134STATEMENT OF THE ISSUE

138The issue in this case is whether Respondent, the Dome

148Grill , Inc., discriminated against Petitioner, Jenn ifer Morehead,

156on the basis of her age, in violation of the Florida Civil Rights

169Act.

172Petitioner and Respondent filed exceptions to the

179Recommended Order. A transcript of the hearing was not ordered

189or filed with the Division. 1/

195T he following rulings are made on the exceptions filed:

205Petitioner ' s Exception Number 1 : DENIED. Petitioner argues

215that the Pinellas County Office of Human Relations investigative

224report was admitted into evidence by virtue of it 's being filed

236with the Division of Administrative Hearings. Such is not the

246case. Petitioner did not offer any exhibits into evidence.

255Petitioner ' s Exception Number 2 : DENIED. Petitioner ' s

266E xception 2 is in reality a request for the hearing record to be

280reopened so that she , as a pro se litigant, may supplement the

292record with evidence purporting to be " Respondent ' s actual

302employment records from that time. " The undersigned can find no

312authority to reopen this case for the purpose of supplementing

322the record.

324Petitioner ' s numbered paragraphs 3, 4, and 5, are listed

335under a " Conclusion of Law " heading. It is unclear whether these

346paragraphs are intended to be exceptions to the Recommended

355Order. In order to resolve this case without further delay, each

366paragraph is DENIED.

369Respondent ' s Exception Number 1 : (inclusive of A., B.,

380and C.): DENIED. The findings were supported by competent

389substantial evidence and will not be changed.
