278On March 5, 2012, Petitioners, Desiree Williams and
286Robert Williams, individually and as parents and next friends of
296Lylyauhnie Williams, a minor, filed a Petition for Determination
305of NICA Coverage with the Division of Admini strative Hearings,
315seeking compensation under the Florida Birth - Related Neurological
324Injury Compensation Plan (Plan).
328On April 20, 2012, Petitioners' counsel, Allison C.
336McMill a n, Esquire, filed a motion to withdraw, which was granted
348by Order dated May 8, 2012. On May 8, 2012, Paul Silva, Esquire,
361filed a Notice of Appearance on behalf of Petitioners. On
371July 6, 2012, Mr. Silva filed an Amended Petition for
381Determination as to Applicability of Florida Birth - Related
390Neurological Injury Compensation Plan, asserting that Petitioners
397did not believe that the claim was compensable under the Plan.
408On July 12, 2012, Palms West Hospital filed a motion to
419intervene, which was granted by Order dated July 25, 2012. On
430July 25, 2012, Dr. Pliskow filed an amended pet ition to
441intervene, which was granted by Order dated August 7, 2012.
451On September 6, 2012, Respondent, Florida Birth - Related
460Neurological Injury Compensation Association, filed a Notice of
468Compensability and Request for Evidentiary Hearing on
475Compensabilit y.
477On October 12, 2012, Mr. Silva filed a motion to withdraw,
488which was granted by Order dated October 22, 2012. On
498October 29, 2012, Petitioners ' current counsel filed a Notice of
509Appearance.
510On October 15, 2012, Respondent filed a Motion for Summary
520Final Order. The motion was denied by Order dated December 21,
5312012.
532On November 2, 2012, Petitioners filed Petitioners' Notice
540of Withdrawal of Acceptance of NICA Compensability and Objection
549to Entry of Summary Final Order on the Issue of Compensabilit y.
561On November 2, 2012, Petitioners filed Petitioners' Motion to
570Amend Amended Petition for Determination as to Applicability of
579Florida Birth - Related Neurological Injury Compensation Plan to
588Add Additional Facts and Claims B ased on the Record. The motio n
601was granted by Order dated December 21, 2012. The amended
611petition asserted that the claim was not compensable and that
621notice had not been provided by Intervenors as required by
631section 766.316.
633On March 18, 2013, Respondent filed a Renewed Motion for
643Summary Final Order, representing that Petitioners no longer
651disputed that the claim was compensable, but still asserted that
661the required notice had not been provided by either Dr. Pliskow
672o r Palms West Hospital. On April 19, 2013, a Partial Summary
684Fina l Order was entered on the issue of compensability, finding
695that the claim was compensable and retaining jurisdiction to
704determine the issue of notice.
709At the final hearing, Joint Exhibits 1 through 17 were
719admitted in evidence. Petitioners testified in t heir own behalf
729and called Dr. Pliskow and Robin Torres as witnesses. Neither
739Respondent nor Intervenors called any witnesses.
745The one - volume Transcript of the final hearing was filed on
757May 15, 2013. Petitioners filed their proposed final order on
767May 2 4, 2013, and Intervenors filed their proposed final orders
778on May 28, 2013. Respondent did not file a proposed final order.
790The parties' proposed final orders have been considered in the
800drafting of this Final Order.
805FINDINGS OF FACT
8081. Desiree Williams first presented to Dr. Pliskow on
817November 28, 2011, for a prenatal visit. She was 34 weeks '
829gestation. When she arrived at Dr. Pliskow's office,
837Mrs. Williams was given some forms to fill out by the
848receptionist. She filled out, signed, and dated a Pa tient
858Registration Form and a Policies and Consent form and returned
868them to the receptionist. The forms were initialed by the
878receptionist.
8792. After she returned the forms to the receptionist,
888Mrs. Williams returned to the waiting room, while her chart was
899being prepared by Dr. Pliskow's medical assistant,
906Marlena Lovely. Ms. Lovely took Mrs. Williams to the triage
916area. Mrs. Williams remembers Ms. Lovely because Ms. Lovely was
926wearing unusual pink tye - dyed shoes.
