195The issue in this case is whether Oliver Bender has suffered
206an injury for which compensation should be awarded under the
216Florida Birth - Related Neurological Injury Compensation Plan
224(Plan).
225PRELIMINARY STATEMENT
227On May 15, 2012, Tyler Dyal, individually and as parent of
238Oliver Bender (Oliver), a minor, filed a Peti tion for
248Determination of Compensability Pursuant to Florida Statute
255Section 766.301 - 766.316 (Petition) with DOAH. The Petition
264alleged that Oliver suffered permanent and substantial physical
272and mental impairment due to lack of oxygen resulting in a birt h -
286related neurological injury.
289DOAH served the Florida Birth - Related Neurological Injury
298Compensation Association (NICA) with a copy of the Petition on
308June 1, 2012; served Orange Park Medical Center on June 4, 2012;
320and served Eric Edelenbos, D.O., on Jun e 4, 2012. The case was
333placed in abeyance.
336On November 14, 2012, NICA filed a response to the Petition,
347giving notice that the alleged injury did not "meet the definition
358of a 'birth - related neurological injury' as defined in section
369766.3021(2), Florid a Statutes, which specifically requires that
377the injury render 'the infant permanently and substantially
385mentally and physically impaired.'" NICA requested that a hearing
394be scheduled to resolve whether the claim was compensable.
403On February 1, 2013, Ora nge Park Medical Center filed Orange
414Park Medical Center, Inc.Ós Petition for Leave to Intervene, which
424was granted by Order dated February 11, 2013. On March 25, 2013,
436Dr. Eric Edelenbos and North Florida OB/GYN filed their Petition
446for Leave to Interven e, which was granted by Order dated April 2,
4592013.
460On October 1, 2013, Intervenors, Dr. Edelenbos and North
469Florida OB/GYN filed a Motion for Partial Summary Judgment on the
480issue of whether Dr. Edelenbos and North Florida OB/GYN gave
490notice pursuant to s ection 766.316. On November 13, 2013, a
501Partial Summary Final Order on Notice was entered, finding that
511Dr. Edelenbos and North Florida OB/GYN provided sufficient notice.
520Jurisdiction was retained to determine whether statutory notice
528was provided by Ora nge Park Medical Center and whether Oliver
539sustained permanent and substantial mental and physical
546impairments. The parties agreed that Oliver had suffered a brain
556injury as a result of oxygen deprivation during labor and
566delivery, and continuing into the immediate post - delivery period.
576On January 9, 2014, the parties filed a Joint Pre - hearing
588Stipulation, in which they agreed to certain facts as set forth in
600section D of the Joint Pre - hearing Stipulation. These facts have
612been incorporated into this Fina l Order.
619At the final hearing, the parties agreed that the only issue
630to be determined was whether OliverÓs injury resulted in a
640substantial and permanent mental and physical impairment.
647At the final hearing, Joint Exhibits A through DD were
657admitted in evidence. Neither Petitioner nor Respondent called
665any live witnesses. Intervenors called Trevor Resnick, M.D., and
674James B. Ball, M.D., as witnesses.
680The Transcript of the final hearing was filed on January 30,
6912014. On February 10, 2014, the parties f iled their proposed
702final orders, which have been carefully considered in the drafting
712of this Final Order.
716FINDINGS OF FACT
7191. Tyler Dyal is the natural mother of Oliver Bender.
7292. Oliver was born a live infant at Orange Park Medical
740Center in Orange Park, Florida, on September 26, 2011. Orange
750Park Medical Center was a hospital licensed in Florida on
760September 26, 2011.
7633. The physician providing obstetrical services at the time
772of OliverÓs birth was Dr. Edelenbos. At all material times,
782Dr. Eric Edelenbos, North Florida Obstetrical and Gynecological
790Associates, P.A., was a participating physician in the Plan.
