141STATEMENT OF THE ISSUE
145The issue in this case is whether Respondents, The Fourth
155Bayshore Condominium Association, Inc. (ÐBayshoreÑ), Karl
161Stemmler (ÐStemmlerÑ), and/or Richard Grove (ÐGroveÑ),
167discriminated against Petitioner, Robert Pagano (ÐPagano"), on
175the basis of his physical handicap in violation of the Florida
186Fair Housing Act.
189PRELIMINARY STATEMENT
191Pagano filed a Housing Discrimination Complaint with the
199Florida Commission on Human Relations (the ÐCommissionÑ) on or
208about April 20, 2 0 12. The Commission entered a Notice of
220Determination of No Cause dated June 6, 2012. A copy of the
232Determination was sent to Pagano via certified mail. Pagano
241then filed a Petition for Relief with the Commission dated
251June 21, 2012. A copy of the Peti tion was forwarded to the
264Division of Administrative Hearings ("DOAH") on June 28, 2012.
275At the final hearing, Pagano testified on his own behalf
285and offered six exhibits, each of which was admitted into
295evidence. Bayshore and Grove called two witnesses : Richard
304Grove and Jerald Van Buren, p resident of Bayshore. 1/ Bayshore's
315Exhibits 1 and 2 , were admitted into evidence. Stemmler did not
326testify or offer any exhibits into evidence. 2/
334The parties advised that a transcript of the final hearing
344would not be ordered. By rule, parties were allowed ten days
355from the final hearing to submit proposed recommended orders
364(PROs). The PROs were due on or before September 4, 2012. Each
376party timely filed a PRO and each was considered in the
387preparation of this R ecommended Order.
393FINDINGS OF FACT
3961. Pagano is a Caucasian male who is handicapped by virtue
407of medical complications which resulted in the amputation of his
417left leg in March 2008. He has been confined to a wheelchair
429since that time. At all times re levant hereto, Pagano was
440renting a condominium unit at Bayshore.
4462. In January 2012 , Pagano saw another unit at Bayshore
456advertised for rent. He called Grove, listed as the owner of
467the unit, and inquired about renting the property. Grove told
477Pagano t hat a key to the unit would be left under a mat between
492the screen door and front door on January 19, 2012. On that
504day, Pagano went to inspect the unit, accompanied by a friend,
515Philip Saglimebene.
5173. Upon arrival at the unit, Pagano and his friend bega n
529looking for the hidden key , but could not find it. They
540apparently made some noise while searching for the key, because
550they were confronted by Stemmler. According to Pagano, Stemmler
559began asking them in unfriendly terms who they were and what
570they we re doing at the unit. The friend then told Stemmler they
583were looking for a key so they could go in and inspect the unit
597as Pagano was interested in renting it from Grove.
6064. Stemmler , supposedly identif ying himself as a Ðbuilding
615representative , Ñ said t here was no key to be found. He also
628reputedly told Pagano and his friend that they would not need a
640key anyway , Ðbecause you are not moving in.Ñ When the friend
651explained that the unit was for Pagano, not him, Stemmler
661allegedly said that Pagano was not moving in either because he
672was an Ðundesirable.Ñ When asked to explain that comment,
681Stemmler purportedly said, ÐHe just is; thatÓs all you need to
692know.Ñ (None of StemmlerÓs comments were verified by competent
701evidence and, without verification or sup port, cannot be relied
711upon to make a finding of fact in this case.)
7215. Pagano believes StemmlerÓs purported comments were
728based on the fact that he (Pagano) has long hair and a beard and
742does not fit into the conventional norm at Bayshore. He also
753belie ves that his handicap served as a basis for StemmlerÓs
764alleged comments. There was no credible evidence presented at
773final hearing to substantiate PaganoÓs suppositions.
