132STATEMENT OF THE CASE
136On October 11, 2012, Petitioners, Amanda Klee and
144Walter Klee, on behalf of and as parents and natural guardians
155of Noah Klee (Noah), a minor, filed a Petition under Protest
166Pursuant to Florida Statut e Section 766.301 et seq. (Petition)
176with the Division of Administrative Hearings (DOAH) for a
185determination of compensability under the Florida Birth - Related
194Neurological Injury Compensation Plan (Plan). The Petition
201named Stephen Snow, M.D., as the phys ician who provided
211obstetric services at the birth of Noah at Orlando Health, Inc.,
222d/b/a Winnie Palmer Hospital (Winnie Palmer Hospital) on
230March 30, 2009.
233DOAH served NICA and Winnie Palmer Hospital with copies of
243the Petition on October 15, 2012. DOAH served Dr. Snow with a
255copy of the Petition on December 26, 2012.
263On October 18, 2012, Winnie Palmer Hospital filed a
272Petition for Leave to Intervene, which was granted by Order
282dated October 31, 2012. On December 19, 2012, the Petition for
293Leave to Inter vene of Emma Fritz, M.D. and Tampa Bay Women's
305Healthcare Alliance, L.L.P. , d/b/a Tampa Bay Women's Care , d/b/a
314Woman's Care Florida was filed and was granted by Order dated
325January 3, 2013.
328On January 17, 2013, NICA filed a Motion for Summary Final
339Order, stating that there were no dispute d facts on the issue of
352compensability and that Noah had not sustained a birth - related
363neurological injury and was not entitled to compensation under
372the Plan. No one filed a written response to the motion.
383The motion was heard by telephonic conference call on
392February 6, 2013. The motion was denied on the basis that it
404was not clear to the undersigned that the affidavit of
414Dr. Donald Willis, which was attached to the motion ,
423sufficiently addressed the issue of whether there had been an
433injury during the period of resuscitation in the immediate
442post delivery period. At the motion hearing, Petitioners
450vigorously argued that the injury was not compensable under the
460Plan and that the motion should be granted.
468The final hea ring was scheduled for March 8, 2013, and an
480Order of Prehearing Instructions was entered, requiring the
488Intervenors to advise Petitioners and Respondent no later than
497February 20, 2013, of any opinions of experts that they had
508retained to testify at the f inal hearing. Petitioners were
518required to advise Respondent and Intervenors by March 1, 2013,
528of the opinions of any experts that Petitioners had retained to
539testify at the final hearing.
544By letter filed on January 20, 2013, Winnie Palmer Hospital
554advise d that the experts retained by Winnie Palmer Hospital
564opined that "Noah Klee did not sustain a 'birth - related
575neurological injury' as defined in Florida Statute §766.302(2)."
583By letter filed on February 26, 2013, Dr. Fritz and Tampa Bay
595Women's Care discl osed that the experts they retained were "of
606the opinion that Noah Klee did not sustain a birth - related
618neurological injury as defined by §766.302(2) of the Florida
627Statutes."
628In responses to requests for admissions served by Winnie
637Palmer Hospital, Petiti oners denied that "Noah Klee sustained an
647injury to his brain caused by oxygen deprivation occurring in
657the course of labor, delivery, or resuscitation in the immediate
667post - delivery period in a hospital." In response to an
678interrogatory, Petitioners resp onded that the denial was based
687on the report of Dr. Willis.
693On February 15, 2013, NICA filed a Renewed Motion for
703Summary Final Order. The motion was served on the other parties
714by email; thus, a response to the motion was due by February 22,
7272013.
728On February 27, 2013, Petitioner filed Petitioner's Motion
736to Take Deposition of Donald Willis, M.D. The motion was heard
747during a status conference held by telephone on February 28,
7572013. At that time, counsel for Petitioners advised that she
767did not have an expert who could testify that Noah had sustained
779a birth - related neurological injury, but that she wanted to
790question Dr. Willis on his opinion that Petitioner was not in
801labor prior to the delivery of Noah. Because Petitioner did not
812have an expert to opine that Noah sustained a birth - related
824neurological injury to testify at the final hearing that was to
835be held in eight days, the motion to take the deposition of
847Dr. Willis was denied, and an oral ruling was made granting the
859Motion for Summary Final Order.
864FINDINGS OF FACT
8671. Noah Klee was born on March 30, 2009, at Winnie Palmer
879Hospital in Orlando, Florida. Noah weighed 4,259 grams at
889birth.
8902. Donald Willis, M.D. (Dr. Willis), an obstetrician
898specializing in maternal - fetal medicine, was request ed by NICA
909to review the medical records for Noah and his mother. In an
921affidavit dated February 14, 2013, Dr. Willis summarized his
930findings as follows:
933The purpose of my review of the medical
941records of NOAH KLEE and AMANDA KLEE was to
950determine whether an injury occurred in the
957course of labor, delivery or resuscitation
963in the immediate post - delivery period in the
972Hospital due to oxygen deprivation or
978mechanical injury occurring in the course of
985labor, delivery, or resuscitation in the
991immediate post - de livery period in the
999Hospital.
