70This cause came on for consideration upon the Motion for

80Summary Final Order filed by Respondent, Florida Birth - Related

90Neurological Injury Compensation Association (NICA), on

100STATEMENT OF THE CASE

104On May 3, 2013, Petitioner, To ndra Whited, on behalf of and

116as parent and natural guardian of Zacari Portor (Zacari), a

126minor, filed a Petition U nder Protest Pursuant to Florida Statute

137Section 766.301 et seq. (Petition) with the Division of

146Administrative Hearings (DOAH) for a determi nation of

154compensability under the Florida Birth - Related Neurological

162Injury Compensation Plan (Plan).

166The Petition named Dr. Shirley Cam p bell - Mogg and Dr. Winston

179O. Bliss as the physicians providing obstetric services at the

189birth of Zacari at Plantatio n General Hospital located in

199Plantation, Florida.

201DOAH served NICA with a copy of the Petition on May 9, 2013.

214On May 29, 2013, Dr. Bliss and Sunlife OB/GYN Services of Fort

226Lauderdale filed a Motion to Intervene, which was granted by

236Order dated June 1 1, 2013. On June 11, 2013, Plantation General

248Hospital Limited Partnership , d/b/a Plantation General Hospital

255filed Plantation General HospitalÓs Motion for Leave to Intervene

264Pursuant to Florida Administrative Code Rule 28 - 106.205, which

274was granted by O rder dated June 25, 2013. DOAH served a copy of

288the Petition on Dr. Cam p bell - Mogg on July 12, 2013. As of the

304date of this Summary Final Order of Dismissal, Dr. Cam p bell - Mogg

318has not petitioned to intervene in this proceeding.

326On September 11, 2013, NICA filed a Motion for Summary Final

337Order, asserting that Zacari did not sustain a "birth - related

348neurological injury" as that term is defined in section

357766.302(2), Florida Statutes.

360As of the date of this Summary Final Order of Dismissal

371neither Petition er nor Intervenors have filed a response to the

382Motion for Summary Final Order.

387FINDINGS OF FACT

3901. Zacari was born on April 2, 2011, at Plantation General

401Hospital located in Plantation, Florida. Zacari weighed eight

409pounds two ounces at birth.

4142. NICA retained Donald Willis, M.D. , as it medical expert

424specializing in maternal - fetal medicine. In an affidavit dated

434September 6, 2013, Dr. Willis opined as follows:

442It is my opinion that labor was indicated at

45139 weeks with no fetal distress during labor.

459Spontaneous vaginal birth resulted in a

465healthy baby with Apgar scores of 9/9. The

473newborn hospital course was uneventful.

478As such, it is my opinion that there was no

488apparent obstetrical event that resulted in

494loss of oxygen or mechanical trauma to the

502babyÓs brain during labor, delivery or the

509immediate post delivery period.

513Further, in that there was no oxygen

520deprivation or mechanical injury occurring in

526the course of labor, delivery or

532resuscitation in the immediately post -

538delivery period in the Ho spital, then

545accordingly, there was no causal event which

552would have rendered Zacari Porter permanently

558and substantially mentally and physically

563impaired as a result of same.

5693. NICA retained Michael S. Duchowny, M.D., as its medical

579expert in pediatric neurology. Dr. Duchowny examined Zacari on

588July 17, 2013, and reviewed his medical records. In an affidavit

599dated September 4, 2013, Dr. Duchowny opined as follows:

608It is my opinion that, in summary, ZacariÓs

616neurological examination is significant only

621for expressive language delay. In contrast,

627he has well - developed motor abilities, both

635gross and fine motor skills and has no focal

644or lateralizing findings.

647I had an opportunity to review medical

654records that were sent on June 27, 2013. The

663records d ocument a relatively uncomplicated

669perinatal and postnatal course without

674evidence of either mechanical injury or

680oxygen deprivation to the brain or spinal

687cord.

688The record review together with todayÓs

694neurological exam reveals developmentally

698appropriate motor function and only a mild

705expressive language delay which suggest that

711Zacari does not have either a substantial

718mental or physical impairment. I therefore

724believe that Zacari should not be considered

731for inclusion within the NICA program.

737As such, it is my opinion that Zacari is not

747permanently and substantially mentally

751impaired nor is he permanently and

757substantially physically impaired due to

762oxygen deprivation or mechanical injury

767occurring during the course of labor,

773delivery or the immediate post - delivery

780period in the hospital during the birth of

788Zacari Porter.

