100This cause came on for consideration pursuant to sections

109766.304 and 766.305(7), Florida Statutes, upon the Stipulation

117and Joint Petition for Compensation of Claim Arising out of

127Florida Birth - Related Neurological Injury Pursuant to Chapter

136766, Florida Statutes (Stipulation and Joint Petition), filed

144with the Division of Administrative Hearings on April 9, 2013,

154for the entry of an order approving the resolution of a claim

166for compensatio n benefits filed in accordance with the

175provisions of chapter 766 and a resolution of the exclusive

185remedy otherwise available as outlined in chapter 766.

193By the terms of their stipulation, Petitioners,

200Lancia Fontes and Lionel Davila on behalf of and as p arents and

213natural guardians of Israel Davila - Fontes, a minor, and

223Respondent, the Florida Birth - Related Neurological Injury

231Compensation Association (NICA) have agreed that Lancia Fontes

239and Lionel Davila are the parents and legal guardians of Israel

250Davi la - Fontes (Israel), a minor; that Israel was born a live

263infant on or about February 26, 2011, at Winnie Palmer Hospital

274for Women and Babies, a ÐhospitalÑ as defined by section

284766.302(6) located in Orlando, Florida; and that Israel's birth

293weight exceede d 2,500 grams. The Parties have further agreed

304that Pamela Cates - Smith, M.D., provided obstetrical services at

314Israel's delivery and was a Ðparticipating physicianÑ in the

323Florida Birth - Related Neurological Injury Compensation Plan, as

332defined by section 766.302(7). The Parties have agreed that

341Israel suffered a Ðbirth - related neurological injury,Ñ as that

352term is defined by section 766.302(2), which was the sole and

363proximate cause of Israel 's permanent and substantial mental and

373physical impairments.

375Pa ragraph 12 of the Joint Stipulation and Petition

384provides:

385The Petitioners disagree as to NICA's

391interpretation of Section 766.31(1)(b)1,

395Florida Statutes, with respect to the

401payment of the parental award. Section

407766.31(1)(b)1, Florida Statutes, states:

411Periodic payments of an award to

417the parents or legal guardians

422of the infant found to have

428sustained a birth related

432neurological injury, which award

436shall not exceed $100,000.

441However, at the discretion of the

447administrative law judge, such

451award m ay be made in a lump sum.

460The issues on which the Parties disagree are

468whether Section 766.31(1)(b)1, Florida

472Statutes, only entitles two parents to a

479single parental award of $100,000 in the

487aggregate, and, if so, whether that statute

494is constitutional. At this time, those

500issues are currently pending before the

506Florida Supreme Court in Samples v. NICA (SC

51410 - 1295). The Parties to the instant case

523request that this case be abated only with

531regard to the above issues until a decision

539is reached in Sample s , so that the

547Administrative Law Judge may later award

553Petitioners a second $100,000 parental award

560if the Samples case should determine that

567Section 766.31(1)(b)1 entitles them to it,

573as well as any attorney fees and costs that

582may be due in connection w ith the second

591parental award.

593It is ORDERED:

5961. The Stipulation and Joint Petition filed on April 9,

6062013, is hereby approved, and the Parties are directed to comply

617with the provisions of the Stipulation and Joint Petition.

6262. Petitioners, Lancia Fon tes and Lionel Davila, as the

636parents and legal guardians of Israel Davila - Fontes, a minor, are

648awarded one hundred thousand dollars ($100,000.00), pursuant to

657section 766.31(1)(b)1, to be paid as periodic payments and for

667use for home, vehicle, or related expenses; payment of benefits

677up to and including the effective date of the Joint Stipulation

688and Petition pursuant to section 766.31(1)(a), subject to the

697provisions of paragraph 20 of the Stipulation and Joint Petition;

707and payment of future expenses as incurred.

7143. Respondent shall pay Hector More, Esquire, attorney for

723Petitioners, t en thousand dollars ($10,000.00) for attorney's

732fees and t wo thousand four hundred nine dollars and thirty cents

744($2,409.30) for expenses, totaling t welve thousand four hu ndred

755nine dollars and thirty cents ($12,409.30) in full, for services

766rendered in the filing of Petitioners' claim.

7734. Upon the payment of the award of $100,000.00, attorney's

784fees and other expenses totaling $12,409.30 incurred in

793connection with the filing of this claim, and past

802benefit/expenses, the claims of Petitioners shall be deemed fully

811satisfied and extinguished, except for the issues reserved in

820paragraph 12 of the Joint Stipulation and Petition and

829Respondent's continuing obligation under section 766.31(2) to pay

837future expenses as incurred.

8415. The Division of Administrative Hearings retains

848jurisdiction over this matter to resolve any disputes, should

857they arise, regarding the partiesÓ compliance with the terms of

867this Order and the issue s reserved in paragraph 12 of the Joint

880Stipulation and Petition.
