244S TATEMENT OF THE ISSUE

249The issue to be determined by this Order is whether the

260Request for Administrative Hearing filed by Petitioner with the

269Department of Environmental Protection ( Ð DEP Ñ ) on February 15,

2812013 , was timely 1/ and , if not, whether the application of the

293doctrine o f equitable tolling would serve to relieve Petitioner

303of the consequences of having failed to file a petition for

314hearing within the time allotted by applicable notice

322provisions.

323PRELIMINARY STATEMENT

325This case arose upon the issuance by the DEP of a renewal

337of a Municipal Separate Storm Sewer System permit (the Ð MS4

348PermitÑ) to Respondents Sarasota County, Town of Longboat Key,

357City of Sarasota, City of Venice, and the Department of

367Transportation District 1 (ÐApplicantsÑ).

371The notice of proposed agency action was published in the

381Sarasota Herald - Tribune, a newspaper of general circulation in

391Sarasota County, on January 30, 2013 . Because the MS4 Permit

402area applied to the Town of Longboat Key, and because a portion

414of the Town o f Longboat Key extends across the Sarasota County

426line into Manatee County, notice w a s also published in the

438Bradenton Herald, a newspaper of general circulation in Manatee

447County, on February 4, 2013 .

453On February 15, 2013, Petitioner filed its Request for

462Administrative Hearing (ÐPetitionÑ) with the DEP. The DEP

470dismissed the Petition with leave to amend. There after , on or

481about March 21, 2013, Petitioner filed an Amended Petition for

491FLS000004 - 004 (ÐAmended PetitionÑ) . On April 8, 2013, the

502Amended Pet ition was transmitted to the Division of

511Administrative Hearings for assignment of an Administrative Law

519Judge.

520On September 11, 2013, Sarasota County filed its Motion to

530Dismiss (ÐMotionÑ), arguing that the Request for Hearing was not

540timely filed, and th at the facts of this case do not warrant the

554application of the doctrine of equitable tolling to excuse the

564untimely filing. Rule 28 - 106.204(2) provides, in pertinent

573part, that Ðmotions to dismiss the petition or request for

583hearing shall be filed no lat er than 20 days after assignment of

596the presiding officer, unless the motion is based upon a lack of

608jurisdiction or incurable errors in the petition.Ñ The failure

617to timely file a petition, if substantiated, constitutes an

626incurable error in the initial Request for Administrative

634Hearing. Thus, the Motion was timely.

640On September 16, 2013, the undersigned entered an Order to

650Show Cause directing Petitioner to show cause as to why the

661Motion should not be granted, and allowing Respondents to file

671memor anda on the issue.

676On September 23, 2013, Petitioner filed its Response to

685Sarasota CountyÓs Motion to Dismiss and Response to Order to

695Show Cause. In its response, Peti ti oner argued that the

706publication of notice in the Bradenton Herald created a new

716point of entry for Petitioner to challenge the MS4 Permit and,

727if the Petition is determined to be untimely filed, the doctrine

738of equitable tolling should be applied.

744On Sep tember 23, 2013, the Department of Transportation

753(ÐDOTÑ) and the DEP filed separate memoranda in support of the

764Motion.

765The Motion was noticed for an evidentiary hearing . See Pro

776Tech Monitoring, Inc. v. Dep't of Corr. , 72 So. 3d 277 , 281 - 282

790(Fla. 1st DCA 2011); Hurley v. Dep't of Bus. & Prof'l Reg . , 965

804So. 2d 359 (Fla. 4th DCA 2007); Nicks v. Dep't of Bus. & Prof'l

818Reg. , 957 So. 2d 65, 68 (Fla. 5th DCA 2007) . The hearing was

832held as scheduled on October 16, 2013 , by video telecon ference

852Sarasota County called as its witness Rene A. Janneman, the

862NPDES Coordinator for Sarasota County. Sarasota CountyÓs

869Exhibits 1 - 7 were received in evidence.

877DEP Exhibit 1 was received in evidence . The DEP did not

889call any witnesses.

892Petitioner called as its witness , Christopher Wright, a

900part - time consultant for Petitioner. In addition, Achim

909Ginsberg - Klemmt and Erika Ginsberg - Klemmt, PetitionerÓs m anaging

920m embers, testified on PetitionerÓs behal f. Petitioner Ó s

930Exhibits 1, 2, 4, and 5 were received in evidence.