9333. While in the triage area, Ms. Lo vely gave Mrs. Williams
945a copy of the brochure published by the Florida Birth - Related
957Neurological Injury Compensation Association (NICA brochure).
963She also gave Mrs. Williams the Patient Information Verification
972form, the Prenatal Risk Screening form, an d the Prenatal Genetic
983Screening form for Mrs. Williams to fill out. Mrs. Williams
993filled out the forms.
9974. The Prenatal Information Verification form contains the
1005following statement:
1007The first OB visit is an important time to
1016insure that you start yo u prenatal care
1024informed and confident that you are making
1031the right decision regarding your pregnancy.
1037As we progress together through the
1043pregnancy, we will discuss many aspects of
1050the prenatal care and delivery. Please
1056confirm that you have received t he following
1064information and that all your questions have
1071been answered.
1073After this statement, there is a list of items and beside each
1085item is a blank for the date and a blank for the patient's
1098initials. The first item listed is the NICA brochure.
1107Mrs. Williams placed the date, "11/28/2011," on the blank for the
1118date and placed her initials on the blank designated for the
1129patient's initials.
11315. After filling out the forms in triage, Mrs. Williams was
1142taken to Dr. Pliskow's office, where Dr. Pliskow dis cussed the
1153pertinent items on the Prenatal Information Verification form
1161with Mrs. Williams. Dr. Pliskow recalls seeing the NICA brochure
1171in Mrs. Williams' lap while he was discussing the items on the
1183form with Mrs. Williams. Dr. Pliskow initialed the Pr enatal
1193Information Verification form after he discussed the items with
1202Mrs. Williams. After his discussion with Mrs. Williams, she was
1212taken to the examination room, where Dr. Pliskow examined her.
12226. Mrs. Williams denies having received the NICA brochur e
1232during her visit to Dr. Pli sk ow's office on November 28, 2011.
1245However, based on the normal routine and practice in
1254Dr. Pliskow's office, it is more likely than not that
1264Mrs. Williams did receive a copy of the NICA brochure from
1275Dr. Pliskow's office on November 28, 2011.
12827 . The routine practice in Dr. Pliskow's office for a first
1294time obstetric patient was to have the receptionist give the
1304patient the Patient Registration form and the Policies and
1313Consent Form to fill out while the patient was in the wa iting
1326room. After the patient returned the forms to the receptionist,
1336the receptionist would initial the forms and give them to
1346Dr. Pliskow's medical assistant to compile a chart. The medical
1356assistant would then take the patient to the triage area where
1367the patient would be given the Prenatal Risk Screening form, the
1378Prenatal Genetic Screening form, and a Prenatal Information
1386Verification form to complete. The medical assistant would give
1395the patient the NICA brochure while the patient was in triage.
1406A fter triage, the patient would be taken to see Dr. Pliskow in
1419his office, where Dr. Pliskow would discuss the items listed in
1430the Prenatal Information Verification form with her. He would
1439also discuss the NICA brochure and advise the patient that he was
1451a participating physician. After this discussion, the patient
1459would be taken to the examination room to be examined by
1470Dr. Pliskow.
14728 . Mrs. Williams presented to Palms West Hospital on
1482December 19, 2011, and pre - registered for her delivery. On
1493December 2 9, 2011, Mrs. Williams presented again to Palms West
1504Hospital for a biophysical profile.
15099 . Palms West Hospital did not provide Mrs. Williams with
1520notice as to the limited no - fault alternative for birth - related
1533neurological injuries under the Plan on De cember 19, 2011, or
1544December 2 9 , 2011.
15481 0 . Palms West Hospital was not prohibited or constrained
1559from providing notice to Mrs. Williams of the Plan on either
1570December 19, 2011, or December 29, 2011.
