132The issue in this case is whether Cairo Gaskin - Dacosta
143suffered an injury for which compensation should be awarded under
153the Florida Birth - Related Neurological Injury Compensation Plan
162(Plan).
163PRELIMINARY STATEMENT
165On March 8, 2012, G ail Gaskin, individually and as parent
176and guardian of Cairo Gaskin - Dacosta (Cairo), a minor, filed a
188Petition for Determination of Compensability Pursuant to Florida
196Statute Section 766.301 et seq. (Petition) , with DOAH. The case
206was assigned to Administ rative Law Judge Susan B. Kirkland. The
217Petition alleged that Cairo suffered oxygen deprivation at birth
226resulting in cerebral palsy and sought a determination as to
236compensability under the Florida Birth - Related Neurological
244Injury Compensation Associati on ( NICA ) statutes.
252The Petition named Megan Indermaur, M.D., as the physician
261providing obstetric services at CairoÓs birth, and that Cairo was
271born at Tampa General Hospital which is located in Tampa,
281Florida, on October 18, 2008.
286DOAH served NICA with a copy of the Petition on March 15,
2982012 , and served Tampa General Hospital and Megan Dawn Indermaur,
308M.D., with a copy of the Petition on March 16, 2012. As of the
322date of this Final Order, neither Tampa General Hospital nor
332Megan Indermaur, M.D., has pe titioned to intervene into this
342proceeding.
343On May 4, 2012, NICA filed a response to the Petition,
354giving notice that the alleged injury did not "meet the
364definition of a 'birth - related neurological injury' as defined in
375section 766.3021(2), Florida Statut es, which specifically
382requires that the injury render 'the infant permanently and
391substantially mentally and physically impaired.'" 1/ NICA
398requested that a hearing be scheduled to resolve whether the
408claim was compensable.
411A final hearing was scheduled for October 1, 2012. After
421several motions for continuance were granted, Judge Kirkland
429entered an Order Placing Case in Abeyance requiring the parties
439to advise the status of the case by August 14, 2015. The case
452was reassigned to the undersigned A dmini strative L aw J udge on
465September 18, 2014, due to Judge KirklandÓs retirement.
473Following one continuance, the final hearing ultimately took
481place on June 2, 2016.
486Petitioner, Gail Gaskin, testified at the final hearing.
494PetitionerÓs E xhibits 1 through 4, which included the deposition
504testimony of Michael Freimark, M.D., and Dan Ha, PT, DPT, were
515admitted into evidence. Respondent, NICA, did not present
523testimony of any live witnesses. RespondentÓs E xhibits 1
532through 4, which included the deposition testi mony of
541Michael Duchowny, M.D., and Gail Gaskin, were admitted into
550evidence.
551The parties filed a Pre - h earing Stipulation, in which they
563agreed to certain facts as set forth in section 3 of the Pre -
577h earing Stipulation. These facts have been incorporated into
586this Final Order.
589A one - volume transcript of the final hearing was filed on
601June 21, 2016. The parties timely filed their proposed final
611orders, which have been carefully considered in the drafting of
621this Final Order.
624FINDINGS OF FACT
6271. Gail Ga skin 2/ is the natural mother of Cairo Gaskin -
640Dacosta.
6412. At all times material hereto, Gail Gaskin was an
651obstetrical patient of Megan Indermaur, M.D., who was a
660participating physician as defined in section 766.302(7), Florida
668Statutes.
6693. Dr. Inderma ur provided obstetrical services in the
678course of Ms. GaskinÓs labor and delivery.
6854. Cairo Gaskin - Dacosta was born on October 18, 2008.
6965. Cairo weighed in excess of 2,500 grams at birth.
7076. Cairo was born live at Tampa General Hospital, which is
718a l icensed Florida hospital.
7237. Petitioner , Gail Gaskin , had a cerclage procedure when
732she was five months pregnant. On October 17, 2008, Ms. Gaskin
743had that removed and was sent home. She went into labor the
755following day and was admitted to Tampa General Hospital on
765October 18, 2008. Upon arrival to the labor and delivery triage
776area, she went to the restroom and noticed she was bleeding and
788shivering. According to her medical records, she went to the
798restroom to void and there was evidence of a small a mount of
811vaginal bleeding. She was immediately placed on a fetal heart
821monitor. Fetal heart tones were in the 90s - 70s. The fetal heart
834tones did not improve. A fetal scalp electrode was placed which
845revealed the fetal heart tracing to be consistently i n the 70s
857to 60s. A stat cesarean delivery was called and Ms. Gaskin was
869taken to the operating room. Delivery was complicated by
878placental abruption.
