86STATEMENT OF THE CASE

90On June 28, 2013, Petitioners, Leah Osceola and

98Miguel Albarran, individually and on behalf of and as parents and

109natural guardians o f Antonia Osceola (Antonia), a minor, filed a

120Petition for Compensation Pursuant to Florida Statute Section

128766.301 et seq. (Petition) with the Division of Administrative

137Hearings (DOAH) for a determination of compensability under the

146Florida Birth - Related Neurological Injury Compensation Plan

154(Plan). The Petition named Robert C. Siudmak, M.D., and Maria C.

165Zedan, C.N.M., as the physician and midwife providing obstetric

174services at the birth of Antonia at Plantation General Hospital

184in Plantation, Florida.

187DOAH served NICA and Plantation General Hospital with copies

196of the Petition on July 5, 2013. Dr. Siudmak and Ms. Zedan were

209served copies of the Petition on July 8, 2013. As of the date of

223this Summary Final Order of Dismissal, Dr. Siudmak, Ms. Zedan,

233and Plantation General Hospital have not petitioned to intervene.

242NICA filed a Motion for Summary Final Order, asserting that

252Antonia did not sustain a "birth - related neurological injury" as

263that term is defined in section 766.302(2), Florida Statutes.

272T he motion was served by Email on September 23, 2013. As of the

286date of this Summary Final Order of Dismissal , Petitioners have

296not filed a response. However, in a Response to Order of

307September 13, 2013, NICA advised that Petitioners did not dispute

317that their claim was not compensable under the NICA Plan.

327FINDINGS OF FACT

3301. Antonia was born on March 14, 2012, at Plantation

340General Hospital located in Plantation, Florida. Antonia weighed

3483,665 grams at birth.

3532. Donald Willis, M.D. (Dr. Willis) , was requested by NICA

363to review the medical records for Antonia. In an affidavit dated

374September 19, 2013, Dr. Willis opined the following:

382It is my opinion that the pregnancy was

390complicated by poorly controlled Diabetes

395with a large - for - gestational age baby and

405resulting in dystocia at delivery. The baby

412was depressed at birth, but Ðrapidly

418improved.Ñ The baby suffered a brachial

424plexus injury from the shoulder dystocia, but

431there was no evidence of brain injury.

438As such, it is my opinion that delivery wa s

448complicated by a shoulder dystocia with

454resulting brachial plexus injury. However,

459there was no apparent brain or spinal cord

467injury from loss of oxygen or mechanical

474trauma.

4753. Michael S. Duchowny, M.D., a pediatric neurologist, was

484retained by NICA to examine Antonia. Dr. Duchowny examined

493Antonia on August 28, 2013. In an affidavit dated September 18,

5042013, Dr. Duchowny opined as follows:

510It is my opinion that AntoniaÓs neurological

517examination reveals evidence of a complete

523left brachial plexus p alsy involving nerve

530roots C5 to T1. She thus has both an ErbÓs

540and KlumpkeÓs paralysis which is judged to be

548severe. There appears to be little benefit

555from her previous surgery as she most likely

563had an avulsive type injury. In contrast,

570AntoniaÓs cog nitive status and motor ability

577in her other three extremities are well

584preserved.

585I had an opportunity to fully review the

593medical records that were sent on July 25,

6012013. The records confirm the familyÓs

607history of shoulder dystocia at birth.

613AntoniaÓ s Apgar scores were 0, 6 & 8 at 1, 5

625and 10 minutes. Her brachial plexus palsy

632was recognized immediately. She was

637intubated in the delivery room but extubated

644at 10 minutes of age. Of note, an MRI of

654AntoniaÓs brachial plexus performed on

659June 29, 2012 [,] revealed pseudomeningocele

666formation at the C7 and T1 levels.

673As such, it is my opinion that AntoniaÓs

681brachial plexus palsy places her damage

687outside the central nervous system as it

694involves cervical and upper thoracic root

700segments. Although her i njury was likely

707acquired as a result of mechanical forces

714during delivery, the location of her

720impairment is outside the central nervous

726system (brain and spinal cord). I therefore

733believe that Antonia should not be considered

740for compensation with the N ICA program.