940At the conclusion of the evidentiary hearing, the parties

949were given the opportunity to submit proposed findings and

958orders in accordance with s ection 120.57(1)(b), Florida

966Statutes. Ea ch party waived that right. A ruling on the Motion

978to Dismiss was thereupon announced from the bench, and is

988memorialized in this Recommended Order of Dismissal.

995FINDINGS OF FACT

998The Parties

10001. Petitioner , SRQUS, LLC , is an active Florida, limited -

1010liability corporation, and is the owner of submerged lands and

1020adjacent upland property contiguous to Sarasota Bay. Petitioner

1028is a closely held entity, the only members being Achim and Eri k a

1042Ginsberg - Klem m t .

10482 . Respondent, Department of Environmental Pr otection , is

1057an agency of the State of Florida having jurisdiction for

1067permitting Municipal Separate Storm Sewer Systems (MS4),

1074including duties as a federally - approved state program for the

1085implementation of the Federal National Pollutant Discharge

1092Elimin ation System (NPDES) Program, pursuant to authority

1100conf erred under s ection 403.0885, Florida Statutes .

11093 . Respondents, Sarasota County, City of Sarasota, City of

1119Venice, Town of Longboat Key, and Department of Transportation

1128( Ð DOT Ñ ) (collectively the Ð A pplicants Ñ ) are responsible for

1143certain existing stormwater point - source discharges to waters of

1153the state from those portions of MS4 facilities owned or

1163operated by one or more of the individual Applicants.

11724 . T he DEP issued a notice of proposed agency action to

1185issue a renewal of an existing MS4 Permit to the Applicants.

11965 . On January 30, 2013, Sarasota County arranged for the

1207notice to be published in the Sarasota Herald - Tribune, which is

1219a newspaper of general circulation in Sarasota County. The

1228notice provided as follows:

1250The Department of Environmental Protection

1255gives notice of its intent to issue a permit

1264to Sa rasota County, 1660 Ringling Boulevard,

1271Sarasota, Florida 34236 within its

1276jurisdiction and including the following co -

1283permittees: Florida Department of

1287Transportation District One, Town of

1292Longboat Key, City of North Port, City of

1300Sarasota, and City of Ve nice, for renewal of

1309a Municipal Separate Storm Sewer System

1315[MS4] permit.

1317Any person whose substantial interests are

1323affected by the proposed permitting decision

1329of the Department may petition for an

1336administrative hearing in accordance with

1341Sections 120. 569 and 120.57 of the Florida

1349Statutes (F.S.). The petition must contain

1355the information set forth below and must be

1363filed (received) in the Department of

1369Environmental Protection, Office of General

1374Counsel, Mail Station 35, 3900 Commonwealth

1380Boulevard, T allahassee, Florida 32399 - 3000.

1387Petitions must be filed within fourteen days

1394of publication of this public notice or

1401within fourteen days of receipt of the

1408notice of intent, whichever occ urs first. A

1416petitioner must mail a copy of the petition

1424to the app licant at the address indicated

1432above, at the time of filing. The failure

1440of any person to file a petition [or a

1449request for mediation, as discussed below]

1455within the appropriate time period shall

1461constitute a waiver of that personÓs right

1468to request an a dministrative determination

1474(hearing) under Sections 120.569 and 120.57,

1480F.S., or to intervene in this proceeding and

1488participate as a party to it. Any

1495subsequent intervention will be only at the

1502discretion of the presiding officer upon the

1509filing of a mo tion in compliance with Rule

1600(5) A statement of facts that the

1607petitioner contends warrant reversal or

1612modification of the DepartmentÓs action;

1617(6) A statement of which rules or statutes

1625the petitioner contends require reversal or

1631modification of the Depa rtmentÓs action; and

1638(7) A statement of the relief sought by the

1647petitioner, stating precisely the action

1652that the petitioner wants the Department to

1659take.

1660Because the administrative hearing process

1665is designed to formulate final agency

1671action, the filin g of a petition means that

1680the final action of the Department may be

1688different from the position taken by it in

1696the notice of intent. Persons whose

1702substantial interests will be affected by

1708any such final decision of the Department on

1716the permit revision have the right to

1723petition to become a party to the

1730proceeding, in accordance with the

1735requirements set forth above.

