122STATEMENT OF TH E CASE
127On April 26, 2012, Petitioners, Dafne Quiroga and
135Alvaro Iriarte, individually and as parents and natural
143guardians of Alvaro Tadeo Iria r te Quiroga (Alvaro), a minor,
154filed a Petition Pursuant to Fla. Stat. §766.301 et seq.
164(Petition) with the Divi sion of Administrative Hearings (DOAH)
173for a determination of compensability under the Florida Birth -
183Related Neurological Injury Compensation Plan (Plan).
189The Petition named Gene Burkett, M.D.; Lesley de la Torre,
199M.D.; Sarah Jeffers, M.D.; Dr. Lewis, Dr. Del Valle; Dr. Gilles ;
210Dr. Toyama ; Dr. Frohoch, and Dr. Missair, as the physicians
220providing obstetric services at the onset of labor through the
230birth of Alvaro at Jackson Memorial Hospital in Miami, Florida.
240The Petition alleges that the named physicia ns were employed by
251the University of Miami , d/b/a University of Miami School of
261Medicine or The Public Health Trust of Miami - Dade County.
272DOAH served NICA with a copy of the Petition on May 23,
2842012. DOAH served copies of the Petition on Jackson Memorial
294Hospital and Drs. Frochock, Gilles, Toyam a , Lewis, Jeffers,
303Missair, De La Torre, Burkett, and Del Valle on May 24, 2012.
315Dr. Jeffers was also served a copy of the Petition by DOAH on
328June 29, 2012.
331On June 6, 2012, Dr. Burkett filed a Petition for Lea ve to
344Intervene, which was granted by Order dated June 19, 2012. On
355June 20, 2012, The Public Health Trust of Miami - Dade County ,
367d/b/a Jackson Health System filed a Petition for Leave to
377Intervene, which was granted by Order dated July 3, 2012. As of
389the date of this Summary Final Order of Dismissal, none of the
401other physicians have petitioned to intervene in this
409proceeding.
410On March 4, 2013, NICA filed a Motion for Summary Final
421Order, asserting that Alvaro did not sustain a "birth - related
432neurological injury" as that term is defined in section
441766.302(2), Florida Statutes. Petitioners have not filed a
449response to the motion and ha d previously taken the position
460that the injury to Alvaro is not compensable.
468By Order dated March 8, 2013, Dr. Burkett was given an
479extension of time in which to file a response to the Motion for
492Summary Final Order. On March 29, 2013, Dr. Burkett, filed a
503response to the Motion for Summary Final Order stating that he
514had no objection to the granting of the Motion for Summar y Final
527Order. On April 1, 2013, Public Health Trust of Miami - Dade
539County filed a response joining Dr. Burkett's response and
548stating that it had no objection to the granting of the Motion
560for Summary Final Order.
564FINDINGS OF FACT
5671. Alvaro Tadeo Iriart e Quiroga was born on May 31, 2007,
579at Jackson Memorial Hos pital in Miami, Florida. Alvaro weighed
5892,865 grams at birth.
5942. NICA retained Michael S. Duchowny, M.D., as its medical
604expert in pediatric neurology. Dr. Duchowny examined Alvaro and
613reviewed his medical records. Dr. Duchowny opined as follows:
622In summary, Alvaro's neurological
626examination reveals evidence of abnormal
631cranial configuration, speech dysarthria,
635short attention span, high activity level,
641inconsistent social visual regard, and
646limited social interaction. He manifests an
652expressive language delay. He also
657demonstrates fine motor incoordination.
661These findings are consistent with a
667diagnosis of pervasive developmental
671disorder (PDD) which does not constitute
677either a substantia l mental or motor
684impairment.
685A review of Alvaro's medical records
691indicates that he was born at 37 weeks
699gestation at Jackson Memorial Hospital with
705a birth weight of 2,865 gm. Cord Blood
714gases reveled [sic] significant acidosis and
720he did not get ox ygen for a prolonged period
730of time (23 minutes). He went on to
738evidence renal failure and liver dysfunction
744and had polcythemia and thrombocytopenia. A
750brain CT scan revealed partial
755craniosynostois of the anterior sagittal
760suture. Of note, Alvaro's MR I scan of the
769brain performed on June 7, 2007 showed no
777significant abnormalities.