8808. At birth, he was limp, blue, with no respiratory effort.
891Bag and mask ventilation was done for fo ur minutes, at which time
904Cairo was intubated for poor respiratory effort. At about ten
914minutes of life, Cairo started spontaneous respiration. CairoÓs
922Apgar scores were 2 (one minute), 4 (five minutes), and 4 (ten
934minutes). 3/ The cord pH was 6.87.
9419. Following delivery, the placenta was sent to pathology.
950The final pathology diagnosis was:
955- Third trimester placenta 665 grams,
961- Placentomegaly,
963- Focal chorangiosis,
966- stage 2 acute chorioamnionitis ,
971- Trivascular umbilical cord.
97510. Cairo was taken t o the NICU, where he stayed for seven
988days and discharged home on October 25, 2008 . His Discharge
999Summary includes the following:
1003Diagnoses:
10041. Respiratory Distress;
10072. Hypoxic ischemic event - Stage 1; and
10153. Sepsis ruled out .
1020* * *
1023Neurologic: EEG done on DOL 0 secondary to
1031increased tone and abnormal movements. This
1037showed no seizures, however, was consistent
1043with diffuse enc e phalopathic process that
1050could include encephalopathy or
1054toxic/metabolic cause. A UDS was negative
1060from 10/18. A CT of h ead (10/20) was found
1070to be negative. Neurology was consulted and
1077recommended a follow up EEG prior to
1084discharge. A follow up EEG was performed on
109210/24 and found to be negative. Neurology
1099did not believe a follow up with them was
1108required.
1109Medical Records of Early Treating Physicians
111511. CairoÓs medical records reflect that he was evaluated
1124for developmental delay in March 2010 , when he was 17 months old ,
1136by pediatric neurologist Carmen Ferreira, M.D. His history
1144included: rolling over at three to four months, sitting at
1154around six months, crawling at around seven months, pulling up
1164and cruising at about nine months, and taking a few steps at the
1177time of the exam. Verbally, he spoke a few words, understood and
1189followed simple commands. Dr. Ferr eiraÓs assessment was
1197developmental delay, motor or speech, and noted that he was
1207progressing very well with his development and did not have any
1218focal neurologic findings that may suggest a neurologic
1226condition. She advised Ms. Gaskin to continue with th e plan of
1238therapy through early steps.
124212. During a follow - up exam two months later, Dr. Ferr ei ra
1256noted under History that Cairo had done very well with motor
1267development, ran well, walked upstairs, and went downstairs with
1276help. She noted that he was not saying many words yet. Her
1288assessment was similar to the previous visit, and she added
1298Ðgait, abnormal, noted to be wobbly when walkingÑ to her
1308assessment.
130913. After moving from Tampa to Miami, Dr. Oscar Papazian, a
1320pediatric neurologist, evaluated Cairo at Miami ChildrenÓs
1327Hospital in January 2012. The medical records reflect the
1336following:
1337Physical Examination:
13391. Vital Signs: HR 78 per minute and
1347regular. RR 18 per minute and regular.
1354WT: 35 pounds. HT: 38 HC: 49 cm
13622. General e xamination reveals no
1368neurocutaneous abnormality or dysmorphic
1372features.
13733. Systemic examination is normal.
1378Permanent contractures NO .
13824. Neurological examination reveals MS:
1387normal except for short attention span,
1393hyperactivity, impulsivity, languag e delay.
1398CN: normal except for drooling. Muscles:
1404mild increase muscle tone in both
1410gastrocnemius, biceps, and pectoralis and
1415less degree wrist and finger flexor. MSR are
14233 at both quadriceps and gastrocnemius
1429without clonus and 2 biceps. Plantar
1435re sponse. Extension bilateral. Gait: mild
1441tip toes and toe in. Station: normal.
1448Sensory: normal.