7994. Oliver weighed in excess of 2,500 grams at birth.
8105. None of the parties dispute that Oliver sustained an
820injury to the brain caused by oxygen deprivation during
829resuscitation in the immediate post - delivery period. Donald C.
839Willis, M.D., NICA's expert, opined:
844In summary, labor was complicated by an
851abnormal FHR pattern and resulted in a
858depressed newborn. Umbilical cord blood gas
864w as consistent with birth hypoxic with a pH of
8746.87. The newborn hospital course was
880complicated by respiratory depression, apnea
885episodes and seizures. MRI identified hypoxic
891ischemic encephalopathy.
893There was an apparent obstetrical event that
900resulted in loss of oxygen to the babyÓs brain
909during labor, delivery, and continuing into
915the immediate post delivery period. The
921oxygen deprivation resulted in brain injury.
927I am not able to comment about the extent of
937the brain injury.
9406. At the time of Oli verÓs birth, his Apgar scores were 3
953at one minute, 6 at five minutes, and 8 at ten minutes, and he
967required resuscitation in the delivery room. His arterial cord
976gas pH was 6.872 with a base deficit of over 20, indicating that
989he had metabolic acidosis a nd had experienced hypoxia during
999labor and delivery. Intubation was attempted but was not
1008successful; however, Oliver improved and did not require
1016intubation thereafter.
10187. Oliver began having dusky spells around 24 hours of age
1029with reported ÐstaringÑ and tight tone. He also demonstrated
1038jitteriness and irritability.
10418. By September 28, 2011, Oliver had begun to have
1051seizures, which were treated with Phenobarbital. Oliver was
1059transferred to WolfsonÓs ChildrenÓs Hospital, where he continued
1067to have s tiffening of his extremities with arching and eye
1078staring.
10799. On September 29, 2011, Oliver had an MRI which showed
1090the following:
1092FINDINGS: There are felt to be diffusion
1099abnormalities present. These are more
1104conspicuous on the B200 (more heavily
1110diff usion weighted) images. These involve
1116predominantly the gray matter involving the
1122left frontoparietal region and the left MCA
1129distribution. In addition there is slight
1135restricted diffusion in the basal ganglia
1141bilaterally. There is restricted diffusion
1146along the calcarine fissures greater on the
1153right than the left. There is a small amount
1162of restricted diffusion in the right frontal
1169lobe along the inferior aspect of the sylvian
1177fissure and extending slightly superiorly.
1182There is also slight restricted diffusion
1188bilaterally felt to localize to the gray
1195matter along in the gray matter of the
1203occipital tips. The cerebellum appears
1208preserved.
1209These diffusion abnormalities are accompanied
1214by subtle T2 prolongation of FLAIR images as
1222well.
1223There is otherw ise no space - occupying lesion,
1232mass effect or midline shift. There is no
1240hydrocephalus.
1241The corpus callosum appears well formed.
1247The intracerebral flow voids on the T2 cube
1255images appear preserved and symmetric. The
1261patient appears to have a complete c ircle of
1270Willis.
1271IMPRESSION
1272Areas of restricted diffusion in distribution
1278as described above. The study discussed with
1285Dr. Driscoll and overall the findings are
1292felt to be consistent with hypoxic ischemic
1299encephalopathy. No obvious focal vascular
1304abnorm alities are seen on the T2 cube images.
1313As such this is likely secondary to somewhat
1321global ischemic etiology rather than embolic
1327phenomenon. There is no evidence of
1333hemorrhage.
133410. Oliver was discharged from WolfsonÓs Chi l drenÓs
1343Hospital on October 5, 2011, with no further seizure activity
1353being noted. He was continued with Phenobarbital and still
1362remains on the medication.
136611. When Oliver was five weeks old, he was seen by
1377Dr. Alana Salvucci at Nemours. Dr. SalvucciÓs assessment of
1386Oliver revealed the following:
1390Since Oliver has been at home, he has made
1399good developmental progress. He is making
1405eye contact and tracks. He startles to loud
1413sounds. He moves both of his extremities
1420equally and spontaneously. He smiles.