7796. Grove had put his condominium unit up for rent at the
791beginning of the year. W hen Pagano called to inquire about it,
803Grove Î who lives out - of - state Î notified a friend to leave a
819key under the mat , as described above. That friend simply
829forgot to leave a key at the unit on the designated date. Grove
842knew nothing about PaganoÓs int eraction with Stemmler. Grove
851had not spoken to Stemmler prior to the day he and Pagano had
864their interaction. Stemmler had no authority to speak for Grove
874or to make a decision concerning to whom Grove would rent his
886condominium unit.
8887. Subsequent t o the day Pagano visited the unit, Grove
899took the unit off the rental market because his wife decided to
911use the unit to house family and friends rather than renting it
923out to someone else. It took several weeks for the rental
934advertisement for the unit t o be removed from a locked bulletin
946board at Bayshore.
9498. Grove said that if the unit ever went back on the
961market, he would call Pagano first about renting it, i.e., Grove
972had no opposition whatsoever to Pagano Ós being a tenant.
9829. Van Buren, presid ent of Bayshore, explained that the
992condominium association utilizes the support of voluntary
999building representatives to assist with security and minor
1007maintenance at Bayshore. The volunteers, who are generally
1015seasonal residents at Bayshore, do not hold keys to individual
1025units and have no authority to grant or deny an applicantÓs
1036request to rent a unit. Stemmler is one of many building
1047representatives who resides part - time at Bayshore.
105510. Pagano does not know of any non - handicapped individual
1066who was allowed to rent a unit at Bayshore to the exclusion of
1079himself or any other handicapped person. In fact, Pagano
1088currently resides in another unit at Bayshore; he is already a
1099resident there.
1101CONCLUSIONS OF LAW
110411. The Division of Administrative Hearings has
1111jurisdiction over the parties to and the subject matter of this
1122proceeding pursuant to s ections 120.569 and 120.57(1), Florida
1131Statutes (2012). Unless specifically stated otherwise herein,
1138all references to the Florida Statutes shall be to the 2012
1149c odification.
115112. Florida's Fair Housing Act (the "Act") is codified in
1162s ections 760.20 through 760.37, Florida Statutes. Section
1170760.23, Florida Statutes, reads in pertinent part:
1177Discrimination in the sale or rental of
1184housing and other prohibited pract ices. Î

11942) It is unlawful to discriminate against
1201any person in the terms, conditions, or
1208privileges of sale or rental of a dwelling,
1216or in the provision of services or
1223facilities in connection therewith, because
1228of race, color, national or igin, sex,
1235handicap, familial status, or religion.
124013. Petitioner has the burden of proving by a
1249preponderance of the evidence that Bayshore, Stemmler , or Grove
1258violated the Act by discriminating against Pagano based on his
1268disability , as set forth in hi s complaint. §§ 120.57(1)(j) and
1279760.34(5), Fla . Stat .
128414. Pagano testified that he was ready, able , and willing
1294to rent the disputed condominium unit and that he was a member
1306of a protected class. He was, he felt, prevented from renting
1317the unit becaus e of discrimination. Pagano established a prima
1327facie case for discrimination.
133115. As shown, Stemmler had no authority whatsoever to make
1341a decision about PaganoÓs rental of the unit. Thus, any action
1352he took is irrelevant to this inquiry. Grove proved that he did
1364nothing other than offer to show Pagano his unit, but that a
1376mistake was made about the key. Bayshore, which already leases
1386a unit to Pagano, took no adverse action whatsoever against
1396Pagano.
139716. There is no persuasive evidence that PaganoÓs handicap
1406was a factor in any decision made concerning his desire to rent
1418the condominium unit. While it is clear that Pagano believes in
1429his heart that he was discriminated against, there is no
1439evidence to support his contention.
1444RECOMMENDATION
1445Based on the foregoing Findings of Fact and Conclusions of
1455Law, it is RECOMMENDED that a final order be entered by the
1467Florida Commission on Human Relations dismissing the Petition
1475for Relief filed by Robert Pagano in its entirety.
