108(NICA) on July 12, 2012.

113STATEMENT OF THE CASE

117On March 16, 2012, Petitioner, Agustina Sanchez,

124individually and on behalf of Kayley Jazzmine Jimenez - Sanchez

134(Kayley), a minor, filed a Petition for Benefits Pursuant to

144Florida Statute Section 766.301 et seq. (Petition) with the

153Division of Administrative Hearings (DOAH) for compensa tion

161under the Florida Birth - Related Neurological Injury Compensation

170Plan (Plan). The Petition named Dr. Lori - Ann Spreitzer and

181Winnie Palmer Hospital.

184DOAH served NICA with a copy of the Petition on March 21,

1962012. DOAH served Winner Palmer Hospital w ith a copy of the

208Petition on March 22, 2012. DOAH sent a copy of the Petition by

221certified mail to Dr. Spreitzer on March 20, 2012. DOAH did not

233receive a return receipt from the United States Postal Service

243showing delivery to Dr. Spreitzer.

248On March 2 7, 2012, Orlando Health, Inc. , d/b/a Winnie

258Palmer Hospital for Women & Babies and Dr. Spreitzer filed a

269Petition for Leave to Intervene. On April 11, 2012, an Order

280Granting Petition to Intervene was entered.

286On July 12, 2012, NICA filed a Motion for Sum mary Final

298Order, asserting that Kayley did not sustain a "birth - related

309neurological injury" as that term is defined in section

318766.302(2), Florida Statutes. NICA represents in its motion

326that neither Petitioner nor Intervenors object to the entry of a

337S ummary Final Order determining that Petitioner's claim is not

347compensable under the Plan as a matter of law.

356FINDINGS OF FACT

3591. Kayley was born January 26, 2009, a t Winnie Palmer

370Hospital in Orlando, Florida. She weighed 2,9 28 grams at birth.

3822. Dona ld Willis, M.D. (Dr. Willis) , was requested by NICA

393to review the medical records of Kayley. In an affidavit dated

404July 9, 2012, Dr. Willis opined as follows:

412Based upon my education and experience, it

419is my professional opinion, within a

425reasonable degre e of medical probability

431that Kayley Jazzmine Jimenez - Sanchez did not

439suffer a "Birth - related Neurological Injury"

446as defined by Florida Statutes Section

452766.302(2) as there was no oxygen

458deprivation or mechanical injury during

463labor, delivery, or resuscit ation in the

470immediate post delivery period which

475resulted in injury to Kayley's brain or

482spinal cord.

4843. Attached to Dr. Willis' affidavit was a report

493detailing his findings based on the medical records of Kayley as

504follows:

505Fetal heart rate (FHR) moni toring on

512admission shows a normal baseline heart rate

519of 145 bpm. The pattern is reactive. The

527FHR monitor strip does not show any fetal

535distress prior to delivery.

539Cesarean section delivery was done without

545difficulty. Birth weight was 2,928 grams

552(6 lbs 7 oz's). Apgar scores were 4 / 8.

562Umbilical cord blood gas was normal with a

570pH of 7.28 and base excess of - 1.9. The

580baby was taken to the nursery. Difficulty

587with feeding occurred with emesis after

593attempting to feed. X - Ray showed a dilated

602loop of bowel. Gastorgrafin enema was done

609for evaluation and identified Small Left

615Colon syndrome.

617Neurology evaluation at 2 days of age was

625done for jitteriness. Exam shows abnormal

631muscle tone. EEG on D O L 2 was normal. Head

642ultrasound also had normal f indings. Skull

649X - Ray showed asymmetry of the skull bones.

658MRI on DOL 3 identified dilation of the left

667lateral ventricle. There were no findings

673suggestive of hypoxic ischemic

677encephalopathy. Genetic evaluation was done

682for the above findings and was n egative.

690Chromosome analysis was normal. Genomic

695hybridization array was negative.

699In summary, there was no fetal distress

706during labor. Delivery was by Cesarean

712section due to breech presentation. The

718newborn was not depressed. Umbilical cord

724blood gas was normal with a pH of 7.28. The

734baby was identified to have congenital

740malformations, including Small Left Colon

745syndrome and dilation of the left ventricle

752in the brain. MRI did not suggest hypoxic

760ischemic brain injury.

