119STATEMENT OF THE ISSUE
123The issue to be resolved in this proceeding is whether
133Petitioner should be awarded attorney's fees and costs pursuant
142to section 57.111, Florida Statutes (2011). 1/
149PRELIMINARY STATEMENT
151On October 30, 2012, the Florida Commission on Human
160Relations (ÐCommissionÑ or ÐRespondentÑ ) entered a Final Ord er,
170adopting the Findings of Fact and Conclusions of Law contained in
181the Recommended Order entered by the undersigned in DOAH Case
191No. 11 - 3 975 (Ðthe underlying proceedingÑ ). In that Recommended
203Order, the undersigned found that Petitioner Judith Amadiz failed
212to establish a reasonable accommodation claim of housing
220discrimination.
221On Octobe r 9, 2012, Sunbeach Apts. Corp. (ÐSunbeachÑ or
231ÐPetitionerÑ ) filed a Motion for Award of AttorneysÓ Fees and
242Costs against Respondent, seeking an award of attorney's f ees and
253costs as a prevailing small business party, pursuant to
262section 57.111(4)(a) .
265On October 9, 2012, the case was referred to the Division of
277Administrative Hearings (ÐDOAHÑ ). The instant case was assigned
286DOAH C ase No. 12 - 3287F. On December 4, 20 12, the hearing was
301scheduled for March 1, 2013. On February 7, 2013, an unopposed
312Motion to Continue was filed, which the undersigned granted , and
322the hearing was rescheduled for April 24, 2013.
330The final hearing commenced as rescheduled. At the formal
339hearing, Petitioner presented the testimony of Michael Scag lione.
348Petitioner's Exhibits 2 and 4 were offered and admitted into
358evidence. Respondent presented the testimony of two witnesses:
366Cole Herbert Keklis and Sara Juliette Purdy Stewart.
374Respondent' s Exhibits 1 through 7 were offered and admitted into
385evidence. At hearing, the parties stipulated that Sunbeach is a
395small business party and was also the prevailing party in the
406underlying proceeding. In addition, the undersigned to ok
414official r ecognit ion of the record in the underlying proceeding.
425The proceeding was recorded and transcribed. The Transcript
433of the final hearing was filed with DOAH on May 9, 2013. The
446undersigned granted Petitioner, Sunbeach's Motion for
452Three - Day Enlargement of Time to Submit its Proposed Recommended
463Or der over Respondent's objection and extended the proposed final
473order deadline to June 3, 2013. The undersig ned considered
483Petitioner's one - day , late - filed Proposed Final Order in
494preparation of this Final Order since Respondent did not object
504to the late filing , and the Final Order had not been finalized at
517the time of Petitioner's submission.
522FINDING S OF FACT
5261. On August 11, 2010, Judith Amadiz ("Amadiz") filed a
538complaint of housing discrimination with the United States
546Department of Housing and Urban Development ("HUD") alleging
556disability discrimination.
5582. The Commission conducted an investigation of the
566complaint. During the investigation, the investigator obtained
573statements and documents from both parties. The investigator's
581final investigative report ("Determination") (Petitioner's
588Composite Exhibit number ed 2) detailed numerous materials
596submitted by the parties for review during the investigation.
605Some of the materials referenced included a Medical Cer tification
615Form submitted on September 3, 2010, from Carlos Sesin, M.D.; a
626copy of Complainant's Lease Application dated December 8, 2009;
635and six letters including a copy of correspondence from
644Complainant dated April 27, 2010, requesting steam cleaning , and
653a copy of correspondence from Complainant dated May 17, 2010,
663requesting steam cleaning.
6663. The Determination dated October 20, 2010, concluded that
675there was reasonable cause to believe that a discriminatory
684housing practice occurred.
6874. The Commi ssion forwarded the Determination to a staff
697attorney to review for legal sufficiency. The Commission's staff
706attorney reviewed the report and , on November 15, 2010, issued a
717Legal Concurrence: Cause citing both statutory and case law
726supporting the Deter mination. The Legal Concurrence concluded
734that there is reasonable cause to believe that Respondent
743discriminated against Complainant.