1425Overall, his grandmother des cribes him as
1432stiff, tending to hold his hands in a fisted
1441position, but will open and grasp objects.
1448He is on phenobarbital 2 mL twice a day,
1457which is approximately 3.5 mg/kg per day. He
1465has had no further events of stiffening
1472concerning for seizure. H owever, he does
1479have episodes where he stares off, typically
1486to the right with no change in tone, lasting
14951 to 2 minutes, occurs at least once a day.
1505There are several times where caretakers can
1512get his attention; however, most of the time,
1520he will not re spond to tactile or verbal
1529stimuli. There are no associated oral
1535automatisms or eye flutter.
1539* * *
1542Oliver has overall been doing well with no
1550stiffening or jerking episodes, he has been
1557smiling, and tracking and milestones have
1563been appropriate fo r his age.
156912. Dr. Salvucci recommended that OliverÓs mother and
1577grandmother videotape OliverÓs episodes of staring off and send
1586the tape to Nemours for review. She arranged for a prolonged, at
1598least four - hour, video EEG in hopes of capturing the starin g
1611episodes described by OliverÓs mother and grandmother. On
1619December 29, 2011, Oliver had a four - hour, sleep - deprived EEG,
1632which was normal with no clinical events during the EEG
1642recording. No evidence was presented that established OliverÓs
1650mother follo wed Dr. SalvucciÓs recommendation to videotape one of
1660OliverÓs staring episodes.
166313. On March 22, 2012, Oliver returned to Nemours and was
1674seen by Dr. Harry Abrams. Dr. Abrams noted that Oliver had made
1686good developmental progress since his discharge fro m WolfsonÓs
1695ChildrenÓs Hospital. Oliver had begun sitting up in a tripod
1705position. He used both hands equally, reaching for objects and
1715transferring objects. According to his mother, OliverÓs
1722stiffness had significantly improved, but Oliver still had ti ght
1732heel cords, making him tend to stand on his toes when bearing
1744weight. Although not babbling, Oliver was making good eye
1753contact, smiling , and tracking. During the visit, OliverÓs
1761mother reported that at least twice a day Oliver had episodes
1772where his arms stiffened and flex ed at the elbow and that he was
1786having jerking movements. She indicated that Oliver had been
1795staring off, and there appeared to be transient episodes of
1805unresponsiveness that lasted several seconds.
181014. Dr. Abrams recommended that an eight - hour video EEG be
1822done in hopes of capturing one of the events with the upper
1834extremity jerking. This recommendation was not followed.
184115. On January 17, 2013, Oliver was admitted to WolfsonÓs
1851ChildrenÓs Hospital for seizures accompanying a fev er and cough.
1861The seizure was a single episode in which Oliver was unresponsive
1872for one minute and nonresponsive to verbal or tactile
1881stimulation. The seizure caused grogginess, and Oliver slept
1889afterwards. The seizure was characterized as generalized a nd
1898staring. The postical symptom was confusion. His mother
1906reported that this was the first seizure that Oliver had had
1917since he was an infant. Oliver was treated with Klonopin and
1928discharged the next day in stable condition.
193516. Oliver visited Dr. Abr ams on April 16, 2013.
1945Dr. Abrams noted that Oliver was doing well. Oliver had no
1956significant evidence of delay. OliverÓs family advised that
1964Oliver had done well, but at times Oliver would stare off and at
1977other times, when he was drowsy or sleepy, he would put his
1989fingers in his ears and shake his head back and forth.
2000Dr. Abrams recommended that OliverÓs dosage of Phenobarbital
2008begin to be tapered.
201217. In May 2013, Oliver had another seizure. Again, this
2022seizure was accompanied by a high fever. Hi s mother was about to
2035give him Tylenol when Oliver suddenly stiffened and jerked for
2045several minutes. The episode stopped spontaneously. As a
2053result, OliverÓs dosage of Phenobarbital was increased.
