83This cause came on for consideration pursuant to sections

92766.304 and 766.305(7), Florida Statutes, upon the Stipulation

100and Joint Petition for Compensation of Claim Arising out of

110Florida Birth - Related Neurological Injury Pursuant to Chapter 766,

120Flori da Statutes (Stipulation and Joint Petition), filed with the

130Division of Administrative Hearings on March 22 , 2013, for the

140entry of an order approving the resolution of a claim for

151compensation benefits filed in accordance with the provisions of

160chapter 7 66 and a resolution of the exclusive remedy otherwise

171available as outlined in chapter 766.

177By the terms of their stipulation, Petitioners,

184Jessica Conover and Cliff Conover, individually, and as parents

193and next friends of Alexander Conover (Alexander), a minor;

202Respondent, the Florida Birth - Related Neurological Injury

210Compensation Association (NICA); and Intervenors, Bayfront

216Medical Center, Inc. , and Elena Dolskaya, M.D. (collectively, the

225Parties) , have agreed that Jessica Conover and Cliff Conover are

235the parents and legal guardians of Alexander, a minor; that

245Alexander was born a live infant on February 20, 2012, at

256Bayfront Medical Center, a ÐhospitalÑ as defined by section

265766.302(6) located in St. Petersburg, Florida; and that

273Alexander's birth wei ght was 2 , 860 grams. The Parties have

284further agreed that Dr. Dolskaya, provided obstetrical services

292at Alexander's delivery and was a Ðparticipating physicianÑ in

301the Florida Birth - Related Neurological Injury Compensation Plan

310(Plan), as defined by sect ion 766.302(7). The Parties have

320agreed that Alexander suffered a Ðbirth - related neurological

329injury,Ñ as that term is defined by section 766.302(2), which was

341the sole and proximate cause of Alexander's permanent and

350substantial mental and physical impai rments.

356Paragraph 12 of the Joint Stipulation and Petition provides:

365The Petitioners disagree as to NICA's

371interpretation of Section 766.31(1)(b)1,

375Florida Statutes, with respect to the payment

382of the parental award. Section

387766.31(1)(b)1, Florida Stat utes, states:

392Periodic payments of an award to

398the parents or legal guardians

403of the infant found to have

409sustained a birth related

413neurological injury, which award

417shall not exceed $100,000.

422However, at the discretion of the

428administrative law judge , such

432award may be made in a lump sum.

440The issues on which the Parties disagree are

448whether Section 766.31(1)(b)1, Florida

452Statutes, only entitles two parents to a

459single parental award of $100,000 in the

467aggregate, and, if so, whether that statute

474is co nstitutional. At this time, those

481issues are currently pending before the

487Florida Supreme Court in Samples v. NICA (SC

49510 - 1295). The Parties to the instant case

504request that this case be abated only with

512regard to the above issues until a decision

520is rea ched in Samples , so that the

528Administrative Law Judge may later award

534Petitioners a second $100,000 parental award

541if the Samples case should determine that

548Section 766.31(1)(b)1 entitles them to it, as

555well as any attorney fees and costs that may

564be due i n connection with the second parental

573award.

574It is ORDERED:

5771. The Stipulation and Joint Petition filed on March 22,

5872013, is hereby approved, and the Parties are directed to comply

598with the provisions of the Stipulation and Joint Petition.

6072. Petitio ners, Jessica Conover and Cliff Conover, as the

617parents and legal guardians of Alexander, a minor, are awarded one

628hundred thousand dollars ($100,000.00), pursuant to section

636766.31(1)(b)1, to be paid as a lump sum; payment of benefits up to

649and including the effective date of the Joint Stipulation and

659Petition pursuant to section 766.31(1)(a), subject to the

667provisions of paragraph 20 of the Stipulation and Joint Petition;

677and payment of future expenses as incurred.

6843. Respondent shall pay the McMillen La w Firm, A

694Professional Association, attorneys for Petitioners, T en thousand

702dollars ($10,000.00) for attorney's fees and S ix hundred thirty -

714five dollars and thirty - one cents ($635.31) for expenses, totaling

725T en thousand six hundred thirty - five dollars and thirty - one cents

739($10,635.31) in full, for services rendered in the filing of

750Petitioners' claim.

7524. Upon the payment of the award of $100,000.00, attorney's

763fees and other expenses totaling $10,635.31 incurred in connection

773with the filing of this cla im, and past benefit/expenses, the

784claims of Petitioners shall be deemed fully satisfied and

793extinguished, except for the issues reserved in paragraph 12 of

803the Joint Stipulation and Petition and Respondent's continuing

811obligation under section 766.31(2) t o pay future expenses as

821incurred.

8225. The Division of Administrative Hearings retains

829jurisdiction over this matter to resolve any disputes, should they

839arise, regarding the partiesÓ compliance with the terms of this

849Order and the issues reserved in parag raph 12 of the Joint

861Stipulation and Petition.
