109April Knill and Jeff ery Knill, individually and as parents,

119natural guardians, and personal representatives of the estate of

132STATEMENT OF THE CASE

136On May 17, 2012, Petitioners, filed a Petition for Benefits

146Pursuant to Section 766.301 et seq., Florida Statutes (Petition)

155with the Divis ion of Administrative Hearings (DOAH) for

164determination of compensability under the Florida Birth - Related

173Neurological Injury Compensation Plan (Plan). The Petition

180named Adrienne George, M.D., Azalea Women's Health Care as the

190physician providing obstetr ical services at the birth of Delaney

200at Tallahassee Memorial Hospital (TMH).

205DOAH provided the Florida Birth - Related Neurological Injury

214Compensation Association (NICA) and Dr. George with copies of

223the Petition on May 23, 2012. TMH was provided a copy o f the

237Petition by DOAH on May 24, 2012.

244On July 6, 2012, Dr. George and Azalea Women's Healthcare,

254P.A. (Azalea), filed a petition for leave to intervene, which

264was granted by Order dated July 20, 2012. On November 1, 2012,

276Tallahassee Memorial Healthcare , Inc. (TMH), filed an unopposed

284petition to intervene, which was granted by Order dated

293November 5, 2012.

296On October 29, 2012, Petitioners filed Petitioners' Motion

304for Summary Final Order. Petitioners filed Petitioners' Amended

312Motion for Summary Final Order on November 16, 2012. NICA and

323Intervenors filed responses, objecting to the language in

331paragraph 6e. of the amended motion. The amended motion was

341heard by telephonic conference call on December 17, 2012.

350Petitioners withdrew the language in par agraph 6e. All parties

360are in agreement that Delaney suffered a birth - related

370neurological injury which resulted in her death.

377FINDINGS OF FACT

3801. Delaney Knill was born on April 10, 2009, at TMH in

392Tallahassee, Florida. She weighed 3,744 grams at birt h.

4022. Delaney was delivered by Cesarean section by

410Dr. George. April Knill was diagnosed with uterine rupture,

419which resulted in a loss of oxygen to Delaney's brain during

430labor, delivery, and continuing into the immediate post delivery

439period. The oxygen deprivation was severe, resulting in brain

448death. Delaney was pronounced dead on April 14, 2009.

4573. At the time of Delaney's birth, Dr. George was employed

468by Azalea and was a participating physician as that term is

479defined in section 766.302. Dr. George and Azalea provided

488notice required by section 766.316 on August 28, 2008. TMH

498provided notice as required by section 766.316 on April 1, 2009.

509CONCLUSIONS OF LAW

5124. The Division of Administrative Hearings has

519jurisdiction over the parties to and the subject matter of these

530proceedings. §§ 766.301 - 766.316, Fla. Stat.

5375. The Plan was established by the Legislature "for the

547purpose of providing compensation, irrespective of fault, for

555birth - related neurological injury claims" relating to bi rths

565occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

5766. The injured infant, her or his personal representative,

585parents, dependents, and next of kin may seek compensation under

595the Plan by filing a claim for compensation with DOAH.

605§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

613which administers the Plan, has "45 days from the date of

624service of a complete claim . . . in which to file a response to

639the petition and to submit relevant written information relating

648to th e issue of whether the injury is a birth - related

661neurological injury." § 766.305(4), Fla. Stat.

6677. If NICA determines that the injury alleged in a claim

678is a compensable birth - related neurological injury, it may award

689compensation to the claimant, provi ded that the award is

699approved by the administrative law judge to whom the claim has

710been assigned. § 766.305(7), Fla. Stat.

7168. In discharging this responsibility, the Administrative

723Law Judge must make the following determination based upon the

733avai lable evidence:

736(a) Whether the injury claimed is a birth -

745related neurological injury. If the

750claimant has demonstrated, to the

755satisfaction of the administrative law

760judge, that the infant has sustained a brain

768or spinal cord injury caused by oxygen

775dep rivation or mechanical injury and that

782the infant was thereby rendered permanently

788and substantially mentally and physically

793impaired, a rebuttable presumption shall

798arise that the injury is a birth - related

807neurological injury as defined in s.

813766.303(2).

814(b) Whether obstetrical services were

819delivered by a participating physician in

825the course of labor, delivery, or

831resuscitation in the immediate postdelivery

836period in a hospital; or by a certified

844nurse midwife in a teaching hospital

850supervised by a pa rticipating physician in

857the course of labor, delivery, or

863resuscitation in the immediate postdelivery

868period in a hospital.

872§ 766.309(1), Fla. Stat. An award may be sustained only if the

884administrative law judge concludes that the "infant has

892sustained a birth - related neurological injury and that

901obstetrical services were delivered by a participating physician

909at birth." § 766.31(1), Fla. Stat.

9159 . The term "birth - related neurological injury" is defined

926in section 766.302(2) as follows:

"931Birth - relate d neurological injury" means

938injury to the brain or spinal cord of a live

948infant weighing at least 2,500 grams for a

957single gestation or, in the case of a

965multiple gestation, a live infant weighing

971at least 2,000 grams at birth caused by

980oxygen deprivation or mechanical injury

985occurring in the course of labor, delivery,

992or resuscitation in the immediate

997postdelivery period in a hospital, which

1003renders the infant permanently and

1008substantially mentally and physically

1012impaired.

10131 0 . The evidence, which is no t refuted, established that

1025Delaney sustained a birth - related neurological injury, which

1034resulted in her death. Petitioners' claim is compensable under

1043the Plan.

1045CONCLUSION

1046Based upon the foregoing Findings of Fact and Conclusions

1055of Law, it is

1059ORDERED that the injuries sustained by Delaney Knill are

1068compensable under the NICA Plan.

1073It is further ORDERED that the parties are accorded 30 days

1084from the date of this Order to resolve, subject to approval of

1096the Administrative Law Judge, the amount and manner of payment

1106of an award to Petitioners ; the reasonable expenses incurred in

1116connection with the filing of the claim, including reasonable

1125attorney's fees and costs; and the amount owing for expenses

1135previously incurred. If not resolved within such period, the

1144parties shall so advise the Administrative Law Judge, and a

1154hearing will be scheduled to resolve such issues. Once

1163resolved, an award will be made consistent with section 766.31.

1173It is further ORDERED that in the event Petitioners file an

1184election of remedies declining or rejecting NICA benefits, this

1193case will be dismissed and DOAH's file will be closed.

1203DONE AND ORDERED this 20th day of December , 2012 , in
