89STATEMENT OF THE CASE

93On March 22, 2013, Petitioners, Amber Lane and Alonzo

102Kelley , on behalf of and as parents of Destini Kelley ( Destini ),

115a minor, filed a Petition Under Protest Pursuant to Florida

125Statutes Section 766.301 et seq. with the Division of

134Administrative Hearings (DOAH) for a determination of

141compensability under the Florida Birth - Related Neurological

149Injury Compensation Plan (Pla n). The case was assigned to

159Administrative Law Judge Susan B. Kirkland. On April 18, 201 3 ,

170Petitioners filed a Motion for Leave to Amend NICA Petition,

180which was granted by Order dated May 29, 2013. The Amended

191Petition (Petition) named Teresa L. Conra d , M.D., as the

201physician who provided obstetric services for the birth of

210Destini on March 26, 2008, at St. JosephÓs Hospital for Women

221located in Tampa , Florida.

225DOAH served NICA with a copy of the Petition on March 27,

2372013 . DOAH received a return rece ipt from the United States

249Postal Service on May 13, 2013, showing that St. JosephÓs

259Hospital for Women had been served with a copy of the Petition.

271DOAH receiv ed a return receipt from the United States Postal

282Service on July 26, 2013, showing that Dr. Co nrad was served with

295a copy of the Petition.

300On May 14, 2013, St. JosephÓs WomenÓs Hospital filed a

310Motion to Intervene, which was granted by Order dated May 29,

3212013. As of the date of the Summary Final Order of Dismissal ,

333Teresa L. Conrad, M.D., has n ot petitioned to intervene in this

345proceeding.

346On August 27 , 201 3 , NICA filed a Motion for Summary Final

358Order, requesting that a s ummary f inal o rder be entered finding

371that the claim was not compensable asserting that Destini did not

382sustain a Ðbirth - rela ted neurological injuryÑ as that term is

394defined in section 766.302(2), Florida Statutes . On

402September 16, 2013, an Order to Show Cause was entered directing

413Intervenors to show in writing by September 2 7, 2013, why NICAÓs

425Motion for Summary Final Order s hould not be granted. On

436September 27, 2013, Intervenor filed a Response to Order to Show

447Cause stating that Intervenor had not been provided with certain

457medical records necessary for Intervenor to evaluate this claim.

466After conducting a telephonic heari ng on the Motion for Summary

477Final Order and Order to Show Cause, Judge Kirkland entered an

488Order Extending Time to Respond to Motion for Summary Final Order

499on October 22, 2013, granting an extension of time until

509November 4, 2013, for Intervenor to file a response to NICAÓs

520Motion for Summary Final Order. The docket does not reflect that

531a response was filed.

535On February 10, 2014, NICA filed a Renewed Motion for

545Summary Final Order. A Motion to Withdraw as Counsel for

555Petitioners was granted by Order d ated April 3, 2014, allowing

566PetitionersÓ counsel to withdraw from representation of

573Petitioners. Intervenor filed a Response to NICAÓs Renewed

581Motion for Summary Final Order on March 27, 2014, in opposition

592to NICAÓs renewed motion. Intervenor asserted that NICAÓs

600maternal - fetal expert, Dr. Willis, had not been provided with

611certain medical records and that Destini had not yet been

621evaluated by a pediatric neurologist. On June 6, 2014, and

631subsequent to a telephonic hearing on the Motion, an Order

641Denyi ng Renewed Motion for Summary Final Order was entered,

651noting that no appearance had been made by new counsel for

662Petitioners, and that Petitioners had not responded to the

671Renewed Motion. On June 6, 201 4 , a Notice of Hearing by Video

684Teleconferencing was issued scheduling the final hearing for

692September 9, 2014. On August 18, 2014, NICA filed a Motion for

704Extension of Time and to Reschedule Final Hearing on the grounds

715that Petitioners had not responded to discovery propounded by

724R espondent, that additio nal discovery propounded upon Petitioners

733by Respondent had not been returned in the mail, and that an

745examination with a pediatric neurologist had been scheduled for

754October 21, 2014.

757On August 21, 2014, a Notice of Case Reassignment was

767entered reassi gning the case to the undersigned, due to Judge

778KirklandÓs impending retirement. On September 2, 2014, an Order

787Granting Continuance was entered.

791On September 3, 2014, a Notice of Appearance was filed by

802Nicole Sivils, Esquire, of The Florida Law Group on behalf of

813Petitioners. On October 3, 2014, NICA filed a Second Renewed

823Motion for Summary Final Order. On October 15, 2014, Intervenor

833filed its Response to NICAÓs Second Renewed Motion for Summary

843Final Order, asserting that Petitioners had not fully r esponded

853to its discovery requests, had not admitted all Requests for

863Admissions without qualification or restriction, and that the

871examination by the pediatric neurologist had not yet taken place.

881On October 20, 2014, NICAÓs Second Renewed Motion for Summ ary

892Final Order was denied.

896Also on October 20, 2014, Petitioners filed a Notice of

906Serving PetitionerÓs Response to Intervenor St. JosephÓs WomenÓs

914HospitalÓs Request for Admissions. Intervenor interprets

920PetitionersÓ responses to be an admission that Destini sustained

929a birth related neurological injury.