1450His diagnosis was
14531. Cerebral Palsy mild spastic
1458quadriparesis,
14592. Global developmental delay,
14633. Preschool ADHD combined type.
1468Etiology: Isc hemic hypoxic encephalopathy)
147314. Cairo was treated more recently by Dr. Tatyana
1482Dubrovsky, a pediatric neurologist. The medical records date
1490from April 2013 through May 2015. On May 20, 2015, Dr. Dubrovsky
1502made the following notation and assessment:
1508Neurological exam: The patient is awake,
1514alert, with normal affect and behavior and
1521cooperative with the exam. Examination of
1527the cranial nerves II - XII was normal except
1536poor tong u e agility probably due to
1544pseudobulbar palsy causing dysarthria and
1549inter mittent drooling. No abnormality of
1555tone, motor and deep tendon reflexes noted.
1562No nystagmus, ataxia or dysmetria noted. No
1569abnormality of stance appreciated.
1573Assessment:
15741. Epilepsy seizure, generalized, convulsive
15792. CP (cerebral palsy), spastic
15843. ADD (attention deficit hyperactivity
1589disorder, inattentive type)
1592Testimony of Treating Physicians and Health Providers
159915 . Petitioner presented the deposition testimony of
1607Dr. Michael Freimark, a pediatric physician with Sunrise
1615Pediatrics in Plantati on, Florida. Cairo became a patient there
1625in 2011 and was first seen by Dr. Freimark in 2012 and last seen
1639by Dr. Freimark in February 2013.
164516. Dr. Freimark noted that Cairo has an abnormal gait and
1656delayed speech, as well as some degree of weakness o n his right
1669side. He characterized CairoÓs abnormal gait as ÐslightÑ lower
1678extremity spasticity. When explaining his use of the word
1687Ðslight,Ñ he testified: Ð We do have patients here with severe
1699spasticity who require bracing and are wheelchair bound. ThatÓs
1708not the case with Cairo.Ñ
17131 7 . Dr. Freimark noted CairoÓs history from the discharge
1724summary from Tampa General Hospital. Based solely upon the
1733hospitalÓs discharge summary, Dr. Freimark surmised that Cairo
1741sustained loss of oxygen at birth. Whil e Dr. Fr ei mark believes
1754that CairoÓs deficits are amount to permanent and substantial, he
1764deferred to pediatric neurologists to make those determinations
1772as he is a pediatrician, not a pediatric neurologist.
1781Dr. Freimark also noted that Cairo had experien ced both febrile
1792and non - febrile seizures.
17971 8 . Petitioner presented the deposition testimony of
1806Dan Ha, a p hysical t herapist who practices at Little Steps
1818Rehabilitation Clinic in North Miami Beach. Cairo receives
1826physical therapy, occupational therapy , and speech therapy at
1834Little Steps. Dr. Ha holds a doctorate in physical therapy.
1844CairoÓs initial evaluation at Little Steps took place on
1853September 13, 2011. The deposition was taken on December 9,
18632013, so Dr. HaÓs testimony relates to that two - year period of
1876time (when Cairo was approximately three - to - five years old).
1888Dr. Ha was asked about whether CairoÓs problems were permanent
1898and whether they constitute a substantial physical impairment:
1906Q. Well, are you able to say what sort of
1916physical impa irments he will have on a
1924permanent basis?
1926A. That would be on my problem list in all
1936my reevals ; the tone, the cerebra l palsy.
1944Off the top of my head -- let me turn to that
1956page.
1957Q. I have his most recent problem list here.
1966A. Yeah. There you go.
1971Ce rebral palsy, I mean thatÓs a lifelong
1979diagnosis. Developmental delay, he will
1984always be behind other kids. Spasticity,
1990lifelong. Tone, lifelong. Rigidity,
1994lifelong. Balance issue, it can get worse.
2001Why, because, you know, for the next 10 years
2010heÓs g oing to gain more weight. HeÓs going
2019to get taller, heÓs going to get bigger. His
2028center of gravity will shift. His base of
2036support will change. Postural stability and
2042balance, itÓs connected. ItÓs going to
2048change. It can get worse. And motor
2055planni ng, like I said, the ability for you to
2065stir a cup of coffee with a spoon. You and I
2076take that for granted, he might not be able
2085to do that.
