43This cause came on for consideration upon a Motion for

53Summary Final Order and a Joint Stipulation of Facts filed by

69Compensation Association (NICA), on August 30, 2013.

76STATEMENT OF THE CASE

80On March 20, 2013, Petitioner, Vonshelle Brothers,

87individually and as parent of Iyonna Hugley (Iyonna), a minor,

97filed a Petition for Determination of Compensability Pursuant to

106Florida Statutes Section 766.301 et seq. (Petition) with the

115Division of Administrative Hearings (DOAH) for a determination of

124compensability under the Florida Birth-Related Neurological

130Injury Compensation Plan (Plan). The Petition named

137Mark Sargent, M.D., as the physician who provided obstetric

146services for the birth of Iyonna. The Petition stated that

156Iyonna was born at Wuesthoff Medical Center, in Rockledge,

165Florida.

166DOAH served NICA and Dr. Sargent with copies of the Petition

177on April 1, 2013. DOAH served a copy of the Petition on

189Wuesthoff Medical Center on April 29, 2013.

196On May 28, 2013, Wuesthoff Health Systems, Inc., filed a

206Petition for Leave to Intervene. By Order dated June 11, 2013,

217Wuesthoff Health Systems, Inc., was granted leave to intervene.

226On August 30, 2013, NICA filed a Motion for Summary Final

237Order, requesting that a Summary Final Order be entered finding

247that the claim was not compensable because Iyonna did not meet

258the requisite minimum statutory birth weight as required by

267section 766.302(2), Florida Statutes. A Joint Stipulation of

275Facts was included with the motion as Exhibit A.

284FINDINGS OF FACT

2871. The parties have stipulated to the following facts.

2962. Iyonna Hugley was born on October 14, 2010, at 1950

307hours at Wuesthoff Medical Center, Melbourne, Florida.

3143. Mark Sargent, M.D., provided obstetrical services during

322the delivery of Iyonna. Dr. Sargent is a participating physician

332in the Plan as defined in section 766.302(7).

3404. At birth, Iyonna weighed 2,347 grams and was delivered

351from a single gestation.

355CONCLUSIONS OF LAW

3585. The Division of Administrative Hearings has jurisdiction

366over the parties to and the subject matter of these proceedings.

377§§ 766.301-766.316, Fla. Stat.

3816. The Plan was established by the Legislature "for the

391purpose of providing compensation, irrespective of fault, for

399birth-related neurological injury claims" relating to births

406occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

4177. The injured infant, her or his personal representative,

426parents, dependents, and next of kin may seek compensation under

436the Plan by filing a claim for compensation with DOAH.

446which administers the Plan, has "45 days from the date of service

458of a complete claim . . . in which to file a response to the

473petition and to submit relevant written information relating to

482the issue of whether the injury is a birth-related neurological

492injury." § 766.305(4), Fla. Stat.

4978. NICA has determined that Iyonna does not have a claim

508that is compensable under the Plan and has filed a Motion for

520Summary Final Order, requesting that an order be entered finding

530that the claim is not compensable.

5369. In ruling on the motion, the Administrative Law Judge

546must make the following determination based upon the available

555evidence:

556(a) Whether the injury claimed is a birth-

564related neurological injury. If the claimant

570has demonstrated, to the satisfaction of the

577administrative law judge, that the infant has

584sustained a brain or spinal cord injury

591caused by oxygen deprivation or mechanical

597injury and that the infant was thereby

604rendered permanently and substantially

608mentally and physically impaired, a

613rebuttable presumption shall arise that the

619injury is a birth-related neurological injury

625as defined in s. 766.303(2).

630§ 766.309(1), Fla. Stat.

63410. The term "birth-related neurological injury" is defined

642in section 766.302(2) as follows:

"647Birth-related neurological injury" means

651injury to the brain or spinal cord of a live

661infant weighing at least 2,500 grams for a

670single gestation or, in the case of a

678multiple gestation, a live infant weighing at

685least 2,000 grams at birth caused by oxygen

694deprivation or mechanical injury occurring in

700the course of labor, delivery, or

706resuscitation in the immediate postdelivery

711period in a hospital, which renders the

718infant permanently and substantially mentally

723and physically impaired.

72611. The stipulation of the parties has established that

735Iyonna was a single gestation and did not weigh at least 2,500

748grams at birth. Thus, Iyonna has not sustained a birth-related

758neurological injury because she did not meet the minimum

767statutory weight as set forth in the definition of "birth-related

777neurological injury," in section 766.302(2).

782CONCLUSION

783Based upon the foregoing Findings of Fact and Conclusions of

793Law, it is ORDERED that the Petition filed by Vonshelle Brothers,

804individually and as parent of Iyonna Hugley, is dismissed with

814prejudice.

815DONE AND ORDERED this 6th day of September, 2013, in