934On December 2, 2014, the parties filed a Status report

944indicating that all parties requested an additional 90 days to

954complete discovery and to report back as to the status of the

966case and whether a he aring would be necessary. On February 5,

9782015, the parties filed another Joint Status Report requesting

987until May 15, 2015, to complete discovery and to report back to

999the undersigned. On March 18, 2015, John McKnight, also of The

1010Florida Law Group, ente red a Notice of Appearance. On March 18,

10222015, PetitionersÓ new counsel filed a Motion to Withdraw which

1032was granted by Order dated March 25, 2015. Petitioners have been

1043representing themselves since that time.

1048NICA filed the instant Third Renewed Motio n for Summary

1058Final Order on May 4, 2015. On May 15, 2015, Respondent filed a

1071Status Report. Counsel for Respondent informed that he was

1080advised by Petitioner Lane that she did not want NICA benefits

1091and did not want her daughter further evaluated. This

1100declaration to RespondentÓs counsel was not confirmed by any

1109pleading filed by Petitioners but is consistent with the Petition

1119for Benefits, as amended, which clearly stated that the Ðparents

1129are NOT CLAIMANTS.Ñ In any event, the scheduled evaluation of

1139Destini by a pediatric neurologist did not take place.

1148On May 18, 2015, Intervenor filed its Response to NICAÓs

1158Third Renewed Motion for Summary Final Order to which Respondent

1168filed a Reply. Intervenor requested a hearing requiring

1176Petitioners to state u nder oath whether they sought NICA benefits

1187and that, if they did not want benefits, the Petition should be

1199withdrawn by Petitioners or dismissed by the undersigned.

1207Several efforts were made by the undersignedÓs office to

1216schedule a telephonic hearing wit h all parties present, but these

1227efforts were unsuccessful due to Petitioners not responding to

1236these efforts. Accordingly, on June 8, 2015, an O rder to Show

1248Cause was entered instructing the parties to inform the

1257undersigned in writing no later than June 22, 2015, as to why

1269NICAÓs third renewed Motion for Summary Final Order should not be

1280granted. The Order to Show Cause informed the parties that

1290whether Petitioners want or do not want NICA benefits, the

1300undersigned is required to make a determination as to whether the

1311claim is compensable pursuant to section 766.304, Florida

1319Statutes. The Order to Show Cause further informed that absent

1329PetitionersÓ withdrawal of their Petition, the undersigned must

1337make a determination of whether or not this claim is c ompensable

1349under the NICA Plan. Intervenor and NICA filed responses to the

1360Order to Show Cause. Petitioners did not file a response.

1370Intervenor reasserted its position that Petitioner , Ms. Lane,

1378should be required to state under oath whether or not she ( they)

1391wanted NICA benefits in that she apparently informed Judge

1400Kirkland during a telephonic hearing at some point in this

1410process that she (they) did want NICA benefits. NICA responded

1420that whether Petitioners want or do not want NICA benefits is

1431irrele vant, and that no evidentiary hearing is necessary and that

1442further examination of Destini is not required to bring this

1452claim to resolution . NICA urges that the case should be

1463determined by NICAÓs pending Third Renewed Motion for Summary

1472Final Order.

1474It is not uncommon for Petitioners in NICA cases to file a

1486Petition for a determination of NICA benefits, when they are not

1497seeking such benefits. In such instances, the Petitions are not

1507dismissed. Rather, the AJL makes a determination of whether the

1517injur y is compensable under the NICA Plan.

1525FINDINGS OF FACT

15281. Destini Kelly was born on March 26 , 2 008 , at St.

1540JosephÓs Hospital for Women in Tampa , Florida. Destini weighed

1549in excess of 2,500 grams .

15562. Donald Willis, M.D. (Dr. Willis), was requested by NICA

1566to review the medical records for Destini . In a report dated

1578May 23 , 201 3 , Dr. Willis described his findings in pertinent part

1590as follows:

1592I have reviewed the medical records for the

1600above individual. The mother, Amber Lane was

1607a 20 year old G1. Pr egnancy course was

1616uneventful. She was admitted to the hospital

1623for induction of labor due to post - dates.

1632Genital Group B streptococcus (GBS) culture

1638during pregnancy was positive and antibiotics

1644were given during labor.

1648The fetal heart rate (FHR) monit or tracing

1656during labor was not available for review.

1663Delivery was by vaginal birth. Birth weight

1670was 3,516 grams or 7 lbs 12 ozs. The newborn

1681was not depressed . Apgar scores were 8/9.

1689Umbilical cord blood gas was not done.

1696Newborn nursery admission ex am was normal.

1703The hospital course was uneventful. The baby

1710was discharged home on two days after birth.

1718In summary, the baby was not depressed at

1726birth and had a normal newborn hospital

1733course.

1734There was no apparent obstetrical event that

1741resulted in loss of oxygen or mechanical

1748trauma to the babyÓs brain during labor,

1755delivery, or the immediate post delivery

1761period. I would not expect review of the FHR

1770tracing during labor to change the above

1777conclusions, but would be happy to review the

1785tracings if available.

