190STATEMENT OF THE ISSUES

194The issues to be determined in this case are whether

204Petitioner Highway 60 and 301 Center, Inc., has standing to

214challenge the proposed Environmental Resource Permit issued to

222Resp ondent Big Bend Center, LLC , by Respondent Southwest Florida

232Water Management District ("District"), and, if so, whether Big

243Bend Center is entitled to issuance of the proposed permit.

253PRELIMINARY STATEMENT

255On January 11, 2012, the District issued Environm ental

264Resource Permit 44003983.007 to Big Bend Center. Petitioner

272filed a petition for hearing to challenge the permit and the

283District referred the matter to DOAH to conduct an evidentiary

293hearing and issue a recommended order. The District

301subsequently approved two modifications to the permit, denoted

309by .008 and .009. Petitioner was twice granted leave to amend

320its petition and the case proceeded as a challenge to the .009

332modification.

333Respondent Enterprise Holdings filed a motion to dismiss

341the peti tion for hearing on the basis that Petitioner lacked

352standing to challenge the permit. The motion was denied, but

362the case was bifurcated so that the issue of standing would be

374the sole issue to be addressed by the parties on January 24,

3862013. Following the hearing on standing, the parties were

395provided an opportunity to submit the transcript of the hearing

405and proposed recommended orders on the issue of Petitioner's

414standing.

415At the hearing, Petitioner presented the testimony of

423Clifford Laubstein, P.E., who was accepted as an expert in civil

434engineering. Petitioner Exhibits 1 and 2 were admitted into

443evidence. Enterprise Holdings presented the testimony of

450Steven Boggs, P.E., who was accepted as an expert in civil

461engineering. Enterprise Exhibits 12 a nd 13 were admitted into

471evidence. The District presented the testimony of

478Scott Hickerson, P.E., who was accepted as an expert in civil

489engineering. District Exhibits 2 - 4 were admitted into evidence.

499Big Bend presented no testimony or exhibits.

506The one - volume Transcript of the hearing on standing was

517filed with DOAH and the parties submitted proposed recommended

526orders that were carefully considered in the preparation of this

536Recommended Order of Dismissal.

540FINDINGS OF FACT

543The Parties

5451. Petitioner ow ns real property located at 105 U.S.

555Highway 301 South, in Tampa, which Petitioner leases to

564commercial businesses.

5662. Respondent Big Bend Center owns real property located

575at 110 U.S. Highway 301 South, which is across Highway 301 from

587Petitioner's prope rty. Big Bend Center is named in the

597District's agency action and is the permittee.

6043. The site affected by the proposed permit modification

613is about 2.5 acres in size. It is part of a larger development

626owned by Big Bend Center, encompassing about 30 a cres.

6364. The 30 - acre site was the subject of a permit issued by

650the District in 1988. The 1988 permit approved a master

660drainage plan applicable to all 30 acres. The permit

669modifications discussed herein are modifications to this initial

677permit.

6785. Res pondent Enterprise Holdings leases the 2.5 - acre site

689at 110 U.S. Highway 301 South, which Enterprise uses for the

700operation of a car and truck rental business.

7086. When Petitioner filed its petition with the District,

717it named Enterprise Holdings, Inc. , as a Respondent, even though

727Enterprise Holdings was not named in the permit. Neither

736Petitioner nor the District ever questioned the right of

745Enterprise Holdings to participate as a party.

7527. Respondent Southwest Florida Water Management District

759is the a dministrative agency charged with the responsibility to

769administer and enforce chapter 373, Florida Statutes, and the

778rules promulgated pursuant thereto in Florida Administrative

785Code Chapter 40D.

788The Permit

7908. The petition for hearing challenged the Dist rict's

799approval of a proposed permit designated 44003983.007. The

807permit authorized the construction of a building over existing

816pavement and the addition of a dumpster pad. After the petition

827for hearing was filed, Big Bend Center requested and the

837Dist rict approved a modification , designated .008, which

845included the .007 changes and, in addition, authorized the

854construction of a section of sidewalk and landscape islands in

864the parking lot. Enterprise then requested and the District

873approved another mod ification , .009, which authorized all the

882changes addressed in .008 and, in addition, authorized changes

891to the paved parking lot.

