48This cause came on for consideration upon the Motion for
58Summary Final Order filed by Respondent, Florida Birth - Related
68Neurological Injury Compensation Associati on (NICA), on June 24,

78STATEMENT OF THE CASE
82On November 29, 2012, Petitioners, Neil Kannikal and
90Renjini Kannikal, on behalf of and as parents and natural
100guardians of Neha, a minor, filed a Petition for Benefits
110Pursuant to Florida Statute Section 766.301 et seq. (Petition)
119with the Division of Administrative Hearings (DOAH) for a
128determination of compensability under the Florida Birth - Related
137Neurological Injury Compensation Plan (Plan).
142The Petition named Shelby Wilbourne , M.D., as the physician
151providing obstetric services at the birth of Neha at Broward
161General Medical Center located in Fort Lauderdale, Florida.
169DOAH served NICA with a copy of the Petition on December 5,
1812012. DOAH received a receipt from the United States Postal
191Service on D ecember 7, 2012, showing that Broward General Medical
202Center had been served with a copy of the Petition.
212Dr. Wilbourne was served a copy of the Petition by DOAH on
224December 6, 2012.
227As of the date of this Summary Final Order of Dismissal,
238neither Browa rd General Medical Center nor Dr. Wilbourne have
248petitioned to intervene in this proceeding.
254On June 24, 2013, NICA filed a Motion for Summary Final
265Order, asserting that Neha did not sustain a "birth - related
276neurological injury" as that term is defined in section
285766.302(2), Florida Statutes. Petitioners filed PetitionersÓ
291Response in Opposition to Motion for Summary Final Order on
301July 1, 2013.
304On July 11, 201 3 , the Motion for Summary Final Order was
316heard by telephonic conference call. Petitioners ha d filed
325medical records from NehaÓs treating physician. The records in
334and of themselves did not refute RespondentÓs allegation that
343Neha did not have a birth - related neurological injury. By Order
355dated July 11, 2013, Petitioners were given an extension of time
366in which to file a supplemental response to the Motion for
377Summary Final Order on or before October 1, 2013. As of the date
390of this Summary Final Order of Dismissal, Petitioners have not
400filed a supplemental response to the motion.
407FINDINGS OF FAC T
4111. Neha was born on May 15, 2012, at Broward General
422Medical Center, located in Fort Lauderdale, Florida. Neha
430weighed six pounds nine ounces at birth.
4372. NICA retained Michael S. Duchowny, M.D., as its medical
447expert in pediatric neurology. Dr. Duc howny examined Neha on
457March 20, 2013, and reviewed her medical records. In an
467affidavit dated April 24, 2013, Dr. Duchowny opined as follows:
477NehaÓs neurological examination is
481significant only for a mild degree of
488hypontia coupled with very slight motor
494development delay. In other regards, she
500seems to be developing quite well and I
508suspect that her language development will
514progress on schedule. There are no focal or
522lateralizing findings to suggest structural
527brain damage.
529A review of medical record s reveals that Neha
538was born by stat cesarean section at Broward
546General Hospital due to fetal bradycardia.
552She was delivered with a full body nuchal
560cord and a true knot that was removed at
569birth. There was evidence of severe
575metabolic acidosis - arterial blood gases drawn
58211 minutes after birth revealed a pH of 6.66,
591PC02 of 162, P02 of 11, and base excess of
601- 32. These values were improved on a repeat
610series drawn at 12:27 PM.
615Thick meconium was suctioned below the vocal
622cords and Neha was diagnosed with meconium
629aspiration syndrome. Seizures occurred
633several after birth and were treated with
640phenobarbital and phenytoin. As previously
645stated by the family, Neha was immediately
652enrolled in a general hypothermia protocol.
658Of significance, a brain ult rasound exam
665obtained on May 15 at 6:46 PM, was normal and
675an MRI scan of the brain obtained on May 23
685(DOL #8) was also within normal limits.
692NehaÓs examination today does not reveal
698either a substantial mental or motor
704impairment, findings are consisten t with the
711lack of significant MRI findings. I believe
718that the hypothermia protocol in all
724likelihood was neuro - protective and more
731likely than not, contributed to NehaÓs
737positive outcome.
739Given NehaÓs favorable outcome, I believe
745that she should not be considered for
752inclusion within the NICA program.
