77This cause came on for consideration upon Respondent's

85Motion for Summary Final Order, filed on April 30, 2012.

95STATEMENT OF THE CASE

99On March 8, 2012, Petitioners, Donald Hawley and

107Camille Hawley, individually and as parents of River Hawley

116(River), deceased, filed a Petit ion for Determination of

125Compensability (Petition) with the Division of Administrative

132Hearings (DOAH) for compensation under the Florida Birth - Related

142Neurological Injury Compensation Plan (Plan). The Petition

149named Douglas Winger, M.D., as the physician who provided

158obstetric services at the birth of River at Florida Hospital

168Celebration.

169DOAH served the Florida Birth - Related Neurological Injury

178Compensation Association (NICA) with a copy of the Petition on

188March 15, 2012, and served Florida Hospital - Cel ebration Health

199on March 16, 2012. Dr. Winger was served with a copy of the

212Petition in March 2012, and a return receipt was returned to

223DOAH on March 21, 2012.

228On March 29, 2012, Dr. Winger and Obstetrics & Gynecology

238Associates, P.A., who is Dr. Winger' s employer, filed a Motion

249to Intervene, stating that they are currently and were

258participants in the Plan at the time of the injury alleged by

270Petitioners. An Order Granting Petition to Intervene was

278entered on April 5, 2012.

283On April 30, 2012, NICA fi led a Motion for Summary Final

295Order, stating that, at the time of River's birth, Dr. Winger

306was not a "participating physician" as that term is defined by

317section 766.302(7), Florida Statutes. No response to the motion

326was filed by either Petitioners or Intervenors.

333On May 16 , 2012, an Order to Show Cause was entered

344requiring Petitioners and Intervenors to show cause on or before

354May 2 9 , 2012, why the motion should not be granted and stating

367that failure to show cause would result in the issuance of a

379s u mmary f inal o rder of d ismissal. No response to the Order to

395Show Cause has been filed.

400FINDINGS OF FACT

4031. The Petition named Dr. Winger as the physician

412providing obstetric services at River's birth on July 25, 2010.

4222. Attached to the motion is an aff idavit of NICA's

433custodian of records, Tim Daughtry, attesting to the following,

442which has not been refuted:

447One of my official duties as Custodian of

455Records is to maintain NICA's official

461records relative to the status of physicians

468as participating phys icians in the Florida

475Birth - Related Neurological Injury

480Compensation Plan who have timely paid the

487Five Thousand Dollar ($5,000) assessment

493prescribed in Section 766.314(4)(c), Florida

498Statutes, and the status of physicians who

505may be exempt from payment o f the Five

514Thousand Dollar ($5,000) assessment pursuant

520to Section 766.314(4)(c), Florida Statutes.

525I maintain NICA's official records with

531respect to the payment of the Two Hundred

539Fifty Dollar ($250.00) assessment required

544by Section 766.314(4)(b)1., Fl orida

549Statutes, by all non - participating, non -

557exempt physicians.

559* * *

562As payments of the requisite assessments are

569received, NICA compiles data in the "NICA

576CARES" database for each physician. The

"582NICA CARES physician payment

586history/report" a ttached hereto for

591Dr. Douglas Winger indicates that in the

598year 2010, the year in which Dr. Winger

606participated in the delivery of River

612Hawley, as indicated in the Petition for

619Benefits, Dr. Winger did not pay the Five

627Thousand Dollar ($5,000) assessment required

633for participation in the Florida Birth -

640Related Neurological Injury Compensation

644Plan.

645Further, it is NICA's policy that if a

653physician falls within the exemption from

659payment of the Five Thousand Dollar ($5,000)

667assessment due to their status as a resident

675physician, assistant resident physician or

680intern as provided in Section 766.314(4)(c),

686Florida Statutes, annual documentation as to

692such exempt status is required to be

699provided to NICA. NICA has no records with

707respect to Dr. Winger in relat ion to an

716exempt status for the year 2010. To the

724contrary, the attached "NICA CARES physician

730payment history/report" shows that in 2010,

736Dr. Winger paid the Two Hundred and Fifty

744Dollar ($250) assessment required by Section

750766.314(4)(b)1., Florida Stat utes, for non -

757participating, non - exempt physicians.

7623. The NICA CARES statement attached to the affidavit of

772Mr. Daughtry support s the representations made in the affidavit.

