FINAL ORDER

THIS CAUSE comes before the State of Florida, Agency for Health Care Administration,

10172 filed

the Agency") regarding certificate of need (" CON") application number by

Northwest Medical Center, Inc. (" NWMC").

I. NWMC filed a CON application which sought the establishment of a 16- bed

in Broward County,

comprehensive medical rehabilitation unit within its hospital located

Florida, Service District 10. The Agency denied NWMC' s CON application 10172.

2. NWMC filed a petition for formal hearing challenging the Agency' s denial of

CON application number 10172.

3. Holy Cross Hospital, Inc., St. John' s Rehabilitation Hospital and Nursing Center,

Inc. d/ a b/ St. Anthony' s Rehabilitation Hospital, and HealthSouth Sunrise Rehabilitation

in

Hospital, LLC, d/ a b/ HealthSouth Rehabilitation Hospital, each filed a petition to intervene

support of the Agency' s denial of NWMC' s CON application 10172.

4. NWMC has since voluntarily dismissed its petition for formal hearing.

5. Based upon the voluntary dismissal, the Division of Administrative Hearings

entered an Order Closing File and Relinquishing Jurisdiction in the above styled matter.

IT IS THEREFORE ORDERED:

6. The denial of NWMC' s CON application 10172 is UPHELD.
