105On May 24, 2013, Petitioners, Yusleidy Atorresgasti and
113Dannel Ortega, on behalf of and as parents and natural guardians
124of Dannel Ortega (Dannel), a minor, filed a Petition Under
134Protest Pursuant to Florida Statute Section 766.301 et s eq .
145(Petition) wit h the Division of Administrative Hearings (DOAH)
154for a determination of compensability under the Florida Birth -
164Related Neurological Injury Compensation Plan (Plan). The
171Petition named Jennifer Swob o da, M.D., and David Marcantel, M.D.,
182as the physicians pr oviding obstetric services at the birth of
193Dannel at Florida Hospital Celebration in Celebration, Florida.
201DOAH served NICA with a copy of the Petition on May 31,
2132013. DOAH served a copy of the Petition on Florida Hospital
224Celebration Health on July 31, 2013. DOAH served copies of the
235Petition on Dr. Swob o da and Dr. Marcantel on June 3, 2013. On
249June 26, 2013, Adventist Health System/Sunbelt, Inc., d/b/a
257Florida Hospital Celebration Health, Florida Hospital Medical
264Group, Inc. (Florida Hospital), and Dr . Swoboda filed a Motion to
276Intervene, which was granted by Order dated July 9, 2013. As of
288the date of th is Summary Final Order of Dismissal, Dr. Marcantel
300has not petitioned to intervene in this proceeding.
308On October 30, 2013, NICA filed a Motion for S ummary Final
320Order, asserting that Dannel did not sustain a "birth - related
331neurological injury" as that term is defined in section
340766.302(2), Florida Statutes.
343On November 4, 2013, Petitioners filed PetitionersÓ Response
351to RespondentÓs Motion for Summa ry Final Order and Motion to
362Abate, requesting that RespondentÓs Motion for Summary Final
370Order be abated until completion of discovery. On November 6,
3802013, Intervenors filed IntervenorsÓ Motion to Defer Ruling or
389Hearing on NICAÓs Motion for Summary Fin al Order, and Motion for
401Extension of Time to Respond to NICAÓs Motion in Order to Allow
413Intervenors Time to Complete Discovery. PetitionersÓ and
420IntervenorsÓ motions were heard by telephonic conference call on
429November 13, 2013, and an Order was entered on November 15, 2013,
441extending the time to respond to RespondentÓs Motion for Summary
451Final Order to February 17, 2014.
457On February 17, 2014, Intervenors filed IntervenorsÓ
464Response to NICAÓs Motion for Summary Final Order, stating that
474they Ðtake no posi tion regarding NICAÓs pending Motion for Final
485Summary Order. " Petitioners filed no further response to the
494Motion for Final Summary Order.
499FINDINGS OF FACT
5021. Dannel O r tega was born on August 9, 2009, at Florida
515Hospital in Celebration, Florida. Danne l weighed eight pounds
524and 11 ounces at birth.
5292. Raymond J. Fernandez, M.D. (Dr. Fernandez), was
537requested by NICA to do an independent medical examination of
547Dannel. Dr. Fernandez examined Dannel on September 10, 2013.
556Based on his examination, Dr. Fe rnandez opined the following:
566There is evidence for substantial mental
572impairment characterized mainly by delay in
578acquisition of expressive speech and
583receptive language skills that will probably
589be permanent, although I anticipate some
595improvement. This is more likely than not
602due to oxygen deprivation during labor,
608delivery, and the immediate postdelivery
613period of resuscitation. There is MRI
619evidence of focal atrophy and gliosis within
626a portion of the left parietal lobe, probably
634due to ischemia resu lting in oxygen
641deprivation. Ischemia is probably explained
646on the basis of hypotension that required
653pharmacologic support. However, there is no
659evidence for motor impairment at this time
666and there is no reason to suspect motor
674impairment will become a problem for Dannel
681in the future.
6843. A review of the file does not show any contrary opinion.
696The opinion of Dr. Fernandez that Dannel does not have a
707permanent and substantial motor impairment is credited.
714CONCLUSIONS OF LAW
7174. The Division of Admi nistrative Hearings has jurisdiction
726over the parties to and the subject matter of these proceedings.
737§§ 766.301 - 766.316, Fla. Stat.
7435. The Plan was established by the Legislature "for the
753purpose of providing compensation, irrespective of fault, for
761bi rth - related neurological injury claims" relating to births
771occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7826. The injured infant, her or his personal representative,
791parents, dependents, and next of kin may seek compensation under
801the Pla n by filing a claim for compensation with DOAH.
812§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
820which administers the Plan, has "45 days from the date of service
832of a complete claim . . . in which to file a response to the
847petition and to submit relevant written information relating to
856the issue of whether the injury is a birth - related neurological
868injury." § 766.305(4), Fla. Stat.
8737. If NICA determines that the injury alleged in a claim is
885a compensable birth - related neurological in jury, it may award
896compensation to the claimant, provided that the award is approved
906by the administrative law judge to whom the claim has been
917assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
928disputes the claim, as it has in the instant ca se, the dispute
941must be resolved by the assigned administrative law judge in
951accordance with the provisions of chapter 120, Florida Statutes.
960§§ 766.304, 766.309, and 766.31, Fla. Stat.
9678. In discharging this responsibility, the a dministrative
975l aw j udge must make the following determination based upon the
987available evidence:
989(a) Whether the injury claimed is a birth -
998related neurological injury. If the claimant
1004has demonstrated, to the satisfaction of the
1011administrative law judge, that the infant has
1018su stained a brain or spinal cord injury
1026caused by oxygen deprivation or mechanical
1032injury and that the infant was thereby
1039rendered permanently and substantially
1043mentally and physically impaired, a
1048rebuttable presumption shall arise that the
1054injury is a birth - related neurological injury
1062as defined in s. 766.303(2).
1067(b) Whether obstetrical services were
1072delivered by a participating physician in the
1079course of labor, delivery, or resuscitation
1085in the immediate postdelivery period in a
1092hospital; or by a certif ied nurse midwife in
1101a teaching hospital supervised by a
1107participating physician in the course of
1113labor, delivery, or resuscitation in the
1119immediate postdelivery period in a hospital.
1125§ 766.309(1), Fla. Stat. An award may be sustained only if the
1137admini strative law judge concludes that the "infant has sustained
1147a birth - related neurological injury and that obstetrical services
1157were delivered by a participating physician at birth."
1165§ 766.31(1), Fla. Stat.
11699. The term "birth - related neurological injury" is defined
1179in section 766.302(2) as follows:
"1184Birth - related neurological injury" means
1190injury to the brain or spinal cord of a live
1200infant weighing at least 2,500 grams for a
1209single gestation or, in the case of a
1217multiple gestation, a live infant weighing at
1224least 2,000 grams at birth caused by oxygen
1233deprivation or mechanical injury occurring in
1239the course of labor, delivery, or
1245resuscitation in the immediate postdelivery
1250period in a hospital, which renders the
1257infant permanently and substantially mentall y
1263and physically impaired.
12661 0 . The evidence, which is not refuted, established that
1277Dannel does not have a permanent and substantial motor
1286impairment; thus, Dannel has not sustained a birth - related
1296neurological injury because he is not permanently and
1304s ubstantially physically impaired. Therefore, Dannel is not
1312eligible for benefits under the Plan.
1318CONCLUSION
1319Based upon the foregoing Findings of Fact and Conclusions of
1329Law, it is ORDERED that the Petition filed by
1338Yusleidy Atorre s gasti and Dannel Ortega on behalf of and as
1350parents and natural guardians of Dannel Ortega, is dismissed with
1360prejudice.