1788Thank you for allowing me to review this

1796case.

17973. In an affidavit dated July 2, 2013, Dr. Willis

1807reaffirmed his opinion that t here was no apparent obstetrical

1817event that resulted in loss of oxygen or mechanical trauma to the

1829babyÓs brain dur ing labor , delivery or the immediate post -

1840delivery period.

18424. Petitioners denied the following request for admission:

1850ÐDestini Kelly did not suffer mechanical trauma to the babyÓs

1860brain or spinal cord during labor, delivery or the immediate

1870post - delivery period.Ñ

18745. Petitioners admitted the following request for

1881admission: ÐDestini Kelly did not suffer oxygen deprivation

1889during labor, delivery or in the immediate post - delivery period

1900that rendered the infant permanently and substantially mentally

1908and phy sically impaired.Ñ

19126. Petitioners denied the following request for admission:

1920ÐDestini Kelly is not permanently and substantially physically

1928impaired.Ñ

19297. Petitioners denied the following request for admission:

1937ÐDestini Kelly is not permanently and subst antially mentally

1946impaired.Ñ

19478. The above quoted - responses are confusing in that

1957Petitioners were denying a negative. These responses are not

1966sufficient to establish that Destini did sustain a birth - related

1977neurological injury as contemplated in section 766.309(1).

1984Moreover, Petitioners did not respond to RespondentÓs Third

1992renewed Motion for Summary Final Order or the Order to Show

2003Cause, thereby raising no disagreement with NICAÓs motion.

20119 . A review of the file reveals that no contrary expert

2023evide nce was presented by either Petitioners or Intervenor to

2033dispute Dr. WillisÓ opinion that there was no apparent

2042obstetrical event that resulted in loss of oxygen or mechanical

2052trauma to the brain during labor, delivery, or the immediate

2062post - delivery perio d. H is opinion was filed initially with

2074NICAÓs Motion for Summary Final Order on August 27, 2013, and

2085again with the Third Renewed Motion for Summary Final Order filed

2096May 4, 2015. Dr. WillisÓ opinion is credited.

2104CONCLUSIONS OF LAW

210710 . The Division of Administrative Hearings has

2115jurisdiction over the parties to and the subject matter of these

2126proceedings. §§ 766.301 - 766.316, Fla. Stat.

213311 . The Plan was established by the Legislature "for the

2144purpose of providing compensation, irrespective of fault, for

2152birth - related neurological injury claims" relating to births

2161occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

217212 . The injured infant, her or his personal representative,

2182parents, dependents, and next of kin may seek compensation under

2192the Plan by filing a claim for compensation with DOAH.

2202§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

2210which administers the Plan, has "45 days from the date of service

2222of a complete claim . . . in which to file a response to the

2237petit ion and to submit relevant written information relating to

2247the issue of whether the injury is a birth - related neurological

2259injury." § 766.305(4), Fla. Stat.

226413 . NICA has determined that Petitioners do not have a

2275claim that is compensable under the Plan and has filed a Motion

2287for Summary Final Order, requesting that an order be entered

2297finding that the claim is not compensable.

230414 . In ruling on the motion, the Administrative Law Judge

2315must make the following determination based upon the available

2324eviden ce:

2326(a) Whether the injury claimed is a birth -

2335related neurological injury. If the claimant

2341has demonstrated, to the satisfaction of the

2348administrative law judge, that the infant has

2355sustained a brain or spinal cord injury

2362caused by oxygen deprivation or mechanical

2368injury and that the infant was thereby

2375rendered permanently and substantially

2379mentally and physically impaired, a

2384rebuttable presumption shall arise that the

2390injury is a birth - related neurological injury

2398as defined in s. 766.30 2 (2).

2405§ 766.309( 1), Fla. Stat.

24101 5 . The term "birth - related neurological injury" is defined

2422in section 766.302(2) as follows:

"2427Birth - related neurological injury" means

2433injury to the brain or spinal cord of a live

2443infant weighing at least 2,500 grams for a

2452single gestat ion or, in the case of a

2461multiple gestation, a live infant weighing at

2468least 2,000 grams at birth caused by oxygen

2477deprivation or mechanical injury occurring in

2483the course of labor, delivery, or

2489resuscitation in the immediate postdelivery

2494period in a hospi tal, which renders the

2502infant permanently and substantially mentally

2507and physically impaired.

25101 6 . The evidence, which is not refuted, established that

2521Destini did not sustain an injury to the brain caused by oxygen

2533deprivation or mechanical injury in th e course of labor, delivery

2544or the immediate post - delivery period. Th erefore , as any injury

2556to Destini does not meet the definition of a Ðbirth - related

2568neurological injuryÑ as defined by section 766.302(2), Destini is

2577not eligible for benefits under the P lan.

2585CONCLUSION

2586Based upon the foregoing Findings of Fact and Conclusions of

2596Law, it is ORDERED that the Petition , as amended, filed by Amber

2608Lane and Alonzo Kelley , o n behalf of and as parents and natural

2621guardians of Destini Kelley , a minor, is dism issed with

2631prejudice.