757As such, it is my opinion that Neha Kannikal
766is not permanently and substantially mentally
772impaired nor is she permanently and
778substantially physically impaired due to
783oxygen deprivation or mechanical inj ury
789occurring during the course of labor,
795delivery or the immediate post - delivery
802period in the hospital during the birth of
810Neha Kannikal.
8123. A review of the file does not show any opinion contrary
824to Dr. Duchowny's opinion that Neha does not have a sub stantial
836and permanent mental and physical impairment due to lack of
846oxygen or mechanical trauma is credited.
852CONCLUSIONS OF LAW
8554. The Division of Administrative Hearings has jurisdiction
863over the parties to and the subject matter of these proceedings.
874§§ 766.301 - 766.316, Fla. Stat.
8805. The Plan was established by the Legislature "for the
890purpose of providing compensation, irrespective of fault, for
898birth - related neurological injury claims" relating to births
907occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
9186. The injured infant, her or his personal representative,
927parents, dependents, and next of kin may seek compensation under
937the Plan by filing a claim for compensation with DOAH.
947§§ 766.302(3), 766.303(2), and 766.305(1), Fl a. Stat. NICA,
956which administers the Plan, has "45 days from the date of service
968of a complete claim . . . in which to file a response to the
983petition and to submit relevant written information relating to
992the issue of whether the injury is a birth - relate d neurological
1005injury." § 766.305(4), Fla. Stat.
10107. If NICA determines that the injury alleged in a claim is
1022a compensable birth - related neurological injury, it may award
1032compensation to the claimant, provided that the award is approved
1042by the administr ative law judge to whom the claim has been
1054assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1065disputes the claim, as it has in the instant case, the dispute
1077must be resolved by the assigned administrative law judge in
1087accordance with the prov isions of chapter 120, Florida Statutes.
1097§§ 766.304, 766.309, and 766.31, Fla. Stat.
11048. In discharging this responsibility, the a dministrative
1112l aw j udge must make the following determination based upon the
1124available evidence:
1126(a) Whether the injury cla imed is a birth -
1136related neurological injury. If the claimant
1142has demonstrated, to the satisfaction of the
1149administrative law judge, that the infant has
1156sustained a brain or spinal cord injury
1163caused by oxygen deprivation or mechanical
1169injury and that the infant was thereby
1176rendered permanently and substantially
1180mentally and physically impaired, a
1185rebuttable presumption shall arise that the
1191injury is a birth - related neurological injury
1199as defined in s. 766.303(2).
1204(b) Whether obstetrical services were
1209de livered by a participating physician in the
1217course of labor, delivery, or resuscitation
1223in the immediate postdelivery period in a
1230hospital; or by a certified nurse midwife in
1238a teaching hospital supervised by a
1244participating physician in the course of
1250labo r, delivery, or resuscitation in the
1257immediate postdelivery period in a hospital.
1263§ 766.309(1), Fla. Stat. An award may be sustained only if the
1275a dministrative l aw j udge concludes that the "infant has sustained
1287a birth - related neurological injury and th at obstetrical services
1298were delivered by a participating physician at birth."
1306§ 766.31(1), Fla. Stat.
13109. The term "birth - related neurological injury" is defined
1320in section 766.302(2) as follows:
"1325Birth - related neurological injury" means
1331injury to the brain or spinal cord of a live
1341infant weighing at least 2,500 grams for a
1350single gestation or, in the case of a
1358multiple gestation, a live infant weighing at
1365least 2,000 grams at birth caused by oxygen
1374deprivation or mechanical injury occurring in
1380the cou rse of labor, delivery, or
1387resuscitation in the immediate postdelivery
1392period in a hospital, which renders the
1399infant permanently and substantially mentally
1404and physically impaired.
140710. The evidence, which is not refuted, established that
1416Neha Kannikal is not permanently and substantially mentally
1424impaired nor is she permanently and substantially physically
1432impaired due to oxygen deprivation or mechanical injury occurring
1441during the course of labor, delivery or the immediate post -
1452delivery period. Theref ore, Neha is not eligible for benefits
1462under the Plan.
1465CONCLUSION
1466Based upon the foregoing Findings of Fact and Conclusions of
1476Law, it is ORDERED that the Petition filed by Neil Kannikal and
1488Renjini Kannikal, on behalf of and as parents and natural
1498guardia ns of Neha, is dismissed with prejudice.
