82This cause came on for consideration upon a Motion for
92Summary Final Order filed by Respondent, Florida Birth - Related
102Neurological Injury Compensation Association (NICA), on March 4,
1102013.
111STATEMENT OF THE CASE
115On October 4, 2012, Petitioner, Valerie Gonzalez, on b ehalf
125of and as parent and natural guardian of Jordan Gonzalez
135(Jordan), a minor, filed a Petition Under Protest Pursuant to
145Florida Statute Section 766.301 et seq. (Petition) with the
154Division of Administrative Hearings (DOAH) for a determination
162of compe nsability under the Florida Birth - Related Neurological
172Injury Compensation Plan (Plan). The Petition named
179Ramon Hechavarri a , M.D., as the physician providing obstetric
188services at the birth of Jordan at North Shore Medical Center in
200Miami, Florida.
202DOAH served NICA with a copy of the Petition on October 10,
2142012. DOAH served copies of the Petition on North Shore Medical
225Center and Dr. Hechavarri a on October 12, 2012.
234On November 27, 2012, Tenet Healthsystem North Shore, Inc.,
243d/b/a North Shore Medical Center filed a petition to intervene,
253which was granted by Order dated December 14, 2013.
262On March 4, 2013, NICA filed a Motion for Summary Final
273Order, asserting that Jordan did not sustain a "birth - related
284neurological injury" as that term is defined in section
293766.302(2), Florida Statutes. NICA represented in a Response to
302Order of February 19, 2013, that the parties agreed that a
313hearing was not necessary and the Petitioner and Intervenor
322concurred the injury was not compensable.
328FINDINGS OF FACT
3311. Jordan Gonzalez was born on May 29, 2008, at North
342Shore Medical Center in Miami, Florida. Jordan weighed 2,530
352grams at birth.
3552. Donald Willis, M.D. (Dr. Willis), was requested by NICA
365to review the medical records for Jordan and his mother. In an
377aff idavit dated February 19, 2013, Dr. Willis opined the
387following within a reasonable degree of medical probability:
395It is my opinion that in summary, fetal
403abnormalities were identified by ultrasound
408during pregnancy. The baby was delivered by
415Cesarean sec tion due to the development of
423fetal ascites. The mother was not in labor.
431The baby had several congenital
436abnormalities including hypoplastic lungs,
440single umbilical artery, ascites, dilated
445ventricles in the brain, agenesis of the
452corpus callosum and a small phallus. MRI
459did not identify findings suggestive of
465hypoxic brain injury.
468As such, it is my opinion that there was no
478apparent obstetrical event that resulted in
484loss of oxygen or mechanical trauma to the
492baby's brain during delivery or during
498re suscitation in the immediate post delivery
505period in the hospital. The mother was not
513in labor. The fetus had known abnormalities
520identified by ultrasound during pregnancy.
525It is most likely the baby's brain
532abnormalities are congenital and not related
538to oxygen deprivation at birth.
5433. Jordan was examined and evaluated by Michael Duchowny,
552M.D. (Dr. Duchowny), on January 30, 2013. In an affidavit dated
563February 27, 2013, Dr. Duchowny found the following on his
573examination of Jordan:
576It is my opinion that the findings from the
585examination are consistent with both a
591substantial mental and motor impairment.
596Jordan is functioning at approximately age
6022 - 3 month level and in addition to his
612global development delay manifests
616microcephaly, dynamic hypotonia and dynamic
621static hypotonia with hyperreflexia and
626pathological reflexes. However his
630examination reveals multiple congenital
634anomalies which together with the
639neuroimaging findings suggest that Jordan's
644neurological deficits were most likely
649acquired p rior to birth.
654As such, it is my opinion that there is no
664evidence from his postnatal course or from
671his present physical fi n dings to indicate
679that Jordan Gonzale z sustained an hypoxic or
687ischemic insults in the course of labor,
694delivery or the immediate neonatal period.
700I therefore am not recommending Jordan for
707inclusion into the NICA program.
