The request was

410granted.

411A Transcript consisting of one volume was filed on

420April 2 3 , 20 1 2 . Petit ioner timely filed a Proposed Recommended

434Order, which ha s been considered in the preparation of this

445Recommended Order. Respondent did not file a post - hearing

455submission. References to Florida Statutes are to the 20 1 1

466version, unless otherwise indicated .

471FINDINGS OF FACT

4741. Petitioner, the Department of Business and Professional

482Regulation, Division of Hotels and Restaurants (D ivision ), is

492the state agency charged with the duty and responsibility of

502regulating the operation of hotel and restaur ant est ablishments

512pursuant to section 20.165 and c hapter 509, Florida Statutes.

5222. Respondent is located in Tallahassee , Florida , with a

531business address of 710 West Orange Avenue . Respondent was

541issued license number 2014 by the D ivision as a mobile food

553disp ensing vehicle .

5573. Critical violations are those violations that , if not

566co rrected, could contribute to food - borne illness , environmental

576health hazards, or contamination o f food .

5844 . Edward Bouza i s employed by the Division a s a plans

598examiner . Befor e becoming a plans examiner, he worked for the

610Division as a Sanitation and Safety Specialist inspector .

619M r . Bouza has received three to four months of in - field training

634regarding public food service and inspections. During the time

643he was a Sanitation and Safety Specialist, he continue d to

654receive continuing education training on a monthly basis . He

664perform ed approximately 800 to 1,000 inspections each year.

6745. Cynthia Ross is employed by the Division as a

684supervisor. She supervises nine inspectors. Prior to becoming

692a supervisor, Ms. Ross worked as a Sanitation and Safety

702Specialist for two years. Prior to working at the Division,

712Ms. Ross worked as a general manager of a Ruby Tuesday

723restaurant for 15 years, as a general manager of a fine dining

735establishment for three years, and as a n owner/operator of a

746full - service restaurant for seven years. She received training

756on the Food Code and was trained in the laws and rules

768pertaining to public food service and lodging establishments.

776In her former capacity as a Sanitation and Safety Specialist,

786she received continuing education training on a monthly basis

795and performed approximately 1,000 inspections a year.

8036 . On April 1 , 20 1 1 , M r . Bouza and Ms. Ross conducted a

820routine food service inspection of Respondent ' s premises . They

831observed Respondent operating without any water at its hand

840sink, its three - compartment sink, and without hot water at its

852hand sink. These are critical violations because without hot

861and cold running water, Respondent could not perform basic

870cleaning functions in its establishment , could not properly wash

879its equipment, or allow its employees to wash their hands.

8897. During the inspection, M r . Bouza and Ms. Ross

900prepared, signed , and issued an inspection report setting forth

909the violations t he y observed . Anthony Rivers , Respondent ' s

921o wner , was present and sign ed the inspection report indicating

932receipt .

9348 . An immediate Administrative Complaint and an Emergency

943Closure Order were issued based on the violations documented on

953the April 1, 2011 inspection report.

959CONCLUSIONS OF LAW

9629 . The Division of Administrative Hearings has

970jurisdiction over the parties and subject m atter in this case.

981§§ 120.569 and 120.57(1), Fla. Stat.

9871 0 . The D ivision is the state agency charged wi th

1000regulating public food service establishments pursuant to

1007section 20.165 and c hapter 509, Florida Statutes.

10151 1 . Pursuant to s ection 509.261(1), the D ivision may

1027impose penalties for violations of c hapter 509, including an

1037administrative fine of no m ore than $1,000 for each separate

1049offense, attendance at personal expense at an educational

1057program sponsored by the Hospitality Education Program, and the

1066suspension or revocation of Respondent ' s license.

107412 . Because the D epartment seeks the imposition of an

1085administrative fine , the D epartment has the burden of proving by

1096clear and convincing evidence the specific allegations in the

1105Administrative Complaint. See , e.g. , Dep ' t of Banking & Fin . v.

1118Osborne Stern & Co. , 670 So. 2d 932 (Fla. 1996).

11281 3 . S ection 509.032(6 ) provides that the Division of

1140Hotels and Restaurants shall adopt such rules as are necessary

1150to carry out the provisions of c hapter 509. Paragraph 1 -

1162201.10(B) and c hapters 2, 3, 4, 5, 6 and 7 of the United States

1177Food and Drug Administra tion ' s Food Code (Food Code) have been

1190incorporated by reference into the Department ' s rules governing

1200public food establishments. Fla. Admin. Code R. 61C - 1 . 001(14) .

12131 4 . Through the Administrative Complaint, Respondent is

1222alleged to have violated the fo llowing provision s of the Food

1234Code, which read in pertinent part:

1246Pressure. Water under pressure shall be

1252provided to all fixtures, equipment, and non -

1260food equipment that are required to use water

1268except that water supplied as specified unde r

1276¶¶ 5 - 104.12(A) and (B) to a temporary food

1286establishment or in response to a temporary

1293interruption of a water supply need not be

1301under pressure.

1310Handwashing Facili ty, Installation.

1314(A) A handwashing lavatory shall be equipped

1321to provide water at a temperature o f at least

133138 ° C (100 ° degrees F) through a mixing valve

1342or combination faucet.

1345(B) A steam - mixing valve may not be used at a

1357handwashing lavatory.

135915 . The D ivision proved by clear and convincing evi dence

1371that Respondent violated r ule 5 - 103 .1 2 , Food Code , in that both

1386inspectors observed that Respondent's establishment did not have

1394any running water at its hand sink and three - compartment sink.

140616 . T he D ivision proved by clear and convincing evidence

1418that Respondent violated r ule 5 - 202 .1 2 (A) and (B) , Food Code, in

1434that Respondent's establishment had no running water at its hand

1444sink.

144517. The Administrative Complaint groups th e above

1453violations of rul es 5 - 103.12 and 5 - 202.12(A) and (B), Food Code,

1468as a single violation. Accordingly, the Division seeks only one

1478penalty to be assessed for both violations. The Division

1487suggests a fine of $500.

149218. Respondent proved that Respondent committed one

1499criti cal violation.

150219 . In its Proposed Recommended Order, the Division

1511proposes the imposition of a fine of $500 for violation of one

1523critical violation . Florida Admin istrative Code Rule 61C -

15331.005 (6) s ets forth the penalty guidelines to be imposed agains t

1546licensees for violations of the applicable statutes and rules.

1555The recommended penalt y is consistent with these guidelines.

1564RECOMMENDATION

1565Upon consideration of the facts found and conclusions of

1574law reached, it is

1578RECOMMENDED:

1579That the Division enter a F inal O rder which confirms the

1591violations found, and imposes an administrative fine in the

1600amount of $ 5 0 0 due and payable to the Division of Hotels and

1615Restaurants, 1940 North Monroe Street, Tallahassee, Florida ,

162232399 - 1011, within 30 cal endar days of the date the Final Order

1636is filed with the Agency Clerk.