18106 . Because a portion of the Town of Longboat Key extends

1822into Manatee County, the Town of Longboat Key arranged for the

1833notice to be published in the Bradento n Herald, which is a

1845newspaper of general circulation in Manatee County. The notice

1854was published on February 4, 2013. The substance of the notice,

1865except for the date of publication, was identical to that

1875published in the Sarasota Herald - Tribune.

18827 . Ne ither Petitioner, nor its representatives, saw either

1892of the published notices prior to the filing of the Petition .

19048 . On or about February 8, 2012, as a result of the filing

1918of a pre - hearing stipulation in related litigation involving an

1929Environmental R esource Permit (ÐERPÑ) issued by the Southwest

1938Florida Water Management District (ÐSWFWMDÑ), Petitioner became

1945aware of the existence of the MS4 Permit . Erika Ginsberg - Klemmt

1958obtained a copy of the permit online, and on Februa ry 12, 2013 ,

1971sent an e - mail t o employees of the DEP Ft. Myers Ó office

1986expressing her general concern with water quality from the

1995disputed stormwater outfall. She expressed her belief that

2003Sarasota County was in violation of the existing MS4 permit, and

2014request ed that the recipients of her e - mail Ð[p]lease be so kind

2028as to look into this matter and let us know what could be done

2042to prevent this unacceptable condition to continue unchecked

2050like it did in the past . Ñ T he e - mail d id not request any

2068information regarding the MS4 Permit r enewal application, nor

2077did it request any information regarding notices or deadlines

2086related to the application.

20909 . On February 13, 2013, Christopher Wright, a consultant

2100for Petitioner, called the DEP to gather information and do some

2111ÐlegworkÑ relat ed to PetitionerÓs challenge to the SWFWMDÓs ERP .

2122The purpose of the call was to determine if information

2132submitted to the DEP in conjunction with the MS4 application ,

2142particularly drainage basin maps, could have been of use in the

2153SWFWMD litigation.

215510 . Mr. Wright spoke with DEP employee , Heather Ritchie ,

2165regarding the drainage basin maps that had been submitted to the

2176DEP . During the course of their discussion, Ms. Ritchie advised

2187Mr. Wright that a Notice of Intent to issue the MS4 Permit had

2200been issued by the DEP. However, Ms. Ritchie did not know when

2212Sarasota County had published the notice or when the deadline

2222for challenging the proposed agency action was to run. In

2232short, Ms. Ritchie expressed to Mr. Wright that Ðshe didnÓt know

2243what the st atus of things were. Ñ The discussion then went back

2256to the primary substance of the call, which was watersheds and

2267dis charge points. Ms. Ritchie agreed to provide Mr. Wright with

2278an electronic copy of a drainage map from the MS4 Permit file.

229011 . At 12:43 p.m. , on February 13, 2013, Ms. Ritchie sent

2302a map to Mr. Wright via e - mail , and indicated that Ð[i]f you

2316have additional questions or comments, you may call or e - mail

2328me.Ñ

232912 . Later on the afternoon of February 13, 2013 ,

2339Mr. Wright decided that he should ask Ms. Ritchie for a copy of

2352the Notice of I ntent.

235713 . At 5:59 p.m. , on February 13, 2013, after the close of

2370business for the day, Mr. Wright wrote to Ms. Ritchie thanking

2381her for her Ðrapid response to my inquiry today,Ñ and pr o viding

2395her with comments on various basin areas and discharge

2404structures. Mr. Wright concluded his e - mail by stating that Ðat

2416this time I would also like to request a copy of the Notice of

2430Intent to Issue the MS4 Permit.Ñ

243614 . The next morning, February 14, 2013, Ms. Ritchie

2446provided Mr. Wright with the Notice of Intent to Issue the MS4

2458Permit as requested. Later that morning, Mr. Wright inquired as

2468to the time for filing a challenge to the permit. Ms. Ritchie

2480replied at 2:34 p.m. that afternoon that the MS4 Permit Ðwas

2491publicly noticed by the county on January 30th with a 14 day

2503window. The window closed yesterday.Ñ There is no evidence

2512that Ms. Ritchie had any specific information as to the date of

2524publication or the deadline for filing a challenge prior to that

2535communication with Mr. Wright.

253915 . Petitioner filed the Petition on February 15, 2013.

2549The disputes identified in the Petition were directed

2557exclusively at a 46 - acre drainage basin in downtown Sarasota,

2568and a related discharge structure t hat discharges stormwater

2577from the basin to Sarasota Bay just south of the intersection of

2589U.S. Highway 41 and Fruitville Road. The disputed basin and

2599discharge point are located in Sarasota County.