763There was no apparent ob stetrical event that

771resulted in loss of oxygen or mechanical

778trauma to the baby's brain during labor,

785delivery or the immediate post delivery

791period.

7924. A review of the file in this case reveals that there

804have been no expert opinions filed that are contrary to the

815opinion of Dr. Willis. The opinion of Dr. Willis that Kayley

826did not suffer a neurological injury due to oxygen deprivation

836or mechanical injury during labor, delivery, or immediate post -

846delivery period is credited.

850CONCLUSIONS OF LAW

8535. The Division of Administrative Hearings has

860jurisdiction over the parties to and the subject matter of these

871proceedings. §§ 766.301 - 766.316, Fla. Stat .

8796. The Plan was established by the Legislature "for the

889purpose of providing compensation, irrespective of fault, for

897birth - related neurological injury claims" relating to births

906occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9177. The injured infant, her or his personal representative,

926parents, dependents, and next of kin may seek compensation under

936the Plan by filing a claim for compensation with DOAH.

946§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

954which administe rs the Plan, has "45 days from the date of

966service of a complete claim . . . in which to file a response to

981the petition and to submit relevant written information relating

990to the issue of whether the injury is a birth - related

1002neurological injury." § 766. 305(4), Fla. Stat.

10098. If NICA determines that the injury alleged in a claim

1020is a compensable birth - related neurological injury, it may award

1031compensation to the claimant, provided that the award is

1040approved by the administrative law judge to whom the cla im has

1052been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

1063NICA disputes the claim, as it has in the instant case, the

1075dispute must be resolved by the assigned administrative law

1084judge in accordance with the provisions of chapter 120, Florida

1094Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

11029. In discharging this responsibility, the Administrative

1109Law Judge must make the following determination based upon the

1119available evidence:

1121(a) Whether the injury claimed is a birth -

1130related neurolo gical injury. If the

1136claimant has demonstrated, to the

1141satisfaction of the administrative law

1146judge, that the infant has sustained a brain

1154or spinal cord injury caused by oxygen

1161deprivation or mechanical injury and that

1167the infant was thereby rendered per manently

1174and substantially mentally and physically

1179impaired, a rebuttable presumption shall

1184arise that the injury is a birth - related

1193neurological injury as defined in s.

1199766.303(2).

1200(b) Whether obstetrical services were

1205delivered by a participating phys ician in

1212the course of labor, delivery, or

1218resuscitation in the immediate postdelivery

1223period in a hospital; or by a certified

1231nurse midwife in a teaching hospital

1237supervised by a participating physician in

1243the course of labor, delivery, or

1249resuscitation i n the immediate postdelivery

1255period in a hospital.

1259§ 766.309(1), Fla. Stat. An award may be sustained only if the

1271administrative law judge concludes that the "infant has

1279sustained a birth - related neurological injury and that

1288obstetrical services were de livered by a participating physician

1297at birth." § 766.31(1) , Fla . Stat.

130410. The term "birth - related neurological injury" is

1313defined in section 766.302(2) as follows:

"1319Birth - related neurological injury" means

1325injury to the brain or spinal cord of a live

1335infant weighing at least 2,500 grams for a

1344single gestation or, in the case of a

1352multiple gestation, a live infant weighing

1358at least 2,000 grams at birth caused by

1367oxyge n deprivation or mechanical injury

1373occurring in the course of labor, delivery,

1380or resuscitation in the immediate

1385postdelivery period in a hospital, which

1391renders the infant permanently and

1396substantially mentally and physically

1400impaired.

140111. The evidence , which is not refuted, established that

1410Kayley did not sustain an injury to the brain or spinal cord

1422caused by oxygen deprivation or mechanical injury occurring in

1431the course of labor, delivery, or resuscitation in the immediate

1441postdelivery period in a h ospital, which renders her

1450substantially and permanently physically and mentally impaired.

1457Therefore, Kayley is not eligible for benefits under the Plan.

1467CONCLUSION

1468Based upon the foregoing Findings of Fact and Conclusions

1477of Law, it is ORDERED that the petition for benefits filed by

1489Agustina Sanchez, individually and on behalf of Kayley, is

1498dismissed with prejudice.