7824. No party has offered any exhibits, affidavits or any

792other evidence refuting the affidavit of Mr. Daughtry, which

801shows that Dr. Winger was not a participating physician in the

812Plan at the time of River's birth. Neither Petitioners nor

822Intervenors have requested additional discovery time, and

829Petitioners have not moved for leave to amend the Petition to

840name any additional physician as rendering obstetrical services

848in connection with River's birth.

8535. Dr. Winger was not a participating physician at the

863time of River's birth on July 25, 2010.

871CONCLUSIONS OF LAW

8746. The Division o f Administrative Hearings has

882jurisdiction over the parties to, and the subject matter of,

892these proceedings. §§ 766.301 - 766.316, Fla. Stat.

9007. The Florida Birth - Related Neurological Injury

908Compensation Plan was established by the Legislature "for the

917pu rpose of providing compensation, irrespective of fault, for

926birth - related neurological injury claims" relating to births

935occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9468. The injured infant, her or his personal representative,

955parents, dependents, and next of kin may seek compensation under

965the Plan by filing a claim for compensation with the Division of

977Administrative Hearings. §§ 766.302(3), 766.303(2), and

983766.305(1), Fla. Stat. The Florida Birth - Related Neurological

992Injury Compensa tion Association, which administers the Plan, has

"100145 days from the date of service of a complete claim . . . in

1016which to file a response to the petition and to submit relevant

1028written information relating to the issue of whether the injury

1038is a birth - rela ted neurological injury." § 766.305(4), Fla.

1049Stat.

10509. If NICA determines that the injury alleged in a claim

1061is a compensable birth - related neurological injury, it may award

1072compensation to the claimant, provided that the award is

1081approved by the administ rative law judge to whom the claim has

1093been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

1104NICA disputes the claim, as it has in the instant case, the

1116dispute must be resolved by the assigned administrative law

1125judge in accordance with the pr ovisions of chapter 120, Florida

1136Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

114410. In discharging this responsibility, the a dministrative

1152l aw j udge must make the following determination based upon the

1164available evidence:

1166(a) Whether the injury claimed is a

1173birth - related neurological injury. If the

1180claimant has demonstrated, to the

1185satisfaction of the administrative law

1190judge, that the infant has sustained a brain

1198or spinal cord injury caused by oxygen

1205deprivation or mechanical injury and that

1211the infant was thereby rendered permanently

1217and substantially mentally and physically

1222impaired, a rebuttable presumption shall

1227arise that the injury is a birth - related

1236neurological injury as defined in s.

1242766.303(2).

1243(b) Whether obstetrical services wer e

1249delivered by a participating physician in

1255the course of labor, delivery, or

1261resuscitation in the immediate postdelivery

1266period in a hospital; or by a certified

1274nurse midwife in a teaching hospital

1280supervised by a participating physician in

1286the course of labor, delivery, or

1292resuscitation in the immediate postdelivery

1297period in a hospital.

1301§ 766.309(1), Fla. Stat. An award may be sustained only if the

1313a dministrative l aw j udge concludes that the "infant has

1324sustained a birth - related neurological injury an d that

1334obstetrical services were delivered by a participating physician

1342at birth." § 766.31(1), Fla. Stat.

134811. Pertinent to this case, "participating physician" is

1356defined by section 766.302(7), to mean:

1362[A] physician licensed in Florida to

1368practice med icine who practices obstetrics

1374or performs obstetrical services either

1379full - time or part - time and who had paid or

1391was exempt from payment at the time of the

1400injury the assessment required for

1405participation in the birth - related

1411neurological injury compensat ion plan for

1417the year in which the injury occurred.

142412. Section 766.314 provides that beginning January 1,

14321990, physicians who are not participating physicians in the

1441Plan shall pay an annual assessment of $250, unless they are

1452excluded from the assessm ent as provided in section

1461766.314(4)(b)4. Physicians participating in the plan are

1468assessed $5,000 annually, unless specifically excluded.

1475§ 766.314(4)(c), Fla. Stat.

147913. Dr. Winger paid an assessment of $250 for the year

14902010, therefore, he is not elig ible to be a participating

1501physician. No evidence was submitted that Dr. Winger was

1510excluded from paying the $5,000 assessment required for

1519participating physicians.

152114. The obstetrical services provided during River's birth

1529were no t provided by a partic ipating physician. Thus, the death

1541of River is not compensable under the Plan.

1549C ONCLUSION

1551Based on the Findings of Fact and Conclusions of Law, it is

1563ORDERED that Respondent's Motion for Summary Final Order is

1572granted, and the Petition is dismissed with p rejudice.