2606CONCLUSIONS OF LAW

260916 . The Division of Administrat ive Hearings has

2618jurisdiction over the parties to and subject matter of this

2628proceeding pursuant to secti ons 120.569 and 120.57(1), Florida

2637Statutes (2013).

2639Burden of Proof

264217 . It is well established that Ð[a]n agency seeking to

2653establish waiver based on the passage of time following action

2663claimed as final must show that the party affected by such

2674action has received sufficient notice to commence the running of

2684the time perio d within which review must be sought.Ñ Henry v.

2696DepÓt of Admin. , 431 So. 2d 677, 680 (Fla. 1st DCA 1983); see

2709also Bryant v. DepÓt of HRS , 680 So. 2d 1144 (Fla. 3rd DCA

27221996); Symons v. DepÓt of Banking and Fin. , 490 So. 2d 1322,

27341323 (Fla. 1st DCA 1986).

273918 . The notice published on January 30, 2013 , in the

2750Sarasota Herald - Tribune was sufficient to place a substantially

2760affected person in Sarasota County on notice of the DEPÓs

2770proposed agency action on the MS4 Permit , and of their rights to

2782challenge th e issuance of the MS4 Permit .

279119 . Petitioner ha s the burden of proving that the Petition

2803was timely filed since its timeliness has been challenged by

2813Sarasota County . Conservation Alliance of St. Lucie C o., Inc.

3031Timel iness of the Petition

303621 . Section 120.569(1) provides , in pertinent part, that:

3045Each notice shall inform the recipient of

3052any administrative hearing or judicial

3057review that is available under this section,

3064s. 120.57, or s. 120.68; shall indicate the

3072proce dure which must be followed to obtain

3080the hearing or judicial review; and shall

3087state the time limits which apply.

309322 . As to the sufficiency of the notice to persons

3104affected by agency action to establish a "clear point of entry"

3115to challenge that action :

3120an agency's rules must clearly signal when

3127the agency's free - form decisional process is

3135completed or at a point when it is

3143appropriate for an affected party to request

3150formal proceedings . . . . In other words,

3159an agency must grant affected parties a

3166cl ear point of entry, within a specified

3174time after some recognizable intended agency

3180action to formal or informal administrative

3186proceedings.

3187Capeletti Bros. v. DepÓt of Transp. , 362 So. 2d 346, 348 (Fla.

31991st DCA 1978).

320223 . Section 120.569(2)(c) provides, in pertinent part,

3210that Ð[a] petition shall be dismissed if it . . . has been

3223untimely filed.Ñ

322524 . Section 403.815 provides, in pertinent part, that:

3234Within 14 days after publication of notice

3241of proposed agency action, any person whose

3248substantial inter ests are affected may

3254request a hearing in accordance with ss.

3261120.569 and 120.57. The failure to request

3268a hearing within 14 days after publication

3275of notice of proposed agency action

3281constitutes a waiver of any right to a

3289hearing on the application unde r ss. 120.569

3297and 120.57.

329925 . The DEP h as adopted Florida Administrative Code Rule

331062 - 110.106(2) , which provides, in pertinent part, as follows:

3320ÐReceipt of Notice of Agency ActionÑ

3326Defined. As an exception to subsection 28 -

3334106.111(2), F.A.C., for the purpose of

3340determining the time for filing a petition

3347for hearing on any actual or proposed action

3355of the Department as set forth below in this

3364rule, Ðreceipt of notice of agency actionÑ

3371means either receipt of written notice or

3378publication of the notice i n a newspaper of

3387general circulation in the county or

3393counties in which the activity is to take

3401place, whichever first occurs . . . .

340926 . As to the time frame within which a challenge to a

3422permit issued under Chapter 403 - - which would include a MS4

3434permit - - may by filed, the DEP has adopted Florida

3445Administrative Code Rule 62 - 110.106(3), which provides, in

3454pertinent part, that :

3458(3) Time for Filing Petition.

3463(a) A petition shall be in the form

3471required by Rule 28 - 106.201 or 28 - 106.301,

3481F.A.C., and must be filed (received) in the

3489office of General Counsel of the Department

3496within the following number of days after

3503receipt of notice of agency action, as

3510defined in subsection (2) of this rule

3517above:

35181. Petitions concerning Department action

3523or propo sed action on applications for

3530permits under Chapter 403, Florida Statutes

3536. . . : fourteen days; . . .

