94This cause came on for consideration upon a Motion for

104Summary Final Order filed by Respondent, Florida Birth - Related

114Neurological Injury Compensation Association (NICA), on

120February 5, 2013.

123STATEMENT OF THE CASE

127On December 13, 2012, Petitioners, Lizbeth Caraballo and

135Edgardo Caraballo, on behalf of and as parents and natural

145guardians of Luis Caraballo (Luis), a minor, filed a Petition

155Under Protest Pursuant to Florida Statutes Sectio n 766.301 et

165seq. (Petition) with the Division of Administrative Hearings

173(DOAH) for a determination of compensability under the Florida

182Birth - Related Neurological Injury Compensation Plan (Plan). The

191Petition named the following physicians who provided o bstetric

200services for the birth of Luis: Peter Perry, M.D.; Javier Pena,

211M.D.; Virgil Davila, M.D.; Hector Ramirez, M.D.; and

219Stephen Carlan, M.D. The Petition stated that Luis was born at

230Arnold Palmer Hospital, in Orlando, Florida.

236DOAH served NICA and Dr. Ramirez with copies of the

246Petition on December 21, 2012. DOAH served a copy of the

257Petition on Dr. Davila on December 20, 2012. On December 28,

2682012, DOAH received a receipt from the United States Postal

278Service (USPS) showing that the Petition had been served on

288Arnold Palmer Hospital. Dr. Carlan received a copy of the

298Petition on December 24, 2012. On December 18, 2012, DOAH sent

309a copy of the Petition to Dr. Pena by United States certified

321mail. DOAH did not receive a receipt from the USPS sho wing that

334a copy of the Petition had been received by Dr. Pena. On

346February 7, 2012, another copy of the Petition was sent to

357Dr. Pena by United States certified mail. On February 19, 2013,

368DOAH received a receipt from the USPS that a copy of the

380Petitio n had been received by Dr. Pena .

389On December 27, 2012, Dr. Perry and Physician Associates,

398LLC, filed a Petition for Leave to Intervene. By Order dated

409January 9, 2013, Dr. Caldera - Nieves and Physician Associates,

419LLC, were granted leave to intervene.

425On December 31, 2012, Orlando Health, Inc. d/b/a Arnold

434Palmer Hospital and Winnie Palmer Hospital filed a Motion to

444Intervene. By Order dated January 17, 2013, the motion was

454granted.

455On February 5, 2013, NICA filed a Motion for Summary Final

466Order, request ing that a Summary Final Order be entered finding

477that the claim was not compensable because Luis did not meet the

489requisite minimum statutory birth weight as required by section

498766.302(2), Florida Statutes.

501As of the date of this Summary Final Order of D ismissal,

513neither Petitioners nor Intervenors have filed a response to the

523Motion for Summary Final Order.

528FINDINGS OF FACT

5311. Luis Caraballo was born on July 2, 2005, at Arnold

542Palmer Hospital in Orlando, Florida. He was a single gestation.

5522. Based o n his birth certificate , Luis weighed five

562pounds at birth. Five pounds equates to 2,267.96 grams. There

573is no dispute that Luis did not weigh at least 2,500 grams.

586CONCLUSIONS OF LAW

5893. The Division of Administrative Hearings has

596jurisdiction over t he parties to and the subject matter of these

608proceedings. §§ 766.301 - 766.316, Fla. Stat.

6154. The Plan was established by the Legislature "for the

625purpose of providing compensation, irrespective of fault, for

633birth - related neurological injury claims" rel ating to births

643occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

6545. The injured infant, her or his personal representative,

663parents, dependents, and next of kin may seek compensation under

673the Plan by filing a claim for compensation with D OAH.

684§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

692which administers the Plan, has "45 days from the date of

703service of a complete claim . . . in which to file a response to

718the petition and to submit relevant written information rel ating

728to the issue of whether the injury is a birth - related

740neurological injury." § 766.305(4), Fla. Stat. In the instant

749case, Petitioners have filed a Petition under protest, stating

758that they are not seeking any benefits under the Plan.

7686. NICA has d etermined that Luis does not have a claim

780that is compensable under the Plan and has filed a Motion for

792Summary Final Order, requesting that an order be entered finding

802that the claim is not compensable.

8087. In ruling on the motion, the Administrative Law Judge

818must make the following determination based upon the available

827evidence:

828(a) Whether the injury claimed is a birth -

837related neurological injury. If the

842claimant has demonstrated, to the

847satisfaction of the administrative law

852judge, that the infant h as sustained a brain

861or spinal cord injury caused by oxygen

868deprivation or mechanical injury and that

874the infant was thereby rendered permanently

880and substantially mentally and physically

885impaired, a rebuttable presumption shall

890arise that the injury is a birth - related

899neurological injury as defined in s.

905766.303(2).

906§ 766.309(1), Fla. Stat.

9108. The term "birth - related neurological injury" is defined

920in section 766.302(2) as follows:

"925Birth - related neurological injury" means

931injury to the brain or spi nal cord of a live

942infant weighing at least 2,500 grams for a

951single gestation or, in the case of a

959multiple gestation, a live infant weighing

965at least 2,000 grams at birth caused by

974oxygen deprivation or mechanical injury

979occurring in the course of labor, delivery,

986or resuscitation in the immediate

991postdelivery period in a hospital, which

997renders the infant permanently and

1002substantially mentally and physically

1006impaired.

10079. The evidence, which is not refuted, established that

1016Luis was a single gestation and did not weigh at least 2,500

1029grams at birth. Thus, Luis has not sustained a birth - related

1041neurological injury because he did not meet the minimum

1050statutory weight as set forth in the definition of "birth -

1061related neurological injury," in section 766.30 2(2).

1068CONCLUSION

1069Based upon the foregoing Findings of Fact and Conclusions

1078of Law, it is ORDERED that the Petition filed by

1088Lizbeth Caraballo and Edgardo Caraballo, on behalf of and as

1098parents and natural guardians of Luis Caraballo, is dismissed

1107with pre judice.