206018. Oliver has not had another episode similar to the one
2071he had in May 2013. His mother and grandmother report that he
2083continues to have episodes in which he stares off and becomes
2094confused. However, he returns to baselines after the staring
2103episodes.
210419. Oliver is an active child; he can run, walk, and p lay.
2117He is able to throw a ball and can drive a power - wheel car by
2133pushing the pedal to drive it. He plays with other children.
2144Oliver likes to play with his Hot Wheels cars. He can pull off
2157his hats, sock s , and clothes. He is able to turn pages in a
2171book, and he can stack blocks. Oliver scribbles on paper with
2182pens, pencils, and crayons. He can feed himself with utensils
2192and drinks from a sippy cup. He can also drink from a straw. He
2206can put his arms inside his sleeves when he is being dressed.
221820 . When asked to point to his body parts, including his
2230eyes, ears, hair, feet, hands, and belly button, he is able to do
2243so. As of October 15, 2013, Oliver could speak approximately
2253eight single words meaningfully and had not spoken any two - word
2265phrases. His speech development at that time was not age
2275appropriate. However, Oliver is able to use nonverbal
2283communications effectively. When he is hungry, he smacks his
2292lips and holds out his hands, indicating that he wants something
2303to eat. He is able to u nderstand and carry out verbal requests.
2316He makes good eye contact. He can identify objects in pictures
2327such as a ball, airplane, and ice cream cone by pointing to the
2340objects. He is not receiving any type of therapy, such as
2351physical, occupational, or speech therapy.
235621. Respondent retained Raymond Fernandez, M.D. , to
2363evaluate Oliver. Dr. Fernandez is board - certified in pediatrics
2373and neurology together with child neurology and has been
2382practicing pediatric neurology for 37 years. Dr. Fernandez
2390revie wed OliverÓs medical records and performed independent
2398medical examinations on Oliver on September 25, 2012, and
2407October 15, 2013. After Dr. FernandezÓs examination on
2415September 25, 2012, he felt that it would be appropriate to
2426reexamine Oliver in six to nine months in order to track his
2438developmental progress before coming to a final conclusion.
2446After his second evaluation, Dr. Fernandez summarized his
2454evaluation as follows:
2457There is no evidence at this time, of
2465substantial mental and motor impairment due
2471to oxygen deprivation sustained during labor
2477and delivery.
2479Oliver has made good progress with his fine
2487and gross motor skills and at this time,
2495there is no convincing evidence for
2501spasticity or cerebral palsy that was noted
2508earlier. There is no reaso n to an ticipate
2517any reversal or regression in his motor
2524skills, strength, or coordination.
2528Expressive speech development has been
2533delayed, but he is improving at a steady pace
2542and this trend should continue. Receptive
2548language skills are also improving s teadily.
2555Delay in speech and language skills, even
2562when improving, is sometimes an early
2568indicator of later learning difficulty in the
2575classroom setting. Whether or not this will
2582prove to be a problem for Oliver remains to
2591be determined. It is a potenti al problem
2599that should not be insurmountable with
2605appropriate input from his teachers.
261022. At the time of Dr. FernandezÓs examination on
2619October 15, 2013, Oliver was able to run without falling and had
2631no abnormality in his gait.
263623. Intervenor, Orange Park Medical Center, retained
2643Trevor Resnick, M.D. , to evaluate Oliver. He is board - certified
2654in pediatrics and neurology with a special competence in child
2664neurology. Dr. Resnick reviewed OliverÓs medical records and
2672examined Oliver. He opined OliverÓs staring spells and resulting
2681confusion were partial complex seizures. These seizures have not
2690been confirmed with a video EEG and have been witnesse d only by
2703his family. However, given the long history of these episodes,
2713more likely than not, the episod es are partial complex seizures.