208819 . When asked about whether Cairo has a substantial
2098physical impairment, Dr. Ha replied as follows:
2105A. For me, based on my professional
2112opinion, when you say Ðsubstantial,Ñ itÓs
2119someone that cannot walk. You know, someone
2126that requires total assistance to transfer
2132from a wheelchair to a bed, thatÓs
2139substantial. Will he be functional in life,
2146yes. Can he live on his own in the future,
2156thatÓs to be determined, based on his
2163cognition. WeÓll know Ï - by the time heÓs
2172like 12, 13, weÓll know for sure.
2179* * *
2182Q: Do you have an opinion now after weÓve
2191talked about his employability a little bit
2198more on whether Cairo ha s a substantial
2206physical impairment?
2208Mr. Grace: Same objection.
2212A: Again, the word ÐsubstantialÑ in my
2219field is someone that is bedbound, canÓt
2226walk. So ÐsubstantialÑ is what I would
2233write on my report i f someone requires
2241assistance to even transfer f rom a
2248wheelchair to a bed, I would put the word
2257Ðsubstantial.Ñ
2258Q: You would for Cairo?
2263A: I would not say substantial. I would
2271not use the word Ðsubstantial.Ñ ICD - 9 codes
2280who use the word substantial for a person
2288that would need assistance just to -- j ust
2297like I say, transfer from a wheelchair to
2305someone that requires assistance to even put
2312on their clothes, thatÓs what you would call
2320substantial in my field and in the ICD - 9
2330coding .
2332Testimony of CairoÓs M other and S chool R ecords
23422 0 . Ms. Gaskin is a s ingle mother who is CairoÓs
2355caregiver. She described CairoÓs continuing problems with both
2363fine and gross motor skill deficits that cause him to drop
2374things, knock things over, and to have difficulty with eating
2384food. Cairo is not allowed to use a knife so she cuts his food
2398for him. Cairo needs help opening a milk carton and Ðmakes a
2410messÑ when eating meals. His speech is poor so she often has to
2423ask him to repeat himself and often has to translate what he
2435says to others, including his teachers.
24412 1 . He has a short attention span that carries over to
2454school. He receives special education services from Miami - Dade
2464County Public Schools. The most recent Individual Educational
2472Plan (IEP) in evidence placed him in Other Health Impaired,
2482Language Impaired, a nd continuing to be eligib le to receive, to
2494a limited extent, physical, occupational and speech therapy
2502within the school context. Cairo still receives these therapies
2511on Saturdays at Little Steps, although Ms. Gaskin indicated that
2521insurance coverage for that will run out soon.
25292 2 . On May 6, 2016, Miami - Dade Public Schools performed an
2543IEP for Cairo. He was finishing the first grade at Gratigny
2554Elementary School. Cairo was reported to be able to follow
2564classroom routines and participate in activitie s with minimal
2573support. He could identify most 2D and 3D shapes. He knew the
2585letters of the alphabet and their sounds. He could identify and
2596add coins. He could add two - digit numbers with regrouping ,
2607subtract two - digit numbers without regrouping , and f ind missing
2618numbers. He was having difficulty writing legibly and using
2627correct writing conventions such as punctuation, capitalization ,
2634and spelling. He had issues with regard to distractibility. He
2644was having difficulty identifying words that rhyme an d words
2654with the same medial sound. Cairo was walking independently in
2664line on all terrains. He had good sitting balance, his posture
2675was appropriate when standing and sitting, his gait pattern and
2685arm swing continued to improve. He could pick up things from
2696the floor. He enjoyed participating in gross motor activities.
2705He was independent in toileting and feeding. He could string
2715beads, insert pegs , and build with L ego blocks. His writing and
2727cutting skills were showing improvement. He was noted to have
2737low muscle tone and difficulty with standing balance. Writing
2746assignments took much time and effort.
27522 3 . Respondent presented the deposition testimony of
2761Dr. Michael Duchowny, M.D. , who was retained to evaluate Cairo .