15771 1 . On January 3, 2012, Mrs. Williams presented to Palm s
1590West Hospital after a spontaneous rupture of membranes. When she
1600arrived at the hospital, she was given some forms to complete and
1612sign. One of the forms that she was given and which she signed
1625and dated was the Acknowledgement of Patient's Receipt of the
1635Florida Birth - Related Neurological Injury Compensation Plan
1643Brochure. The form stated:
16471. I ACKNOWLEDGE THAT I HAVE RECEIVED THE
1655OFFICIAL INFORMATION BROCHURE OF THE Florida
1661Birth - Related Neurological Injury
1666Compensation Plan.
16682. I acknowledge that any questions I may
1676have had with regard to the operation of this
1685plan and the potential benefits available to
1692me have been answered to my satisfaction.
16993. I hereby consent to the rendering of all
1708necessary medical services including having
1713received the official information NICA
1718brochure which describes my rights and
1724limitations under that plan.
17284. I acknowledge and understand that I may
1736contact the Florida Birth - Related
1742Neurological Compensation Association about
1746the details of the plan.
17511 2 . Mrs. Wi lliams ' signature on the acknowledgement form
1763was witnessed by Robin Torres, a registered nurse in the labor
1774and delivery unit at Palms West Hospital. Part of Ms. Torres'
1785duties and routine practice at Palms West Hospital is to give
1796incoming obstetrical p atients a copy of the NICA brochure prior
1807to her signing her name to the acknowledgement form as a witness.
1819Ms. Torres also routinely manually inputs data into the hospital
1829computer showing that the NICA brochure was given to the patient.
1840The records of Palms West Hospital show that on January 3, 2012,
1852Ms. Torres entered data into the hospital computer system
1861indicating that Mrs. Williams was provided a copy of the NICA
1872brochure on that date.
18761 3 . Mrs. Williams denies being given a copy of the NICA
1889brochu re when she presented to Palms West Hospital on January 3,
19012012, but concedes that she did not read the forms that were
1913provided to her on that date. The greater weight of the evidence
1925demonstrates that Mrs. Williams was given a copy of the NICA
1936brochure by the staff of Palms West Hospital on January 3, 2012.
19481 4 . At the time that Mrs. Williams presented to Palms West
1961Hospital on January 3, 2012, she could not be transferred to
1972another hospital because her membranes had broken and she was in
1983labor.
1984CONCLUS IONS OF LAW
19881 5 . The Division of Administrative Hearings has
1997jurisdiction over the parties to and the subject matter of this
2008proceeding. §§ 766.301 - 766.316, Fla. Stat. (2012).
20161 6 . The only issue that was to be determined in the final
2030hearing is whether n otice was provided pursuant to section
2040766.316, which provides:
2043Each hospital with a participating physician
2049on its staff and each participating
2055physician, other than residents, assistant
2060residents, and interns deemed to be
2066participating physicians under s .
2071766.314(4)(c), under the Florida Birth -
2077Related Neurological Injury Compensation Plan
2082shall provide notice to the obstetrical
2088patients as to the limited no - fault
2096alternative for birth - related neurological
2102injuries. Such notice shall be provided on
2109forms furnished by the association and shall
2116include a clear and concise explanation of a
2124patientÓs rights and limitations under the
2130plan. The hospital or the participating
2136physician may elect to have the patient sign
2144a form acknowledging receipt of the notice
2151form. Signature of the patient acknowledging
2157receipt of the notice form raises a
2164rebuttable presumption that the notice
2169requirements of this section have been met.
2176Notice need not be given to a patient when
2185the patient has an emergency medical
2191condition as defined in s. 395.002(8)(b) or
2198when notice is not practicable.
22031 7 . Section 766.309(1)(d) provides:
2209(1) The administrative law judge shall
2215make the following determination based upon
2221all available evidence:
2224* * *
2227(d) Whether if raised by the claimant
2234or other party, the factual determinations
2240regarding the notice requirements in s.
2246766.316 are satisfied. The administrative
2251law judge has the exclusive jurisdiction to
2258make these factual determinations.
