100STATEMENT OF THE ISSUE
104Whether Respondent, Home Depot, is liable to Petiti oner for
114unlawful discrimination in employment based on race , in
122violation of the Florida Civil Rights Act of 1992, sections
132760.01 - 760.11 and 509.092, Florida Statutes.
139PRELIMINARY STATEMENT
141The final hearing was originally scheduled to be held on
151October 5, 2012. On September 17, 2012, PetitionerÓs counsel
160filed an Unopposed Motion for Continuance which represented he
169was filing a notice of appearance on behalf of Petitioner and
180wished to discuss settlement with Respondent. The case was
189placed in abeyan ce to allow settlement discussions.
197On October 22, 2012, Petitioner, through counsel, filed a
206Notice of Failure to Settle and requested the case be set for
218hearing. The case was set for hearing on December 19, 2012,
229after consultation with the parties as to available dates. The
239Order Re - Scheduling Hearing by Video Teleconference was entered
249on November 5, 2012, and provided to all parties. The Order
260clearly states ÐContinuances will be granted only by order of
270the Administrative Law Judge for good cause shown.Ñ
278On December 18, 2012, at 3:54 p.m., PetitionerÓs counsel
287filed a Motion for Continuance stating as grounds Ðhe has been
298unable to contact Plaintiff, Brendale Fields, until recently.Ñ
306The Motion was opposed by Respondent. The undersigned denied
315th e Motion and PetitionerÓs counsel was notified of the denial
326via telephone, since the late - filing did not allow a written
338order to be entered prior to the scheduled hearing. Respondent
348was informed that the Motion was denied when RespondentÓs
357counsel cont acted the Division to determine whether the hearing
367would go forward.
370The hearing commenced as scheduled on December 19, 2012, by
380video teleconference in Tallahassee and Jacksonville, Florida.
387FINDINGS OF FACT
3901 . Petitioner did not attend the final hearin g.
4002 . PetitionerÓs counsel appeared at the final hearing and
410moved for c ontinuance ore tenus , stating that Petitioner was
420taking a final exam and that neither Petitioner nor her counsel
431was aware the exam date conflicted with the hearing date when
442the h earing was set.
4473 . Respondent, who had traveled from Orlando to attend the
458final hearing , opposed PetitionerÓs Motion .
4644 . Upon consideration of PetitionerÓs Motion, RespondentÓs
472argument against a continuance, the fact that there was no
482emergency, and the motion was untimely under Florida
490Administrative Code Rule 28 - 106.210 (ÐExcept in cases of
500emergency, requests for continuance must be made at least five
510days prior to the date noticed for the hearingÑ), as well as the
523circumstances outlined above, Pet itionerÓs Motion for
530Continuance was DENIED.
5335 . Following the denial of PetitionerÓs Motion for
542Continuance, PetitionerÓs counsel stated that Petitioner was his
550only witness. PetitionerÓs counsel offered no evidence into the
559record.
560CONCLUSION S OF LAW
5646 . The Division of Administrative Hearings has
572jurisdiction over the parties to and the subject matter of this
583proceeding pursuant to section 120.569 and subsection 120.57(1),
591Florida Statutes, and Florida Administrative Code Rule 60Y -
6004.016(1).
6017 . Because P etitioner is asserting the affirmative in this
612administrative proceeding, she has the burden of proving her
621claim against Respondent. Fla. Dep't of Transp. v . J.W.C. Co.,
632Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).
6418 . As no evidence was presented to suppor t her claim,
653Petitioner failed to meet her burden.
659RECOMMENDATION
660Based upon the foregoing , and Petitioner having failed to
669meet her burden of proof, it is
676RECOMMENDED:
677That the Florida Commission on Human Relations enter an
686order dismissing this ca se.