354527 . Petitioner Ó s interests are affected solely by virtue

3556of actions arising in Sarasota County and affecting their

3565property in Sarasota County. Thus, Petitioner received a clear

3574point of entry by reason of the January 30, 2013 , publication in

3586the Sarasota Herald. That f irst published notice started the

3596clock, and established the relevant time period within which the

3606time for challenging the MS4 Permit was to be calculated. Cf.

3617Labelle v. Bio - Med Servs. , 598 So. 2d 207 (Fla. 2d DCA 1992)

3631( Ð The rule provides for reasonable notice within the meaning of

3643section 120.57(1)(b)2 . , and the Ò whichever comes first Ó

3653provision of the rule governing the beginning of the fourteen -

3664day period for the filing of a petition seeking a hearing serves

3676a meaningful purpose. Ñ ) .

368228 . Pet itioner did not see the notice published by the

3694Town of Longboat Key in the Bradenton Herald, and was not misled

3706by that notice. 2/ PetitionerÓs substantial interests were not

3715affected by any activities authorized by the MS4 Permit that

3725were to occur in Ma natee County.

373229 . It is the opinion of the undersigned that , for permits

3744that apply in multiple counties , the publication of notice in a

3755newspaper serving an a djoining county does not serve to extend a

3767point of entry that has been created through the publication in

3778a newspaper of general circulation in the county in which the

3789activity that is the subject of the dispute is to take place. 3 /

380330 . The Petition was filed with the DEP on February 15,

38152013, 16 days after the publication of notice in the Sarasota

3826Herald - Tribune. Thus, the Petition was not timely filed .

3837Equitable Tolling

383931 . Dismissal of an untimely request for hearing is

3849mandatory , unless facts exist to support the application of the

3859doctrine of equitable tolling. § 120.569(2)(c), Fla. Stat.;

3867Fla. Admin. Code R. 28 - 106.111(4); Machules v. DepÓt of Admin. ,

3879523 So. 2d 1132 (Fla. 1988); Riverwood Nursing Ctr., LLC v. Ag.

392032 . Equitable tolling may be applicable Ðwhen the

3929plaintiff has been misled or lulled into inaction, has in some

3940extraordinary way been prevented from asserting his rights, or

396233 . The evidence in this case does not demonstrate that

3973Petitioner was misled or lulled into inaction as a result of any

3985act or omission of the DEP.

399134 . Petitioner relies on the discussions and

3999correspondence that took place betw een Mr. Wright and

4008Ms. Ritchie on February 13 and February 14, 2013 , as evidence

4019that it was misled or lulled into inaction. However, the

4029evidence de monstrates that Mr. WrightÓs interactions with

4037Ms. Ritchie on February 13, 2013 , were focused on obtaining

4047copies of basin maps. Furthermore, Mr. Wright understood that,

4056although Ms. Ritchie knew that a Notice of Intent had been

4067issued, she did not know t he status of the notice . The evidence

4081demonstrates that Ms. Ritchie did not provide Mr. Wright with

4091any information that was inacc urate or incorrect, nor did

4101Ms. Ritchie give Mr. Wright information that would have lulled

4111him into believing that some action was unnecessary.

411935 . Petitioner argues that Ms. Ritchie should have known

4129of PetitionerÓs interest in the 46 - acre drainage basin and

4140discharge structure, and thus should have provide d information

4149regarding the published notice to Mr. Wright, despi te the lack

4160of any specific request , and despite her lack of any specific

4171knowledge .

417336 . The doctrine of equitable tolling places no

4182affirmative obligation on the part of an agency employee to

4192discern the intent behind a request for information, or to

4202provide documents in the absence of a request. In this case,

4213Ms. Ritchie provided a copy of the Notice of Intent almost

4224immediately upon receipt of the request. The fact that

4233Mr. Wright did not request the notice until after the time for

4245challenging the MS4 Permit had passed does not constitute a

4255misleading act on the part of Ms. Ritchie, nor does it

4266constitute an act that could be construed in any way as lulling

4278Petitioner into inaction.

