82STATEMENT OF THE CASE

86On February 27 , 2013, Petitioners, Matthew Salling and

94Mandy Schumacher , on behalf of and as parents and natural

104guardians of Jackson J. Salling (Jackson ), a minor, filed a

115Petitio n for Benefits Pursuant to Florida Statute Section 766.301

125et seq. (Petition) with the Division of Administrative Hearings

134(DOAH) for a determination of compensability under the Florida

143Birth - Related Neurological Injury Compensation Plan (Plan).

151The Petit ion named Luisa Vanegas , M.D., as the physician

161providing obstetric services at the birth of Jackson at Brandon

171Regional Hospital located in Brandon , Florida.

177DOAH served NICA with a copy of the Petition on March 4,

1892013 . DOAH served a copy of the Petit ion on Dr. Vanegas on

203March 4 , 2013. DOAH received a return receipt from the United

214States Postal Service on May 1, 2013, showing that Brandon

224Regional Hospital had been served with a copy of the Petition.

235As of the date of th is Summary Final Order of Di smissal, neither

249Dr. Vanegas nor Brandon Regional Hospital has petitioned to

258intervene in this proceeding.

262On July 25 , 2013, NICA filed a Motion for Summary Final

273Order, asserting that Jackson did not sustain a "birth - related

284neurological injury" as that term is defined in section

293766.302(2), Florida Statutes. A response to the motion was due

303to be filed on August 1 , 2013. No response was filed. On

315August 6, 2013, an Order was entered requiring Petitioners to

325show cause on or before August 20 , 2013, why the motion should

337not be granted. As of the date of this Summary Final Order of

350Dismissal, Petitioners have filed no response to the motion for

360summary final order.

363FINDINGS OF FACT

3661. Jackson J. Salling was born on February 28, 2008 , at

377Brandon Regio nal Hospital in Brandon , Florida. Jackson weighed

3864,070 grams at birth.

3912. NICA retained Michael S. Duchowny , M.D., as its medical

401expert in pediatric neurology. Dr. Duchowny examined Jackson and

410reviewed his medical records. In an affidavit dated July 22 ,

4202013, Dr. Duchowny opined as follows:

426Based upon the history provided to me and

434my physical and neurological examination of

440the child, and as further described in my

448evaluation report, I concluded that the child

455has a substantial mental impairment but does

462not evidence a substantial motor impairment.

468Further the medical records do not provide

475support for neurological injury of the brain

482or spinal cord acquired due to oxygen

489deprivation or mechanical injury. Rather,

494JacksonÓs present neurological prob lems are

500prenatal in origin and unrelated to

506intrapartum or immediate post - delivery

512events.

513* * *

516It is my medical opinion that Jackson

523Salling has not suffered a birth - related

531neurological injury as defined by the

537provisions of Chapter 766, Flor ida Statutes,

544and the he therefore is not eligible for

552compensation under the Florida Birth - Related

559Neurological Injury Compensation Plan.

5633. NICA retained Donald Willis, M.D., as an expert in

573maternal - fetal medicine to review the medical records of Jack son

585and his mother. In an affidavit dated July 19 , 2013, Dr. Willis

597opined:

598Jackson Salling was born by vaginal

604delivery after elective induction of labor at

61139 weeks gestation. Delivery was complicated

617by a shoulder dystocia lasting three minutes

624which resulted in a fractured humerus bone.

631Umbilical cord gas was within normal limits,

638and did not suggest hypoxia at birth. The

646newborn was cyanotic, floppy, and without

652spontaneous respirations at birth. His one -

659minute Apgar score was 3. Bag and mask

667ven tilation was given and the child quickly

675improved, with an Apgar score of 9 at five

684minutes and 9 at 10 minutes. Significant

691oxygen deprivation during labor and birth

697would be unlikely with normal Apgar scores of

705five and ten minutes. The fractured humer us

713required orthopedic management. No MRI or CT

720scan of the head was done.

726Based on my review of medical records, it

734is my opinion that there was no obstetrical

742event that resulted in loss of oxygen or

750mechanical trauma to the babyÓs brain during

757labor, delivery, or the immediate post -

764delivery period.