272424 . When Oliver experiences a staring episode and resulting
2734confusion, he will return to his baseline condition and is able
2745to carry on with the activities previously described. The
2754episodes are transient in nature; thus, any physical or mental
2764impairment that occurs during the episode is not permanent.
277325. Dr. FernandezÓs opinion that Oliver does not have a
2783substantial, permanent physical and mental impairment is
2790credited.
2791CONCLUSIONS OF LAW
279426. The Division of Adminis trative Hearings has jurisdiction
2803over the parties to and the subject matter of this proceeding.
2814§§ 766.301 - 766.316, Fla. Stat. (2011).
282127. The Plan was established by the Legislature "to provide
2831compensation on a no - fault basis, for a limited class of
2843c atastrophic injuries that result in unusually high costs for
2853custodial care and rehabilitation." § 766.301 , Fla. Stat . The
2863Plan applies only to a birth - related neurological injury, which is
2875defined in section 766.302(2) as follows:
2881'Birth - related neurol ogical injury' means
2888injury to the brain or spinal cord of a live
2898infant weighing at least 2,500 grams for a
2907single gestation or, in the case of a multiple
2916gestation, a live infant weighing at least
29232,000 grams at birth caused by oxygen
2931deprivation or mech anical injury occurring in
2938the course of labor, delivery, or
2944resuscitation in the immediate postdelivery
2949period in a hospital, which renders the infant
2957permanently and substantially mentally and
2962physically impaired . This definition shall
2968apply to live bir ths only and shall not
2977include disability or death caused by genetic
2984or congenital abnormality. (emphasis added).
298928. The injured infant, her or his personal representative,
2998parents, dependents, and next of kin, may seek compensation under
3008the plan by filing a claim for compensation with DOAH.
3018§§ 766.302(3), 766.303(2), and 766.305(1) , Fla. Stat . The Florida
3028Birth - Related Neurological Injury Compensation Association, which
3036administers the Plan, has "45 days from the date of service of a
3049complete claim . . . in which to file a response to the petition
3063and submit relevant written information relating to the issue of
3073whether the injury is a birth - related neurological injury."
3083§ 766.305(4) , Fla. Stat .
308829. If NICA determines that the injury alleged in a claim is
3100a compensable birth - related neurological injury, it may award
3110compensation to the claimant, provided that the award is approved
3120by the Administrative Law Judge to whom the claim has been
3131assigned. § 766.305(7) , Fla. Stat . If, on the other hand, NICA
3143disputes the claim, as it has in the instant case, the dispute
3155must be resolved by the assigned Administrative Law Judge in
3165accordance with the provisions of chapter 120, Florida Statutes.
3174§§ 766.304, 766.309, and 766.31 , Fla. Stat .
318230. In discharg ing this responsibility, the Administrative
3190Law Judge must make the following determinations based upon all
3200available evidence:
3202(a) Whether the injury claimed is a birth -
3211related neurological injury. If the claimant
3217has demonstrated, to the satisfaction of the
3224administrative law judge, that the infant has
3231sustained a brain or spinal cord injury caused
3239by oxygen deprivation or mechanical injury and
3246that the infant was thereby rendered
3252permanently and substantially mentally and
3257physically impaired, a rebutt able presumption
3263shall arise that the injury is a birth - related
3273neurological injury as defined in s.
3279766.302(2).
3280(b) Whether obstetrical services were
3285delivered by a participating physician in the
3292course of labor, delivery, or resuscitation in
3299the imme diate postdelivery period in a
3306hospital; or by a certified nurse midwife in a
3315teaching hospital supervised by a
3320participating physician in the course of
3326labor, delivery, or resuscitation in the
3332immediate postdelivery period in a hospital.
3338§ 766.309(1), F la. Stat. An award may be sustained only if the
3351Administrative Law Judge concludes that the "infant has sustained
3360a birth - related neurological injury and that obstetrical services
3370were delivered by a participating physician at birth."
3378§ 766.31(1) , Fla. St at .