7904. A review of the file does not show any opinion contrary

802to the opinions of Dr. Willis and Dr. Duchowny that Zacari does

814not have a substantial and permanent mental and physical

823im pairment due to lack of oxygen or mechanical trauma during

834labor, delivery, or the immediate post - delivery period are

844credited.

845CONCLUSIONS OF LAW

8485. The Division of Administrative Hearings has jurisdiction

856over the parties to and the subject matter of t hese proceedings.

868§§ 766.301 - 766.316, Fla. Stat.

8746. The Plan was established by the Legislature "for the

884purpose of providing compensation, irrespective of fault, for

892birth - related neurological injury claims" relating to births

901occurring on or after Jan uary 1, 1989. § 766.303(1), Fla. Stat.

9137. The injured infant, her or his personal representative,

922parents, dependents, and next of kin may seek compensation under

932the Plan by filing a claim for compensation with DOAH.

942§§ 766.302(3), 766.303(2), a nd 766.305(1), Fla. Stat. NICA,

951which administers the Plan, has "45 days from the date of service

963of a complete claim . . . in which to file a response to the

978petition and to submit relevant written information relating to

987the issue of whether the injury is a birth - related neurological

999injury." § 766.305(4), Fla. Stat.

10048. If NICA determines that the injury alleged in a claim is

1016a compensable birth - related neurological injury, it may award

1026compensation to the claimant, provided that the award is approved

1036by the administrative law judge to whom the claim has been

1047assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1058disputes the claim, as it has in the instant case, the dispute

1070must be resolved by the assigned administrative law judge in

1080accorda nce with the provisions of chapter 120, Florida Statutes.

1090§§ 766.304, 766.309, and 766.31, Fla. Stat.

10979. In discharging this responsibility, the a dministrative

1105l aw j udge must make the following determination based upon the

1117available evidence:

1119(a) Wheth er the injury claimed is a birth -

1129related neurological injury. If the claimant

1135has demonstrated, to the satisfaction of the

1142administrative law judge, that the infant has

1149sustained a brain or spinal cord injury

1156caused by oxygen deprivation or mechanical

1162inj ury and that the infant was thereby

1170rendered permanently and substantially

1174mentally and physically impaired, a

1179rebuttable presumption shall arise that the

1185injury is a birth - related neurological injury

1193as defined in s. 766.303(2).

1198(b) Whether obstetrical services were

1203delivered by a participating physician in the

1210course of labor, delivery, or resuscitation

1216in the immediate postdelivery period in a

1223hospital; or by a certified nurse midwife in

1231a teaching hospital supervised by a

1237participating physician in t he course of

1244labor, delivery, or resuscitation in the

1250immediate postdelivery period in a hospital.

1256§ 766.309(1), Fla. Stat. An award may be sustained only if the

1268administrative law judge concludes that the "infant has sustained

1277a birth - related neurologi cal injury and that obstetrical services

1288were delivered by a participating physician at birth."

1296§ 766.31(1), Fla. Stat.

130010. The term "birth - related neurological injury" is defined

1310in section 766.302(2) as follows:

"1315Birth - related neurological injury" me ans

1322injury to the brain or spinal cord of a live

1332infant weighing at least 2,500 grams for a

1341single gestation or, in the case of a

1349multiple gestation, a live infant weighing at

1356least 2,000 grams at birth caused by oxygen

1365deprivation or mechanical injury occ urring in

1372the course of labor, delivery, or

1378resuscitation in the immediate postdelivery

1383period in a hospital, which renders the

1390infant permanently and substantially mentally

1395and physically impaired.

139811. The evidence, which is not refuted, established th at

1408Zacari Porter is not permanently and substantially mentally

1416impaired nor is he permanently and substantially physically

1424impaired due to oxygen deprivation or mechanical injury occurring

1433during the course of labor, delivery or the immediate post -

1444delivery period. Therefore, Zacari is not eligible for benefits

1453under the Plan.

1456CONCLUSION

1457Based upon the foregoing Findings of Fact and Conclusions of

1467Law, it is ORDERED that the Petition filed by Tondra Whited, on

1479behalf of and as parent and natural guardian of Zacari Porter, is

1491dismissed with prejudice.