779Despite his adverse perinatal
783circumstances, I do not believe that
789Alvaro's present neurological problems
793resulted from either mechanical injury or
799oxygen deprivation in the course of labor or
807delivery. Furthermore, he has neither a
813substantial mental nor motor impairment.
818For these reasons, I am not recommending
825Alvaro for compensation within the NICA
831program.
8323. A review of the file does not show any opinion contra ry
845to Dr. Duchowny's opinions Alvaro did not suffer a neurological
855injury due to oxygen deprivation or mechanical injury during
864labor or delivery and that Alvaro does not have a substantial
875and permanent mental and physical impairment due to lack of
885oxygen or mechanical trauma are credited.
891CONCLUSIONS OF LAW
8944. The Division of Administrative Hearings has
901jurisdiction over the parties to and the subject matter of these
912proceedings. §§ 766.301 - 766.316, Fla. Stat.
9195. The Plan was established by the Legis lature "for the
930purpose of providing compensation, irrespective of fault, for
938birth - related neurological injury claims" relating to births
947occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
9586. The injured infant, her or his personal represen tative,
968parents, dependents, and next of kin may seek compensation under
978the Plan by filing a claim for compensation with DOAH.
988§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
996which administers the Plan, has "45 days from the date of
1007s ervice of a complete claim . . . in which to file a response to
1023the petition and to submit relevant written information relating
1032to the issue of whether the injury is a birth - related
1044neurological injury." § 766.305(4), Fla. Stat.
10507. If NICA determines t hat the injury alleged in a claim
1062is a compensable birth - related neurological injury, it may award
1073compensation to the claimant, provided that the award is
1082approved by the administrative law judge to whom the claim has
1093been assigned. § 766.305(7), Fla. St at. If, on the other hand,
1105NICA disputes the claim, as it has in the instant case, the
1117dispute must be resolved by the assigned administrative law
1126judge in accordance with the provisions of chapter 120, Florida
1136Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
11448. In discharging this responsibility, the Administrative
1151Law Judge must make the following determination based upon the
1161available evidence:
1163(a) Whether the injury claimed is a birth -
1172related neurological injury. If the
1177claimant has demonstra ted, to the
1183satisfaction of the administrative law
1188judge, that the infant has sustained a brain
1196or spinal cord injury caused by oxygen
1203deprivation or mechanical injury and that
1209the infant was thereby rendered permanently
1215and substantially mentally and phys ically
1221impaired, a rebuttable presumption shall
1226arise that the injury is a birth - related
1235neurological injury as defined in s.
1241766.303(2).
1242(b) Whether obstetrical services were
1247delivered by a participating physician in
1253the course of labor, delivery, or
1259r esuscitation in the immediate postdelivery
1265period in a hospital; or by a certified
1273nurse midwife in a teaching hospital
1279supervised by a participating physician in
1285the course of labor, delivery, or
1291resuscitation in the immediate postdelivery
1296period in a hos pital.
1301§ 766.309(1), Fla. Stat. An award may be sustained only if the
1313administrative law judge concludes that the "infant has
1321sustained a birth - related neurological injury and that
1330obstetrical services were delivered by a participating physician
1338at birt h." § 766.31(1), Fla. Stat.
13459. The term "birth - related neurological injury" is defined
1355in section 766.302(2) as follows:
"1360Birth - related neurological injury" means
1366injury to the brain or spinal cord of a live
1376infant weighing at least 2,500 grams for a
1385single gestation or, in the case of a
1393multiple gestation, a live infant weighing
1399at least 2,000 grams at birth caused by
1408oxygen deprivation or mechanical injury
1413occurring in the course of labor, delivery,
1420or resuscitation in the immediate
1425postdelivery peri od in a hospital, which
1432renders the infant permanently and
1437substantially mentally and physically
1441impaired.
144210. The evidence, which is not refuted, established that
1451Alvaro did not sustain an injury to the brain or spinal cord
1463caused by oxygen deprivation or mechanical injury occurring in
1472the course of labor or delivery which resulted in substantial
1482and permanent mental and physical impairments. Therefore,
1489Alvaro is not eligible for benefits under the Plan.
1498CONCLUSION
1499Based upon the foregoing Findings o f Fact and Conclusions
1509of Law, it is ORDERED that the Petition filed by Dafne Quiroga
1521and Alvaro Iriarte, individually and as parents and natural
1530guardians of Alvaro Tadeo Iriarte Quiroga, is dismissed with
1539prejudice.
