106STAT EMENT OF THE CASE
111On April 19, 2013, Petitioner, Sherita Leeks, individually
119and as personal representative of the estate of JerÓDonis Pringle
129(JerÓDonis), on behalf of his survivors , and Gregory Pringle,
138individually, filed a Petition Filed Under Protest (Petition)
146with the Division of Administrative Hearings (DOAH) for a
155determination of compensability under the Florida Birth - Related
164Neurological Injury Compensation Plan (Plan). An Amended
171Petition Filed Under Protest (Amended Petition) was filed on
180May 6, 2013.
183The Petition named Edmund Andah as the physician who
192delivered JerÓDonis at Heart of Florida Regional Medical Center
201located in Davenport, Florida.
205DOAH served NICA with a copy of the Petition on May 9, 2013.
218On May 29, 2013, Haines City HMA, L LC., d/b/a Heart of Florida
231Regional Medical Center filed a Motion for Leave to Intervene,
241which was granted by Order dated June 11, 2013. On June 14,
2532013, Dr. Andah and Heart of Florida OB/GYN Associates, P.A.,
263filed a Motion for Leave to Intervene, whi ch was granted by Order
276dated July 17, 2013.
280On August 29, 2013, NICA filed a Motion for Summary Final
291Order, asserting that JerÓDonis did not sustain a "birth - related
302neurological injury" as that term is defined in section
311766.302(2), Florida Statutes. Neither Petitioners nor
317Intervenors filed a response to the motion.
324On September 16, 2013, an Order to Show Cause was entered
335requiring Petitioners and Intervenors to show cause in writing
344why the Motion for Summary Final Order should not be granted. On
356October 1, 2013, NICA filed a Status Report, representing that
366all parties agree and stipulate to the entry of a Summary Final
378Order finding that PetitionersÓ claim is not compensable.
386FINDINGS OF FACT
3891. JerÓDonis Pringle was born on June 24, 2011, at He art of
402Florida Regional Medical Center located in Davenport, Florida.
410JerÓDonis weighed 3,004 grams at birth.
4172. NICA retained Donald Willis, M.D., a Florida board -
427certified obstetrician and gynecologist specializing in maternal -
435fetal medicine to review the medical records of JerÓDonis. In an
446affidavit dated July 2, 2013, Dr. Willis opined as follows:
456Based upon my education and experience, it is
464my professional opinion, within a reasonable
470degree of medical probability that the
476pregnancy was complicate d by Maternal
482Diabetes, that fetal testing at 34 weeks
489suggested fetal distress, that based on
495available medical records, the mother did not
502appear to be in labor at time of delivery by
512Cesarean section, and that the baby suffered
519severe oxygen deprivation and resulting brain
525damage. Overall findings suggest that severe
531brain injury occurred a t some time prior to
540hospital admission and, therefore, prior to
546delivery.
5473. A review of the file does not show any opinion contrary
559to Dr. WillisÓ opinion that Sh erita Leeks was not in labor prior
572to delivery and that JerÓDonis suffered severe oxygen deprivation
581resulting in brain injury prior to admission to the hospital and
592delivery is credited.
595CONCLUSIONS OF LAW
5984. The Division of Administrative Hearings has j urisdiction
607over the parties to and the subject matter of these proceedings.
618§§ 766.301 - 766.316, Fla. Stat.
6245. The Plan was established by the Legislature "for the
634purpose of providing compensation, irrespective of fault, for
642birth - related neurological injury claims" relating to births
651occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
6626. The injured infant, her or his personal representative,
671parents, dependents, and next of kin may seek compensation under
681the Plan by filing a claim for c ompensation with DOAH.
692§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
700which administers the Plan, has "45 days from the date of service
712of a complete claim . . . in which to file a response to the
727petition and to submit relevant writt en information relating to
737the issue of whether the injury is a birth - related neurological
749injury." § 766.305(4), Fla. Stat.
7547. If NICA determines that the injury alleged in a claim is
766a compensable birth - related neurological injury, it may award
776compen sation to the claimant, provided that the award is approved
787by the administrative law judge to whom the claim has been
798assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
809disputes the claim, as it has in the instant case, the dispute
821must be r esolved by the assigned administrative law judge in
832accordance with the provisions of chapter 120, Florida Statutes.
841§§ 766.304, 766.309, and 766.31, Fla. Stat.
8488. In discharging this responsibility, the a dministrative
856l aw j udge must make the following determination based upon the
868available evidence:
870(a) Whether the injury claimed is a birth -
879related neurological injury. If the claimant
885has demonstrated, to the satisfaction of the
892administrative law judge, that the infant has
899sustained a brain or spinal cord injury
906caused by oxygen deprivation or mechanical
912injury and that the infant was thereby
919rendered permanently and substantially
923mentally and physically impaired, a
928rebuttable presumption shall arise that the
934injury is a birth - related neurological inj ury
943as defined in s. 766.303(2).
948(b) Whether obstetrical services were
953delivered by a participating physician in the
960course of labor, delivery, or resuscitation
966in the immediate postdelivery period in a
973hospital; or by a certified nurse midwife in
981a tea ching hospital supervised by a
988participating physician in the course of
994labor, delivery, or resuscitation in the
1000immediate postdelivery period in a hospital.
1006§ 766.309(1), Fla. Stat. An award may be sustained only if the
1018administrative law judge conclud es that the "infant has sustained
1028a birth - related neurological injury and that obstetrical services
1038were delivered by a participating physician at birth."
1046§ 766.31(1), Fla. Stat.
10509. The term "birth - related neurological injury" is defined
1060in section 766 .302(2) as follows:
"1066Birth - related neurological injury" means
1072injury to the brain or spinal cord of a live
1082infant weighing at least 2,500 grams for a
1091single gestation or, in the case of a
1099multiple gestation, a live infant weighing at
1106least 2,000 grams at birth caused by oxygen
1115deprivation or mechanical injury occurring in
1121the course of labor, delivery, or
1127resuscitation in the immediate postdelivery
1132period in a hospital, which renders the
1139infant permanently and substantially mentally
1144and physically impaired .
114810. The evidence, which is not refuted, established that
1157JerÓDonisÓ mother was not in labor prior to delivery and that
1168JerÓDonis suffered severe oxygen deprivation resulting in brain
1176injury prior to delivery. Thus, Petitioners are not entitled to
1186com pensation under the plan.
1191CONCLUSION
1192Based upon the foregoing Findings of Fact and Conclusions of
1202Law, it is ORDERED that the Petition filed by Sherita Leeks,
1213individually and as personal representative of the estate of
1222JerÓDonis Pringle, and by Gregory Pr ingle, individually , is
1231dismissed with prejudice.