226218 . Petitioners contend that Dr. Plisko w did not provide
2273notice and that any notice that may have been provided by the
2285hospital was insufficient. Respondent did not take a position on
2295the notice issue. Intervenors contend that the appropriate
2303statutory notice was given. As the proponent of t he proposition
2314that appropriate notice was given, the burden on the issue of
2325notice is upon the Intervenors. Tabb v. Fla. Birth - Related
2336Neurological Injury Comp. Ass'n. , 880 So. 2d 1253, 1257 (Fla. 1st
2347DCA 2004).
234919 . The greater weight of the evidence es tablished that
2360Dr. Pliskow provided Mrs. Williams a copy of the NICA brochure
2371when she made her first visit to his office on November 28, 2011.
2384Thus, Dr. Pliskow satisfied the notice requirement in section
2393766.316.
23942 0 . Petitioners and Palms West Hospital stipulated that the
2405hospital did not provide Mrs. Williams with a copy of the NICA
2417brochure when she pre - registered at the hospital on December 19,
24292011, and when she went to the hospital on December 2 9 , 2011, for
2443testing. The greater weight of the evide nce did establish that
2454Palms West Hospital did provide Mrs. Williams with a copy of the
2466NICA brochure when she presented to the hospital on January 3,
24772012.
24782 1 . In Weeks v. Florida Birth - Related Neurological Injury
2490Compensation Association , 977 So. 2d 616 , 618 - 619 (Fla. 5th DCA
25022008), the court stated:
2506[T]he formation of the provider - obstetrical
2513patient relationship is what triggers the
2519obligation to furnish the notice. The
2525determination of when this relationship
2530commences is a question of fact. Once the
2538relationship commences, because [section
2542766.316] is silent on the time period within
2550which notice must be furnished, under well -
2558established principles of statutory
2562construction, the law implies that notice
2568must be given within a reasonable time.
2575Burnsed v. Seaboard Coastline R. Co. , 290 So .
25842d 13, 19 (Fla. 1974); Concerned Citizens of
2592Putnam County v. St. Johns River Water Mgmt.
2600Dist. , 622 So. 2d 520, 523 (Fla. 5th DCA
26091993). The determination depends on the
2615circumstances, but a central consideration
2620sh ould be whether the patient received the
2628notice in sufficient time to make a
2635meaningful choice of whether to select
2641another provider prior to delivery, which is
2648the primary purpose of the notice
2654requirement.
26552 2 . The facts of this case established that a provider
2667obstetrical patient relationship was established between
2673Mrs. Williams and Palms West Hospital when Mrs. Williams pre -
2684registered at the hospital on December 19, 2011. There was
2694nothing that prevented the hospital from providing Mrs. Williams
2703with the NICA brochure at that time, but the hospital chose not
2715to do so.
27182 3 . Palms West Hospital had a second opportunity to provide
2730Mrs. Williams with the required statutory notice on December 2 9 ,
27412011, when Mrs. Williams presented to the hospital for testi ng.
2752Again, there was nothing which prevented the hospital from
2761providing the notice on December 2 9 , 2011, but it chose not to do
2775so.
27762 4 . In Northwest Medical Center, Inc. v. Ortiz , 920 So. 2d
2789781, 784 (Fla. 4th DCA 2006), the court, (citing Galen of
2800Flor ida, Inc. v. Braniff , 920 So. 2d 781 (Fla. 1997)) discussed
2812the timing of the provision of notice required by section 766.316
2823and stated:
2825The supreme court [in Braniff ] determined
"2832this language makes clear that the purpose
2839of the notice is to give an ob stetrical
2848patient an opportunity to make an informed
2855choice between using a health care provider
2862participating in the NICA Plan or using a
2870provider not a participant and thereby
2876preserving her civil remedies."
2880* * *
2883The court also determined that "whether a
2890health care provider was in a position to
2898give a patient pre - delivery notice of
2906participation and whether notice was given a
2913reasonable time before delivery will depend
2919on the circumstances of each case and
2926therefore must be determined on a cas e - by -
2937case basis."