428137 . Petitioner further asserts that the February 12, 2013 ,

4291e - mai l from Erika Ginsberg - Kle mmt to employees of the DEP

4306Ft. Myers Ó office should be accepted as the timely filing of a

4319petition in the wrong forum . As indicated in the findings of

4331fact herein , the e - mail expresse d general concern with water

4343quality from the disputed stormwater outfall , and suggested that

4352Sarasota County was violating the existing MS4 permit . De spite

4363the request that the recipients Ð[p]lease be so kind as to look

4375into this matter and let us know what could be done to prevent

4388this unacceptable condition to continue unchecked like it did in

4398the past,Ñ the e - mail d id not , in any way , request a hearing or

4415suggest that it was intended to initiate a proceeding regarding

4425the MS4 Permit renewal. Thus, the e - mail does not constitute

4437the timely asserti on of PetitionerÓs rights mistakenly in the

4447wrong forum , or otherwise form a basis for the application of

4458equitable tolling.

446038 . Finally, the facts alleged by Petitioner are not so

4471extraordinary as to have prevented Petitioner from asserting its

4480rights. Rather, this case is little more than the not uncommon

4491instance of a person failing to monitor public notices and

4501failing to ask the agency for copies of any notices in a timely

4514manner.

451539 . The facts set forth by Petitioner are not sufficient

4526basis to apply the doctrine of equitable tolling. As stated by

4537the Third District Court of Appeal :

4544[Petitioner] has not demonstrated that he

4550was in any way prevented from timely

4557requesting a hearing within the twenty - one -

4566day period. He has merely alleged that he

4574mistakenly failed to do so.

4579Such a mistake, even if it rises to the

4588level of excusable neglect, does not provide

4595[Petitioner] with an escape from the

4601consequences of his late - filed petition.

4608Aleong v. State, Dep't of Bus. & Prof'l

4616Regulation , 96 3 So. 2d 799, 801 (Fla. 4th

4625DCA 2007). In closing, we quote the

4632following language from this Court:

4637We, like the Second District before us,

4644recognize that denying a late request

4650for an administrative hearing could be,

4656and perhaps should be, compared to

4662entry of a default in a judicial

4669proceeding, and that the administrative

4674rules should encourage the setting

4679aside of defaults to permit claims to

4686be heard on their merits rather than

4693decided on procedural technicalities.

4697Cann v. Dep't of Children & Family

4704Servs . , 813 So. 2d 237, 239 (Fla. 2d

4713DCA 2002). However "the legislature or

4719the relevant agencies are the decision -

4726makers to which these policy arguments

4732must be directed. In the context of

4739administrative law, the courts cannot

4744override a filing rule th at does not

4752violate due process." [ Id . ] at 240.

4761The final order is, therefore,

4766affirmed. (Emphasis in original)

4770Gonzalez v. Fla. Dep't of Fin. Servs. , 6 0 So. 3d 469 (Fla. 3d

4784DCA 2011) ( citing Patz v. Dep't of Health , 864 So. 2d 79, 82

4798(Fla. 3d DCA 2003) ) ; see also Nicks v. Dep't of Bus. & Prof'l

4812Reg. , 957 So. 2d 65, 68 (Fla. 5th DCA 2007)( Ð equitable tolling

4825would be available to extend the 21 - day deadline if [Petitioner]

4837can establish reasonable reliance upon a clear and affirmative

4846representation to him that his previous submission preserved his

4855right to contest factual allegations in the Department's

4863complaint. Ñ ); Jancyn Mfg. Corp. v. Dep Ót of Health , 742 So. 2d

4877473, 476 (Fla. 1st DCA 1999)( Ð the record reveals that the

4889failure to seek yet another exten sion or to file for a chapter

4902120 proceeding was the result of appellant's own inattention,

4911and not the result of a mistake or agency misrepresentation . Ñ )

492440 . In conclusion , PetitionerÓs request for hearing must

4933be dismissed because it was filed with the D EP more than 14 days

4947after the publication of a valid and compliant notice in the

4958Sarasota Herald - Tribune, and because Petitioner failed to prove

4968the elements necessary to support the application of equitable

4977tolling in this case.

498141 . The untimeliness of PetitionerÓs request for hearing

4990cannot be cured and, therefore, the opportunity to amend the

5000request for hearing is neither necessary nor appropriate.

5008See § 120.569(2)(c), Fla. Stat. (ÐDismissal of a petition shall,

5018at least once, be without prejudice to petitioner's filing a

5028timely amended petition curing the defect, unless it

5036conclusively appears from the face of the petition that the