7465. On or about November 17, 2010, the Commission issued a
757Notice of Determination (Cause), charging Respondent with
764e ngaging in discriminatory housing practices in violation of the
774Fair Housing Act, reflecting the October 20, 2010, findings of
784the Determination.
7866. On or about March 2, 2011, the Commission filed a Notice
798of Failure of Conciliation after a conciliation agreement had not
808been entered into with Sunbeach , and the complaint had not been
819withdrawn.
8207. On or about January 26, 2011, Amadiz elected to have the
832Commission represent her and seek relief in the proceeding and
842resolve the charge in an administrative proceeding before DOAH .
8528. On or about March 3, 2011, the Commission filed the Petition
864for Relief before DOAH on Amadiz's behalf.
8719. On December 12, 2011, the Commission moved to withdraw
881from the underlying proceeding, citing "significant and
888irreco ncilable differences." On December 13, 2011, after a
897hearing on the motion, the undersigned entered an Order allowing
907the Commission's withdrawal. The Order also cancelled the final
916hearing scheduled for December 14, 2011, and provided Amadiz
925until Janua ry 23, 2012, to obtain new counsel to represent her in
938the matter.
94010. Amadiz subsequently notified DOAH of her intent to
949proceed pro se. Amadiz proceeded to hearing without counsel.
95811. The final hearing was held before the undersigned on
968May 9, 2012 . The undersigned entered a Recommended Order on
979August 16, 2012, recommending the dismissal of Amadiz's Petition
988for Relief in its entirety.
99312. On October 9, 2012, Sunbeach filed a Motion for Award
1004of Attorneys' Fees and Costs against the Commission.
101213. On October 30, 2012, the Commission entered a Final
1022Order Dismissing Petition for Relief from Discriminatory Housing
1030Practice , adopting the undersigned's Recommended Order and
1037dismissing the action of Amadiz.
104214. Sunbeach was repre sented by counsel, a 30 - year AV - rated
1056lawyer, who defended the underlying action for a period of over
1067two years. Sunbeach's counsel billed 75.8 hours of service at
1077$150.00 per hour. The amount of attorney's fees claimed in this
1088matter is $10,460.00 and costs of $2,277.47 f or a total of
1102$12,737.47, which is being sought in the matter.
1111CONCLUSIONS OF LAW
111415. The Division of Administrative Hearings has
1121jurisdiction in this proceeding pursuant to sections
112857.111(4)(b) 1, 120.569, and 120.57, Florida Statutes.
113516. In this matt er, Respondent has stipulated that
1144Petitioner is a small business party and that Petitioner is the
1155prevailing party in the underlying action. Therefore, the only
1164issues remaining for resolution are whether Respondent initiated
1172the underlying action and i f Respondent's action against
1181Petitioner was "substantially justified." § 57.111(4)(a),
1187Florida Statutes .
119017. Section 57.111(3)(b) provides:
1194(b) The term "initiated by a state agency"
1202means that the state agency:
12071. Filed the first pleading in any state or
1216federal court in this state;
12212. Filed a request for an administrative
1228hearing pursuant to chapter 120; or
12343. Was required by law or rule to advise a
1244small business party of a clear point of
1252entry after some recognizable event in the
1259investigatory or other free - form proceeding
1266of the agency.
126918. In the underlying proceeding, on March 3, 2011, the
1279Commission filed a request for an administrative hearing pursuant
1288to chapter 120 with its Petition for Relief. Hence, the plain
1299meaning of section 57.111( 3)(b) is met in that , by filing the
1311request , the Commission initiated this matter.
131719. A proceeding is "substantially justified" if it had a
1327reasonable basis in law and fact at the time it was initiated by
1340a state agency. § 57.111(3)(e), Fla. Stat.
134720. It is Respondent's burden to show that its initiation
1357of an administrative action was substantially justified as
1365envisioned by section 57.111(4)(e). "It is the agency which must
1375affirmatively raise and prove the exception."