29392 5 . In Ortiz , the patient, Mrs. Ortiz, had preregistered at
2951the hospital over three months prior to her delivery. The
2961hospital did not give notice to the patient at the time of
2973preregistration. When Mrs. Ortiz came to the hospital for
2982delivery, she was having soft contractions. About five hours
2991after she arrived at the hospital, she was given an NICA
3002acknowledgment form to sign. A short time later a cesarean was
3013performed on Mrs. Ortiz because she was in critical condition.
3023The cour t held that the notice provided by the hospital was
3035ineffective.
3036Northwest [the hospital] knew that Mrs. Ortiz
3043intended to deliver her child there three
3050months before her actual admission. At that
3057time she was given substantial information
3063regarding her m edical care at the hospital
3071and she signed several consent forms. If the
3079purpose of the notice requirement is to give
3087the patient the choice to choose NICA
3094protected delivery or not, hospitals should
3100give notice at a time where such choice can
3109still be ma de. By waiting until an emergency
3118arises, the hospital is depriving the patient
3125of this choice. Therefore, by failing to
3132give notice of NICA participation a
3138reasonable time prior to delivery, although
3144able to do so, Northwest lost the protection
3152of NICA and the Ortizes are entitled to
3160pursue their civil remedies.
3164* * *
3167Northwest also argues that even if it could
3175have given an earlier notice, it satisfied
3182the statutory notice provision by informing
3188Mrs. Ortiz about NICA on the day she was
3197admitte d to the hospital. The Ortizes
3204maintain this notice was ineffective because
3210it was not given to Mrs. Ortiz until a time
3220when she would have been unable to act on the
3230information. Because the purpose of the
3236notice is "to give an obstetrical patient an
3244opp ortunity to make an informed choice
3251between using a health care provider
3257participating in the NICA plan or using a
3265provider who is not a participant and thereby
3273preserving her civil remedies," see
3278Braniff , 696 So . 2d at 309 - 310, the notice
3289was ineffective in this case.
3294Ortiz , 920 So. 2d at 785 - 786.
33022 6 . The notice provided by Palms West Hospital on
3313January 3, 2012, was ineffective because at the time the notice
3324was provided Mrs. Williams could not have been transferred to
3334another hospital. She did not hav e sufficient time to make an
3346informed choice on whether to use a participating health care
3356provider. The hospital had two opportunities to provide notice
3365to Mrs. Williams prior to her presenting for delivery, but did
3376not avail itself of those opportunitie s. Thus, Palms West
3386Hospital did not comply with the provisions of section 766.316
3396for providing notice.
3399CONCLUSION
3400Based on the foregoing Findings of Fact and Conclusions of
3410Law, it is
3413ORDERED that Dr. Pliskow provided notice as required by
3422section 766. 316 and that Palms West Hospital did not provide
3433notice as required by section 766.316.
3439It is further ORDERED that the parties are accorded 30 days
3450from the date of this Order to resolve, subject to approval of
3462the Administrative Law Judge, the amount and manner of payment of
3473an award to Petitioners; the reasonable expenses incurred in
3482connection with the filing of the claim, including reasonable
3491attorney's fees and costs; and the amount owing for expenses
3501previously incurred. If not resolved within such p eriod, the
3511parties shall so advise the Administrative Law Judge, and a
3521hearing will be scheduled to resolve such issues. Once resolved,
3531an award will be made consistent with section 766.31.
3540It is further ORDERED that in the event Petitioners file an
3551elec tion of remedies declining or rejecting NICA benefits, this
3561case will be dismissed and DOAH's file will be closed.
3571DONE AND ORDERED this 21st day of June , 2013 , in

3853Review of a final order of an administrative law judge shall be
3865by appeal to the District Court of Appeal pursuant t o section
3877766.311(1), Florida Statutes. Review proceedings are governed by
3885the Florida Rules of Appellate Procedure. Such proceedings are
3894commenced by filing the original notice of administrative appeal
3903with the agency clerk of the Division of Administra tive Hearings
3914within 30 days of rendition of the order to be reviewed, and a
3927copy, accompanied by filing fees prescribed by law, with the