2772Dr. Duchowny was deposed on Nov ember 27, 2012 , and again on
2784May 10, 2016. Dr. Duchowny is board - certified in pediatric s,
2796neurology with special competence in child neurology , and in
2805clinical neurophysiology. He is a senior staff attending
2813physician in neurology at Nicklaus ChildrenÓs Hospital where he
2822is emeritus director of the Comprehensive Epilepsy Center and is
2832the director of the neurology training programs. Dr. Duchowny
2841is a clinical professor of neurology and pediatrics at the
2851University of Miami School of Medicine and clinical professor of
2861neurology at the Florida International University School of
2869Medicine. His roles include patient care, teaching, research ,
2877and administration.
28792 4 . Dr. Duchowny reviewed Cairo Ós medical records and
2890performed an independent medical examinatio n (IME) on Cairo on
2900April 25 , 201 2, and again on March 23, 2016 .
29112 5 . During his first deposition on November 27, 2012,
2922Dr. Duchowny was of the opinion that Cairo began to suffer
2933oxygen deprivati o n before labor began. He believed the slight
2944tightness of the heel cords and the absence of any post - natal
2957situation would suggest any neurological compromise was acquired
2965during labor and delivery. As additional support, Dr. Duchowny
2974noted that Cairo did not require prolonged intubation or
2983mechanical ventilatio n. There was no evidence of multi - organ
2994system failure and his CT scan on day of life 3 was normal.
3007This suggested to Dr. Duchowny more likely than not that CairoÓs
3018neurological problems were acquired prior to the onset of labor.
3028Dr. Duchowny expected t hat if a brain MRI was done currently on
3041Cairo , it would provide better information as to whether Cairo
3051suffered hypoxic ischemic encephalopathy. Dr. Duchowny thought
3058it was too early at 3.5 years to tell if CairoÓs speech would be
3072completely normal , but he believed his speech would improve and
3082progress. Dr. Duchowny also believed that CairoÓs drooling
3090would improve , but his oral motor coordination would remain poor
3100and his speech articulation will never be 100 percent .
31102 6 . On March 23, 2016, Dr. Duchown y performed an updated
3123IME on Cairo. On physical examination , his findings were
3132normal. Head circumference was not only within standard
3140percentages but was an appropriate increase from the
3148circumference measurement taken at the 2012 IME. From a
3157neurolog ical standpoint , Cairo was interactive and playful but
3166also impulsive and did not stay on task. CairoÓs speech was not
3178clear. It was dysarthic for all sounds and consonants that
3188involve movement of the lips, tongue and cheek muscles. The
3198motor exam did reveal some abnormalities with tone more
3207increased in the lower extremities. Range of motion was full ,
3217there was no focal weakness, no atrophy of muscles , and no
3228involuntary movement. Hand coordination was impaired and he had
3237difficulty with individual f inger movements and pincer grasp.
3246His gait was stable , although he walked in an awkward manner.
3257Dr. Duchowny was still of the opinion that Cairo did not suffer
3269a birth - related neurological injury. He testified that his
3279opinion was supported by the brain MRI which was done on
3290February 21, 2014. Dr. Duchowny read the scan as normal and saw
3302nothing which would suggest Cairo suffered hypoxic ischemic
3310encephalopathy. Dr. Duchowny did not know the cause of CairoÓs
3320s eizures because the brain MRI was normal , b ut regard s CairoÓs
3333seizure disorder as developmentally based because the brain MRI
3342had no obvious lesions that provide a structural acquired
3351symptomatic explanation for the seizures. Dr. Duchowny believed
3359Cairo did suffer from neurological impairments but his motor
3368disability was mild to moderate, not a substantial motor
3377disability. Dr. Duchowny , in his March 30, 2016, report , stated
3387the following .
3390In summary, CairoÓs neurological examination
3395again reveals evidence of a spastic
3401diparesis and marked ex pressive language
3407dysfluency with oromotor and oculo - motor
3414dyspraxia. He has developed a seizure
3420disorder that is relatively well controlled
3426and additionally evidences problems in
3431learning and behavior.
3434I have reviewed additional medical records
3440sent on July 29, 2014, deposition testimony
3447of CairoÓs mother, his pediatrician
3452D r . Michael Freinark [ sic ] , and physical
3462therapist, Mr. Dan Ha. I also reviewed MR
3470imaging studies including his most recent
3476studies acquired in 2014. His last study is
3484notable as t he brain is entirely normal with
3493the possible exception of a slight asymmetry
3500in the hippocampi.