138121. When dealing with license disciplinary actions, in
1389order to determine whether there was substanti al justification
1398for filing an administrative c omplaint against a licensee, the
1408focus is upon the information before the probable cause panel at
1419the time it found probable cause an d di rected the filing of an
1433administrative c omplaint. Fish v. Dep't of Health , 825 So. 2d
1444421, 423 (Fla. 4th DCA 2002); Dep't of Bus. & Prof'l Reg. v.
1457Toledo Realty , 549 So. 2d 715, 716 (Fla. 1st DCA 1989); Kibler v.
1470Dep't of Prof'l Reg. , 418 So. 2d 1081 (Fla . 4th DCA 1982).
148322. The basis for proceeding at the time the Administrative
1493Complaint was authorized must be solid but not necessarily
1502correct.
1503To sustain a probable cause determination
1509there must be some evidence considered by the
1517panel that would reas onably indicate that the
1525violation had indeed occurred. The evidence,
1531however, need not be as compelling as that
1539which must be presented at formal
1545administrative hearing on the charges to
1551support a finding of guilt and the imposition
1559of sanctions.
1561Fish , 825 So. 2d 423 (citations omitted); Toledo Realty .
157123. Even though the Commission does not utilize probable
1580cause panels, its process of investigating and evaluati ng
1589evidence to determin e whether the information provides reasonable
1598cause to believe a viol ation has occurred is parallel to license
1610disciplinary actions . Hence, applying the Fish test in this
1620matter is appropriate.
162324. In this case, the Commission's Legal Concurrence:
1631Cause, which was based on the Determination , detailed both a
1641reasonable ba sis in law and fact to direct the charges in the
1654Notice of Determination (Cause). The Commission considered
1661evidence such as the final investigative report, statutory
1669authority , and case law indicating that a discriminatory action
1678had occurred. Therefore , the Commission had "some evidence [ it ]
1689considered . . . that would reasonably indicate that the
1699violation had indeed occurred." Fish , 825 So. 2d at 423.
170925. Petitioner points to the letters Amadiz provided to
1718Sunbeach, which the Commission used as part of its foundation of
1729the Commission's factual determination that the discriminatory
1736practice of failing to provide a reasonable accommodation had
1745occurred as the same letters the undersigned used in the
1755underlying case to establish that a prima facie case had not been
1767met. Further, Petitioner argues that the evidence presented to
1776the Commission was virtually the same as that presented at formal
1787hearing, after which the undersigned recommended dismissal of the
1796charges. The deficiencies cited by Petitioner go to weight and
1806credibility.
180726. While the Commission only considers whether some
1815evidence exists to proceed, the burden at hearing is determining
1825whether the evidence support s an alleged violation. Ferris v.
1835Turlington , 510 So. 2d 292 (Fla. 1987). Th e two cannot be
1847equated. That the evidence presented at hearing was not
1856sufficient to ultimately sustain the charges does not mean that
1866it was insufficient to initiate the proceedings.
187327. Moreover, it cannot be said that the Commission had all
1884of the sa me information presented at formal hearing. The
1894undersigned had the benefit of testimony of Petitioner's expert.
1903Moreover, all witnesses who testified at the underlying
1911proceeding were subjected to cross - examination. The Commission
1920does not have the opp ortunity or the responsibility to weigh the
1932strengths and weaknesses of each party's position, but rather
1941simply to determine if some evidence exists to support the
1951conclusion that a violation has occurred. Ag. for Health Care
1961Admin. v. Gonzalez , 657 So. 2d 56 (Fla. 1st DCA 1995); Gentele v.
1974Dep't of Prof'l Reg . , B d . of Optometry , 513 So. 2d 672
1988(Fla. 1st DCA 1987). Here, the Commission performed that
1997function. The fact that the charges in the action were
2007ultimately dismissed does not form a basis for f ees and costs
2019pursuant to section 57.111.
2023ORDER
2024Based on the foregoing Findings of Fact and Conclusions of
2034Law, it is ORDERED that Pe titioner's Motion for AttorneysÓ Fees
2045and Costs is denied, and Sunbeach shall recover nothing in the
2056action. The file of t he Division of Administrative Hearings is
2067closed.