338431. The parties have stipulated that a participating
3392physician provided obstetric services at OliverÓs birth in a
3401hospital licensed in Florida. Oliver was born a live infant and
3412weighed more than 2,500 grams. NICA agrees that Oliver sustained
3423an in jury to the brain caused by oxygen deprivation during labor,
3435delivery, and resuscitation in the immediate post - delivery
3444resuscitation period. The issue to be determined is whether the
3454injury resulted in a permanent and substantial mental impairment
3463and a permanent and substantial physical impairment, inasmuch as
3472both are required to establish compensability. Fla. Birth - Related
3482Neurological Injury Comp. Ass'n v. Div. of Admin. Hearings , 686
3492So. 2d 1349 (Fla. 1997)(the Ð Birnie " decision).
350032. Petitioner ha s the burden to establish that the injury
3511Oliver sustained resulted in h im being rendered permanently and
3521substantially mentally and physically impaired.
3526§ 766.309(1)(a) , Fla. Stat . See also Balino v. Dep't of Health &
3539Rehab. Servs . , 348 So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he
3552burden of proof, apart from statute, is on the party asserting the
3564affirmative of an issue before an administrative tribunal.").
357333. The Legislature did not define "permanently and
3581substantially mentally and physically impaire d." However, those
3589terms should be read in the context of the legislation creating
3600the Plan. The Legislature intended that only a limited class of
3611catastrophic injuries be compensable under the Plan.
361834. In Matteini v. Florida Birth - Related Neurologica l Injury
3629Compensation Association , 946 So. 2d 1092, 1095 (Fla. 5th DCA
36392006), the court discussed the criteria for a physical impairment.
3649Under the Plan, a "physical impairment"
3655relates to the infant's impairment of his
"3662motor abnormalities" or "physical functions,"
3667which along with the brain injury
3673significantly affects the infant's mental
3678capabilities so that the infant will not be
3686able to translate his cognitive capabilities
3692into adequate learning or social development
3698in a normal manner.
370235. In Adve ntist Health System/Sunbelt, Inc. v. Florida
3711Birth - Related Neurological Injury Compensation Association , 865
3719So. 2d 561, 567 (Fla. 5th DCA 2004), the court in explaining the
3732Birnie decision stated: "[U]nder NICA, the identification of a
3741substantial mental impairment may include not only significant
3749cognitive deficiencies but can include, in a proper case,
3758additional circumstances such as significant barriers to learning
3766and social development."
376936. The child in the Birnie decision was found to have both
3781permanent and substantial mental and physical impairments,
3788although tests indicated that he was average or above average in
3799his cognitive skills and preacademic skills. The child in Birnie
3809is described as follows:
3813At the time of the hearing in this case, Eric
3823was 4 1/2 years old. He was unable to stand
3833up, walk, or crawl. His only method of
3841independent mobility was to roll over. The
3848use of his hands and arms was very limited.
3857He also had great difficulty talking and/or
3864communicating and he must take l ong pauses to
3873formulate a response to any inquiry.
3879Eric's brain dysfunction is permanent.
3884Because Eric's speech is greatly impacted by
3891his condition, it is virtually certain that he
3899will always be severely limited in his verbal
3907expression and other commu nication skills.
3913While continued therapy may help him to
3920communicate better and to become somewhat more
3927mobile, he will almost certainly never be able
3935to walk, feed, groom or toilet himself.
3942* * *
3945As a direct result of his injury, Eric will
3954not be a ble to communicate, attend school or
3963otherwise learn and develop intellectually
3968without substantial accommodation. His social
3973and vocational development have unquestionably
3978been significantly impaired.
3981688 So. 2d at 1352.
398637. There is a sharp contrast between Oliver and the child
3997in the Birnie decision. Oliver is able to walk, run, feed
4008himself, use his hands, and talk. Oliver should be able to
4019attend school and should be able to learn and to communicate.
403038. Petitioner has failed to establish that Oliver has a