3503Although Cairo is unequivocally disabled
3508from both a motor and mental standpoint, he
3516is ambulatory and is demonstrating learning
3522capacity. Also, his recent b rain MR imaging
3530study does not show significant abnormality
3536which suggests that CairoÓs neurological
3541disability was acquired prenatally and is
3547not birth related. Certainly, there are no
3554features to suggest either a mechanical
3560injury or oxygen deprivation in the course
3567of either labor or delivery. For these
3574reasons, I am not recommending Cairo for
3581inclusion within the NICA program.
35862 7 . Dr. DuchownyÓs opinion that CairoÓs injury is
3596inconsistent with either a mechanical injury or oxygen
3604deprivation to the brain in the course of labor or delivery is
3616credited.
36172 8 . The greater weight of the evidence establishes through
3628the expert opinions of Dr. Duchowny that that there was no
3639apparent obstetrical event that resulted in loss of oxygen to
3649CairoÓs brain during labor, delivery and continuing into the
3658post - delivery period that resulted in brain injury.
366729 . Dr. Duchowny Ós opinion that Cairo has permanent, but
3678not substantial, mental and physical impairments is credited.
36863 0 . Dr. DuchownyÓs opinion in this regard is consistent
3697with CairoÓs physical therapist, Dr. Ha, who does not
3706characterize CairoÓs physical impairments as substantial because
3713Cairo is ambulatory. Moreover, Dr. Fr ei mark characterized
3722CairoÓs abnormal gait as Ðslight,Ñ in contrast to those patient s
3734who require bracing and who are wheelchair bound.
37423 1 . The greater weight of the evidence , including CairoÓs
3753educational records, along with Dr. DuchownyÓs expert opinions,
3761establishes that while Cairo has permanent motor and mental
3770deficits, these defi cits do not render him substantially
3779mentally and physically impaired.
3783CONCLUSIONS OF LAW
37863 2 . The Division of Administrative Hearings has
3795jurisdiction over the parties to and the subject matter of this
3806proceeding. §§ 766.301 - 766.316, Fla. Stat. (2011).
38143 3 . The Plan was established by the Legislature "to provide
3826compensation on a no - fault basis, for a limited class of
3838catastrophic injuries that result in unusually high costs for
3847custodial care and rehabilitation ." § 766.301 , Fla. Stat .
3857(emphasis added ) . The Plan applies only to a birth - related
3870neurological injury, which is defined in section 766.302(2) as
3879follows:
3880'Birth - related neurological injury' means
3886injury to the brain or spinal cord of a live
3896infant weighing at least 2,500 grams for a
3905single g estation or, in the case of a
3914multiple gestation, a live infant weighing at
3921least 2,000 grams at birth caused by oxygen
3930deprivation or mechanical injury occurring in
3936the course of labor, delivery, or
3942resuscitation in the immediate postdelivery
3947period in a hospital, which renders the
3954infant permanently and substantially mentally
3959and physically impaired . This definition
3965shall apply to live births only and shall not
3974include disability or death caused by genetic
3981or congenital abnormality. (emphasis added).
39863 4 . The injured infant, her or his personal representative,
3997parents, dependents, and next of kin, may seek compensation under
4007the P lan by filing a claim for compensation with DOAH.
4018§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA ,
4026which admini sters the Plan, has "45 days from the date of service
4039of a complete claim . . . in which to file a response to the
4054petition and submit relevant written information relating to the
4063issue of whether the injury is a birth - related neurological
4074injury." § 766. 305(4), Fla. Stat.
40803 5 . If NICA determines that the injury alleged in a claim
4093is a compensable birth - related neurological injury, it may award
4104compensation to the claimant, provided that the award is approved
4114by the Administrative Law Judge to whom the cl aim has been
4126assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
4137disputes the claim, as it has in the instant case, the dispute
4149must be resolved by the assigned Administrative Law Judge in
4159accordance with the provisions of chapter 120, Florida Statutes.
4168§§ 766.304, 766.309, and 766.31, Fla. Stat.
