119STATEMENT OF THE CASE

123On November 20, 2012, P etitioners, Jaime Ventura and

132Jahdai Rodriguez, on behalf of and as parents and natural

142guardians of Izael Jariel Ventura - Rodriguez (Izael), a minor,

152filed a Petition for Benefits Pursuant to Florida Statutes

161Section 766.301 et seq. (Petition) with the Div ision of

171Administrative Hearings (DOAH) for a determination of

178compensability under the Florida Birth - Related Neurological

186Injury Compensation Plan (Plan). The Petition named Timothy D.

195O'Leary, M.D., as the physician who provided obstetric services

204for t he birth of Izael. The Petition stated that Izael was born

217at Winnie Palmer Hospital for Women and Babies, in Orlando,

227Florida.

228DOAH served NICA with a copy of the Petition on December 5,

2402012. DOAH served a copy of the Petition on Dr. O'Leary on

252Februar y 11, 2013. On December 13, 2012, Orlando Health, Inc.,

263d/b/a Winnie Palmer Hospital for Women and Babies filed a

273Petition for Leave to Intervene, which was granted by Order dated

284January 3, 2013.

287On March 20, 2013, NICA filed a Motion for Summary Final

298O rder, requesting that a s ummary f inal o rder be entered finding

312that the claim was not compensable because Izael did not meet the

324requisite minimum statutory birth weight as required by section

333766.302(2), Florida Statutes. On March 20, 2013, the parties

342f iled a Joint Stipulation of Facts, in which the parties

353stipulated, among other facts, that Izael's birth weight was

362935.5 grams. The parties' Joint Stipulation of Facts have been

372incorporated in this Summary Final Order of Dismissal.

380FINDINGS OF FACT

3831. Jamie Ventura and Jahdai Rodriguez are the parents and

393natural guardians of Izael.

3972. Izael was born on December 26, 2010, at Winnie Palmer

408Hospital for Women and Babies in Orlando, Florida.

4163. Timothy D. O'Leary provided obstetrical services during

424the delivery of Izael. Dr. O'Leary is a participating physician

434as defined in section 766.302(7).

4394. Izael weighed 935.5 grams at birth.

446CONCLUSIONS OF LAW

4495. The Division of Administrative Hearings has jurisdiction

457over the parties to and the subject mat ter of these proceedings.

469§§ 766.301 - 766.316, Fla. Stat.

4756. The Plan was established by the Legislature "for the

485purpose of providing compensation, irrespective of fault, for

493birth - related neurological injury claims" relating to births

502occurring on or a fter January 1, 1989. § 766.303(1), Fla. Stat.

5147. The injured infant, her or his personal representative,

523parents, dependents, and next of kin may seek compensation under

533the Plan by filing a claim for compensation with DOAH.

543§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

551which administers the Plan, has "45 days from the date of service

563of a complete claim . . . in which to file a response to the

578petition and to submit relevant written information relating to

587the issue of whether the injury is a birth - related neurological

599injury." § 766.305(4), Fla. Stat. In the instant case,

608Petitioners have filed a Petition under protest, stating that

617they are not seeking any benefits under the Plan.

6268. NICA has determined that Izael does not have a cla im

638that is compensable under the Plan and has filed a Motion for

650Summary Final Order, requesting that an order be entered finding

660that the claim is not compensable.

6669. In ruling on the motion, the Administrative Law Judge

676must make the following determina tion based upon the available

686evidence:

687(a) Whether the injury claimed is a birth -

696related neurological injury. If the claimant

702has demonstrated, to the satisfaction of the

709administrative law judge, that the infant has

716sustained a brain or spinal cord inj ury

724caused by oxygen deprivation or mechanical

730injury and that the infant was thereby

737rendered permanently and substantially

741mentally and physically impaired, a

746rebuttable presumption shall arise that the

752injury is a birth - related neurological injury

760as de fined in s. 766.303(2).

766§ 766.309(1), Fla. Stat.

77010. The term "birth - related neurological injury" is defined

780in section 766.302(2) as follows:

"785Birth - related neurological injury" means

791injury to the brain or spinal cord of a live

801infant weighing at least 2,500 grams for a

810single gestation or, in the case of a

818multiple gestation, a live infant weighing at

825least 2,000 grams at birth caused by oxygen

834deprivation or mechanical injury occurring in

840the course of labor, delivery, or

846resuscitation in the imm ediate postdelivery

852period in a hospital, which renders the

859infant permanently and substantially mentally

864and physically impaired.

86711 . The evidence, which is not refuted, established that

877Izael did not weigh at least 2,500 grams at birth. Thus, Izael

890h as not sustained a birth - related neurological injury because

901Izael did not meet the minimum statutory weight as set forth in

913the definition of "birth - related neurological injury," in section

923766.302(2).

924CONCLUSION

925Based upon the foregoing Findings of Fact and Conclusions of

935Law, it is ORDERED that the Petition filed by Jaime Ventura and

947Jahdai Rodriguez, on behalf of and as parents and natural

957guardians of Izael Jariel Ventura - Rodriguez, is dismissed with

967prejudice.

968DONE AND ORDERED this 27th day of March , 2013 , in
