87STATEMENT OF THE CASE
91On March 8 , 2012, Petitioner, Chanelle Huggins ,
98individually and as parent of Jamal White , a minor, filed a
109Petition for Determination of Compensability Pursuant to Flor ida
118Statute Section 766.301 et seg. [sic] (Petition) with the
127Division of Administrative Hearings (DOAH) for compensation
134under the Florida Birth - Related Neurological Injury Compensation
143Plan (Plan). The Petition named Natalia Camacho, M.D., as the
153physic ian providing obstetric services at the birth of Jamal at
164St. Joseph Women and Children's Hospital in Tampa, Florida.
173DOAH served NICA with a copy of the Petition on March 15,
1852012. DOAH served copies of the Petition on St. Joseph Women
196and Children's Hos pital and Dr. Camacho on March 16, 2012 .
208On February 26, 2013, NICA filed an Unopposed Motion for
218Summary Final Order, asserting that Jamal did not sustain a
"228birth - related neurological injury" as that term is defined in
239section 766.302(2), Florida Statu tes. NICA represented in the
248motion that counsel for Petitioner, Ronald Gilbert, was
256contacted on February 6, 2013, and had no objection to the
267granting of the motion.
271FINDINGS OF FACT
2741. Jamal White was born on August 1 9, 2010 , at St. Joseph
287Women and Children's Hospital in Tampa , Florida. Jamal weighed
2963,530 grams at birth.
3012. Donald Willis, M.D. (Dr. Willis), was requested by NICA
311to review the medical records for Jamal and his mother. In an
323affidavit dated February 22 , 2013, Dr. Willis opined the
332following within a reasonable degree of medical probability:
340In summary, delivery was complicated by a
347shoulder dystocia. Cord blood pH was within
354normal limits with pH of 7.08. The baby
362suffered a brachial plexus injury. Hospital
368course was otherwise n ormal.
373Labor was complicated by a shoulder dystocia
380that resulted in a difficult delivery and a
388brachial plexus injury. However, the
393shoulder dystocia did not result in brain
400injury. There is no obstetrical event that
407resulted in oxygen deprivation or m echanical
414trauma to the brain or spinal cord during
422labor, delivery, or the immediate
427postdelivery period.
4293. Jamal was examined and evaluated by Raymond J.
438Fernandez , M.D. (Dr. Fernandez ), on May 30 , 2012. In an
449affidavit dated February 25, 2013, Dr. F ernandez found the
459following on his examination of Jamal :
466Jamal has mild weakness of his left arm, but
475in spite of this, he has good use of the
485arm, proximally and distally. The left arm
492weakness was due to a mechanical injury of
500his left brachial plexus during delivery
506that was complicated by shoulder dystocia.
512There was no evidence for substantial and
519permanent mental and physical impairment due
525to brain or spinal cord injury due to lack
534of oxygen or mechanical trauma.
5394. A review of the file does not show any contrary
550opinion, and Petitioner has no objection to the issuance of a
561summary final order finding that the injury is not compensable
571under Plan. The opinion of Dr. Willis that Jamal did not suffer
583a neurological injury due to oxygen deprivation or mechanical
592injury during labor, delivery, or resuscitation in the immediate
601postdelivery period is credited. The opinion of Dr. Fernandez
610that Jamal does not have a substantial and permanent mental and
621physical impairment due to lack of oxygen or mech anical trauma
632is credited.
634CONCLUSIONS OF LAW
6375 . The Division of Administrative Hearings has
645jurisdiction over the parties to and the subject matter of these
656proceedings. §§ 766.301 - 766.316, Fla. Stat.
6636 . The Plan was established by the Legislature "f or the
675purpose of providing compensation, irrespective of fault, for
683birth - related neurological injury claims" relating to births
692occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7037 . The injured infant, her or his personal representative,
713p arents, dependents, and next of kin may seek compensation under
724the Plan by filing a claim for compensation with DOAH.
734§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
742which administers the Plan, has "45 days from the date of
753service of a complete claim . . . in which to file a response to
768the petition and to submit relevant written information relating
777to the issue of whether the injury is a birth - related
789neurological injury." § 766.305(4), Fla. Stat.
7958 . If NICA determines that the i njury alleged in a claim
808is a compensable birth - related neurological injury, it may award
819compensation to the claimant, provided that the award is
828approved by the administrative law judge to whom the claim has
839been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
850NICA disputes the claim, as it has in the instant case, the
862dispute must be resolved by the assigned administrative law
871judge in accordance with the provisions of chapter 120, Florida
881Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat .
8909 . In discharging this responsibility, the Administrative
898Law Judge must make the following determination based upon the
908available evidence:
910(a) Whether the injury claimed is a birth -
919related neurological injury. If the
924claimant has demonstrated, to t he
930satisfaction of the administrative law
935judge, that the infant has sustained a brain
943or spinal cord injury caused by oxygen
950deprivation or mechanical injury and that
956the infant was thereby rendered permanently
962and substantially mentally and physically
967im paired, a rebuttable presumption shall
973arise that the injury is a birth - related
982neurological injury as defined in s.
988766.303(2).
989(b) Whether obstetrical services were
994delivered by a participating physician in
1000the course of labor, delivery, or
1006resuscitat ion in the immediate postdelivery
1012period in a hospital; or by a certified
1020nurse midwife in a teaching hospital
1026supervised by a participating physician in
1032the course of labor, delivery, or
1038resuscitation in the immediate postdelivery
1043period in a hospital.
1047§ 766.309(1), Fla. Stat. An award may be sustained only if the
1059administrative law judge concludes that the "infant has
1067sustained a birth - related neurological injury and that
1076obstetrical services were delivered by a participating physician
1084at birth." § 76 6.31(1), Fla. Stat.
10911 0 . The term "birth - related neurological injury" is
1102defined in section 766.302(2) as follows:
"1108Birth - related neurological injury" means
1114injury to the brain or spinal cord of a live
1124infant weighing at least 2,500 grams for a
1133single ge station or, in the case of a
1142multiple gestation, a live infant weighing
1148at least 2,000 grams at birth caused by
1157oxygen deprivation or mechanical injury
1162occurring in the course of labor, delivery,
1169or resuscitation in the immediate
1174postdelivery period in a h ospital, which
1181renders the infant permanently and
1186substantially mentally and physically
1190impaired.
11911 1 . The evidence, which is not refuted, established that
1202Jamal did not sustain an injury to the brain or spinal cord
1214caused by oxygen deprivation or mechan ical injury occurring in
1224the course of labor, delivery, or resuscitation in the immediate
1234post - delivery period in a hospital. Therefore, Jamal is not
1245eligible for benefits under the Plan .
1252CONCLUSION
1253Based upon the foregoing Findings of Fact and Conclusion s
1263of Law, it is ORDERED that the Petition filed by
1273Chanelle Huggins, individually and as parent of Jamal White , is
1283dismissed with prejudice.
1286DONE AND ORDERED this 5th day of March , 2013 , in