896Standing

8979. Petitioner contends that proposed permit, modification

904.009 , would injure Petitioner because the authorized chan ges

913would result in flooding of Highway 301 that could reach

923Petitioner's property or, even if it did not reach that far,

934would interfere with traffic on Highway 301 in a manner that

945would disrupt Petitioner's business.

94910. The sole factual allegation upo n which Petitioner

958bases its claim of flooding is that the previously - installed

969pipes that convey runoff to a retention pond may be too small;

981smaller than was required by Big Bend Center's 1988 permit.

991Petitioner's expert, Clifford Laubstein, stated that a boundary

999s urvey in the permit file shows two 18 - inch diameter pipes

1012connected to a 24 - inch diameter pipe. Big Bend Center's 1988

1024permit required these pipes to be 24 inches and 30 inches,

1035respectively.

103611. Laubstein admitted that the "as built" constr uction

1045drawings that were submitted to the District by Big Bend Center

1056after the construction of the master drainage system certifies

1065that the pipes are the required, larger size.

107312. Laubstein did not have firsthand knowledge of the size

1083of the pipes. H e did not know which document was correct, the

1096survey or the as built drawings. His position was simply that

1107if the survey information was correct, Big Bend Center's

1116stormwater system would fail to function properly and flooding

1125could occur. Laubstein di d not know whether the system had

1136failed to function properly in the past or had ever caused

1147flooding.

114813. Laubstein did not determine what storm event or volume

1158of runoff would result in flooding of Highway 301, or the extent

1170of flooding that would occur under various storm events.

117914. Because as built constructions drawings are prepared

1187by an engineer and submitted to the District for the very

1198purpose of certifying that a system has been constructed in

1208accordance with the requirements of the permit, inf ormation in

1218the as built drawings about components of the system would

1228generally be more reliable than such information in a survey

1238that was prepared for another purpose.

124415. Furthermore, Enterprise's expert witness, Steve Boggs,

1251measured the pipes and de termined they were 24 and 30 inches, as

1264required by the permit.

126816. By refuting Petitioner's claim that the pipes "may" be

1278undersized, Respondents refuted Petitioner's claim that Highway

1285301 or Petitioner's property "may" be flooded if the proposed

1295permit modification is issued by the District.

130217. The stormwater system for the proposed project is

1311properly sized to handle the stormwater runoff.

131818. Petitioner failed to meet its burden to prove by a

1329preponderance of the evidence that it could be injured b y the

1341proposed permit modification.

1344CONCLUSIONS OF LAW

134719. A person or other entity not named in the agency

1358action that is challenged cannot be forced to participate simply

1368by being named in the petition as a respondent. An

1378a dministrative hearing is not like a civil action where everyone

1389sued by a plaintiff is thereby made a party - defendant. The

1401better procedure in this case would have been for Enterprise

1411Holdings to file a petition to intervene.

141820. However, because Petitioner named Enterprise Holdings

1425as Respondent and acquiesced in Enterprise Holdings'

1432participation as a full party, any objection available to

1441Petitioner on this point was waived. The Administrative Law

1450Judge grants Enterprise Holdings the right to participate as

1459Respondent.

146021. In or der to have standing to initiate a proceeding

1471under section 120.57, Florida Statutes, P etitioner must show (1)

1481it Ðwill suffer injury in fact which is of sufficient immediacy

1492to entitle him to a hearing,Ñ and, (2) that the Ðsubstantial

1504injury is of a type or nature which the proceeding is designed

1516to protect.Ñ Agrico Chem. Co. v. DepÓt of Envtl. Reg . , 406 So.

15292d 478, 482 (Fla. 2d DCA 1981).

153622. The injury or threat of injury must be real and

1547immediate, not conjectural or hypothetical. Village Park Mobile

1555Homes AssÓn, Inc. v. State, DepÓt of Bus. Reg . , Div. of F la.

1569Land Sales , 506 So. 2d 426, 433 (Fla. 1st DCA 1987).

158023. Petitioner failed to demonstrate its standing because

1588it failed to show a real and immediate threat of injury from the

1601proposed permit m odification.

1605RECOMMENDATION

1606Based on the foregoing Findings of Fact and Conclusions of

1616Law, it is

1619RECOMMENDED that the District dismiss the petition and

1627issue Environmental Resource Permit 44003983.009.