1000* * *
1003In summary, the pregnancy was complicated by
1010insulin dependent diabetes with decreased
1015fetal movement and onset of severe
1021preeclampsia at 37 weeks gestational age.
1027Emergency Cesarean section was done for
1033susp ected fetal distress on the FHR monitor.
1041The patient was not in labor. The baby was
1050depressed at birth, but Apgar score was
1057normal by 5 minutes and the umbilical cord
1065blood gas pH was above 7. The baby did
1074suffer brain injury, but the above findings
1081sug gest the injury did not occur during
1089labor, delivery or resuscitation in the
1095immediate post - delivery in the Hospital.
1102The patient was not in labor. There was no
1111apparent obstetrical event that resulted in
1117loss of oxygen or mechanical trauma to the
1125baby's brain during delivery or
1130resuscitation in the immediate post - delivery
1137in the Hospital.
1140As such, it is my opinion that there was no
1150oxygen deprivation or mechanical injury
1155during the course of labor, delivery or
1162resuscitation in the immediate post - deliver y
1170in the Hospital.
11733. A review of the file in this case reveals that there
1185have been no expert opinions filed that are contrary to the
1196opinions of Dr. Willis. The opinion of Dr. Willis that Noah did
1208not suffer a neurological injury due to oxygen depriva tion or
1219mechanical injury during labor, delivery, or immediate
1226postdelivery period is credited.
1230CONCLUSIONS OF LAW
12334. The Division of Administrative Hearings has
1240jurisdiction over the parties to and the subject matter of these
1251proceedings. §§ 766.301 - 766.316, Fla. Stat.
12585. The Plan was established by the Legislature "for the
1268purpose of providing compensation, irrespective of fault, for
1276birth - related neurological injury claims" relating to births
1285occurring on or after January 1, 1989. § 766.303(1), F la. Stat.
12976. The injured infant, her or his personal representative,
1306parents, dependents, and next of kin may seek compensation under
1316the Plan by filing a claim for compensation with DOAH.
1326§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NIC A,
1335which administers the Plan, has "45 days from the date of
1346service of a complete claim . . . in which to file a response to
1361the petition and to submit relevant written information relating
1370to the issue of whether the injury is a birth - related
1382neurologica l injury." § 766.305(4), Fla. Stat.
13897. If NICA determines that the injury alleged in a claim
1400is a compensable birth - related neurological injury, it may award
1411compensation to the claimant, provided that the award is
1420approved by the administrative law jud ge to whom the claim has
1432been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
1443NICA determines that the claim is not compensable, as it has in
1455the instant case, any dispute must be resolved by the assigned
1466administrative law judge in accordance with the provisions of
1475chapter 120, Florida Statutes. §§ 766.304, 766.309, and 766.31,
1484Fla. Stat.
14868. In discharging this responsibility, the Administrative
1493Law Judge must make the following determination based upon the
1503available evidence:
1505(a) Whether t he injury claimed is a birth -
1515related neurological injury. If the
1520claimant has demonstrated, to the
1525satisfaction of the administrative law
1530judge, that the infant has sustained a brain
1538or spinal cord injury caused by oxygen
1545deprivation or mechanical injury and that
1551the infant was thereby rendered permanently
1557and substantially mentally and physically
1562impaired, a rebuttable presumption shall
1567arise that the injury is a birth - related
1576neurological injury as defined in s.
1582766.303(2).
1583(b) Whether obstetrical ser vices were
1589delivered by a participating physician in
1595the course of labor, delivery, or
1601resuscitation in the immediate postdelivery
1606period in a hospital; or by a certified
1614nurse midwife in a teaching hospital
1620supervised by a participating physician in
1626the c ourse of labor, delivery, or
1633resuscitation in the immediate postdelivery
1638period in a hospital.
1642§ 766.309(1), Fla. Stat. An award may be sustained only if the
1654administrative law judge concludes that the "infant has
1662sustained a birth - related neurological injury and that
1671obstetrical services were delivered by a participating physician
1679at birth." § 766.31(1), Fla. Stat.
16859. The term "birth - related neurological injury" is defined
1695in section 766.302(2) as follows:
"1700Birth - related neurological injury" means
1706i njury to the brain or spinal cord of a live
1717infant weighing at least 2,500 grams for a
1726single gestation or, in the case of a
1734multiple gestation, a live infant weighing
1740at least 2,000 grams at birth caused by
1749oxygen deprivation or mechanical injury
1754occurrin g in the course of labor, delivery,
1762or resuscitation in the immediate
1767postdelivery period in a hospital, which
1773renders the infant permanently and
1778substantially mentally and physically
1782impaired.
178310. The evidence, which is not refuted, established that
1792No ah did not sustain an injury to the brain or spinal cord
1805caused by oxygen deprivation or mechanical injury occurring in
1814the course of labor, delivery, or resuscitation in the immediate
1824postdelivery period in a hospital. Therefore, Noah is not
1833eligible for benefits under the Plan.
1839CONCLUSION
1840Based upon the foregoing Findings of Fact and Conclusions
1849of Law, it is ORDERED that the Petition filed by Amanda Klee and
1862Walter Klee, on behalf of and as parents and natural guardians
1873of Noah Klee, is dismissed with prejudice.