7664. A review of the file does not show any opinions contrary

778to the opinions of Dr. Duchowny and Dr. Willis that Jackson did

790not suffer a neurological injury due to oxygen deprivation or

800mechanical injury d uring labor , delivery , or resuscitation in the

810immediate post - delivery period and that Jackson does not have

821substantial and permanent mental and physical impairment s due to

831lack of oxygen or mechanical trauma are credited.

839CONCLUSIONS OF LAW

8425. The Divi sion of Administrative Hearings has jurisdiction

851over the parties to and the subject matter of these proceedings.

862§§ 766.301 - 766.316, Fla. Stat.

8686. The Plan was established by the Legislature "for the

878purpose of providing compensation, irrespective of f ault, for

887birth - related neurological injury claims" relating to births

896occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9077. The injured infant, her or his personal representative,

916parents, dependents, and next of kin may seek compensation u nder

927the Plan by filing a claim for compensation with DOAH.

937§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

945which administers the Plan, has "45 days from the date of service

957of a complete claim . . . in which to file a response to the

972petitio n and to submit relevant written information relating to

982the issue of whether the injury is a birth - related neurological

994injury." § 766.305(4), Fla. Stat.

9998. If NICA determines that the injury alleged in a claim is

1011a compensable birth - related neurologic al injury, it may award

1022compensation to the claimant, provided that the award is approved

1032by the administrative law judge to whom the claim has been

1043assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1054disputes the claim, as it has in the insta nt case, the dispute

1067must be resolved by the assigned administrative law judge in

1077accordance with the provisions of chapter 120, Florida Statutes.

1086§§ 766.304, 766.309, and 766.31, Fla. Stat.

10939. In discharging this responsibility, the Administrative

1100Law Judge must make the following determination based upon the

1110available evidence:

1112(a) Whether the injury claimed is a birth -

1121related neurological injury. If the claimant

1127has demonstrated, to the satisfaction of the

1134administrative law judge, that the infant h as

1142sustained a brain or spinal cord injury

1149caused by oxygen deprivation or mechanical

1155injury and that the infant was thereby

1162rendered permanently and substantially

1166mentally and physically impaired, a

1171rebuttable presumption shall arise that the

1177injury is a birth - related neurological injury

1185as defined in s. 766.303(2).

1190(b) Whether obstetrical services were

1195delivered by a participating physician in the

1202course of labor, delivery, or resuscitation

1208in the immediate postdelivery period in a

1215hospital; or by a ce rtified nurse midwife in

1224a teaching hospital supervised by a

1230participating physician in the course of

1236labor, delivery, or resuscitation in the

1242immediate postdelivery period in a hospital.

1248§ 766.309(1), Fla. Stat. An award may be sustained only if the

1260ad ministrative law judge concludes that the "infant has sustained

1270a birth - related neurological injury and that obstetrical services

1280were delivered by a participating physician at birth."

1288§ 766.31(1), Fla. Stat.

129210. The term "birth - related neurological inj ury" is defined

1303in section 766.302(2) as follows:

"1308Birth - related neurological injury" means

1314injury to the brain or spinal cord of a live

1324infant weighing at least 2,500 grams for a

1333single gestation or, in the case of a

1341multiple gestation, a live infant wei ghing at

1349least 2,000 grams at birth caused by oxygen

1358deprivation or mechanical injury occurring in

1364the course of labor, delivery, or

1370resuscitation in the immediate postdelivery

1375period in a hospital, which renders the

1382infant permanently and substantially me ntally

1388and physically impaired.

139111. The evidence, which is not refuted, established that

1400Jackson did not sustain an injury to the brain or spinal cord

1412caused by oxygen deprivation or mechanical injury occurring in

1421the course of labor , delivery , or durin g resuscitation in the

1432immediate post - delivery period, which resulted in substantial and

1442permanent mental and physical impairments. Therefore, Jackson is

1450not eligible for benefits under the Plan.

1457CONCLUSION

1458Based upon the foregoing Findings of Fact and C onclusions of

1469Law, it is ORDERED that the Petition filed by Matthew Salling and

1481Mandy Schumacher , on behalf of and as parents and natural

1491guardians of Jackson J. Salling , is dismissed with prejudice.