7124. A review of the file does not show any contrary
723opinions to those of Dr. Willis and Dr. Duchowny. The opinions
734of Dr. Willis and Dr. Duchowny that Jordan di d not suffer a
747neurological injury due to oxygen deprivation or mechanical
755trauma during labor, delivery, or resuscitation in the immediate
764postdelivery period are credited.
768CONCLUSIONS OF LAW
7715. The Division of Administrative Hearings has
778jurisdiction over the parties to and the subject matter of these
789proceedings. §§ 766.301 - 766.316, Fla. Stat.
7966. The Plan was established by the Legislature "for the
806purpose of providing compensation, irrespective of fault, for
814birth - related neurological injury clai ms" relating to births
824occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
8357. The injured infant, her or his personal representative,
844parents, dependents, and next of kin may seek compensation under
854the Plan by filing a claim for compensation with DOAH.
864§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
872which administers the Plan, has "45 days from the date of
883service of a complete claim . . . in which to file a response to
898the petition and to submit relevant written informat ion relating
908to the issue of whether the injury is a birth - related
920neurological injury." § 766.305(4), Fla. Stat.
9268. If NICA determines that the injury alleged in a claim
937is a compensable birth - related neurological injury, it may award
948compensation to t he claimant, provided that the award is
958approved by the administrative law judge to whom the claim has
969been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
980NICA disputes the claim, as it has in the instant case, the
992dispute must be resolved by the assigned administrative law
1001judge in accordance with the provisions of chapter 120, Florida
1011Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
10199. In discharging this responsibility, the Administrative
1026Law Judge must make the following determinati on based upon the
1037available evidence:
1039(a) Whether the injury claimed is a birth -
1048related neurological injury. If the
1053claimant has demonstrated, to the
1058satisfaction of the administrative law
1063judge, that the infant has sustained a brain
1071or spinal cord injur y caused by oxygen
1079deprivation or mechanical injury and that
1085the infant was thereby rendered permanently
1091and substantially mentally and physically
1096impaired, a rebuttable presumption shall
1101arise that the injury is a birth - related
1110neurological injury as defi ned in s.
1117766.303(2).
1118(b) Whether obstetrical services were
1123delivered by a participating physician in
1129the course of labor, delivery, or
1135resuscitation in the immediate postdelivery
1140period in a hospital; or by a certified
1148nurse midwife in a teaching hospi tal
1155supervised by a participating physician in
1161the course of labor, delivery, or
1167resuscitation in the immediate postdelivery
1172period in a hospital.
1176§ 766.309(1), Fla. Stat. An award may be sustained only if the
1188administrative law judge concludes that the "infant has
1196sustained a birth - related neurological injury and that
1205obstetrical services were delivered by a participating physician
1213at birth." § 766.31(1), Fla. Stat.
121910. The term "birth - related neurological injury" is
1228defined in section 766.302(2) as follows:
"1234Birth - related neurological injury" means
1240injury to the brain or spinal cord of a live
1250infant weighing at least 2,500 grams for a
1259single gestation or, in the case of a
1267multiple gestation, a live infant weighing
1273at least 2,000 grams at birth cause d by
1283oxygen deprivation or mechanical injury
1288occurring in the course of labor, delivery,
1295or resuscitation in the immediate
1300postdelivery period in a hospital, which
1306renders the infant permanently and
1311substantially mentally and physically
1315impaired.
131611. Th e evidence, which is not refuted, established that
1326Jordan did not sustain an injury to the brain or spinal cord
1338caused by oxygen deprivation or mechanical injury occurring in
1347the course of labor, delivery, or resuscitation in the immediate
1357postdelivery per iod in a hospital. Therefore, Jordan is not
1367eligible for benefits under the Plan.
1373CONCLUSION
1374Based upon the foregoing Findings of Fact and Conclusions
1383of Law, it is ORDERED that the Petition filed by
1393Valerie Gonzalez on behalf of and as parent and natura l guardian
1405of Jordan Gonzalez, is dismissed with prejudice.
