44This cause has come before the undersigned on the parties '

124STATEMENT OF THE ISSUE
128The issue to be determined is the amount of attorney s' fees
140and co sts to be awarded to Petitioner pursuant to section
151120.595(4 ), Florida Statutes (2011).
156PRELIMINARY STATEMENT
158This is an action for attorneys' fees and costs following a
169successful challenge by Petitioner to a statement defined as a
179rule but not adopted as such, in violation of section 120.54,
190Florida Statutes. I n Case No. 12 - 1201RU, a Final Order was
203issued on July 5, 2012 , holding that the statement of the Office
215of Insurance Regulation challenged by Premier constituted an
223unadopted rule. The Final Order retained jurisdiction to
231determine the amount of attorney s' fees and costs to be awarded
243to Petitioner, and directed that any motion seeking fees and
253costs must be filed within 60 days.
260On September 4, 2012, Petitioner filed a Motion for the
270Determination of Amoun t of Attorney's Fees and Costs. On
280Septemb er 11, 2012, a new case number, Case No. 12 - 2938F, was
294assigned to address the amount of the attorney s ' fees.
305On September 13, 2012, an Order was entered directing
314Petitioner to file an itemized statement listing the fees and
324costs for which it seeks reim bursement no later th an October 3,
3372012, and providing a timeline for responses thereto and for
347providing dates for hearing.
351On October 2, 2012, the parties filed a Stipulation as to
362Attorney's Fees, along with a Stipulated Final Order. Based on
372the stip ulation of the parties, the following findings of fact
383and conclusions of law are made:
389FINDINGS OF FACT
3921. Petitioner, Premier Group Insurance Company
398("Premier"), filed a challenge to an agency statement that had
410not been adopted as a rule in Premier G roup Insurance Company v.
423Office of Insurance Regulation and Financial Services
430Commission , DOAH Case No. 12 - 1201RU (Fla. DOAH July 5, 2012).
4422. A Final Order was entered finding that the statement of
453the Office with respect to the allowance of federal i ncome taxes
465as an expense for excess profits reporting was an unadopted
475rule.
4763. Premier was the prevailing party i n Case No. 12 - 1201RU.
4894. As detailed more thoroughly in the Final Order in Case
500No. 12 - 1201RU, the Office was on notice that the agency
512statement may constitute an unadopted rule for substantially
520more than 30 days preceding the filing of the Petition in that
532case.
5335 . Premier incurred attorneys' fees and costs in its
543challenge to the Office's agency statement in excess of $50,000 .
5556 . The parties have agreed that $50,000 .00 in attorney s '
569fees shall be awarded to Premier.
575CONCLUSIONS OF LAW
5787 . The Division of Administrative Hearings has
586jurisdiction over the subject matter and the parties to this
596action in accordance with se ctio ns 120.569 and 120.57(1),
606Florida Statutes (2012).
6098 . Section 120.595(4), Florida Statutes, provides in
617pertinent part:
619(4) CHALLENGES TO AGENCY ACTION PURSUANT TO
626SECTION 120.56(4). --
629(a) If the appellate court or
635administrative law judge determi nes that all
642or part of any agency statement violates s.
650120.54(1)(a), or that the agency must
656immediately discontinue reliance on the
661statement and any substantially similar
666statement pursuant to section 120.56(4)(e),
671a judgment or order shall be entered against
679the agency for reasonably costs and
685reasonable attorney's fees, unless the
690agency demonstrates that the statement is
696required by the Federal Government to
702implement or retain a delegated or approved
709program or to meet a condition to receipt of
718fede ral funds.
721(b) . . . The administrative law judge shall
730award reasonable costs and reasonable
735attorney's fees accrued by the petitioner
741prior to the date the notice was published,
749unless the agency proves to the
755administrative law judge that it did not
762kn ow and should not have known that the
771statement was an unadopted rule. Attorney's
777fees and costs under this paragraph and
784paragraph (a) shall be awarded only upon a
792finding that the agency received notice that
799the statement may constitute an unadopted
805rul e at least 30 days before a petition
814under section 120.56(4) was filed and that
821the agency failed to publish the required
828notice of rulemaking pursuant to section
834120.54(3) that addresses the statement
839within that 30 - day period. . . . An award of
851attorney' s fees as provided by this
858paragraph may not exceed $50,000.
8649. Premier is entitled to attorney's fees and costs
873pursuant to section 120.595(4).
87710. The parties have stipulated that Premier is entitled
886to an award of $50,000 .00 , the maximum amoun t allowed pursuant
899to section 120.595(4). The undersigned concludes that the
907amount of the award is reasonable.
913Accordingly, it is
916ORDERED that Petitioner, Premier Group Insurance Company,
923is hereby awarded the sum of $50,000.00 in attorney's fees an d
936costs. The above sum is to be paid by Respondent, as provided
948in the parties' stipulation, on or before the 60th day following
959the entry of this Final Order.