41753 6 . In discharging this responsibility, the Administrative
4184Law Judge must make the following determinations based upon all
4194available evidence:
4196(a) Whether the injury claimed is a birth -
4205related neu rological injury. If the claimant
4212has demonstrated, to the satisfaction of the
4219administrative law judge, that the infant has
4226sustained a brain or spinal cord injury
4233caused by oxygen deprivation or mechanical
4239injury and that the infant was thereby
4246rendered permanently and substantially
4250mentally and physically impaired, a
4255rebuttable presumption shall arise that the
4261injury is a birth - related neurological injury
4269as defined in s. 766.302(2).
4274(b) Whether obstetrical services were
4279delivered by a participating physician in the
4286course of labor, delivery, or resuscitation
4292in the immediate postdelivery period in a
4299hospital; or by a certified nurse midwife in
4307a teaching hospital supervised by a
4313participating physician in the course of
4319labor, delivery, or resuscitat ion in the
4326immediate postdelivery period in a hospital.
4332§ 766.309(1), Fla. Stat. An award may be sustained only if the
4344Administrative Law Judge concludes that the "infant has sustained
4353a birth - related neurological injury and that obstetrical services
4363we re delivered by a participating physician at birth."
4372§ 766.31(1), Fla. Stat.
43763 7 . In the instant case, Petitioner filed a claim alleging
4388that Cairo did sustain oxygen deprivation resulting in cerebral
4397palsy and as a result is substantially impaired. As t he
4408proponent of the issue of compensability, the burden of proof is
4419upon Petitioner. § 766.309(1)(a), Fla. Stat. See also Balino v.
4429Dep't of Health & Rehab. Servs . , 348 So. 2d 349, 350 (Fla. 1st
4443DCA 1977)("[T]he burden of proof, apart from statute, is on the
4455party asserting the affirmative of an issue before an
4464administrative tribunal.").
44673 8 . The parties have stipulated that a participating
4477physician provided obstetric services at CairoÓs birth in a
4486hospital licensed in Florida. Cairo was born a live in fant and
4498weighed in excess of 2,500 grams. The parties agree that CairoÓs
4510mental and motor deficits are permanent but disagree as to
4520whether they were caused by oxygen deprivation or mechanical
4529injury during labor, delivery, or the immediate post - delivery
4539period, and whether his deficits are substantial as contemplated
4548by section 766.302(2).
455139 . Dr. DuchownyÓs expert opinion establishes that that
4560there was no apparent obstetrical event that resulted in loss of
4571oxygen to CairoÓs brain during labor, deliver y and continuing
4581into the post - delivery period that resulted in brain injury.
459240 . Dr. DuchownyÓs expert opinion that CairoÓs deficits are
4602not ÐsubstantialÑ is consistent with CairoÓs physical therapist,
4610Dr. Ha, who does not characterize CairoÓs physical i mpairments as
4621substantial because Cairo is ambulatory. Moreover, Dr. Fr ei mark
4631characterized CairoÓs abnormal gait as Ðslight,Ñ in contrast to
4641those patients who require bracing and who are wheelchair bound.
46514 1 . Even if the evidence support ing an ischemi c event were
4665more substantial, the remaining issue to be determined is whether
4675the injury resulted in a permanent and substantial mental
4684impairment and a permanent and substantial physical impairment,
4692inasmuch as both are required to establish compensabili ty. Fla.
4702Birth - Related Neurological Injury Comp. Ass'n v. Div. of Admin.
4713Hearings , 686 So. 2d 1349 (Fla. 1997)(the Ð Birnie " decision).
47234 2 . While Petitioner has presented factual evidence
4732regarding CairoÓs difficult birth, and that he has physical and
4742mental impairments, it has not been established through expert
4751opinion that Cairo has a substantial mental and physical
4760impairment as contemplated by section 766.302. There have been
4769no expert opinions filed contrary to the credible opinions of
4779NICAÓs expert pediatric neurologist. Thus, Cairo is not entitled
4788to benefits under the NICA Plan.
4794CONCLUSION
4795Based on the foregoing Findings of Fact and Conclusions of
4805Law, it is ORDERED that the P etition filed by Gail Gaskin, on
4818behalf of and as parent of Cair o Gaskin - Dacosta, is dismissed
4831with prejudice.
