130STATEMENT OF THE CASE

134On October 16, 2012, Petitioners, Petra Crespo and

142Alexander G. Soriano, on behalf of and as parents and natural

153guardians of Alexandra G. Soriano, Jr. (Alexander), a minor,

162filed a Petition for Benefits Pursuant to Fl orida Statute

172Section 766.301 et seq. (Petition) with the Division of

181Administrative Hearings (DOAH) for a determination of

188compensability under the Florida Birth - Related Neurological

196Injury Compensation Plan (Plan).

200The Petition named Norman L. Lamberty , M.D., as the

209physician providing obstetric services at the birth of Alexander

218at Winnie Palmer Hospital in Orlando, Florida.

225DOAH served NICA with a copy of the Petition on October 18,

2372012. DOAH served Dr. Lamberty with a copy of the Petition on

249Octobe r 19, 2012.

253On November 7, 2012, Orlando Health, Inc. , d/b/a Winnie

262Palmer Hospital for Women & Babies (Winnie Palmer Hospital)

271filed Intervenor's Motion to Intervene, which was granted by

280Order dated November 26, 2012. On November 16, 2012, Penny A.

291Da nna, M.D., and Physician Associates LLC , filed a Petition for

302Leave to Intervene by Penny A. Danner, M.D. , and Physician

312Associates LLC, which was granted by Order dated November 29,

3222012.

323NICA filed a Motion for Summary Final Order, asserting that

333Alex ander did not sustain a "birth - related neurological injury"

344as that term is defined in section 766.302(2), Florida Statutes.

354NICA represented in the motion that Petitioners and Intervenors

363are accepting NICA's denial of benefits under the Plan and have

374no objections to the granting of the Motion for Summary Final

385Order.

386FINDINGS OF FACT

3891. Alexander Sor iano born on July 3, 2011, at Winnie

400Palmer Hospital in Orlando, Florida. Alexander weighed 3,442

409grams at birth.

4122. Donald Willis, M.D. (Dr. Willis), w as requested by NICA

423to review the medical records for Alexander. In a medical

433report dated March 28, 2013, Dr. Willis opined the following:

443In summary, the mother presented at term

450with decreased fetal movement and an

456abnormal FHR pattern. There was no mention

463of the mother being in labor. Her cervix

471was not dilated and consistent with no

478active labor. Cesarean section delivery was

484required. The baby was severely depressed

490and had no detectable cardiac activity at

497birth. The hospital course was consi stent

504with hypoxic ischemic brain injury with

510multisystem dysfunction, EEG and MRI studies

516should [sic] brain injury.

520Available information suggests the patient

525was not in labor. Oxygen deprivation and

532brain injury most likely occurred at some

539time prior to delivery. Although the

545hypoxia and brain injury may have continued

552during delivery and into the post - delivery

560period, the initial brain injury and

566substantial damage were most likely already

572present prior to birth.

5763. NICA retained Michael S. Ducho wny, M.D., a Florida

586board - certified pediatric neurologist to review the instant

595claim and to conduct an examination of Alexander, and render an

606opinion whether a birth - related neurological injury occurred.

615In a report dated January 23, 2013, Dr. Duchowny opined:

625While Alexander's birth history documents

630severe problems resulting from his meconium

636aspiration syndrome, his present

640neurological examination reveals neither a

645permanent nor substantial mental or physical

651impairment. Essentially Alexander has d one

657remarkably well despite his neonatal course,

663and I would anticipate continued improvement

669in the future. I regard his developmental

676abnormalities as unrelated to the perinatal

682circumstances and therefore not recommend

687Alexander for inclusion in the NI CA program.

6954. A review of the file does not show any contrary

706opinions, and Petitioners and Intervenors have no objection to

715the issuance of a summary final order finding that the injury is

727not compensable under Plan. The opinion of Dr. Willis that

737Ale xander did not suffer a neurological injury due to oxygen

748deprivation or mechanical injury during labor, delivery, or the

757immediate postdelivery period is credited. Dr. Duchowny's

764opinion that Alexander does not have a permanent and substantial

774mental and physical impairment is credited.

