101STATEMENT OF THE CASE

105On November 3 0 , 2012, Petitioner s, Daniel Courtney McGrane

115and Heather Louise McGrane , on behalf of and as parents and

126natural guardians of Matthew Eugene McGrane (Matthew ), a minor,

136filed a Petition for Benefits Pursuant to Florida Statute

145Section 766.301 et seq. (Petition) with the Div ision of

155Administrative Hearings (DOAH) for a determination of

162compensability under the Florida Birth - Related Neurological

170Injury Compensation Plan (Plan). The Petition named

177Amanpreet Singh Bhullar, M.D. , as the physician who provided

186obstetric services for the birth of Matthew. The Petition

195stated that Matthew was born at Winnie Palmer Hospital for Women

206and Babies , in Orlando, Florida , on July 7, 2010 .

216DOAH served NICA with a cop y of the Petition on December 5 ,

2292012.

230On December 1 7, 2012, Dr. Bhullar and Orlando Health, Inc. ,

241d/b/a Winnie Palmer Hospital for Women and Babies filed

250Interveners' Petition for Leave to Intervene. By Order dated

259January 3 , 2013, Dr. Bhullar and Winnie Palmer Hospital for

269Women and Babies were granted leave to intervene.

277O n June 3 , 2013, NICA filed a Motion for Summary Final

289Order, requesting that a s ummary f inal o rder be entered finding

302that the claim was not compensable because Matthew did not meet

313the requisite minimum statutory birth weight as required by

322section 766.30 2(2), Florida Statutes.

327As of the date of this Summary Final Order of Dismissal,

338neither Petitioners nor Intervenors have filed a response to the

348Motion for Summary Final Order.

353FINDINGS OF FACT

3561. Matthew Eugene McGrane w as born on July 7 , 20 10 , at

369Winni e Palmer Hospital for Women and Babies in Orlando, Florida.

3802. Based on his hospital records , Matthew weighed 1,415

390grams at birth. He was a single gestation.

398CONCLUSIONS OF LAW

4013. The Division of Administrative Hearings has

408jurisdiction over the part ies to and the subject matter of these

420proceedings. §§ 766.301 - 766.316, Fla. Stat.

4274. The Plan was established by the Legislature "for the

437purpose of providing compensation, irrespective of fault, for

445birth - related neurological injury claims" relating t o births

455occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

4665. The injured infant, her or his personal representative,

475parents, dependents, and next of kin may seek compensation under

485the Plan by filing a claim for compensation with DOAH.

495§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

503which administers the Plan, has "45 days from the date of

514service of a complete claim . . . in which to file a response to

529the petition and to submit relevant written information relating

538t o the issue of whether the injury is a birth - related

551neurological injury." § 766.305(4), Fla. Stat.

5576. NICA has determined that Matthew does not have a claim

568that is compensable under the Plan and has filed a Motion for

580Summary Final Order, requesting th at an order be entered finding

591that the claim is not compensable.

5977. In ruling on the motion, the Administrative Law Judge

607must make the following determination based upon the available

616evidence:

617(a) Whether the injury claimed is a

624birth - related neurolog ical injury. If the

632claimant has demonstrated, to the

637satisfaction of the administrative law

642judge, that the infant has sustained a brain

650or spinal cord injury caused by oxygen

657deprivation or mechanical injury and that

663the infant was thereby rendered perm anently

670and substantially mentally and physically

675impaired, a rebuttable presumption shall

680arise that the injury is a birth - related

689neurological injury as defined in s.

695766.303(2).

696§ 766.309(1), Fla. Stat.

7008. The term "birth - related neurological injury " is defined

710in section 766.302(2) as follows:

"715Birth - related neurological injury"

720means injury to the brain or spinal cord of

729a live infant weighing at least 2,500 grams

738for a single gestation or, in the case of a

748multiple gestation, a live infant weighi ng

755at least 2,000 grams at birth caused by

764oxygen deprivation or mechanical injury

769occurring in the course of labor, delivery,

776or resuscitation in the immediate

781postdelivery period in a hospital, which

787renders the infant permanently and

792substantially menta lly and physically

797impaired.

7989. The evidence, which is not refuted, established that

807Matthew was a single gestation and did not weigh at least 2,500

820grams at birth. Thus, Matthew has not sustained a birth - related

832neurological injury because he did not meet the minimum

841statutory weight as set forth in the definition of "birth -

852related neurological injury," in section 766.302(2).

858CONCLUSION

859Based upon the foregoing Findings of Fact and Conclusions

868of Law, it is ORDERED that the Petition filed by Daniel Cou rtney

881McGrane and Heather Louise McGrane , on behalf of and as parents

892and natural guardians of Matthew Eugene McGrane , is dismissed

901with prejudice.