7474. A review of the file does not show any contrary opinions

759to those of Dr. Willis and Dr. Duchowny. The opinions of

770Dr. Willis and Dr. Duchowny that Antonia did not suffer a brain

782or spinal cord injury due to oxygen deprivation or mechanic al

793injury during labor, delivery, and resuscitation during the post -

803delivery period are credited.

807CONCLUSIONS OF LAW

8105. The Division of Administrative Hearings has jurisdiction

818over the parties to and the subject matter of these proceedings.

829§§ 766.301 - 766.316, Fla. Stat.

8356. The Plan was established by the Legislature "for the

845purpose of providing compensation, irrespective of fault, for

853birth - related neurological injury claims" relating to births

862occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8737. The injured infant, her or his personal representative,

882parents, dependents, and next of kin may seek compensation under

892the Plan by filing a claim for compensation with DOAH.

902§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NI CA,

911which administers the Plan, has "45 days from the date of service

923of a complete claim . . . in which to file a response to the

938petition and to submit relevant written information relating to

947the issue of whether the injury is a birth - related neurologic al

960injury." § 766.305(4), Fla. Stat.

9658. If NICA determines that the injury alleged in a claim is

977a compensable birth - related neurological injury, it may award

987compensation to the claimant, provided that the award is approved

997by the administrative law ju dge to whom the claim has been

1009assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1020disputes the claim, as it has in the instant case, the dispute

1032must be resolved by the assigned administrative law judge in

1042accordance with the provisions of ch apter 120, Florida Statutes.

10529. In discharging this responsibility, the Administrative

1059Law Judge must make the following determination based upon the

1069available evidence:

1071(a) Whether the injury claimed is a birth -

1080related neurological injury. If the clai mant

1087has demonstrated, to the satisfaction of the

1094administrative law judge, that the infant has

1101sustained a brain or spinal cord injury

1108caused by oxygen deprivation or mechanical

1114injury and that the infant was thereby

1121rendered permanently and substantially

1125mentally and physically impaired, a

1130rebuttable presumption shall arise that the

1136injury is a birth - related neurological injury

1144as defined in s. 766.303(2).

1149(b) Whether obstetrical services were

1154delivered by a participating physician in the

1161course of lab or, delivery, or resuscitation

1168in the immediate postdelivery period in a

1175hospital; or by a certified nurse midwife in

1183a teaching hospital supervised by a

1189participating physician in the course of

1195labor, delivery, or resuscitation in the

1201immediate postdelive ry period in a hospital.

1208§ 766.309(1), Fla. Stat. An award may be sustained only if the

1220administrative law judge concludes that the "infant has sustained

1229a birth - related neurological injury and that obstetrical services

1239were delivered by a participating physician at birth."

1247§ 766.31(1), Fla. Stat.

125110. The term "birth - related neurological injury" is defined

1261in section 766.302(2) as follows:

"1266Birth - related neurological injury" means

1272injury to the brain or spinal cord of a live

1282infant weighing at least 2,500 grams for a

1291single gestation or, in the case of a

1299multiple gestation, a live infant weighing at

1306least 2,000 grams at birth caused by oxygen

1315deprivation or mechanical injury occurring in

1321the course of labor, delivery, or

1327resuscitation in the immediate postdelivery

1332period in a hospital, which renders the

1339infant permanently and substantially mentally

1344and physically impaired.

134711. The evidence, which is not refuted, established that

1356Antonia did not sustain an injury to the brain or spinal cord

1368caused by oxygen deprivation or mechanical injury occurring in

1377the course of labor, delivery, or resuscitation in the immediate

1387post - delivery period in a hospital. Therefore, Antonia is not

1398eligible for benefits under the Plan.

1404CONCLUSION

1405Based upon the foregoing Findings of Fact and Conclusions of

1415Law, it is ORDERED that the Petition filed by Leah Osceola and

1427Miguel Albarran, individually and as parents and natural

1435guardians of Antonia Osceola is dismissed with prejudice.