780CONCLUSIONS OF LAW

7835. The Division of Administrative Hearings has

790jurisdiction over the parties to and the subject matter of these

801proceedings. §§ 766.301 - 766.316, Fla. Stat.

8086. The Plan was established by the Legisla ture "for the

819purpose of providing compensation, irrespective of fault, for

827birth - related neurological injury claims" relating to births

836occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8477. The injured infant, her or his personal representa tive,

857parents, dependents, and next of kin may seek compensation under

867the Plan by filing a claim for compensation with DOAH.

877§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

885which administers the Plan, has "45 days from the date of

896ser vice of a complete claim . . . in which to file a response to

912the petition and to submit relevant written information relating

921to the issue of whether the injury is a birth - related

933neurological injury." § 766.305(4), Fla. Stat.

9398. If NICA determines tha t the injury alleged in a claim

951is a compensable birth - related neurological injury, it may award

962compensation to the claimant, provided that the award is

971approved by the administrative law judge to whom the claim has

982been assigned. § 766.305(7), Fla. Stat . If, on the other hand,

994NICA disputes the claim, as it has in the instant case, the

1006dispute must be resolved by the assigned administrative law

1015judge in accordance with the provisions of chapter 120, Florida

1025Statutes. §§ 766.304, 766.309, and 766.31, Fl a. Stat.

10349. In discharging this responsibility, the administrative

1041law judge must make the following determination based upon the

1051available evidence:

1053(a) Whether the injury claimed is a birth -

1062related neurological injury. If the

1067claimant has demonstrat ed, to the

1073satisfaction of the administrative law

1078judge, that the infant has sustained a brain

1086or spinal cord injury caused by oxygen

1093deprivation or mechanical injury and that

1099the infant was thereby rendered permanently

1105and substantially mentally and physi cally

1111impaired, a rebuttable presumption shall

1116arise that the injury is a birth - related

1125neurological injury as defined in s.

1131766.303(2).

1132(b) Whether obstetrical services were

1137delivered by a participating physician in

1143the course of labor, delivery, or

1149re suscitation in the immediate postdelivery

1155period in a hospital; or by a certified

1163nurse midwife in a teaching hospital

1169supervised by a participating physician in

1175the course of labor, delivery, or

1181resuscitation in the immediate postdelivery

1186period in a hosp ital.

1191§ 766.309(1), Fla. Stat. An award may be sustained only if the

1203administrative law judge concludes that the "infant has

1211sustained a birth - related neurological injury and that

1220obstetrical services were delivered by a participating physician

1228at birth ." § 766.31(1), Fla. Stat.

123510. The term "birth - related neurological injury" is

1244defined in section 766.302(2) as follows:

"1250Birth - related neurological injury" means

1256injury to the brain or spinal cord of a live

1266infant weighing at least 2,500 grams for a

1275single gestation or, in the case of a

1283multiple gestation, a live infant weighing

1289at least 2,000 grams at birth caused by

1298oxygen deprivation or mechanical injury

1303occurring in the course of labor, delivery,

1310or resuscitation in the immediate

1315postdelivery per iod in a hospital, which

1322renders the infant permanently and

1327substantially mentally and physically

1331impaired.

133211. The evidence, which is not refuted, established that

1341Alexander did not sustain an injury to the brain or spinal cord

1353caused by oxygen depriva tion or mechanical injury occurring in

1363the course of labor, delivery, or resuscitation in the immediate

1373postdelivery period in a hospital which resulted in a permanent

1383and substantial mental and physical impairment. Therefore,

1390Alexander is not eligible fo r benefits under the Plan.

1400CONCLUSION

1401Based upon the foregoing Findings of Fact and Conclusions

1410of Law, it is ORDERED that the Petition filed by Petro Crespo

1422and Alexander G. Soriano, on behalf of and as parents and

1433natural guardians of Alexander Soriano, Jr., is dismissed with

1442prejudice.
